    Nope. Legal separation lang (you're still married to each other, but you are allowed to live separately from each other).

    If the HIV or STD was contracted after the marriage was celebrated, again, legal separation lang.

     

    If the HIV was already existing at the time of the marriage, it can be a ground for annulment (has to be filed within 5 years from the time the marriage took place, otherwise, paso na).

     

    If the STD was already existing at the time of the marriage, but was concealed by the person afflicted, it can be a ground for annulment (has to be filed within 5 years from the time you learned he had STD at the time of the marriage, otherwise, paso na).

     

    3. If no intimacy or wala nang sex sa marriage or ayaw na ng asawa mo sayo grounds na din ba for annulment?

     

    Nope. Not even grounds for legal separation.

    Note, however, that adultery and sex with prostitutes, contracting HIV or STD, no intimacy or wala nang sex sa marriage or ayaw na ng asawa mo sa yo; always ignoring the other spouse and living in an emotionally miserable unhappy life with spouse COULD BE SYMPTOMS OF PSYCHOLOGICAL INCAPACITY to comply with the essential marital obligations of marriage. Get a good enough psychiatrist, who can come up with this conclusion; AND YOU"RE ALL SET to file a petition for declaration of nullity of your marriage, based on psychological incapacity of your husband..

    Hi Tease, thank again for the relentless answering my inquiry. Does it mean ba kapag hindi na forward sa NSO at kumuha ako ng CENOMAR 100% single ang lalabas?

    The NSO's records are composed of the documents submitted to them by the local civil registrar. Accordingly, if the local civil registrar has not sent the certificate to the NSO, the latter will not have any record of that marriage.

    If the marriage certificate has been forwarded to the NSO, yes, lalabas ang kasal mo. The marriage license is not submitted to the NSO, so it doesn't matter whether you had one or not. So long as the certificate of marriage was submitted to the Civil Registrar, who forwards the same to the NSO, lalabas at lalabas yung record ng kasal mo.

  4. Need guidance lang po. Kinasal ako civi lang. Ang hawak ko lang po is marriage certificate, kailangan ko pa ba ng "mariage license" para legal? Hindi ako kumuha non kasi hindi ko naman alam na may ganon pala. Ibig bang sabihin VOID ang kasal kasi hindi ako nakapag apply ng "marriage license"? Kinasal ako 2009.     tingnan mo sa marriage certificate mo, sa may lower third portion (sa taas ng pirma ng solemnizing officer) kung may nakalagay na Marriage License Number; or kung ikinasal kayo dahil limang taon na kayong nagsasama bago kayo ikasal (Art. 34, Family Code) kaya di na kailangan ang marriage license.

     

    Kung may Marriage License No., ibig sabihin ginawan ng paraan yan nung kayo ay ikinasal. Punta ka sa municipality/city na nakalagay na nag-issue ng marriage license at i-check mo sa Civil Registrar dun kung tutoo ngang may marriage license na naka-issue sa pangalan ninyong mag-asawa. Kung meron, mahihirapan kang patunayan na di ka nag-apply for a marriage license nung ikinasal ka. Kung walang ganung license, swerte mo, void ang kasal mo. Maaari kang pumunta agad sa abugado para ihain ang kaukulang kaso para ideklarang walang bisa ang kasal mo.

     

    Kung nakalagay na ikinasal kayo dahil limang taon na kayong nagsasama bago kayo ikasal (Art. 34, Family Code), KUNG MAY MALAKAS KANG KATIBAYAN na di naman tutoo yun, maaari ka ring maghain ng kaukulang kaso para ideklarang walang bisa ang kasal mo, kasi nga wala kayong lisensya at kailangan meron dahil di naman kayo nagsama ng limang taon bago ang kasal.

    P.S. Mahirap umasa na void ang kasal mo dahil walang lisensya. Magagaling ang mga fixer sa kasalang civil. Mas malamang sa hindi, may lalabas na lisensya sa kasal mo. But anyway, no harm in trying.

  6. hi, bago lang po ako sa manila tonight...itatanong ko lang po sana ang kasalukuyan kong problema sa pinaupahan kung restobar, 5 yrs po ang term of contract at sa oct2015 po ito macocomplete ang term pero nung katapusan ng aug2015 isinara na ng umuupa ang restobar. ang malaking problema ko po ay lahat ng improvements sa restobar ay tinanggal ng umupa at ang natira lang ang poste at bubong kahit nakasaad sa kontrata na pagkatapos ng 5 yrs or kontrata wala silang gagalawin sa mga fixed improvements sa restobar kagaya nung mga electric wirings, kitchen, bar etc...ang tanong ko po ngayon ang kontrata po namin ay hindi notarized pero pirmado namin ng umuupa at may witnesses...valid po ba ito kung sakaling ireklamo ko ito ng breached of contract or kung hindi man ito valid pwede ko po ba itong kasuhan ng pagnanakaw kasi ibig sabihin ako ang meari pero kinuha nila ang mga kagamitan na nasa pag-aari ko/restobar ko? maraming salamat po...

    ito ay valid. sa pangkalahatan, dito sa Pilipinas, ang kontrata ay mabisa kahit ano pa ang anyo nito (nakasulat, verbal, notaryado, di-notaryado). Ang importante, nagkasundo ang magkabilang panig sa kanilang kontrata. Ang pagnonotaryo, kalimitan, ay hindi kailangan para magkabisa ang kontrata. MAS MADALI LANG PATUNAYAN SA KORTE ang notaryadong dokumento, dahil nga di mo na kailangan mag-prisinta ng testigo para patunayan na tutoo ito, di tulad ng di-notaryado, na kailangang patunayan na talagang tutoo ito. Sa kaso mo, pirmado ninyo pareho, at may testigo ka pa. Ayos na yun.

     

    [Note: May ilang kasunduan na kailangan notaryado para maging mabisa, tulad ng donasyon ng real property, pero di naman ito applicable sa kaso mo]

     

    Sa problema mo naman sa improvements, kailangan may matibay kang ebidensya na may improverments talaga sa restobar. Sa susunod, mag-require ka ng malaking deposit na sasagot sa danyos at isosoli lang sa umuupa pag siya ay tumupad sa lahat ng usapin sa ilalim ng kontrata.

What if you build a closed shed for your car to park in to protect it from the weather then your neighbor is envious about it so they will spray water using a hose on any opening to make your car inside wet. The shed is not on their property at all. What kind of charges or complaint can you file against them? What kind of penalties will the charges have?

  9. need some advice.. here's the scenario

     

    november 2013 - new roof was installed

    june 2014 - construction next door started ( apartment complex, adjacent to the south side of the house)

    october 2014 - we filed a complaint against the construction for damages to the property.. they did not put up a net to catch any falling debris and the almost year old roof was damaged. their worker would sometimes take their breaks on our roof without permission. and they would also step on our roof. we have construction waste (wood .. i think you call it dos por dos? basically its the long squarish wood that might actually be 2x2) at one point we even found a plastic full of human waste. we filed a complaint sa barangay

    december 2014 - an agreement was settled that they would replace the roof and fix any damages caused by their construction

     

    as of now, they have not done any repairs and roof replacement. also it rained tonight and the second floor was flooded... some of my stuff had water damage because of it. although the stuff are not expensive (craft materials) but they do hold a lot of sentimental value for me... clothes were damaged too and most probably the floor.

     

    question, can i take them to court at this point? it has been 9 months since an agreement was documented through the barangay and there is still nothing.

     

    btw, we went next door to talk to them after the rain, and they did not come out to talk to us. so basically nagtatago na sila.

     

    another thing, i have not sued anybody so i dont know how much lawyers would cost. so if anyone can pm me if i can sue the neighbors for damages as well as how much we'll need. im hoping to sue them and have them pay an amount so we can have the roof replaced again since it doesnt look like they'll fix it. or should we go thoruogh the barangay again?

     

    btw last time we went to the barangay they were no help at all... like they just sat down and asked us to talk instead of tell the neighbors to fix our roof.

    I am unhappy with my marriage and i want an annulment. The problem is my husband won't concede. He said he can take anything, even if i am having an affair. I keep begging that he should spare me. I even knelt down and crying my heart out. But to no avail, he said no annulment happening. I am having too much headache on this. Can i still win if i file for annulment eventhough he is not willing to and he said he is willing to prove to court that he wants to save the marriage at all cost.

     

    Another question, i want to acquire properties but i am afraid it will be divided when annulment materializes. Can we make a written agreement that he has nothing to do with the property. What do i need? Since he said he is willing to sign that agreement..

    If your spouse opposes the petition, it makes it more difficult to prevail, but it does not necessarily mean that the petition will be denied. Sa madaling salita, you can still file, mas mahirap nga lang ipanalo.

     

    2. Can we make a written agreement that he has nothing to do with the property. What do i need?

     

    Unfortunately, no waiver of rights, interests, shares and effects in the community/conjugal property can be made during the marriage (see Arts. 89/107, Family Code). Whatever agreement you enter into regarding your properties will be void, unless you enter into such an agreement upon getting a judicial separation of property or after your marriage is annulled/declared void.

    (1) A woman who gives birth as a result of rape or crimes against chastity, even without a final conviction of the offender: Provided, that the mother keeps and raises the child;

     

    (2) Parent left solo or alone with the responsibility of parenthood due to death of spouse;

     

    (3) Parent left solo or alone with the responsibility of parenthood while the spouse is detained, or is serving sentence for a criminal conviction for at least one (1) year;

    The law applies to the spouses of prisoners, whether or not a final judgment has been rendered, provided they are in detention for a minimum period of one (1) year;

     

    (4) Parent left solo or alone with the responsibility of parenthood due to physical and/or mental incapacity of spouse as certified by a public medical practitioner;

     

    (5) Parent left solo or alone with the responsibility of parenthood due to legal separation or de facto separation from spouse for at least one (1) year: Provided, that he or she is entrusted with the custody of the children;

    3. Kailagan ba na yung nagfile ng Single Parent Benefeciary eh nasa custody nya ang bata or kahit wala?

     

    Ayun sa definition ng solo parent - ito ay "left alone with the responsibility of parenthood," kung kaya't lumalabas na kailangan nasa custody niya yung bata.

    Mukhang yung 5% monthly lang ang defective (sabi kasi ng Supreme Court, ang interest na 3% or more per month ay iniquitous). the rest seems OK.

    para pag na certify nila hindi fake yun binibigay na owner's copy, saka lang ibibigay ng

    pinagsasanlaan yun pera sa nagsasanla kapalit nung verified owner's copy, contract, etc.

    you can go to the rd and check if the owner's copy and the RD copy are the same. tapos, magtanong ka na run kung ano ang security features na dapat lalabas sa owner's copy, para makita mo kung tutoo nga. As far as i know, yung bagong titles, pag xinerox mo, may lumalabas na words na "owner's duplicate copy", pero hindi ito nakikita sa title, lumalabas lang sa copy pag xinerox.

  16. I need assistance on how to file void ab initio. May na file na marriage contract pero wala pong marriage license at ang wedding date is sept 30. I left philippines august 6. Baka po may makakatulong sa akin mag papakasal na po aq ex ko po ang nagfile ng marriage contract dati. Mali din po ang name niya sa marriage contract. Paano po ang procedure. Thank u

    Meron gusto magsanla samin ng titulo ng lupa. We checked sa register of deeds authenticity ng certified true copy of TCT. wala naman encumbrance or adverse claim . All taxes are updated. WE then inspected the property and since dun padin nakatira may ari, pinakita nadin samin and we inspected yun owner's copy of title na hawak nya.

    Yun din ang i collateral nya.

     

    6 months lang daw gagamitin pera, and willing sila mag issue

    Ng PDCs for monthly interest paymens and PDC din for the whole amount of

    Principal sa dulo ng 6 months.

     

    Ang concern ko lang, ang request ng borower eh wag daw na daw sana ipa annotate sa title ang pagkaka utang. 6 months lang naman daw.

     

    Ang tanung ko :

     

    Normal ba ganitong kalakaran na hindi pinapa annotate sa Register of

    Deeds sa titulo ng lupa pag short term lang ang loan ?

     

    Kung sakaling pumayag kami na hindi ipa annotate, ano protection namin na

  18. I have also concern. may nabili kami na condo sa PagIbig, yung na remata na unit. Bali sumali kami sa bidding at kami ang nanalo. Now upon move in, inform kami ng admin ng condo, na yung dating may ari nyan (say mr dela cruz) ay may mga utang sa assoc dues, say mga 4 yrs na di nakabayad and nadadagdagan yung hanggang stop the day na kami mag move.     Look at the deed of restrictions on the title. usually kasi, condition yan sa ownership ng condo (or ng lote sa exclusive subdivision) that the monthly dues have to be paid by the owner. By buying the condio, basically, you agreed to the conditions stated in the deed of restrictions. Kung nakalagay dun na yung dues ay kailangang bayaran ng owner ng condo, to include past due ones, kayo magbabayad (although, pwede nyong kasuhan si dela cruz for reimbursement para mahabol yung amount na binayad nyo, kasi nga siya naman talaga ang may utang nito. Ngunit, subalit, datapwat... hindi nga makabayad sa PAG-IBIG kaya naremata yung unit, mas malamang sa hindi, wala rin yang pera para ma-reimburse kayo sa dues. In other words, baka magsasayang lang kayo ng pera sa paghahabol kay dela cruz).

     

    Isa pa, kahit sa PAG-IBIG nyo binili yan, as-is where-is kalimitan ang bilihan. ang assumption diyan, na-inspect nyo yung condo, to include yung status ng dues, bago nyo nabili yan, kaya di kayo pwede magreklamo na di nyo alam na may outstanding dues pala.

     

    as for the parking slot, kung kasama ito sa unit na nabili nyo, you could probably waive ownership of the same to pay for the dues (if the condominium mgt agrees). but the important thing first is to confirm kung talagang mayron ngang parking slot at kung kasama ito sa unit na nabili nyo. Usually kasi, hiwalay ang ownership ng parking slot sa condo unit. Alamin nyo muna.

  19. Hi, I have a concern with the title of our lot. Nakapangalan sa mama ko ang titulo na binili nila ng papa ko. Patay na ang papa ko so ngayon gustong ibenta ng mama ko ang lupa at bahay.     they're supposed to offer to buy the property first. if you don't like to sell, or you don't like the price they're offering, then you can go to court, either to contest the taking (on the ground that its not going to be used for a public purpose, or the taking is unnecessary), or to contest the price.

    If they do not offer to buy, but you are willing to sell, go to them (the govt agency) and offer your property for sale. if they do not offer to buy, and you are not willing to sell, then prevent them from entering/taking your property.

I just realized that if I want to put a wall the post and line of Meralco will touch the wall or worse obstruct it and can't put the wall because of the power lines.. How can I go about in requesting from Meralco to move the line or is this even possible? Thanks in advance..

    Kung happy ka na sa pagtanggap ng pera (in other words, wala ka ng grievance), you can opt not to inform the NLRC, or attend hearings there. The NLRC will just dismiss your case for "lack of interest" of the complainant to continue with the case.

     

    I wouldn't bet on this happening though. If I were the employer and an employee has filed a complaint with the NLRC, I would pay only if the employee agrees to have the case dismissed, hence I would pay only after we enter into such an agreement before the NLRC (to show the NLRC that the dismissal is voluntary on your part).

     

     

    2. What will happen to the July 3 appointment if he will promise (again) that I would received the money together with my June 30th cut-off pay but I will only know if I received the money 5-10 days AFTER the cut-off? What's the best thing to do?

     

    Agree to this during the July 3 hearing, before the NLRC arbiter. Then, you insist that they pay you your money before the NLRC. In other words, if he promises to pay, make his promise official by making him say the promise during the hearing. Then when he gives a date during the hearing when he will pay, ask the NLRC to schedule another hearing on the day he is supposed to pay, and then agree that payment will be made during that 2nd hearing in front of the Arbiter. It is only after the payment that you agree to the dismissal of the case. Sa madaling salita, kung mangangako sila na magbabayad pero after cut-off, kung OK lang sa yo yun, sabihin mo na sabihin nila yung pangako nilang yun sa NLRC dun sa hearing. Tapos sabihin mo rin sa Arbiter sa hearing na mag-schedule sila ng isa pang hearing para sa bayaran dahil nga ang gusto mo magkabayaran kayo sa harap ng Arbiter. Sabihin mo rin na pumapayag ka ipa-dismiss yung kaso kapag nabayaran ka on the 2nd hearing, Siguraduhin mo na nakasulat sa minutes before you sign the same.

     

    Sir, I went to NLRC to file the complaint and they scheduled me on July 3 for the arbitration. Coincidentally, after a few days after I filed the complaint, the Operations Manager added me thru Skype. But he just greeted me and didn't brought up anything so I didn't asked him about my complaint because I was really waiting for the arbitration date since I lose trust in them already. Today, he asked me if I have pending/outstanding dispute so I told him yes and I also told him to check with his staff because I have been passed around for more than 2 months already so I decided to handle it by myself. He said he's going to check it with his staff and will get back at me. I strongly feel that NLRC has called them up already and maybe he didn't mention it to me anymore because of pride or strategy.     you need an extrajudicial settlement wherein all the heirs of your mother agree that the car is part of your share in the inheritance (for convenience and closure, include ALL the properties registered in your mother's name in the settlement, e.g. all land titles, all shares of stock, all vehicles). If you are the only heir, you execute an affidavit of self-adjudication wherein you claim all the properties of your late mother, including the car, as your inheritance.

     

    After you have this document, you can now sell the car, on the claim that you are now the owner of the car. In short, you execute the deed of sale over the car, and then together with the deed of sale, you give the buyer a copy of the extrajudicial settlement.

     

    P.S. Kung ako ang buyer, i-rerequire muna kitang ipalipat ang CR ng sasakyan sa pangalan mo bago ko bilhin, para walang hassle. pero, if a buyer is willing to accept the OR and CR of the car still in your mother's name, together with the extrajudicial settlement, AYOS.
