  1. On the assumption na ang titulo ay nakapangalan pa rin sa magulang mo.

     

    dahil nawala ang titulo, ang pinakamaganda mong gawin ay magpatatak ASAP ng adverse claim sa titulo setting out your claim to the property (basically, you execute an affidavit where you allege that you are, through inheritance, now a part-owner of the property, together with your siblings. You then submit the affidavit of adverse claim to the register of deeds). This way, anyone who deals with the property is informed that there are several co-owners of the property, not just the person he is dealing with.

If you are a regular employee and your position is higher that of an "agent" position, if their offer of an "agent" position will give you lesser compensation and monetary benefits, that is contrary to labor laws, and you have right to refuse this offer. however, even if an "agent" position is lower in rank, if your compensation and benefits will remain the same, mgt has a right to do so, and you may not refuse this offer.

     

    now, if the "agent" position will result in lesser compensation and monetary benefits, you have a right to refuse the same; and your being on "floating status" (I am assuming that you are not receiving compensation and benefits during this "floating" period) for MORE than 6 months is now considered as constructive dismissal. you can now file a complaint with the NLRC on this.

     

    kaka 6 months ko lang po nitong september 28 na naka floating status. last communication ng HR sa was september 10 para mang alok ng agent position. since then wala pa akong nakuhang communication sa kanila. hingi lang po ako ng payo kung ano po ba ang mabuting gawin from this point? kating kati na po ako mag work ulit pero ayoko naman gumawa ng hakbang na magpapa complicate sa sitwasyon ko.

    Sir Rocco, good day po....just want to ask kung may something wrong sa setup ng current company na pinapasukan ko ngayon...........IT Company po sya...almost 10years narin po ako employed sa knila....tapos this year since mejo dumadami na ang head count ng mga empleyado nila they decided to put or build a new company to handle other products from my current company... kung baga yung ibang mga products na sinu-support namin is mapupunta na sa bagong company na itatayo nila.... in short mag kakaroon ako ng dalwang Company ID...isa para sa current Company ko at isa para sa itatayo nilang company, so as being 1 person or identity dalawang company ang pinapasukan ko.. yung dalawang company na yun is in same location/building and floors but different address (ang pinag iba lang nila is yung room#)

     

    Since ganito ang magiging setup ng company ngayon, meron ba dapat akong benefits na makukuha? (ex: money, upgrade ng salary)

    mangangailangan naman kayo ng proof na kayo nga ang heirs ng tatay ninyo, kaya kailangan ninyo ng Extrajudicial Settlement of Estate dun sa naiwang ari-arian ng tatay nyo.

     

    tanungin niyo na rin ng bangko kung ano ang kailangan nilang documents para ma-release yung pera sa account, para pag may list na kayo, i-compile nyo na ang mga ito. Dito nyo na rin malalaman kung kailangan nyong kumuha talaga ng abugado.

    Gandang gabi po.. ask ko lng pano procedure kasi my dad died may naiwan syang negosyo.. partnership ito 3 silang mgpapartner pero un isa 10yrs nang inactive pero hinde updated un sec papers.. may naiwan na pera un business sa bank pano namin un makukuha.. un bank account ay nka pangalan sa business po. At And account ito.. saka po may papadating pa kami mga recievables na cheke pano namin ito maidedeposit sa account? Sabi ng bank ay froZEN na daw un account kasi may partner na patay na daw..

     

    Di naman namin pdeng irequest na sa ibang account ipanhalan un mga padating na cheke kasi nka base sila sa invoice na iniissue ng company namin.. pano po dpt namin gwin para makuha un pera sa bank at un mga padating pa na recievables?

  11. hindi legal ang employment bond KUNG wala silang damages na na-suffer. Sabi ko nga, an employee can resign at any time. Yung one-month advance notice, para lang hindi ma-disrupt ang operations ng employer at may time siya maghanap ng replacement. kung di naman madi-disrupt ang operation ng employer, anong damages ang pinag-uusapan natin.

     

    ang problema mo, kung maliit lang ang amount na ikakaltas sa employment bond, baka mas perwisyo pa yung magcomplain ka sa Labor kesa dun sa amount na ikakaltas sa iyo. Pero kung malaki, pwede ka magreklamo sa Labor niyan.

     

    Note: pag nag-resign ka, entitled ka rin sa 13th month pay (9/12 of your monthly salary), baka dun nila kunin yung employment bond na sinasabi nila, ikakaltas nila dun.

  13. an employee can resign at any time (unless he has signed an agreement not to do so, eg. after being given training one can agree to work for a certain period of time for the compny who provided the training), but he is supposed to give notice in writing one month in advance. If he does not give the notice, his resignation will still be effective, but he could be held liable for damages by the company.

     

    In your case, kung wala ka namang project, at walang itu-turn-over, the company will PROBABLY not suffer damages (probably, di natin alam), so hindi sila siguro maghahabol pag nagresign ka "effective immediately.".

     

    In any case, just remember that an employee who resigns is not entitled to separation pay.

    good day po...ang father ko po is SSS pensioner but he died last year October, kaso mga 1 month bago namatay yung father ko, wala na syang natanggap na pension from SSS, delayed lang daw sabi ng SSS....so ayun nag antay kami... till umabot na ng almost 10 months wala parin kkaming narereceived na pension from SSS...lagi nman kami nag pa-followup sa SSS kaso ang laging sagot nila sa amin eh mag antay lang daw....

     

     

     

    ano po ba ang pwede ko gawin para makuha na po nmin ang pension para sa father ko? saka diba automatic na yun na sa asawa na mapupunta yung pension ng asawang SSS Pensioner na namatay??

  15. It depends on your contract of lease.

     

    read the contract first to see whether there is a stipulation there as to who is responsible for this kind of repairs. if there is a clause in the contract of lease that says this kind of repairs is your responsibility, then, sagutin mo yung ganitong repair, sorry ka.

     

    But if there is no stipulation as to who makes this kind of repairs, Paragraph #2 of Art. 1654 of the Civil Code says that "the lessor is obliged to make on the [premises] all the necessary repairs in order to keep it suitable for the use to which it has been devoted." Pag ganun, sagutin ng owner yung repairs.

     

    In this connection, Art. 1658 of the Civil Code says "the lessee may suspend the payment of the rent in case the lessor fails to make the necessary repairs or to maintain the lessee in peaceful and adequate enjoyment of the property leased.

     

    Kapag ganito ang sitwasyon mo, sulatan mo yung lessor mo demanding that he make the necessary repairs and warning him that if he does not do so within the period you give (bigyan mo ng 15 days), you will suspend payment of rentals, copy furnished the condominium administration (para di ka mapalayas sa pamamagitan ng kutsabahan ng owner at ng condominium association)

     

     

    I am renting a condo and the owner refuses to repair the leaking ceiling and other parts of the house that needs repairing. Is it not the owner's responsibility? Any advice? Thanks in advance!

    Sir salamat sa reply. I went to the RD but un copy kasi nila na nasa computer is just a scanned copy of the TCT that I have. Saan ko po ba pwede makita un orig title ng lot ko?

    the only land that can be titled is alienable and disposable land of the public domain. kahit gaano pa katagal nakatira yung seller mo dun sa lupa, kung hindi ito alienable and disposable land, hindi pa rin ito mapapatitulohan. Pumunta ka sa DENR at magtanong dun kung ano ang status ng lupa mo, kung ito ba ay alienable and disposable.

    it was inhabited by the previous owner for many years but they did not

    pursue land title due to family dispute.

     

    the mother land was divided amongst children and a part was sold to me.

    now, i'm having a problem in regards to titling of my land due to that it is

    a part of the water shed of angat dam.

     

    is there a way i can have my land titled to my name since the land was inhabited

    by the people who sold it to me since birth ( mentionly the owner died at the age of 102)

    and the land is already a part of a progressive baranggay that has schools, church, etc.

    The children get whatever remains after the debts and charges owed by the estate of the deceased are paid. In other words, kaya pa ring habulin sa properties na naiwan yung civil liability nung namatay.

     

    If a rich person has a tax evasion case. There is both a civil and criminal lialibility di ba . Then he got sick and suddenly dies.I know the criminal liability would be moot and academic. How about his assets who would own them. The state or the children. Me nag adviceNa kaya pa ding habulin ng state kahit patay na  alam ko inheritance tax. How about tax evasion case na civil liability meron pa baSa properties kahit patay na????

  19. Kung may transfer certificate of title kayo, pwede na siya ibenta. risk na ng buyer kung may squatter dun o wala. Tanga rin naman yung bibili ng lupa na hindi titingnan yung mismong lupa.

    may lupa kasi kami and hindi pa namin napuntahan yun exact location although mayroon kami title at nagbabayad kami ng real estate tax, mayroon din kami subdivision plan na luma and last time we checked sa LMB/DENR wala daw silang kopya (or baka nagaantay lang ng lagay para pagtyagaan nila maghanap kasi luma na yun dokumento..)...most likely may mga squatter na sa lupa namin since nakuha yun mga 20yrs ago pa...tanong ko lang po sana kung kailangan pa namin i pa survey ulit yun lupa para maibenta or kung pwede na sya ibenta or isanla w/ just the title/subdivision plan,

    When we say "selling price", we assume that your father sold the properties to you and your brother; that is, your father executes a Deed of Absolute Sale in you and your brother's favor. "Selling price" would be the price appearing in the Deed of Absolute Sale executed by your father in your favor (this, clearly, is not the current market price nor the price of the property when it was first bought, although your father could choose to use these values as the "selling price" in the Deed of Absolute Sale, it's entirely up to your father how much he sells the property to you and your brother)

     

    The transaction would then be subject to 6% capital gains tax, based either on the price stated in the Deed of Absolute Sale, or the zonal valuation given to the property by the BIR, WHICHEVER IS HIGHER (With a selling price lower than the zonal valuation, you end up paying a capital gains tax based on the zonal valuation, the latter being the higher value.On the other hand, with a selling price higher than the zonal valuation, you end up paying a capital gains tax based on the selling price, its up to the parties really).

     

    With a Deed of Sale, you ALWAYS pay a 6% capital gains tax.

     

    With a Deed of Donation, for property whose market value or zonal valuation (whichever is higher) is less than 1.8M, you pay a lesser amount (as the tax rate is less than the 6% capital gains tax (see http://www.bir.gov.ph/taxinfo/tax_donors.htm#8119 for the applicable tax rates), provided you are donating to a member of your family or relative within the 4th degree of consanguinity (donations to a stranger is taxed 30% of the value of the property donated)

     

    At a value of 1.8M, the capital gains tax and donor's tax are the same. For real properties valued higher than 1.8M, the donor's tax is higher than capital gains tax.

    Yes, deed of donation, you follow the form required for donations (see Art. 748 and 749, Civil Code). Donations mortis causa are more familiarly called wills. You follow the form of a will in the making of a donation mortis causa (see Art. 804, 805, 806 or 810, Civil Code)

     

    For tax purposes, the donor pays a donor's tax in a deed of donation; while in donations mortis causa, you pay estate tax (for the privilege of inheriting property).

    The Deed of Donation is easier to make; plus you do not need to file a petition for probate. A will could be more difficult to make (unless its a holographic will [see Art. 810], and you need to have it probated (kailangan magsampa ng kaso sa hukuman para patunayan na ito nga ang huling habilin nung namatay), kaya dagdag gastos at pahirap.

     

    Sir, when you say selling price, is it the current market price (need to be appraised?) or yung price na unang binili yung property? Also, may difference ba yung deed of donation vs deed of donation mortis causa in terms of tax and alin ang mas mabilis gawin? by the way, my dad is old(75) na rin and in a poor health na kaya naisip na niyang ilipat yung name sa amin magkakapatid.

  21. Ang sabi ng Section 108 of Presidential Decree No. 1529, otherwise known as the Property Registration Decree:

     

    SEC. 108. No erasure, alteration, or amendment shall be made upon the registration book after the entry of a certificate of title or a memorandum thereon and the attestation of the same by the clerk or any register of deeds, except by order of the proper Court of First Instance.

     

    Sa madaling salita, kung may typographical error sa titulo mo, kailangan mo ng court order para i-ayos ito. Kakailanganin mong magsampa ng kaso sa korte para dito (haaaaaaay, gastos na naman!!!).

     

    Siguraduhin mo muna na may error nga sa titulo. Patingnan mo sa geodetic engineer o architect (o kahit sino na may alam sa surveying) yung "technical description" sa titulo mo para mai-plot nga ito (2nd opinion, kumbaga). Kung talagang di nagsasara, punta ka sa Register of Deeds at tingnan mo yung kopya nila ng titulo mo. I-compare mo ito sa owner's duplicate na hawak mo. Kung magkaiba yung technical description sa Register of Deeds copy at sa Owner's Duplicate Copy, yung error ay nasa copy mo lang (Ipa-check mo rin sa geodetic engineer yung technical description na nasa Register of Deeds copy. Kung nagsasara yung technical description sa Register of Deeds copy, AYUN, may typographical error dun sa kopya mo lang. Pwede mo nang gamitan ng eraser ang kopya mo ng titulo at i-retype yung tamang description DOON SA KOPYA MO. Solb ang problem!

     

    Ang problema, kung pareho ang technical description sa copy mo at copy na nasa Register of Deeds.

Kung nagsasara yung sa naunang titulo, AYUN, may typographical error sa titulo mo. Kung medyo bago pa lang na nai-issue yung titulo mo (or kahit hindi, baka sakaling makalusot) kausapin mo yung taga-Register of Deeds, kasi kasalanan nila, baka pwede nilang gawan ng paraan at i-erase na lang yung mali sa kopya ng titulo mo na nasa kanila (medyo suntok sa buwan na ito kung luma na yung titulo mo, at mas malamang sa hindi, naka-microfilm na yung titulo, di na pwedeng basta-basta gamitan ng eraser at i-retype yung mali sa kopya nila at sa kopya mo), tapos i-retype mo na rin yung mali sa kopya mo.

     

    Kung pareho pa rin yung technical description sa pinanggalingan na title OR ayaw ng Register of Deeds na baguhin yung typographical error, mapipilitan kang magfile ng kaso sa korte para ipa-correct ang title mo.

     

    Kung pareho ang technical description dun sa pinanggalingan na titulo (i-trace mo lahat ng titulo pabalik hanggang sa pinaka-unang titulo to see kung talagang mali ang description from the very beginning or may typographical error lang somewehere along the way) at mukhang mali talaga ang technical description from the very beginning, mapipilitan kang magpa relocation survey sa lupa mismo (haaay, gastos talaga!) para makita kung ano nga ba talaga yung mali sa description. Kakailanganin mo rin naman ito sa petition for correction na isasampa mo sa korte. Pag nalaman na yung mali, ayun, kumausap ka na ng abugado para sa paghain ng kaso mo.

    assuming that your marriage took place after 1988, and that you have no pre-nuptial agreement, you will be governed by the regime of absolute community of property (which basically means that everything you own is also owned by your spouse).

     

    so, when you buy property, you will basically be using BOTH your property, and then when you put it in the name of your kids, it would basically be a donation to your children.

     

    Under the Family Code, one spouse cannot donate their property (in this case, the property bought using money belonging to both of you) without the written consent of the other, and that any such donation is void.

     

    In short, not only can your wife demand a share, she could actually have the donation declared void (resulting in the property reverting back to the absolute community of property existing between both of you).
