japlog Posted August 20, 2012 Share Posted August 20, 2012 Thanks sir for taking the time to answer my query...follow question lang po... in case un sharing ng properties is still in process then unexpectedly un isa sa mga magkakapatid na may anak ay mamatay, un po bang mga anak ang magiging entitled for the share? #1 kung nabubuhay pa ang magulang ng uncle mo (lolo at lola mo) mapupunta yung property sa kanila. Kung wala na ring magulang ang uncle mo, mapupunta ang property sa mga kapatid niya (kung full blood brothers and sisters ito, pare-pareho share nila) #2 nung mamatay ang uncle mo, at ng malaman ito ng aunt mo na nabigyan ng SPA, wala nang bisa ang SPA. Wala rin cyang karapatan na ilipat sa pangalan lng nia yung properties dahil hindi lng siya ang nagmana nito (see answer to #1) Quote Link to comment

In other words, ng mamatay si uncle, lahat ng properties niya ay namana ng mga kapatid niya at sila na ang may-ari nito mula sa pagkamatay ni uncle.at dahil siya na ang may-ari ng parte niya, ng mamatay naman si kapatid, yung parte niya sa properties ni uncle ay kanya namang isinasalin sa kanyang tagapag-mana. Yung mga anak (at asawa kung meron) na ni deceased kapatid ang may-ari ng lahat ng iniwan ni kapatid, kasama yung parte niya sa property ni uncle. You can even ask your local Business Permit & Licensing Office. I'm not sure if it's illegal per se but it's probably illegal to operate it within a certain distance from schools, just like lotto. You can send that and do whatever extra legal acts you wish to pursue prior to a court case. Ano ba goal mo? Collection or makulong cya? May pangbayad ba? Kung wala, may properties ba cya? What amount is acceptable to you? You need to answer these questions in order for a proper course of action can be recommended. Remember court action takes time. Quote Link to comment

Now, you can complain with the barangay but lupon proceedings requires her to agree to any payment. If she refuses to pay, you still will have to go to court. Have a lawyer send her a demand letter and see how it goes. Considering that your goal is recovery of the Php 21,000.00, it's best to determine if she has any assets which you can get. Kung meron, you might consider filing a small claim case rather than a criminal case. Mas mabilis and you don't have to worry bout atty. fees. You can still opt to file a criminal case, however, usually maaaaataaaaagaaaal talaga yung kaso unless maswerte ka at mapunta yung kaso sa judge na masipag. Quote Link to comment

Actually, 4 months nga na-delay yung payout namin eh. Gulat kmi kasi nung pumasok yung increase eh sobrang liit. Tpos yung retro pay hindi kasama yung mga holiday pay from the previous months. And until now, they have not explained to us why it has changed. Ok lang sana kung bago mag start ang fiscal year nila kami na inform... Kaso we are already in mid-year. Kung gusto ng complainant ituloy ang reklamo laban sa iyo, this would be proof in the criminal case (should one be filed) that the matter was reported to the police. Kung me mangyari sa complainant, this could also be used as proof of motive if a case is filed against you. 2. pwede ba magamit sa akin to pag tatakbo akong councilor or kung ano man? the incident that was reported to the police could be used by your opponent to smear your character during the campaign. as proof that the incident supposedly happened, he can use the blotter entry. 3. para saan pa yung pina blotter sa akin? Kung me mangyari sa complainant, this could also be used as proof of motive if a case is filed against you. so para saan pa yung police blotter na ginawa against sa akin? pwede ba magamit sa akin to pag tatakbo akong councilor or kung ano man? rocco69 Posted September 20, 2012 Share Posted September 20, 2012 kung yung person na nakalista as tatay ay kasal dun sa nakalistang nanay, yung nakalista lang as tatay ang pwedeng magfile ng kaso to cancel the entry. sabi mo na rin, yung taong nakalista ay hindi tunay na tatay. Sa English, ito ay "impugning the legitimacy of the child." Ang pwede lang maghain ng ganitong kaso kapag kasal sa isa't-isa yung nakalistang tatay at nanay ay ang lalaki (at ito ay dapat maihain sa loob ng isang taon mula ng malaman ng sinasabing ama yung pagka-anak nung bata, kapag nakatira sila ng bata sa iisang siyudad o munisipyo, dalawang taon kung sa magkahiwalay na munisipyo, at tatlong taon kung sa ibang bansa nakatira si lalaki - see Article 170, Family Code, otherwise paso na). Kung hindi naman kasal yung sinasabing tatay at yung ina, may posibilidad mabago ang birth certificate, pero dahil magbabago ang status ng bata, ito ay maaaring gawin lamang sa pamamagitan ng paghain ng petisyon sa korte. Kung may makukuha po sya, as roco69 said, depende po sa batas ng finland. sabi mo meron, pero d ka po sure kung applicable sya sa kaibigan mo, depende na po yun sa interpretation ng korte sa finland.
