here are some of the details i can provide.

 

my relative has 3 Syndicated estafa case filed against her, trials are on going, but trial schedules only proceeds to about 10 hearings a year or less.

for the past 10 yrs of hearings there is still no final resolution, all petitions for bail is denied, she is now detained for 9yrs and 10months in total

Under the Speedy Trial Act (or Rep. Act. No. 8493), a time period for trial is provided. It requires that the entire trial period not exceed one hundred eighty (180) days from the first day of trial. However, in Tan v. People of the Philippines, G.R. No. 173637 [21 April 2009], the Supreme Court laid down the principles when the right to speedy trial can be invoked,

 

“In determining the right of an accused to speedy trial, courts are required to do more than a mathematical computation of the number of postponements of the scheduled hearings of the case. A mere mathematical reckoning of the time involved is clearly insufficient, and particular regard must be given to the facts and circumstances peculiar to each case.

what stage na yung cases? after 10 years, malamang defense na. kung ganun, delay could be attributable sa accused.

 

ang sabi its all on final stages na,paperworks na lang tumatakbo. pero yung isang case, humihirit pa na makapagsalang ng witness para makabawi.. yung isa naman nagpalit ng judge dahil yung pinalit na prosecutor ay family friend ng judge.. so iraraffle off na naman yun case.

I think land ownership is absolute to holders of land titles. tax declarations are just for tax purposes. meaning anyone can pay for the realty tax & the city or mun will accept it. this is not proof of ownership. the tenants on the land can claim that they are settling there longer than you. as you know for untitled properties, possession is 90% ownership.

 

if your land is a titled land then you own it even without stepping on it all your life.

Sir ginamit nya vehicle, materials, name of the company and collection. madaling sabi nangontrata sya sa kanya napunta payment. nasa sales dept. kasi sya.

then charge him with estafa,

keeping money that does not belong to him.

 

but best way to terminate someone is by proving that he did not report to work or AWOL.

sir question lang po uli regarding sa labor code. tama lang po ba less than 12 hours ang interval ng work hours ng isang employee. for example ang pasok ko today is from 9am - 5pm then ang pasok ko bukas is 4am-12pm. gusto ko lang po malaman kung may law regarding sa work hours.TIA sir

Magsimula tayo sa basic principles:

 

1. Ang isang work day ay 24 consecutive hours.

 

2. ang empleyado ay dapat magtrabaho ng 8 hours lang sa isang workday, kapag sumobra dun, dapat may overtime pay.

 

3. ang iyong workday, kung pumapasok ka ng 9am, ay nagsisimula sa oras na iyon at natatapos ng 9am sa sunod na araw.

 

Dahilan dito, kung ikaw ay nagtrabaho ng 9am to 5pm , lumalabas na ang work day ninyo ay 7 hours lang (assuming 1-hr lunch break) [hindi naman ito ganun ka-importante dahil lumalabas na mas pabor ang company policy ninyo kesa sa batas, imbes na 8 hours, 7 hours lang kayo nagtratrabaho; kapag sumobra dito, overtime pa rin dapat]

 

At dahil ang workday mo ay nagtatapos ng 9am, kapag pinagtrabaho ka sa sunod na araw mula 4am - 12 pm, dapat bayaran ka ng overtime! Yung oras ng pagpasok mo mula 4am hanggang 9am ay pasok sa naunang work day mo (na tumatakbo ng 9am to 9am the next day), at dahil dito ay sobra na sa normal workday load mo na 7 hrs a day ang itrinatrabaho mo, kaya dapat ay bayaran ka na ng overtime (see DOLE Manual, Sec. 4323-01).

 

Note: baka magtanong ka naman, kung yung 4am - 9am ay overtime pala nung nakalipas na araw, paano yung 9am - 12pm na naiwan nung sunod na araw, undertime naman ako nun dahil 3 oras lang ang natrabaho ko sa sumunod na workday ko?

 

Tama yun, undertime ka na nga nun dahil 3 oras nga lang ang itrinabaho mo sa sumunod na araw. Pero, ayon sa Art. 88 ng Labor Code, ang undertime ay hindi na-o-offset ng overtime. Sa madaling salita, hindi maaaring i-charge sa kulang na oras mo sa sumunod na araw yung oras ng overtime mo nung nakalipas na araw. Kailangan talagang bayaran ng employer ang 30% na additional para sa overtime mo.

For persons who got married between the ages of 18 and 21, for your marriage to be valid, you have to have the consent of your father, mother, or guardian (in that order; kung may tatay, kelangan consent ng tatay, kung wala nang tatay, consent na ng nanay; kung me nanay at tatay, kahit payag yung nanay, kung ayaw ng tatay, walang consent, kasi nga, in that order dapat).

 

sabi mo, nung ikinasal ka, 19 ka lang at walang consent ng magulang mo, pwedeng ipa-annul ang kasal mo for lack of consent (see Art. 45, Family Code).

 

NGUNIT, SUBALIT, DATAPWAT...

 

ikaw ay mayroon lamang limang taon mula ng ikaw ay mag-21 para isampa ito sa korte. sa madaling salita, kung ikaw ay lampas 26 años na ngayon, PASO na ang kaso mo.

 

Isa pa, kailangan na di na kayo nagsama nung ikaw ay nag-21, dahil ang patuloy na pagsasama ng mag-asawa kapag ikaw ay umabot na ng 21 ay makakalunas sa depekto ng kasal. sa madaling salita ulit, kung nagsama pa rin kayo nung nag-21 ka, yung kakulangan ng pahintulot ng magulang mo ay DI NA RIN BASEHAN para ipawalang-bisa ang kasal mo (kahit di pa lumilipas ang 5-taong termino para i-file ang kaso na yan).

 

At dahil, sabi mo na rin na umuuwi ka sa inyo pag nagbabakasyon ka, lumalabas na nagsama kayo ng ikaw ay nag-21. Kaya, ang kawalang pahintulot ng magulang mo ay di na pwedeng gamitin bilang basehan para ipawalang-bisa ang kasal mo.

 

Sa birth certificate naman, yung wala kang birth certificate ay hindi magagamit para ipawalang bisa ang kasal mo.

 

Pero tingnan mo na rin yung lisensya ng kasal nyo. Sabi mo na rin, pinalabas na taga-Cavite ka, baka peke ang lisensya na ginamit sa kasal ninyo. I-check mo na rin at kung ito ay peke, walang bisa ang kasal mo.

 

Dear Lawyers,

 

I want to consult this situation regarding my marriage. Me and my wife got married at the age of 19 without consent of both our parents. She was pregnant at that time and she arrange everything herself for the marriage. The marriage was solemnize on a municipal hall. On the marriage certificate, my address is incorrect and showing I am a resident from Cavite which I never live on that place. After few years, I applied for work abroad and applied for a passport. When I go to my hometown to get a birth certificate, I found out that I am not registered and so I apply for late registration.

 

I am an OFW and right now not in good relationship with my wife and not talking or communicating with her for the past 7 years. Although I go home annually (vacation) in our house for the sake of our kids, I don't talk to her. I want to get her out of my life due to irreconcilable differences.

 

My question now, is there a chance I can annul our marriage considering that I am not at legal age at the time of our marriage and don't have record (birth Certificate) at the local registry. I am planning to buy properties for myself and for the kids and I don't want her to be part of it.

up for this thread. I recently applied for work abroad while I'm still connected with the company. I asked for a COE and indicated on my request that it is for my application abroad. The HRD denied my request and the reason given to me was of conflicting interest (me applying for work abroad versus me still connected with the company) and that I should file my resignation first. Is this correct? I have read the labor code and there is no stipulation saying the company cannot provide me a COE for my application abroad.

about 2 months ago, nilayasan ko na po asawa ko since di ko na po sya matiis. We have been married for 17 years and most of the time, nag-aaway lang po kami. 3 years ago, nilayasan ko na rin po sya dahil sobrang magastos sya at lagi nya akong inaaway. And as mentioned, about 2 months ago, nilayasan ko po sya ulit and this time it is final. Ayaw ko na po sya makasama though I stilll care for her.

 

 

I am staying po with my brother since malaki po ang bahay nya...I also met this girl who I am dating exclusively....and malas lang po, one day, bumisita yung wife ko sa bahay ng brother ko and natyempohan kami nung girl na nasa room. We are not doing anything sexual...I was listening to music and my girl is watching videos sa tablet nya...nakahiga po sya sa hita ko at that time....she was also able to take some pictures of me and the girl I am now dating....so, sa madaling salita, nag-amok po yung wife ko to the point na nagbasag at nagwala talaga sya sa loob ng bahay ng brother ko....inawat sya ng mga kasambahay namin and due to that, nagkaroon sya ng mga pasa. I did not hurt her in any way po...ako po ang maraming tama sa mukha, katawan, braso due to her punches and kicks....

 

I recently came to know na after the incident, nagpa medico-legal pala sya and nag file ng complaint sa fiscal's office....2 weeks ago, I received a subpoena for RA 9262 or (Law against violence against women and children).

 

I did my own research and the only thing na pwede nila gamitin is yung "Any act where it causes phsychological/emotional distress".....any grounds po sa charges laban sa akin? what are my options? Me and the girl I am dating are not living together..she only visits me in my brother's house twice a week....so, di po ako pwede kasuhan ng Concubinage since I am only having an extra-marital affair...right? my wife is also DEMANDING i support her with 40,000pesos per month (WALA po syang work kasi tamad sya)....17 years ko po sya binuhay at sinuportahan....nasanay lang na hindi sya nagtatrabaho.... I am the only bread winner sa family...

 

BTW, yung youngest namin (16 years old) sa akin po nakatira since she also hates her mom. Yung panganay na 19 years old nasa college pa po..

 

2 months passed and I am still giving/providing her support...20k a month so that wag lang syang magwala....

 

Does she have a good case against me?

Does she have the right to demand money/support from me?

Anong lawyer po kelangan ko...family/litigation....??

 

Any advise is appreciated.

Unfortunately, dahil me mga pasa at nagpa-medico-legal pa, at first glance mukhang ginulpi mo asawa mo. ayun sa kwento mo, ito ay dahil sa pag-wat ng kasambahay. lumalabas na ito ay question of credibility, sino ang mas kapani-paniwala ang kwento. At dahil denial ang depensa mo, mas malamang sa hindi na isasampa sa korte ang kaso na yan (which is not to say na mananalo siya, only that mas malamang sa hindi, sa hukuman kayo hahantong para dun nyo patunayan ang respective claims nyo).

 

2. Does she have the right to demand money/support from me?

 

Yes, kasal kayo eh. Spouses are obliged to support each other.

 

3. Anong lawyer po kelangan ko...family/litigation....??

 

Criminal/trial lawyer kailangan mo dahil criminal case yan.

Ask ko lang po ng help yung friend ko po kasi nagkaroon siya ng kaso regarding bouncing cheques, yung tao po na pinag binigyan nya ng teske ay nag file ng case sa court last 2006, at di nya na po makita ngayun nag reflect po yun sa clearance nya sa NBI, gusto nya po mag work outside the country ask nya lang po kung makakalabas ba siya ng bansa o malolocate yung pangalan nya sa watch list pag nasampahan ng kaso.

Malapit na po sya umalis kaya lang kinakabahan siya baka i hold sa sa airport maari po ba makahingi ng tulong?

Ang problema niya kung nagrequest yung nagsampa ng kaso sa Immigration na ilagay siya sa watch-list. Maghanap siya ng kakilala sa Immigration na titingin kung siya ay nakalagay sa watchlist (although I doubt it, kung dahilan lang sa talbog na cheke, na di naman siguro milyon-milyon, malabo na mapa-watchlist ang isang tao, mabuti [masama pala ehek] kung katulad siya ni Mayor Co ng Pagadian na marami ang nagrereklamo at milyones ang involved dahil sa Aman Futures scam)

I would like to ask for some legal advice for my sister. She got an auto loan from a financing company 2 years ago. Last year she lost her job and was unable to pay the monthly amortizations. In February she started receiving calls and text messages from the company telling her to expect a warrant arrest any day for a carnapping case the company filed against her. The company also texted messages like "balasubas ka, uutang ka ng pera tapos magtatago ka".

 

We don't want to file a court case because it's too expensive and too slow but the company shouldn't be allowed to harass and threaten clients just because they are unable to pay. Is there a government agency in charge of financing companies (like the BSP for banks) that we can approach to file a complaint against the company for their harassment and threats? Thank you.

Check Republic Act 8556 or the Financing Company Act. It is the SEC that has general supervision over financing companies.

Mga attorneys, ask ko lang po meron po bang habol yung ditse ko kung di sya pamanahan ng father ko kasi po naki live in sya sa isang lalaking may asawa na. Ang damuhong lalaki,nag pakilala na binata at ang tanga kong ditse nag pa uto naman, hayun nagsasama na sila for 5 years nows., at balita ko pong meron na silang isang anak na babae na 5 years old, napag alaman ko lang ho sa sa mag classmates ng ditse ko sa facebook...

Tanong ko po: kung sakaling mag pakita sa pamilya namin ang ditse ko after my father died and asking for her share ng mana nya,meron po ba syang habol? Kahit na po na paghatian na po namin ang mga pamana namin, kaso di na po sya napartehan ng aking ama nag dahil sa ginawa nya na pagsama sa lalaking may asawa.

Since di pala pwede silang mag pakasal ng ditse ko at ang damuhong lalaki kc kasal pa ito sa una nyang asawa. Tanng ko din po, yung bata na ank ng ditse ko meron din po ba syang parte just in case na meron pang mahabol na pamana ang ditse ko?

 

Five years ko ng di ko na nakkita ditse ko.maski mali ang ginawa nyang pagsama sa damuhong lalaking yun, na miss ko sya... Sa pagkakaalam ko po nsa iabng bansa na sila ngayun. Matigas talga ulo ng ditse ko.maraming salamat po

Meron. Sa mismong sandali na namatay ang tatay nyo, nagkaroon na ng parte sa mana ang kapatid mo. Sa madaling salita, naging may-ari na ng parte niya ang ate mo nung mamatay ang tatay nyo.

 

2. Kahit na po na paghatian na po namin ang mga pamana namin?

 

Dahil naging may-ari nga siya ng parte niya mula sa pagkamatay ng tatay ninyo, pwede niyang habulin ang kanyang parte kahit na pinaghati-hatian na ninyo ito, at mayroon nga siyang karapatan dito (Note: mayron siyang sampung taon mula sa pagrehistro ng lupa [i am assuming na lupa ang naiwan ng tatay ninyo] sa inyong mga pangalan para habulin ito. kung pinaghati-hatian lang ninyo ang lupa, pero hindi naman inirehistro ang pagsalin ng lupa sa inyong mga pangalan sa Register of Deeds, hindi pa nagsisimulang tumakbo yuung 10-year period).

 

3. Di na po sya napartehan ng aking ama ng dahil sa ginawa nya na pagsama sa lalaking may asawa?

 

Yung pakikisama sa lalaking may asawa ay maaaring gamitin ng isang magulang upang tanggalan ng mana ang isang anak (Artikulo 919, No. 7, Kodigo Sibil) at ito ay bumabagsak sa "leading a dishonorable or disgraceful life."
