In the absence of such authority or consent, the disposition or encumbrance shall be void.

     

    Kapag picture-picture or video lang, hindi ito matibay na ebidensya na pumayag talaga siya sa bentahan (baka sabihin pa nga niyan, Photoshop o inedit nyo lang yung video). Pinakamaganda, gumawa siya ng SPA kung saan binibigyan niya ng kapangyarihan yung asawa niya dito sa Pilipinas na ibenta yung property. Tapos, ipanotaryo niya sa consul. Kung hindi siya maka-appear sa consulate, pwede naman yung authentication lang (ipapanotaryo niya sa local notary public, tapos ipapadala sa consul by mail; depende ito sa lugar, icheck na lang sa internet).

Hi may tanong lang po ako sa rent increase ng isang commercial property. ano po ba ang minimum percent na pwedeng itaas ang isang commercial property annually? may minimum and maximum increase ba ang isang commercial property or depende na yun sa owner ng property kung ilang percent ang itataas ng increase sa rent?

    Pag commercial, no minimum or maximum. Bahala ang owner kung magkano ang gusto niya. Kung di kaya ng tenant, he can always refuse to lease. Basically, market forces will dictate rental prices.

  4. I wish to post this question regarding writing a DEED OF SALE document. I have a bit of a situation i am not familiar with regarding this.

     

    My brother and I both are owners of this house and lot. My brother and i have both agreed that i will buy out his share of the property. How do i go about writing the DEED OF SALE?

     

    I know how a regular DEED OF SALE document looks like and how to write it. The reason i am asking this, since my brother is the seller and im the one buying it. How would it look like in writing the document?

     

    And also does this type of transaction require any additional documents different from a regular DEED of Sale transaction?

     

    If anyone has a SAMPLE document of this type of DEED OF SALE would be also appreciated.

    How do i go about writing the DEED OF SALE?

     

    Its the same as the regular Deed of Sale, only that you describe the property to be sold as "Seller's 1/2 interest in a house and lot located at_______". No other documents are needed. It's just a regular sale, only that he is selling his one-half share in property. If your brother is married, have the wife sign the Deed of Sale at the end, after the signatures of the Seller and Buyer, under the heading "With my marital conformity"

    The land was given to me as a present after i graduated and all the titles were transferred to my name legally.

     

    Now, since the land is now in my name, I would assume that any agreement that my grandparents and the caretaker had, written or unwritten, must be redone now that they are no longer the rightful owners.

     

    Thus, #3 of the land reform no longer applies to the situation because I do not consent to the relationship.

    Sorry, no dice. If that was the case, it would be very easy to eject tenants. Just transfer the land to somebody else who will claim that they no longer consent to the relationship.As a transferee, you are bound by whatever agreements your predecessor entered into with the tenant. Dapat, before they transferred the property, pinaalis na nila yung caretaker. That is the reason why buyers of agricultural land always insist that tenants be evicted/removed prior to their buying the property.

    So i just inherited some land from my grandparents. around 5 hectares worth so i know it's worth some money. when i went to survey the place, i was introduced to the caretaker that's been living on the land for the last 20+ years. Now that the land is being transferred to me, I would like to ask him to pack up his things and leave. He has been using the land for his own personal farming and has been paying a small amount to my grandparents at the beginning of each month. However, my relative have been telling me that i must either, 1. give him a small portion of the land or 2. pay him a large amount of money in order for him to leave. but i'm thinking is that he was using land that was not his in the first place to support himself and his family for all these years. i feel like that should be compensation enough. are there actual laws that require me to pay him or give him land? thanks all

    1. First things first... how did you inherit the land? (unang gagawin ng caretaker, tatanungin - ano ang karapatan mo sa lupa?)

     

    i. Kung sa pamamagitan ng will, ayon sa Art. 838 ng Civil Code, "[n]o will shall pass either real or personal property unless it is prove and allowed in accordance with the Rules of Court."

     

    Ang ibig lang sabihin nito, bago magamit ang will na basehan ng pagmamana, kailangan aprubahan muna ito ng korte. Hangga't di ito dumadaan sa korte, di mo maaaring sabihin na namana mo na yung lupa. In other words, pwedeng pagmatigasan ng caretaker na wala kang karapatan na mag-astang may-ari.

     

    ii. Kung walang will, kailangan meron kang extra-judicial settlement na pirmado ng lahat ng tagapagmana, kung saan nagkakasundo na yung lupa ang parte mo sa mana (ibig sabihin patay na ang magulang mo at tumatayo ka sa kanilang kapakanan).

     

    iii. Kung walang will at buhay pa ang iyong magulang, ibig sabihin binibigay ng mga tagapagmana sa iyo ang lupa. Kailangan meron kang Deed of Donation, nakasulat, notaryado.

     

    iv. Kung walang will, at walang kasunduan (extra-judicial settlement) sa mga tagapagmana, kailangan may Court Order ka na hawak kung saan ibinabahagi sa iyo ng hukuman yung lupa (resulta ng paghahabla for partition or for settlement of estate).

     

    v. Kung buhay pa ang grandparents mo, hindi ito inheritance. You'd still need a notarized Deed of Donation.

    2. Assuming na ikaw na nga ang may-ari ng lupa, and that you have documentary evidence supporting your claim of ownership... ANG PROBLEMA MO land reform!

     

    Ayon sa batas, ang agricultural tenant ay may security of tenure, in other words hindi basta-basta napapalayas ang nagsasaka sa lupa mo.

     

    Para maging agricultural tenant, kailangang present ang sumusunod:

     

    1) the parties are the landowner and the tenant or agricultural lessee;

    2) the subject matter of the relationship is agricultural land;

    3) there is consent between the parties to the relationship;

    4) the purpose of the relationship is to bring about agricultural production;

    5) there is personal cultivation on the part of the tenant or agricultural lessee; and

    6) the harvest is shared between the landowner and the tenant or agricultural lessee.

     

    Sa pagbabasa ng kuwento mo, lahat ng elements na ito ay present.

    1) Your grandparents were the landowners, the caretaker is their tenant

    2) the 5-hectare property appears to be agricultural land

    3) your grandparents consented to the relationship, the caretaker having been there for the past 20+ years without protest on their part

    4) one of the purposes why the tenant is there is for farming, as he has been farming the land

    5) the caretaker has been personally cultivating the land

    6) he pays a small amount monthly to your grandparents for the use of the land.

     

    Kung tenant siya, di mo na siya mapapalayas unless there is a ground for his eviction (failure to comply with terms of contract, use for purposes other than that agreed upon, non-payment of rentals, damage to the land thru his fault, sublease of the land). At kailangan mong maghabla muna sa DARAB.

     

    Ano ngayon ang option mo. Pwedeng i-waive ng tenant yung karapatan niya sa lupa. PAPAANO?

     

    Bayaran mo siya, either by giving him a portion of the land in exchange for giving up his rights as a tenant, or by paying him a large enough sum of money that he agrees to give up his rights as a tenant.

     

    In ending, THERE IS NO LAW REQUIRING you to pay or give up land. But if you want to get rid of your tenant, these are some of the usual ways to get him to agree to move.

(3)Nais kong magbigay tulong sa nasugatan, maari ba niya itong gamitin sa laban sa akin? Na maari niyang sabihin na "guilty" ako kaya ko ito ginagawa?

     

    Maraming salamat sa tutugon.

    (1) Mayroon ba kaming liability sa taong injured?

     

    Ayon sa Article 221 ng Family Code:

     

    Art. 221. Parents and other persons exercising parental authority shall be civilly liable for the injuries and damages caused by the acts or omissions of their unemancipated children living in their company and under their parental authority subject to the appropriate defenses provided by law.

     

    Klaro. Magulang ang sasagot sa danyos na naidulot ng kanilang menor-de-edad na anak.

     

    Ngunit, subalit, datapwat... ito ay kung ang menor-de-edad ang may kasalanan. Sa kuwento mo, maaaring masabi na walang kasalanan yung bata, at sa mall ay maraming tao, expected na mag-ingat ang mga naglalakad sa karamihan. Mas lalo na ang nabangga ay nasa wastong gulang na.

     

    (2) May participation ba ang mall management sa ganitong incident?

     

    Kung ang insidente ay hindi maiuugnay sa kapabayaan o kamalian sa panig ng mall management, hindi sila maisasama sa usapin. sa kwento mo, banggaan lang ng dalawang tao, di natin masasabi na kasama ang mall mgt. sa ganitong pangyayari.

Pagmatigasan ninyo na ito ay tulong lamang para maayos ang gusot sa pagitan ng mga partido, HINDI NA UMAAMIN KAYO NA MAY OBLIGASYON KAYO SA KANILA. Ito ang Offer of Compromise na nasasakop ng Sec. 27

    On long runs, chafing occurs.

     

    Gumamit ng tamang running shorts para di magkasugat ang mga body parts (like inner thighs, or armpits) na nagcha-chafe. Others use compression shorts under regular shorts.

     

    You can also use lubricants or gels on "hot spots". Bodyglide, Chamois Butt'r, Vaseline all work. Personally, I use Bag Balm (got it on order from the US).

     

    Don't wear cotton shirts. They tend to rub on nipples, which begin to bleed after a while. Sometimes, even with technical shirts, chafing of nips occur.

     

    I suggest using 3M Transpore Surgical Tape (available at Mercury Drug) to cover your nips. Effective!

     

     

    Cotton socks are also a no-no, you'll end up with blisters, or black toenails.

     

    Use socks made with synthetic yarn. I think Thorlo and Dri-max are available on the market. The socks offered at Runnr or other running shoe stores are probably good too. Again, I use Balega (my size - XL - which, unfortunately is not available here in the Phils.)

    Ang function ng barangay ay ipagkasundo kayo. Kung hindi ito magtagumpay, ang option ng partido na ang pakiramdam ay agrabyado siya ay ang pumunta sa korte (kung sumusunod ito sa legal, may ilan naman kasi, dadaanin sa puwersa, pananakot, etc.).

     

    Kaya ang sagot sa katanungan mo ay OO, malaking posibilidad na dalhin ang asunto sa korte. Kung may panggastos sila, maaaring mapunta kayo sa korte, at pera lang naman ang kailangan para makakuha ng abugado.

  10. thank you for this response...walang HOA sa subd..Barangay lang po..just incase what kind of complain can we file in the barangay...kasi what i might think is just that they may find excuse na ganun lang tlaga sila magsara...besides bakuran naman nila kesyo naka underwear lang sila...pakialam ba namin..yung mga ganun excuse ba....what i was trying to ask is what kind of case can we file in the barangay(just incase)..for now...we just ignoring it as much as possible..no eye contact on both parties naman as if non exist..pero somehow we feel na nananadya na....i had to admit noob ako sa mga laws and case things kasi....i feel somehow offended on their action ...I just really dont know or how or what to do for the mean time..sensya na sa mga tanong ko..i just need some idea or opinion ..just incase para atleast may alam me what to do next...thank you in advance...

  11. we have this iritating prob regarding sa neighborhood namin..I know we should ignore it lang..but it's about our neighbors located front of our house..(katapat na bahay)..we are not in-good terms since our instalation of maynilad before..pinalampas nalng namin ung issue before(1yr after na)..kasi after that nawala sila...and lately dumating ulit sila (almost half a year na) ..for the us the good thinig is we just ignore them lang...ang problem kasi this time everytime na may nagbubukas sila ng gate nila eh lagi pabalibag ang bagsak ng gate..kahit madaling araw ang dating...andyan pabalibag ang bukas sara ng gate nila..na kahit nasa room na me eh maririnig mo pa..I know we should ignore it nalang..pero minsan for me parang sinasadya na kasi everytime nakikita kami sa bakuran...andyan lalabas ng hauz pabalibagg ang sara at bukas...pag ibang tao nagbubukas ng gate nila.ni wla ka maririnig na ingay sa pagbubukas nila ng gate ..pero pagsila lang talaga at mostly pagnakikita lang kami saka sila nagbabalibag ng gate..so for me pananadya na kasi ..at thrice ko na napupuna..pag yung mom ko nagsasampay..eh andyan lalabas yung bunso nila (24yrs old na)..nagtotothbrush pero naka underwear lang.....nalabas dun sa bakuran nila..i know i know we should ignore it lang...pero minsan kasi parang nakaka irita na kahit ignore mo lang...

    that's what the homeowner's association is for, to settle disputes between neighbors. Kung walang HOA, sa barangay.

    depende. tingnan mo na lang kung ano ang mangyayari sa SeNa. Pero maganda na rin mag-isip ka kung magkano OR ano ba talaga gusto mo, para kung tatanungin ka, may masasabi ka.

    wala pang argumentong legal sa puntong ito, at ipinagkakasundo nga lang kayo. Pag-uusapan lang kung ano ang magandang solusyon sa hidwaan ninyo. Alalahanin mo rin na hindi ang empleyado ang magpapatunay na mali ang pagtanggal sa kanya; ang employer ang magpapatunay na tama ang pagtanggal sa empleyado.

     

    Pag hindi kayo nagkasundo sa loob ng dalawang hearing, doon ka na maghahain ng pormal na reklamo sa NLRC. May taga-PAO naman sa NLRC na tutulong sa iyo para gawin ang mga argumento mo.

  14. meron na po ako nung dalawang notice.. so if bibigyan nila ako ng termination paper di ko muna pipirmahan ?? sabihin ko lang na di ko tinatanggap un at mag coconsult muna ako sa mlrc? pde ba ako kumuha ng copy nun para ma i forward din sa nlrc if possible ?? di nila ako pde pilitin pumirmasa termination paper di ba ??     Kung sa pirma, ang ibig mong sabihin, ay ire-receive mo yung notice, pwede mong tanggapin yung notice na tineterminate ka na nila.

    Tsaka, itago mo rin yung kopya nung dalawang notice na ibinigay sa iyo. Pati kontrata mo, pay slip, ID, at iba pang dokumento o bagay na magpapatunay na empleyado ka nila. magagamit mo lahat ng iyan sa NLRC.

    Oo naman. Kaya lang, kung tinatanggal ka na, ala ring silbi ang di mo pagpirma, at kailangan mo ring umuwi. Pag-uwi mo, sasabihan lang naman nila yung sekyu na wag ka nang papasukin kinabukasan. O, di tanggal ka pa rin.

    Pwede. Kaya lang, nasa kumpanya nga yun. Kung talagang desidido silang tanggalin ka, kahit wala sila sa tama, magagawa nila yun. Ang bagsak mo, sa NLRC pa rin.

    NOTE: Mali din yung basta ka na lang bibigyan ng termination paper, dahil ayon sa batas, dalawang notice dapat ang ibibigay sa iyo. UNA, kailangan bigyan ka ng notice na sinasabing magpaliwanag ka kung bakit di ka dapat tanggalin, minimum ng 5 araw para magpaliwanag. PANGALAWA, pagkatapos mong magpaliwanag, yung NOTICE na na tinatanggal ka dahil di katanggap-tanggap yung paliwanag mo.

  16. Question lang po ... I work in a BPO company and I am already a regular employee, after 6 months in the company I got transferred to a different account and now that account performed a background check. They found discrepancies on the dates from my previous employer that I worked for before and said that it can be grounds for termination. I already gave them Certificate of Employment to prove that I resigned from those companies without any bad records but they are saying that its still terminable since the dates that I placed on my resume was incorrect. I dont remember the exact dates or even the account I handled way back then and thats the reason for the date discrepancies. Can they terminate me because of that even if I am already a regular employee and does not have any work issues that might cause my termination ?? Thanks for your help.

    They can terminate you. Kung gusto ka i-terminate ng employer mo, pwedeng-pwede nila gawin yun.

    Kung tutoo ang sinasabi mo na nagkamali ka lang sa dates dahil di mo maalala, at wala ka naman talagang bad record sa former employers mo, hinbdi magiging legal ang pagterminate sa iyo.

     

    Maaari mo itong ireklamo sa NLRC kung gagawin nila ito. Alalahanin mo, wag kang magre-resign! Kung pipilitin ka nilang magresign dahil sa dahilang mali ang date na nakalagay sa application o resume mo. wag mo gawin. Kailangan tanggalin ka nila! Ito ay para matibay ang kaso mo na isasampa sa NLRC.

    The Cooperative Development Authority (CDA) is the lead government agency mandated by virtue of Republic Act No. 9520 (Philippine Cooperative Code of 2008) to promote the viability and growth of Philippine cooperatives. It is the only government agency that registers cooperatives.
    Clearly, for a cooperative to exist, it needs to be registered ONLY with the CDA, ergo SEC registration is not needed for it to exist.
    You may be charged criminally if you participate in illegal activities being undertaken by the cooperative. You may be charged civilly if you participate in activities being undertaken by the cooperative that cause damage to others.
    But mere membership would not.

    The Housing and Urban Development Coordinating Council (HUDCC) has extended the rent control regulation for residential units occupied by low-income brackets for another two years until December 2017.

    Effective January 1, 2016 until December 31, 2017, the rent of any residential unit for those paying monthly rent of up to P3,999.00 shall not increase by more than 4% per annum. On the other hand, monthly rentals of P4,000 up to P10,000.00 shall not be increased by more than 7% per annum provided that the unit is occupied by the same lessee. This regulation applies to all residential units covered by the specified monthly rent, across the country.

    If it's a Deed of Absolute Sale in your name, with a Chattel Mortgage to secure the payment of the loan, it becomes part of your absolute community property. If, on the other hand, the car is titled in the financing company's name, with a Deed of Sale to be executed in your favor after full payment of the loan, and full payment comes after your marriage has been declared void, it doesn't.

     

    Your problem would be that most, if not all, car financing schemes are of the first kind.

  22. Is it possible to fil legal separation even if my ex-wufe is out of the country?

    yes, although it might just make the process longer. if nobody accepts the summons (the order requiring her to answer the petition for separation) at her last known address on the ground that she is out of country and the process server informs the Court of that fact, the Court might then require publication of the summons and the petition (that would now take additional time). On the other hand, if somebody accepts the summons, and the process server reports that the summons have been duly served through substituted service, the case starts rolling on the normal process.

     

    [People cannot prevent others from filing cases by going out of the country; that would make rich people more privileged than the poor, who may not be able to afford to travel abroad. Remember, justice should be equally accessible to all]

     

    On a side note, why file for legal separation. Gagastos ka na rin lang, declaration of nullity or annulment na ang isampa mo, almost pareho din lang naman ang gastos.

  23. I was rear ended by another car yesterday. The owner said his insurance is expired and so I presume his car registration is also expired. Assuming his car registration is expired, is it a ground on my end to complain to the traffic investigator regarding this and ask the policeman to include this fact in his police report?

    it does not follow that just because the insurance has expired , his car registration has also expired (he was probably referring to comprehensive insurance, which would have covered damage to the car). what the law mandates to be obtained yearly is Third-Party Liability Insurance, which answers for bodily injury or death in car accidents (it doesn't cover property damage). The best proof of registration of the vehicle would be the Official Receipt (OR). Kung wala siya nun, mas malamang sa hindi expired ang rehistro. Kung expired na, you can ask the investigator to include this in the report (altho hindi rin naman problema kung hindi isasama, dahil kung hindi talaga rehistrado, pwede mo i-raise ang point na ito at anytime).

  24. Hello Sir, would like to for some legal advice and direction for someone I know:

     

    A lady friend got knocked up by her bf and they eventually got married. However, due to complications in their relationship, the guy, who is a seaman by the way, took off and moved to a Middle East country. He somehow settled there, started a new family and abandoned the girl and child here with no support or communication whatsoever. The friend would like to know if she could have her husband deported and if so, what would be the right legal procedures to take to make it happen.

    Unfortunately, abandonment of one's spouse is not a ground for deportation back to the Philippines. What she can do is to file child abuse charges against her husband here in the Phils. Should her husband come back to the Philippines, then he has to face the charges. But so long as he is not in the Phils., she basically has no remedy. Our laws cannot be enforced abroad.
