  1. I file a resignation last june 9 and the last day will be this June 15, to be exact I reached ten years (in this company) I don't have a contract. Now, I want to know if there is a chance that they will give me separation pay, or do I have the right to ask for that, they promised that if an employee reached at least 10 years they will provide some cash assistance and I'm hoping that they will grant that.     At the end of the day, ikaw ay umaasa na lamang sa good will ng kumpanya. Kung wala kang matibay na ebidensyang pinanghahawakan sa mga sinasabi mong pangako ng kumpanya, mas malamang sa hindi, naghihintay ka sa wala.

    yup, the answer is the same, as in fact, the advise given was on the assumption that the property was paraphernal (i.e. property belonging solely to your tiyahin),

  3. Question po, My father and his remaining siblings have this real property (House and Lot) in Gen. Santos City, Mindanao owned in common (co-ownership). Since my father is the eldest, he was put in charge to represent all of them to have the property disposed of (to be sold). My question is this, one of his siblings/sister has recently died, leaving with her estranged husband and two children, is the signature of his estranged husband required in the contract to sell or deed of absolute sale or her two children assent will suffice?

    Dahil "estranged" lang naman yung husband, di naapektuhan ang property relations nilang mag-asawa (walang court decision eh), so may share pa rin yung asawa sa property. Kailangang pumirma lahat ng tagapagmana ng tiyahin mo, in this case the husband and the two children (assuming na nasa edad na yung dalawa).

     

    Ngunit, subalit, datapwat...

     

    Bago sila pumirma, kailangan munang ayusin ang properties na naiwan ng tiyahin mo (to include her share in the property you mentioned) ng mga naiwan. Ito ay ginagawa kalimitan sa pamamagitan ng "Extrajudicial Settlement of Estate" kung saan pinagkakasunduan ng mga tagapagmana ang hatian sa properties na naiwan ng namatay. Sa pamamagitan ng extrajudicial settlement, mapapatunayan natin na yung mga tagapagmana na nga ang may-ari ng property at sila na ang may karapatan na pumirma sa Deed of Sale (para sa parte ng nasira mong tiyahin).

    Nope. It can stand in court even if unnotarized, But it is easier to prove the authenticity and due existence of a notarized document in court

    Ang lupon ng barangay ay hindi hukuman. Ang trabaho ng lupon ay IPAGKASUNDO ang mga partido. Hindi pumupunta ang tao sa barangay para maghabla, dahil nga ang trabaho lang ng lupon ay ayusin ang hidwaan na namamagitan sa dalawang partido.

    Sorry, but NO.

     

    One, di pwede ang divorce at walang divorce dito sa Pilipinas. Filipino citizens cannot divorce each other.

     

    Two, for legal separation, ang grounds ay:

     

    (1) Repeated physical violence or grossly abusive conduct directed against the petitioner, a common child, or a child of the petitioner;

    (2) Physical violence or moral pressure to compel the petitioner to change religious or political affiliation;

    (3) Attempt of respondent to corrupt or induce the petitioner, a common child, or a child of the petitioner, to engage in prostitution, or connivance in such corruption or inducement;

    (4) Final judgment sentencing the respondent to imprisonment of more than six years, even if pardoned;

    (5) Drug addiction or habitual alcoholism of the respondent;

    (6) Lesbianism or homosexuality of the respondent;

    (7) Contracting by the respondent of a subsequent bigamous marriage, whether in the Philippines or abroad;

    (8) Sexual infidelity or perversion;

    (9) Attempt by the respondent against the life of the petitioner; or

    (10) Abandonment of petitioner by respondent without justifiable cause for more than one year.

     

    Mapapansin mo na hindi kasali ang case nyo sa grounds for legal separation. Ang hindi malimit na pagtatalik, o di-kaya'y katabaan kaya hirap makipagtalik ay hindi basehan para sa legal separation. mas lalong hindi ground yung pagkawala ng anak.

     

    I suggest marriage counselling. Masyadong drastic yung pakikipaghiwalay dahil lang sa di na kayo malimit magsex.

    Need ko po ng advise, I'm working na sa company namin ng 16years sa position na Acting-supervisor. At bigla isang umaga nabulaga ka na lang na may bago ng pinakilala ang boss mo na supervisor sayo. Tanong kahit na po pasado at mataas ang aking appraisal grade sinace wala pa naman talaga sakin yung position na yun ganon lang po ba na babalewalain ka without any explanation na di ka capable sa position. Instead gagawin ka na lang asst. supervisor. May labor law po ba sa ganitong sitwasyon? Para kasing unfair, nga pala bago na yung GM namin at mukang binabalasa nila ang tao.

     

    Kung di naman bumaba sweldo mo, at di rin binago place of work mo, di ka makakareklamo. Management prerogative ang tawag diyan. Kung ibinaba ang sweldo mo, diminution of benefits yan na bawal sa Labor Code.

  9. Anong running event ang magandang salihan this April?

     

    NatGeo's Earth Day Run on the 26th looks good. With RunRio handling the event, this run should be well-organized. Don't know about the in-store registration however, which starts Monday (laging magulo ang RunRio in-store registration, altho they seem to have learned from their lapses already. Registration for RunUnited 2 should be quite organized now: 1 pre-paid card per buyer only; option to pick up race kit, resulting in no delivery fee; all registration to be done online hence no race kit on registration, only on delivery or on pick-up etc.)

  10. Can I use my house as a collateral when applying to a business loan? I'm still paying this house thru pag-ibig (Housing Loan).

     

    Pwede naman yan kasi nasa nagpapautang yan kung papayag silang maging 2nd mortgagee lang. Tanungin mo yung uutangan mo kung OK sa kanila yun (pag bangko, malabong pumayag, sa palagay ko lang)

  11. Condura Skyway Marathon:

     

    42k run started at 12midnight, although the start was divided into 11 waves of 500 runners each (A to K) sent-off at supposedly 2-minute intervals due to safety concerns (the ramp going up to the Skyway being single lane only, it was feared that a massed start could lead to a stampede). 44 PNP personnel positioned at intervals immediately after the start each held photos of the Fallen 44, with runners encouraged to salute the fallen as they passed by. Wave J started at 12:32.

     

    From Alabang to Sucat, the wind on the elevated portion between Alabang and Sucat was a tailwind pushing runners forward (I thought the pace I was running was too fast and feared I would burn-out early, but realized coming back it was just the wind (which was now a headwind making it a bit more difficult running the last 5k)

     

    According to the race route released by organizers, after a U-turn at Buendia, runners would run back to the NAIA portion of the Skyway and loop around to run back to Buendia, before running back to Alabang. However, the actual course had runners, after looping around the NAIA interchange, run a significant distance back to Sucat before making a the U-turn back to Buendia.

     

    Per the usual with Runrio-handled events, hydration stations were amply stocked [and with portalets at each station]. I found bananas at only one station though, although I kept seeing banana peels at the beginning of the second half of the course.

     

    It may just be me but I also think the hydration stations in the middle portion of the run were too close to each other. I kept getting surprised after coming from a hydration station to come to another after what seemed a too short distance from a previous one. I ended up skipping around 3 or 4 hydration stations which I felt was too near a previous one as it got more and more difficult to start running again after stopping to get a drink. Parang ansarap na maglakad na lang after you stopped to get a drink, kailangan talaga ng mental effort para pilitin ang katawan na tumakbo ulit. Then, there was a significant distance before the hydration station at the Sucat toll gate.

     

    Fireworks started lighting up the sky at 5am, while I was still far away from Alabang.

     

    As I was aiming for a sub-5 finish to a first-time marathon effort, notricing I had only 15 mins to do so, had to really pump the dead-tired legs for the last 3 k. There was a hydration station at South Station, probably 300 or so meters before the finish line. Made it sub-5 with about 4mins to spare. YEEES!

     

    As stated by floppydrive, there were long inclines and false flats.Ended up with only one bloody blister. Thanks to my Altras and Balega socks for a great run!

     

    Pero pahinga muna bago umulit ng ganung distance! Felt dead on my feet at the runner's village.

  12. Runrio seems hellbent on alienating its customer base. Andami nang nagalit ng ni-reschedule nila ng madalian yung Milo National Finals.

     

    Tapos, eto na naman, nare-sked pala yung in-store registration ng Run United 1 2015, di yata maganda yung dissemination nila. Andami daw nakapila kahapon sa Toby's SM North (may iba, nag-absent na daw sa trabaho para lang dun), only to find out, wala palang registration at ni-reset pala nila. Buti na lang, may ibang lakad ako. Was actually planning on lining up as early as 9:30am to register. Was able to pass by at 5pm only to learn, na-reset nga.

     

    Per the usual, no comment na naman ang runrio about this.

  13. Does anyone know where one can purchase Bag Balm (Bag Balm is a salve developed in 1899 to soothe irritation on cows' udders after milking). After some research on the net, this seems highly recommended for inner thigh chafing (which I begin to get after runs longer than 15k).

     

    Will be trying Transpore Clear 1st Aid tape for nip chafe (read that too on the net) as I get bloody nips at times too. Got the tape at Mercury Drug.

    Kung ang ibig mong sabihin sa salitang "ex-wife" ay ito ay naging "ex" mo dahil may desisyon na ang korte na pinapawalang bisa ang kasal ninyo, isa sa mga epekto ng desisyon ng korte ay ang paglusaw ng community property/conjugal property ng mag-asawa, kung kaya't lahat ng ari-arian na maipupundar mo pagkatapos ng desisyon ng korte ay sa iyo lang.

     

    pero, kung ang ibig mong sabihin sa salitang "ex-wife" ay ito ay naging "ex" mo dahil kayo ay naghiwalay lamang (ang tawag dito sa batas ay separation de facto), ayon sa Art. 100 ng Family Code:

     

    Art. 100. The separation in fact between husband and wife shall not affect the regime of absolute community except that:

    (1) The spouse who leaves the conjugal home or refuses to live therein, without just cause, shall not have the right to be supported;

    (2) When the consent of one spouse to any transaction of the other is required by law, judicial authorization shall be obtained in a summary proceeding;

    (3) In the absence of sufficient community property, the separate property of both spouses shall be solidarily liable for the support of the family. The spouse present shall, upon proper petition in a summary proceeding, be given judicial authority to administer or encumber any specific separate property of the other spouse and use the fruits or proceeds thereof to satisfy the latter's share. (178a)

     

    Lumalabas, walang epekto ang basta-basta lang na paghihiwalay, kung kaya't lahat ng maipupundar mo sa panahong kayo ay nagkahiwalay ay pag-aari nyo pa ring pareho, at may habol ang "ex wife" mo (na hindi naman talaga natin matatatatwag na "ex wife" mo dahil kasal pa rin kayo sa isa't-isa).

Siguro, hindi lang nabibigyan ng pansin yung mga hinihilang maliliit na trailer kaya nakakalusot, pero, technically, dapat iparehistro din.

    Because he is not legally a sibling, your brother, being the owner, can expel him from the house. In fact, even if he is a sibling, the owner can expel him from the house. The owner can refuse entry and use of his house from anyone.

A penalty lower by two (2) degrees than that prescribed for the consummated felony under Section 5 hereof shall be imposed [2 years, 4 months and 1 day to 8 years] upon the principals of the attempt to commit the crime of child prostitution under this Act, or, in the proper case, under the Revised Penal Code.

If I were to get a Certificate of Deposit from a Bank for BIR regarding my deceased father's SSS savings account, is it normal that the certificate is sealed even if I have the passbook of my father and they also let me signed as receive what I think is the same document inside the envelope?     The race route was one of a kind. Minsan mo lang masabing natakbo mo ang commonwealth ave, circle, at quezon ave, underpass sa sto somingo at overpass sa EDSA & Q. AVE. Saktong 21.22 yung distance ko base sa garmin ko.

     

    2 to 3 lanes ung pinagamit sa mga runners so maluwag. And in fairness, it wasn't as polluted as I thought it was, although, pansin ko, mas mabilis ako mapagod, siguro nga dahil CO2 nang na traffic na mga sasakyan ang nilalanghap mo as opposed to clean air.

  22. 1. does a simple board resolution gives company B the rights to collect for another company who is now closed/bankrupt/dissolved?

     

    A company can authorize another person [in this case, Company B] to collect the debts other persons owe it. Since a Company can act only through its Board, this would have to be by a Board resolution. Notably, Company B will have to prove that the resolution exists and is authentic.

     

    Note: Hindi dahil bankrupt yung company ay inexistent na ito, kailangan may petition to dissolve the company sa SEC (na approved ng SEC), or revocation ng articles of incorporation nito.

     

    2. does the board resolution of company supersede the contract and that I now owe company B?

     

    Not necessarily. Ang utang mo ay sa Company A, therefore dapat sa Company A ka lang may obligasyon. Kaya lang... baka naman kasi may clause sa kontrata mo na nagsasabi na pwede nila i-assign ito sa iba without your consent 9pero dapat mayron ding Deed f Assignment pag ganun]. Kung walang ganitong clause at Deed of Assignment, sa Company A ka lang may utang, at collecting agent lang ang Company B, at the most (their right to collect has to be supported by a Board resolution).

     

    3. Can I sue them in tampering with my checks?

     

    Pwede mong kasuhan ng falsification of commercial documents, kasi ayon sa iyo, pangalan ng Company A ang nakalagay sa cheke nung ibinigay mo ito sa Company A. Ito ay violation ng Article 172, in relation to Art. 171(6) [Making any alteration or intercalation in a genuine document which changes its meaning].

    Kaya lang, kailangan matibay ang ebidensya mo na sa Company A nga nakapangalan yung cheke nung ibinigay mo ito, at kailangang maituro rin kung sinong tao sa Company B ang nagbago ng cheke.

     

    4. What other options/actions can I do?

     

    Hingin mo yung Board resolution, tapos i-check mo kung tutoo ito (dapat meron itong sworn certification ng Board Secretary ng Company A)

     

    I saw that they stamped the name of their company (company A) only...they also let me validate the name of the company (again just company A)

  23. When you issued the checks, was the name of the payee blank?

    Just this March 2014, a lending firm (lets term this as company A) that i once owed closed shop..as in they got bankrupt. I still owe them a sum of money and nag-issue ako ng checks. Now, another company (named company B). Now, company B is saying that they are the holdings firm of company A since company B is the re-discounting firm of company B. My contract is ONLY with Company A and now company B is threatening to sue me for BP 22. When I asked for a copy of the checks I issued, ,I was surprised that their company name (company B) is now on the face of my checks (not my handwriting) but was stamped (yes, rubber stamp was used) on the face of the checks. Last communication they sent is via SMS threatening to sue me for "Sum of Money" and will levy any possession/properties.

     

    Now, what rights does company B have over my checks? They say that company A, before going bankrupt, issues a circular/board resolution authorizing company B to collect loan payments for their clients (clients of company A). - does a simple board resolution gives company B the rights to collect for another company who is now closed/bankrupt/dissolved?

     

    My contract also says that I owe company A and NOT company B --does the board resolution of company supersede the contract and that I now owe company B? I know my obligations, but I just want to be sure that whatever I am/going to pay is going to the right people/company.

     

    Can I sue them in tampering with my checks?
