A study opf R.A 9165 (Dangerous Drugs Act of 2002) will show that it punishes the person who will "sell, trade, administer, dispense, deliver, give away to another, distribute dispatch in transit or transport any dangerous drug". on the other hand, the user can be convicted only for possession or use of dangerous drugs. yung alleged texts kung saan a persons tries to buy, if true, would probably constitute an attempt to sell or trade wherein the seller or trader could be punishable under the law. in short, siya pa ang sasabit pag ginawa niya yan.

     

    remember also, mahirap patunayan nga galing sa yo ang text (andaling magpalit ng SIM ngayon). pag napatunayan man niya, kung ang mga sagot niya sa text ay magpapatunay na pusher siya, siya pa ang madadale, dahil di naman yan use or posession, na siyang krimen na maaring malabag ng isang user.

    I loaned my ex-officemate a large amount of money. He issued a post-dated check as payment but when the check matured he kept asking for time to fund the check. After two months passed, I said I will deposit the check even if it bounces. He became hostile and threatened to accuse me of trying to buy drugs from him. He said he will print previous texts I sent him and edit them to make it appear as if I tried to buy drugs from him.

    Yes, there will be problems (not really for her, for her younger sister). siyempre, dahil lalabas na may gumamit na ng pangalan niya sa passport, kailangan muna niyang patunayan na siya nga talaga yung taong yun. medyo madali naman ito dahil yun naman talaga ang totoo. afterwards, makakakuha na siya ng passport. ang problema, yung kapatid naman niya ang sasabit.

     

    pag-apply nung tao ng passport, lalabas na may passport na na-issue sa pangalan niya (pero iba ang mukha ng nag-apply para dito). dalawa ang options niya:

     

    OPTION 1 - sabihin na hindi niya kilala kung sino yun (medyo kaduda-duda rin ito dahil kalimitan, ang gumagamit ng ibang pangalan para sa passport application ay kamag-anak din nung taong ginamit ang pangalan, mas me problema pag magkamukha sila ng kapatid niya).

     

    pag sinabi nyang di niya kilala, siyempre magkukunwari siyang galit siya sa tao na yun - mapipilitan siya ngayong magharap ng demanda laban sa tao na yun (or at the very least, gumawa ng sworn statement na gagamitin naman ng DFA sa paghabla sa tao na yun)

     

    OPTION 2 - aminin na kapatid niya ang gumamit. ganun din ang resulta - mapipilitan siyang gagumawa ng sworn statement na gagamitin naman ng DFA sa paghabla sa kapatid nya

     

    criminal offense ang pagkuha ng passport gamit ang pangalan ng iba (see Section 19 and [c], RA No. 8239). kakasuhan ang gumawa nito ng DFA ng violation ng batas (ang problema pa, kung ang address na ginamit niya sa application ay talagang address ninyo, madaling ma-trace yang kapatid mo).

     

     

    2) Can her younger sister apply for a passport under her real identity?

     

    Yes, kung di pa nagkaka-alaman tungkol sa ginawa niyang katarantaduhan.

    pag nagka-alaman na, at alam na siya ang gumawa, sabi sa Section 8(a3) ng RA 8239 na ang sinong lumabag sa batas na yun ay maaaring ma-deny ng pasport application (altho sa palagay ko naman, bago ito mag-apply kailangan na ma-convict muna siya). Alalahanin din niya - pag siya ay nag-apply, binibigyan niya ang DFA ng datos na maaaring gamitin laban sa kanya, i.e. kung nagka-alaman na na may anomalya sa passport na ginamit niya, dapat na siyang magtago, bakit siya pa mismo ang pupunta dun sa mga taong naghahanap na sa kanya?

    anyway, kung di naman mag-aapply yung kapatid niya, hindi ito lalabas (yun nga lang, di makakakuha ng passport yung kapatid niya)

     

    MORAL LESSON: Wag mag-gawa ng iligal, lalo na sa passport, mabigat ang parusa ng batas laban sa mga pumepeke nito.

    Would like to ask your help on this matter:

     

    A friend of mine has a younger sister who wants to go to Japan as an entertainer, but due to the fact that she is underage during the time of application, she used her elder sister's document in order to get a passport. She was able to get the passport, with her elder's sister identity. However, she was not able to go to Japan due to some reason. Now, her elder sister wants to get a passport using her real identity. Well, of course she does not want to sue her younger sister for using her identity.

     

    Questions:

    1) Would there be problems if the elder sister will apply for passport using her real identity? The records will say that she already has a passport.

    2) Can her younger sister apply for a passport under her real identity? The passport that bears her elder sister's name is still unexpired.

     

    Please help me on what to do or who to talk to. Thanks!

  6. kung nakalagay sa kontrata na non-refundable yun, dahil wala pang dalawang taon na siya ay nagbabayad, in fact, downpayment pa nga lang (kasi kung 2 years na, RA No. 6552 sana ang applicable), hindi na mababawi yun. kung wala namang nakalagay sa kontrata na forfeited yung downpayment, mababawi niya yun.

     

    kung ang dahilan ng pag-atras ng dad mo ay dahil may violation sa terms ng kontrata ang developer (dapat medyo mabigat na violation, kung minor lang, di rin pwede), pwede rin niyang bawiin (see 1191, Civil Code).

  8. No. The DFA is only concerned with your first name, middle name and surname as they appear in your birth certificate. A passport has to follow the official name of the applicant, which is the name (first, middle, and surname) that appears in your birth certificate. All the other entries in your birth certificate are basically irrelevant to your passport application. However, this might cause problems for some other applications (SSS, GSIS, etc.). you can have this corrected by applying for correction of entry with the Civil Registrar of the place where your birth was registered.

     

    I noticed something wrong with my birth certificate. My mother's maiden last name was incorrectly encoded and it appears as the same as my father's middle name. So the result is that my middle name does not match my mother's maiden last name in my birth certificate. Will this pose as a problem if I apply for a passport?

  9. For Adultery case, do you really need to show a video or pictures of actual sexual intercourse to prove they are guilty? No. direct proof of sexual intercourse is not necessary, circumstantial evidence showing that the parties accused have had sex together is sufficient.

     

    What if you only have chat or email exchanges and intimate pictures to prove their affair, would that be enough? No. you have to have a witness saying that he saw the two sleep together, or that the two were living together as husband and wife. the intimate pictures and chat and email messages will corroborate the testimony of the witness.

     

    For Adultery case, do you really need to show a video or pictures of actual sexual intercourse to prove they are guilty? What if you only have chat or email exchanges and intimate pictures to prove their affair, would that be enough?

    2.) can Miss B, ask the Store to review the CCTV camera records on the night of the crime to check who entered and left the store?

     

    yes. pwede siyang mag-request sa store. kahit naman sino, pwede mag-request. ang tanong, pagbibigyan ba siya.

     

    what if the store refuse?

     

    mangangailangan siya ng court order kung di siya pagbibigyan ng store sa request niya.

     

    what if the store says that the CCTV does not make any recording?

     

    yari siya. di naman niya pwedeng pilitin ang kumpanyang maglabas ng recording kung walang ganun talaga.

     

    3.) since PNR does not have any CCTV cameras installed on their stations and the tickets were always collected at the destination station, how can Miss B use the PNR ride as an evidence though she was alone when she boarded the train?

     

    alibi yan, madaling sabihin. mahirap paniwalaan lalo't wala siyang ebidensya na nakasakay nga siya dun nung oras na yun.

     

    4.) can the bag be used as evidence to collect finger prints to check if Miss B ever touched the bag?

     

    pwede. pero sa tagal ng pangyayari, malabong maging ebidensya na hindi niya ginalaw yung bag.

     

    5.) was it right to detain an employee accused for stealing a personal belonging by its own company?

     

    hindi. kung walang reklamong kriminal, hindi dapat dine-detain yung empleyado. bawal yan.

     

    6.) what other move can Miss B take other than seek legal help to clear her name?

     

    makiusap/makipag-areglo sa nagrereklamo.

     

    kung gusto niya ng kakaibang move... kuha siya ng manghuhula na magsasabi/magpapatunay na hindi siya ang nagnakaw (kung naniniwala yung nagrereklamo sa manghuhula... bwa ha ha ha)

     

    Ultimately, dahil wala namang nakakita nung pagkuha ng credit card, ang tanging ebidensya na nagli-link sa kanya sa krimen ay yung statement ng store crew na siya ang gumamit nung card. without the store crew, walang kaso. kapag nagsampa ng kaso laban sa kanya, kailangang humarap yung crew sa piskalya para ituro siya. kapag walang ganun, walang kaso.

     

     

    ihingi ko lang po ng opinion tong scenario na ito:

     

     

    a credit card was stolen and was used to buy 2 units of mobile phones in an Hello Telecom Store in a Mall. The owner of the card, Miss A , accused her colleague Miss B who sits beside her for stealing the card and immediately filed a blotter in two different stations, 1st, near the office and 2nd, near the Mall.

     

    Miss B, the accused, said that she "never ever" touched the bag or any personal property of Miss A.

     

    The office that Miss A and B occupies has no CCTV Camera installed.

     

    The credit card was used at the span of 1830H to 1900H (the actual time was not pinpointed) but the accused claimed that at that specific time, she was alone and on her way home riding a PNR train and she boarded the train at 1835H.

     

    The owner of the card Miss A, went to the store where the phones were bought using the card and shown the crew of the store a picture of Miss B and the crew of the store said the girl on the picture was the one who bought the said two units, and signed a document pinpointing Miss B as the person who bought the units using the card but not checking the CCTV camera records nor asking for the personal appearance of Miss B to verify the actual identity.

     

    Miss B, was detained in the office where she is working due to the accusations and was not allowed to leave the office for some unknown reason until her mother came to the said office to claim her daughter.

     

    questions:

    Meron pong lote na binebenta sa kapatid ko. In an area where the lots sell for 5k per sqm, the lot offer is 100sqm at 1M. Sabi ko sa kanya, doble ang turing ng lote. And nung binisita ko yung property wala naman pong special doon.

     

    Question po: In buying property such as this, what exactly are we supposed to pay for? At bakit dobel ang presyo ng lote? Pwede po ba yun?

  12. depende. ang test lagi ay ang "test of reasonableness."

     

    kung reasonably required ng trabaho mo sa company yang training na ibinibigay sa iyo, at reasonable din naman yung time na nakatali ka sa company, maaari kang ma-charge for insubordination.

     

    pero, kung di naman necessary yung training sa trabaho mo (ex. kung for convenience lang)di ka nila mare-require na matali sa corporation; or kung sobrang haba naman yung time na nakatali ka sa company, di ka nila pwedeng pilitin na mag-attend ng training na yan.

  13. if the land is titled in your name (mahirap kasi pag rights lang ang meron kayo), start writing demand letters to the people living on the lot, demanding that they leave w/in 15 days from receipt of the letter. if they refuse to leave after receiving the letters, pwede ka nang magsampa ng forcible entry cases against these people.

     

    likewise, if you have sufficient proof against the policeman, file a criminal and administrative complaint against him with the Office of the Ombudsman (wag sa NAPOLCOM, PLEB, IAS, etc. at nalalakad nila yan) for renting out your property without your knowledge and consent, pretending to be the owner of the lot.

  14. hindi mo na maipapawalang-bisa yung kasal mo kung ang pagbabasehan mo ay ang kawalan ng consent ng magulang mo ng ikaw ay magpakasal.

     

    oo nga at ito ay ground upang ipawalang-bisa ang isang kasal, pero ito ay dapat isampa sa loob ng limang taon mula ng ikaw ay naging 21. ayun na rin sa kwento mo, 20 years old ka nung 1999, ibig sabihin naging 21 ka nung 2000. Hanggang 2005 ka lang pwedeng magsampa ng kaso para sa ground na ito. dahil 2010 na, paso na ang kaso.

     

    pero ikaw na rin ang nagsabi na fixer ang naglakad ng papeles mo. tingnan mo ang iyong marriage certificate - sa dulo nito ay may bahagi na nagsasabing "Marriage License". tingnan mo kung anong numero ng lisensya at kung saang lugar ito na-issue. puntahan mo ang Civil Registrar ng lugar na nag-issue ng marriage license at magtanong ka dun kung meron ngang ganung marriage license (may mga fixer kasi nung 90's na gumagamit ng fake na marriage license). pag sinabi ng Civil Registrar dun na walang marriage license na na-issue sa pangalan mo at nung asawa mo, maswerte ka, at walang-bisa ang kasal mo mula sa simula - punta na sa abugado para maihain agad ang kaso. pero alalahanin mo na ito ay suntok sa buwan, kapag may ganun ngang marriage license, ang option mo na lang ay ipa-walang bisa ang kasal mo sa ilalim ng Art. 36 ng Family Code - na "psychologically incapacitated" ang asawa mo.

    Sir, What would be the probability or chances of my marriage to be null and void kung ganito po ang nangyari.

    1) Nagpakasal po kmi sa Manila City Hall pero hindi dumaan sa tamang proseso. May fixer po kc pero may nagkasal sa amin doon.

    2) Wla po yung parents ko and kailangan nila ng written parents consent because Im only 20 years old(male) and my wife is 25. Dpo alam sa amin to. So ginawa po nila dinaya na lang po yung written parents consent na ako po ang nag sign.

    3) Nagtaka rin po ako dhil sabi nung employee don na sa Caloocan City Hall daw namin makukuha marriage contract kc mahigpit daw po don sa MCH at that time. Sa manila ako nagpakasal pero sa caloocan ang marriage contract ko.

    4) 1999 pa po kami kasal and valid po ang kasal kc naka registered po sa NSO.

     

    I want to know the chances kc po sayang naman po yung magagastos ko kung wla naman pong mangyayari...

  15. sabi nga ni redblack, legal separation only allows you to live separately from your spouse, but the marriage bond is not severed. sa madaling salita, kasal pa rin kayo sa isa't-isa - mabisa pa rin ang kasal nyo, yun nga lang, pwede na kayong di magsama.

     

    kung humihingi ka ng legal separation, ito ay pag-amin na walang diperensya ang kasal nyo, na ito ay mabisa - kaya nga, imbes na hingiin mo na ipawalang-bisa ito, ang hinihingi mo na lang ay payagan ka ng hukuman na hindi na makisama sa asawa mo.

     

    best advise - yung sabi ni redblack, mag-ipon ka na lang para mai-raise mo yung amount na kailangan para sa kaso na "declaration of nullity" ng kasal mo.

  16. kailangan muna na sumulat kayo sa kanila na pinapalayas nyo na sila. ang unang sulat kasi ay sinisingil lang sila. bago ka makapagsampa sa korte ng ejectment, kailangan may sulat na pinapalayas mo ang tenant.

     

    baka kailangan din na dumaan muna ito sa barangay (altho maaaring di na ito dumaan dun dahil nasa US naman ang may-ari)

     

    mangangailangan nga lang ang tatay mo ng SPA mula sa Lola mo na nagbibigay sa kanya ng kapangyarihan upang magsampa ng kaso laban sa mga tenant (kung wala pa kayo nito, dahil nasa America na ang lola mo, kailangan ang SPA ay notaryado sa consulate ng Pilipinas sa America - yung may pulang ribbon at gintong selyo).

     

    at kung mga anak ng lola nyo, o di-kaya'y apo, ang nakatira, kailangan din may alegasyon sa reklamong isasampa sa korte, na sinubukan nyong magkasundo pero ito ay di nagtagumpay (Art. 151, Family Code).

     

    para siguradong di mabubulilyaso ang pagpapalayas nyo sa mga di nagbabayad, kumunsulta na sa abugado.

  17. alalahanin mo din na ang paghahain ng petition for legal separation ay isang pag-amin na mabisa ang kasal mo (otherwise, hindi lang legal separation ang isinampa mo, kundi nullity of marriage na). dahil dito, baka hindi ka na payagan, later on, na maghain ng action for nullity of marriage (dahil nga inamin mo beforehand na valid ang kasal mo).

    worker A works for company X and is seconded to company Y. company Y is closing shop and company X wants all remaining (< 5) employees to be transferred to company X other units. company Y has, 2 years ago, retrenched all other employees (abt 50) and these remaining (<5) are just there as a transition team.

     

    does worker A have an option to be retrenched and opt not to be transferred to company X?

    under Section 21 of the Implementing Rules and Regulations, emergency leaves cannot be charged to the solo parent leave. however, the leave is not cumulative, nor is it convertible to cash. Ergo, solo parent's leave is really only 7 days every year.

    in a contract of lease, where the owner has visitorial rights over the property pending notice to lessor and yet visits or sends his agent to the property without previous notice, is this violation enough to rescind the contract?

     

    i mean, there should be notice given to holder of the property that a visit would be conducted, but the owner persists on coming over without any notice. is this sufficient right for the renter to rescind the contract?

    No. Your uncle does not become the sole owner of the property just because he was the one paying taxes. all that he has is a right to be reimbursed for the share of the taxes that should have been paid by your father (see Art. 488, Civil Code).

     

     

    2. what happens when my father and uncle pass away too without being able to transfer the land under their names. How do we, as the grandchildren sort the ownership of this land?

     

    you'll have to partition the property among yourselves, 1/2 of the property going to your uncle's heirs (plus the right to be reimbursed for 1/2 of the amount of taxes he has paid), the other half to your father's heirs. notably, you'll have to likewise settle the estate of your grandfather, since the property originally came from him. all of these will require the payment of estate taxes (plus the penalties and interest that have accrued) due on the estate of your deceased grandfather, as well as the estate taxes due on the estate if your father and uncle. also, transfer tax, documentary stamp taxes, etc.

     

    it would be better to have the property transferred to your father and uncle's name NOW while they are still alive to avoid complications later on (as well as to stop the running of BIR penalty charges and interest). if the grandfather died without a will, they can now extrajudicially settle the estate of their father.

  24. assuming that the closure of the Makati branch is really because they have lost an account and have no other option but to move to Clark (in fact, even if they had not lost an account, a decision DONE IN GOOD FAITH to move to Clark would still be a valid exercise of management's prerogatives), your GF would be entitled to 1 month salary or 1/2 month's salary per year of service, whichever is higher (see Art. 283, Labor Code).

     

    Hello, I would appreciate legal advise on a Labor related matter.

     

    My girlfriend's call center has lost an important account in their Makati site. The only option left for them is to move to Clark, Pampanga which is not a viable option for her. If she doesn't move to Clark, she won't have anything to do in Makati and the company will be forced to terminate her employment. My question is: Is it mandated by law to provide severance/redundancy pay or is it company prerogative? In this case, if she stays and waits until her employment is terminated by the company, will she get anything? Is there a specific formulated amount for severance/redundancy pay?

     

    I hope someone will help me regarding this matter. Thank you in advance.
