    if the failure to have sex dates back to the beginning of the marriage and is due to physical incapacity which is incurable, this is a ground for annulment.

     

    however, a reading of your post seems to imply that there was sex at the beginning, only that now, she refuses to have sex. refusal to have sex is not a ground for annulment (see Art. 45, Family Code)

     

    however, for "declaration of nullity" (this is different from annulment), refusal to have sex, if you can get a psychiatrist/psychologist to say that this is caused by a very serious psychological disorder on the part of the wife, would constitute "psychological incapacity" to comply with essential marital obligations and would result in the nullity of the marriage.

     

    Note1: mere refusal to have sex, without expert testimony linking this to a psychological disorder, is insufficient.

    Note2: likewise, it is going to be very very difficult to prove that the spouses have not been having sex

     

    2)If you filed a case and convicted your wife with adultery, can you marry again or you have to file an annulment first?

     

    conviction for adultery does not result in the dissolution of the marriage of the convicted wife. the husband still has to file a petition for declaration of nullity (assuming there are no other defects in the marriage, you'll have to prove that the adultery is a symptom of a severe psychological incapacity on the part of the wife)

     

    I have two questions:

  5. dahil buhay pa ang asawa mo (at alam mo na buhay pa ito), ang option na available sa yo ay maghain ng petition para ipawalang bisa ang kasal mo. mas malamang sa hindi, ang available na lang sa yo ay petition for declaration of nullity of marriage on the ground na "psychologically incapacitated" ang asawa mo. kailangan mo na kumunsulta sa abugado para dito.

     

    Note: hindi instant ito, dadaan sa proseso, baka abutin ka ng dalawang hanggang tatlong taon.

     

    kung Filipino citizen ka, maari din namang mag-iba ka ng nationality (dun ka sa bansa na may divorce). pag iba na ang citizenship mo, pwede mo na i-divorce ang asawa mo.

    Kahit gaano pa katagal kayong hiwalay, so long as alam mo na buhay pa yung asawa mo, di nawawalan ng bisa ang kasal nyo. Sa kaso mo, di lang kayo nag-communicate for 8 years, pero kung talagang gugustuhin mo, mahahanap mo yang asawa mo (wag mong sabihin na di mo alam kung saan nakatira yang asawa mo, o di kaya ang magulang niya, pwedeng-pwede ma-trace kung nasaan na yang asawang hiniwalayan mo).

     

    para mawalan ng bisa ang kasal mo, kailangan mong maghain ng petition para dito.

    Hindi na po 14 ang marrying age ngayon, 18 na (the Civil Code provisions on marriage were repealed by the Family Code on Aug. 3, 1988).

     

    Sa ilalim ng Family Code, kailangan ng consent kapag 18 above but below 21. Dahil 22 na yung babae, kailangan niya ng PARENTAL ADVICE (not parental consent). Kapag walang parental advice, mabisa pa rin ang kasal (altho maaari silang makasuhan sa paggagamit ng impostor – ito ay hindi nakaka-apekto sa bisa ng kasal)

     

    Scenario:

     

    They got married in civil in Iloilo Hall of Justice, the age of the guy is 35 and the girl is 22. Iloilo City has this requirement that the girl will require a parental consent if she is less than 25 years of age. The Girl's dad is already dead and the mother is living in a far away province. To get around this problem, a friend posed as the girl's legal guardian and the girl signed an affidavit that the poser is really her guardian.

     

    Question: Will this invalidate the marriage and can be a ground for annulment since the poser is not really her legal guardian? However, in the Philippine civil code, the legal requirement for a girl to marry is only 14 (if what I'm reading is correct). Will this render the requirement above to have a legal guardian if the girl is less than 25 not binding and thus the marriage is legal and binding?

    kung cash ang ipampipiyansa nyo, at siya ay mapapa-walang sala, mababawi nyo ang ipinam-bail nyo. kung surety bond ang gagamitin nyo, di nyo na mababawi ang premium na ibinayad nyo sa bonding company (pwede kasi na sa halip na cash bond, kumuha kayo ng bond mula sa bonding company, mas mababa ang bayad - pero di nyo na mababawi, tsaka maraming rekisitos na hinihingi ang bonding company)

     

    5. can we do counter charges at anong kaso kung meron man?

     

    malabo kayong makapag-counter-charge. kung nawalan talaga ng gamit yung foreigner, may karapatan cyang magreklamo kung sino ang inaakala nyang salarin. otherwise, wala nang magrereklamo sa takot na sila ay laging maka-counter-charge. kung mapawalang-sala ang kapatid mo, magpasalamat ka na! PERO kung ang findings ay hindi talaga ang kapatid mo ang me kagagawan (o di kaya na gawa-gawa lamang yung reklamo), maaari kang mag-counter-charge (pero gastos at abala din yun), nasa sa inyo na yun.

    7. procedure / process nang arraignment

     

    tatawagin ang kaso niya c korte, kung me abugado siya (pero sabi mo, abugado niya ay PAO, kaya lumalabas na me abugado siya nun) babasahan siya nung reklamo, tapos tatanungin siya kung inaamin niya o hindi – siyempre sasabihin niya na DI NIYA INAAMIN. yun, tapos na ang arraignment. tapos, next hearing, pre-trial na. tingnan-tingnan nyo - kung di sumipot ang nagrereklamo sa arraignment, mas malamang sa hindi, hindi na yan magpapakita. kung ganun, mga 2-3 hearing pa, madidismiss ang kaso - dahil walang testigo para sa prosekusyon. ipagdasal nyo na ganun ang mangyari.

Pag nakuha na ang number ng kaso, pumunta sa clerk of court ng RTC at magtanong kung saang judge/sala napunta yung kaso. dun kayo sa korteng yun magpipiyansa (kailangan kasama na si utol, at dala ang pambayad). magpipiyano siya run, at kukunan ng picture, tapos i-se-set na yung kaso for arraignment.

     

    kung di nyo kayang magbayad ng abugado, me PAO na naka-assign sa korte na yun. kung gusto nyo ng mas maasikaso kayo, may Legal Aid ang Arellano School of Law (sa may Menlo St ito) o di kaya ang UP (sa Diliman).

    1) Gumawa nang counter affidavit ( walang katotohanan and puro kasinungalngan binibintang nang complainant na theft ) and brother ko after nya ma receive yong first (1st)na pinadala which is SUBPOENA (naka attached [1]Pasay City Police (SPD) Station Investigation & Detective Mngt Section - A endorsement letter filling a case of THEFT and take not AT-LARGE naka indicate plus, [2] Afidavit from the taiwanese complainant ), pero ang brother ko di naka attend nang hearing dahil busy sa pag papasada nang taxi.

     

    2) Kaya na receive nya yong second (2nd)na pinadala which is RESOLUTION (3pages lang) pero walang amount doon nang bail ang meron lang doon ay amount nang total cost nang laman nang bag which is Php 60,000 for the value of different items like laptop,ps3 and mp3, walang cash na laman as the complainant affidavit.

     

    4) Wala pang warrant of arrest kasama ang resolution na hinatid sa bahay via courier pero as per advised nang napag tanungan namin na PAO sa cityhall yon na daw susunod (warrant of arrest) kaya nag aalala kami. kaya nag tatanong ako dito online kung how much ang maaring bail kahit estimate lang kasi doon sa PAO ang sususngit at laging busy.

     

    Lastly, sabi nang PAO mahina daw ang kaso na THEFT kaya lang since foreigner ang complainant binigyan nang pabor ang taiwanese dahil mainit pa ang nangyari sa Bus Hostage na mga foreigner ang involve at kaya napa bilis din pag asikaso.

  11. mahirap yang plano nyong ipatubos yung sasakyan. kasi, kung ako ang may-ari, kakasuhan ko talaga ng carnapping ang me hawak ng sasakyan kapag di isinoli. pag ipatubos yung sasakyan sa akin, palalabasin ko sa pulis na ninakaw at ipinapa-ransom ng nagnakaw.

    The crimes of adultery and concubinage shall not be prosecuted except upon a complaint filed by the offended spouse.

     

    lumalabas, yung asawa lang ang pwedeng magreklamo.

     

    May a child file a case of concubinage against his/her father or is it only the mother/wife who can do this? Thank you.

    lamang ang employee sa kaso na ito. unang-una, sinabi na ng Supreme Court na hindi compatible ang abandonment sa pagsasampa ng reklamo sa Labor, i.e. bakit magrereklamo ang isang tao na tinanggal siya kung tutoong inabandona niya ang trabaho niya. In other words, hindi kapanipaniwala ang depensa na ito, lalo pa (ayun na rin sa iyo), na inilabas nila ang mga notice [kuno] nung naisampa na ang reklamo sa Labor.

     

    intindihin mo na rin lang na trabaho ng company lawyer na depensahan yung kumpanya, kaya siyempre, ikakatwiran talaga niya na iniwanan ng empleyado yung trabaho niya. sabi ko nga early on, whether maniniwala ang arbiter sa argumentong ito ay ibang kwento na. anyway, alam na ng abugado mo [o ng PAO] ang mga argumento na gagamitin niya para sa Position Paper nyo. good luck!

    3. a clear intention to sever the employer-employee relationship

     

    i believe yung Return to Work Order ang gagamitin nila para maprove yung 2nd requirement sa awol. but basing sa date kung kelan nila inissue yung notice, 2 months and 11 days ng absent si employee and definitely 2 months after nila marecieve yung complaint ni employee. and please note na inissue yung Return to Work Order sa supposedly 3rd hearing since d sila sumipot sa first 2.

When employment not deemed terminated. - The bona fide suspension of the operation of a business or undertaking for a period not exceeding six months, or the fulfillment by the employee of a military or civic duty shall not terminate employment. In all such cases, the employer shall not reinstate the employee to his former position without loss of seniority rights if he indicates his desire to resume his work not later than one month from the resumption of operations of his employer or from his relief from the military or civic duty.

     

    sa kaso mo, dahil walang openings at the moment para sa inyong managers, pwede kayong ipa-floating muna (Temporary Lay-Off ang tawag ng kumpanya mo sa status na ito). sabi nga ng 286, hindi ito nagte-terminate ng employment, pero dahil di naman pwedeng perpetually kang "floating", pwede lang ang floating status ng maximum of 6months. pag di ka pa nahanapan ng pwesto by that time, considered kang "constructively dismissed" at dapat ka nang mabayaran ng separation pay.

     

    Alalahanin mo rin na ang prinsipyong umiiral salabor ay "no work, no pay". dahil di ka naman nagtratrabaho sa panahong floating ka, di ka entitled sa sweldo.

    Sir, I hope you can answer my question. I work in a call center as one of the operation managers. Our account was migrated to another site and only the agents were transferred. Us managers were not transferred since there were already existing managers in that site.

     

    My dillema is that the company has no department or account to transfer us to. They are having us apply in some of the internal openings the company has. However, if we don't get accepted in those departments, we will have to consume our leaves. When we consume all our leaves, the company will put us in Temporary Lay Off (TLO) status and we will get no salary.

     

    Based from what my manager told me, the company can have an employee stay on TLO status for a period of 6 months, and only after which if they don't find a placement for me, that's the time they are obliged to pay severance to an employee.

     

    Does the law allow this? I have a lawyer friend who said that this is not legal and companies get away with such acts since employees hardly contest it. He says that the company should either place the employee or pay severance without having to wait 6 months.

     

    So is it legal for a company to put an employee on TLO for 6 months not paying an employee salary or is my lawyer friend correct in saying it's not legal?

  17. magiging malaking problema yan. hindi kinikilala sa Pilipinas ang divorce na kinuha ng isang Filipino citizen. kung Filipino siya, walang bisa ang divorce kung ang nag-apply dito ay siya o silang dalawa (no-fault divorce), pero kung ang nag-file ng divorce ay hindi siya kundi ang Amerikanong asawa niya, maaari siyang mag-asawa muli dito sa Pilipinas.

     

    ang tanong, paano siya naging dual citizen (akala ko siya ay na-petition sa America, at dun ay naging American citizen). kung nag-apply siya para maging Filipino citizen ulit, kelan ito nangyari (before or after the divorce)?

    panu po kung sa hearing sa labor arbiter pinalalabas ng company na d nila tinanggal yung employee at nagabsent lang daw. sa hearing unang nag issue ng return to work order na asking for written explanation for the unjustified absences since june 1, 2010 - exactly 2 months and 11 days after magstart na d pumasok kasi tinanggal nga. kung kayo po tatayong lawyer ng employer, anu po ang magagamit na defense against sa employee basing dito po sa series of events sa baba?

     

    2010 timeline:


    •  
    • may 5 - ininform si employee na ireretrench by june 30 (verbal lang)
    • may 25 - ininform si employee na until may 31 na lang sya, declined the request for resignation letter (verbal lang)
    • may 28 - payday, walang na recieve na sahod, wala na rin dumating na supplies for the month of june
    • may 30 - pinai-email yung resignation letter (text message recieved, did not comply)
    • may 31 - still no salary
    • june 1 - filed for illegal dismissal
    • june 2 - 2nd half ng allowance for april recieved (2 gives eh)
    • june 21 - kung pede daw magusap (text message)
    • june 24 - 1st hearing, d sumipot
    • july 14 - 2nd hearing, d sumipot
    • july 15 - bat mo pa pinaabot sa ganito (text message recieved)
    • aug 11 - 3rd hearing, respondent's lawyer issued a return to work order, explain in writing the absences since june 1, dated aug 11, 2010 (declined), nasa payroll pa daw si employee
    • aug 13 - secured a bank statement from jan2010 to aug2010, proved no salary recieved for the May 15-31 cutoff
    • sept 1 - 4th hearing, for position paper
    • sept 21 - 5th hearing, issuance of position paper

     

    Notes:


    •  
    • field worker, no time records, doctors' signature ang proof ng attendance ng nature of work nya
    • 3 years and 6 months tenured employee as of may 31,2010
    • no text message sent from the employee to the employer since may
    • no letter or any document sent by company for awol process

  19. lumalabas na sinadya yung mga "errors" sa birth certificate, kung kaya hindi ito "typographical error" na maco-correct sa Civil Registrar lang. Kailangan na sa korte ito ipa-correct. Problema mo, merong falsification dito.

     

    Anyway, kung may kakilala sa Local Civil Registrar, subukan niyo munang palabasin na typographical error ito, kung sakaling makalusot, wala na kayong problema.

     

    however, pag di kinaya, talagang sa korte kayo pupunta para ipa-correct ito.

     

    Re: Birth Certificates

     

    Situation:

     

    A child was born to parents, who were both 17 years old at the time of birth, but in the birth certificate the ages were "18". Moreover, by coercion of their parents, the young couple were "married" by a local public official but also changed a few entries in the marriage certificate, which is by my assumption already made said marriage null and void due to incorrect/falsified entries.

     

    After 4 years, this couple now of legal age, were 'united again' this time at a church, thereby legitimizing their child.

     

    Now the question is, how can the child's birth certificate entries (re: age of parents at the time the child was born & date of marriage of parents) be corrected and what legal repercussions can arise from this?

  20. ang kopya ng NSO ay galing sa Local Civil Registrar. Pinapadala lamang ito ng Civil Registrar sa kanila (kung kaya't wala silang nilalagay na date of birth sa kung anumang dokumento), in fact, kung kumukuha ka ng NSO-certified na birth certificate, mapapansin mo na xerox copy din lang ito (sine-xerox lang on security paper yung kopya na nasa NSO [na galing din sa Civil Registrar]).

     

    Note: Sa paggawa ng birth certificate, ito ay ginagawa in 4 copies (one copy ay sa magulang napupunta, one copy sa Civil Registrar, one copy sa NSO, at one copy sa hospital/midwife etc.), pagsubmit ng birth certificate sa Civil Registrar, ifoforward ng Civil Registrar sa NSO yung isang kopya.

     

    dahil galing din lang sa Civil Registrar yung kopya na nasa NSO, nagkakaroon ngayon ng question kung bakit magkaiba ang entry sa kopya na nasa NSO, at yung kopya na naiwan sa Civil Registrar (ang problema pati, ang presumption ay mas tama yung kopya na nasa NSO kesa dun sa kopya na nasa Civil Registrar - dahilan daw na mas walang motibo na baguhin ng mga taga-NSO yung kopya na nasa kanila, samantalang mas madaling mabago yung nasa Civil Registrar dahil mas madaling lapitan ang taga-munisipyo kesa sa taga-NSO).

     

    however, posible namang kasalanan ng taga-NSO o taga-Civil Registrar yan, dahil nga malabo yung kopya na nasa NSO - kaya nga, mas magandang makiusap muna siya kay Dir. Hufana para dito, at baka pumayag ang NSO na magpakuha na lang ng klarong kopya mula sa Civil Registrar.

     

    Hinde ba dapat correction of copy of birth certificate ito sa NSO? Dapat kasi yung NSO rineregister yung copya ng birth certificate ng Local Civil Registry. Pagnalaman nila na mali yung date of birth na linagay nila sa copya nila, hinde ba dapat icorrect nila.

  21. magbabago edad mo (babata ka by two days), ayun sa Section 2[3] ng RA 9048, anumang pagbabago na mag-iinvolve ng edad ay di pwedeng sa Civil Registrar lang (ibig sabihin, sa korte ang punta mo).

     

    Si Dir. Hufana ay Director ng Civil Registration Department ng NSO. Sabi ko nga before, pag di niya magawan ng paraan yang kaso mo, sa korte talaga ang punta mo niyan.

     

    Madali siyang lapitan at napakabait nyan.

     

    Public service yan, at trabaho nga nila yan sa NSO na mag-ayos ng mga ganyang problema (or at the very least, i-advice ka kung ano ang dapat mong gawin). Punta na!

     

    di naman po mababago ang edad, just a matter of 2 days only, birth date of 28 in the local registry copy of my birth certificate, to 30 in the NSO copy. sino po ba itong si Dir. Lourdes Hufana, madali po ba syang lapitan? ano sasabihin ko para malapitan sya? may bayad din ba ito or public service?

  22. Yup. According to Art. 14 of the Family Code:

     

    Art. 15. Any contracting party between the age of twenty-one and twenty-five shall be obliged to ask their parents or guardian for advice upon the intended marriage. If they do not obtain such advice, or if it be unfavorable, the marriage license shall not be issued till after three months following the completion of the publication of the application therefor. A sworn statement by the contracting parties to the effect that such advice has been sought, together with the written advice given, if any, shall be attached to the application for marriage license. Should the parents or guardian refuse to give any advice, this fact shall be stated in the sworn statement.

  23. dahil nasa edad na naman sila, kapag di makakuha ng parental advice yung partner niya, made-delay lang ng tatlong buwan yung marriage license nila, kaya... mag-apply ng maaga ng marriage license para tumakbo agad yung 3-month period.

  24. Punta ka kay Dir. Lourdes Hufana sa NSO office sa EDSA cor. Times Street (malapit sa Quezon Ave ito). Sa kanya ka humingi ng tulong. Pag di nagawan ng paraan ni Dir. Hufana, mahihirapan ka at kakailanganing mag-file ng kaso sa korte pag edad ang maiiba sa birth certificate.

     

    patulong naman po, ang birth certificate ko sa local registry at sa baptismal, 28 ang nakalagay na birth date ko, sa NSO ay malabong 2 or 3 at malinaw na 0 kaya sinabi na ang birthdate ko daw ay 30. nagamit ko since then ay 28 kayamga records ko is 28, kayo mas matimbang daw ang NSO copy. i'm having difficulty kumuha ng passport. saan po ba ko pupunta, sino lalapitan ko, anu-ano ba gagawin ko para mabago ang record ko sa NSO?

  25. she has to file letter-requests with the agency concerned asking that they change her records to reflect her new status. she will probably need certified true copies of the divorce decree (probably has to be certified as well by the Phil. consul assigned to the place where she got the divorce), as well as proof of her new nationality (including the date she was naturalized as an American – to show that at the time the divorce was obtained she was no longer a Filipino). to save time, it would probably be better to call up the agency itself and ask what their specific documentary requirements are for changing her status on their records.

    What will be the next step in order to change her married status here in the Phils? Though they are already divorced, but she haven't yet updated any legal documents here in the Phils. Thank you...
