Thanks sir for taking the time to answer my query...follow question lang po...

 

in case un sharing ng properties is still in process then unexpectedly un isa sa mga magkakapatid na may anak ay mamatay, un po bang mga anak ang magiging entitled for the share?

 

#1 kung nabubuhay pa ang magulang ng uncle mo (lolo at lola mo) mapupunta yung property sa kanila.

 

Kung wala na ring magulang ang uncle mo, mapupunta ang property sa mga kapatid niya (kung full blood brothers and sisters ito, pare-pareho share nila)

 

#2 nung mamatay ang uncle mo, at ng malaman ito ng aunt mo na nabigyan ng SPA, wala nang bisa ang SPA.

 

Wala rin cyang karapatan na ilipat sa pangalan lng nia yung properties dahil hindi lng siya ang nagmana nito (see answer to #1)

so long as buhay yung kapatid ng mamatay yung uncle (bale, namatay si uncle, tapos namatay yung kapatid ni uncle), nagmana na siya sa properties ni uncle.

 

In other words, ng mamatay si uncle, lahat ng properties niya ay namana ng mga kapatid niya at sila na ang may-ari nito mula sa pagkamatay ni uncle.

at dahil siya na ang may-ari ng parte niya, ng mamatay naman si kapatid, yung parte niya sa properties ni uncle ay kanya namang isinasalin sa kanyang tagapag-mana.

 

Yung mga anak (at asawa kung meron) na ni deceased kapatid ang may-ari ng lahat ng iniwan ni kapatid, kasama yung parte niya sa property ni uncle.

Just want to ask if there are any laws prohibiting video arcades (yung ps2 na hinuhulugan ng piso)?

If you're going to register your business, you can ask DTI if it's illegal. You can even ask your local Business Permit & Licensing Office. I'm not sure if it's illegal per se but it's probably illegal to operate it within a certain distance from schools, just like lotto.

at dahil siya na ang may-ari ng parte niya, ng mamatay naman si kapatid, yung parte niya sa properties ni uncle ay kanya namang isinasalin sa kanyang tagapag-mana.

Violation of Batas Pambansa 22 (Bouncing Check Law). But you have to first make a formal demand on the person who issued the check to make good on it within 5 business days from receipt of the demand letter (kailangan matanggap niya ang sulat na ito, mas maganda PERSONAL mo na ipa-receive sa kanya).

 

No demand received, premature ang complaint.

 

How can I file a case against someone if they paid me with a bounced cheque and refused to pay

Theres this girl who bought some merchandise from me and paid me with a cheque with no funds in it .

Up till now she hasnt paid me. what can I do to make her pay up...

Can I file for estafa case? because of the bounced cheque. .

does it depend sa amount? 21,000 kasi yun... ano kaya pwede ko gawin para maforce siya magbayad... barangay? help please

The problem is she keeps on promising na magbabayad siya pero mag 2 months na wala paring bayad.

she keeps on promising pero puro empty promises.. i have all her text messages.. may bearing ba yun?

pwede ko kaya i complain muna sa barangay? or sa pulis? bago magpa korte

You need to send her a formal final demand letter. You can send that and do whatever extra legal acts you wish to pursue prior to a court case. Ano ba goal mo? Collection or makulong cya? May pangbayad ba? Kung wala, may properties ba cya? What amount is acceptable to you? You need to answer these questions in order for a proper course of action can be recommended. Remember court action takes time.

Well, in that case, to "force" her to pay legally, you need a court order which requires court action. Now, you can complain with the barangay but lupon proceedings requires her to agree to any payment. If she refuses to pay, you still will have to go to court. Have a lawyer send her a demand letter and see how it goes.

 

Considering that your goal is recovery of the Php 21,000.00, it's best to determine if she has any assets which you can get. Kung meron, you might consider filing a small claim case rather than a criminal case. Mas mabilis and you don't have to worry bout atty. fees. You can still opt to file a criminal case, however, usually maaaaataaaaagaaaal talaga yung kaso unless maswerte ka at mapunta yung kaso sa judge na masipag.

It's possible. If you fIle a criminal case and an information is filed with the court, magkakarecord cya. Incidentally, based on my experience, kung d natatakot sa demand letter galing abogado, d yun natatakot sa kaso.

sa ating sistema ng batas, basta nagkasundo na ang mga partido, kahit hindi nakasulat may bisa ang kontrata (maliban sa mga kontrata na bumabagsak sa Art. 1403, at yung nangangailangan ng partikular na porma, tulad ng donasyon).

I want to file a complaint and I need to know the specific terms I should use should I go ahead to NLRC about this...

Ayun sa article 100 ng Labor Code, bawal ang pagbabago sa sistema ng benepisyo ng empleyado kapag ito ay magreresulta sa pagbaba o pagliit ng benepisyong dating tinantanggap ng empleyado.

 

Art. 100. Prohibition against elimination or diminution of benefits. Nothing in this Book shall be construed to eliminate or in any way diminish supplements, or other employee benefits being enjoyed at the time of promulgation of this Code.

 

siguraduhin mo lang na may ebidensya ka tungkol sa dating tinatanggap ninyong benepisyo at ebidensya na may tinanggal o binago sa bagong sistema na nagresulta sa pagliit ng inyong benepisyo. In other words, EBIDENSYA, EBIDENSYA, EBIDENSYA. Kailangan meron kang pinanghahawakan.

hindi. lalabas lang yan pag may nagsampa ng kaso laban sa yo sa korte

so that the police has a record that someone has filed a complaint against you at the police station (a blotter is a record of the activities that occur during the day at the police station). what the police does with the complaint depends on the complainant. Kung gusto ng complainant ituloy ang reklamo laban sa iyo, this would be proof in the criminal case (should one be filed) that the matter was reported to the police.

 

Kung me mangyari sa complainant, this could also be used as proof of motive if a case is filed against you.

 

2. pwede ba magamit sa akin to pag tatakbo akong councilor or kung ano man?

 

the incident that was reported to the police could be used by your opponent to smear your character during the campaign. as proof that the incident supposedly happened, he can use the blotter entry.

 

3. para saan pa yung pina blotter sa akin?

 

Kung me mangyari sa complainant, this could also be used as proof of motive if a case is filed against you.

 

so para saan pa yung police blotter na ginawa against sa akin? pwede ba magamit sa akin to pag tatakbo akong councilor or kung ano man? (Example lang bro =P )

edi para saan pa yung pina blotter sa akin?

kung yung person na nakalista as tatay ay kasal dun sa nakalistang nanay, yung nakalista lang as tatay ang pwedeng magfile ng kaso to cancel the entry.

 

sabi mo na rin, yung taong nakalista ay hindi tunay na tatay. Sa English, ito ay "impugning the legitimacy of the child." Ang pwede lang maghain ng ganitong kaso kapag kasal sa isa't-isa yung nakalistang tatay at nanay ay ang lalaki (at ito ay dapat maihain sa loob ng isang taon mula ng malaman ng sinasabing ama yung pagka-anak nung bata, kapag nakatira sila ng bata sa iisang siyudad o munisipyo, dalawang taon kung sa magkahiwalay na munisipyo, at tatlong taon kung sa ibang bansa nakatira si lalaki - see Article 170, Family Code, otherwise paso na).

 

Kung hindi naman kasal yung sinasabing tatay at yung ina, may posibilidad mabago ang birth certificate, pero dahil magbabago ang status ng bata, ito ay maaaring gawin lamang sa pamamagitan ng paghain ng petisyon sa korte. Kailangan mong sumangguni sa atty.

Mga sirs, may question po ako.. a friend of mind is legally married to a finnish here and in finland.. they mutually separated nung 2004. question is, since nde pa sila legally separated, pwede ba sila mag file ng divorce?? and since wala sila pinirmahan na pre nup, may makukuha kaya sya sa kanyang husband??

so that your friend can have capacity to remarry again, it should be her husband filing for divorce in Finland. hindi dapat na siya ang magfa-file ng divorce (hindi kasi kinikilala ng Pilipinas ang divorce na na-obtain ng isang Filipino citizen. pero kung foreigner na kasal sa Pilipino ang kumuha ng divorce, OK lang, may bisa yun)

 

2. may makukuha kaya sya sa kanyang husband?

 

depende. one, kung voluntary na bibigyan siya ng Finnish na asawa nya, OK.

two, kung sa batas ng Finland, ang diniborsyong asawa ay entitled sa property o pera from the divorcing spouse, pwede sya makakuha dun sa Finland (but not here in the Phils., since we do not recognize divorce)

Thanks sir, pero sa nabasa ko sa law ng Finland e entitled sya.. though it did not stipulate na kung foreigner ang asawa ay may makukuha sya.. uhmm any attorney wants to help?? kaht magbigay sya ng certain percentage to her lawyer kung may makuha sya.. thanks

kung may divorce po sa finland, pwede po, as long as it is the foreigner (husband in this case) that files for divorce in finland. then papa enforce na lang po dito sa Pilipinas yung divorce decree. Kung may makukuha po sya, as roco69 said, depende po sa batas ng finland. sabi mo meron, pero d ka po sure kung applicable sya sa kaibigan mo, depende na po yun sa interpretation ng korte sa finland.
