Ask ko lang din po. My relative also works in a call center pero that specific call center has had a lotta complaints for the past years. Upon further investigation from BIR, QC Hall we found out that they had no permits whatsoever found in QCH and even the BIR is after them because they're not registered into their system considering that call center branch has been in operations for nearly or more than a decade. My question is, since there are no legal permits from that company eh automatic void na ba ang contract? Marami kasing employees dun nakausap ko who are complaining about the bonds, sudden loss of benefits w/o even revising the contract... kumbaga, team huddle nalang daw, verbal broadcast and yung attendance sheet will also double as a signature of agreement. Mayrron palang ganun? Attendance signature pwede gawing Signature of consent??? Diba dapat ire-revise ang buong contract specially when it's money/benefits ang babawasan or tatanggalin? Hope you guys can enlighten me. Thanks.

No, the existence/lack of legal permits does not affect the employees' right to salaries/wages, specially for services already rendered. It could affect the continuation of employment, since if (and its a BIG IF) the company is not allowed to continue operations, logically, the employees cannot continue working also (but they would then be entitled to separation benefits IF the company is disallowed to continue operations).

No, that is illegal, an attendance signature is not a sign of consent.

 

Note also that under the Labor Code (see Art. 100), bawal ang pagbabawas o pagtatanggal ng mga benefits na dati nang tinatanggap ng empleyado.

@rocco69 - thanks po sa mga sagot. May pahabol pa po kung ok lang sana? Yung sa contract nila may bond n 20K for "training expenses" so that means declared tax/liability yan. If the training bond is provided for in the contract they signed, and if the company really did train the employee, there would be a basis for collecting on the bond. The fact that they have no permits has no relevance to the furnishing of training to the employee.

I'd say no, as the amount of P20K is not just limited to the amount spent by the company for training the employee, but would also cover the incidental damages suffered by the company due to the premature departure of the employee.

Mga maesters, may itatanong lang po.

 

Kung ang respondent sa isang labor case ay hindi umattend kahit isang hearing noong preliminaries pa lang, at napunta ang kaso sa commission, gaano kalaki ang chance na manalo ang complainant?

 

Nakapag-file ba ang respondent ng position paper and reply paper?

dahil hindi naman ganun ka-istrikto ang procedure sa labor cases, it actually depends on whether the complainant really has a valid complaint against the employer.

 

lamang ang complainant sa labor cases, dahil nga may bias para sa employee ang batas, lalo na sa kasong ito na nakapag-desisyun na ang arbiter in his favor. Kaya lang, kung wala naman talagang violation, at ito ay mapapatunayan on appeal ng employer, maaaring ma-reverse pa rin yung decision ng arbiter.

 

pero, kung tutoong agrabyado ang empleyado, mas malamang sa hindi, panalo ka pa rin sa Commission.

 

Magpasalamat ka pa nga na umapila, at mas madali ang pagkolekta ng award pag nanalo ka (para maka-apila ang employer, kailangan niyang magdeposito ng cash o surety bond equivalent sa amount ng award, ito yung pwede mong habulin pag nanalo ka na sa Commission, di ka na maghihirap sa paghahanap ng assets ng employer).

 

Hindi tinanggap yung position paper nila dahil late ng 3 weeks. So wala ring reply. Nakapaglabas na ng decision yung Arbiter at the time and then saka sila nag-appeal sa commision.

Hi sirs and madams, need some serious advise.

 

Im an OFW po and i acquired a house&lot 2 yrs ago from a developer in mamplasan, binan laguna. I availed thru bank financing scheme (bank loan).

 

Para mapabilis po ang turnover i paid spot cash more than the amount of the downpayment, it should save me a year kasi under normal conditions ay 1 year to pay yung DP.

 

Then i paid 12mos amortization sa developer which finished last december. Approved na po ang bank loan ko at nag lapse na ng dalawang beses so i have to resend documents to the bank which is quite a hassle coz i need to go to our embassy to authenticate the docs.

 

The problem is nakaka 4 inspection na po kami ng unit at hindi ma turn over kasi puro defects ang unit. Kaya po hindi rin ma release ng bank ang loan kasi hindi pa naka pangalan samin ang unit kasi nga di namin ina accept.

 

Kahit anong pakiusap namin sa coordinator parang binabaliwala lang nya kami. Laki na din ng gastos namin kasi we need to book a flight just to inspect the unit.

 

Can someone advise if we have the option to pull out from the contract or baka puedeng Lot na lng kunin namin.

Give it six months to a year. Tapos, motion for reconsideration pa pag natalo sila sa Commission (mga 3-6 months more), tapos baka may apila pa sa Court of Appeals (probably another year or two), tapos subok ulit sa Supreme Court (possibly another year also).

You can have the contract cancelled/rescinded for the developer's failure to comply with their contractual obligations. What specific defects have you found? Btw, what is the name of the developer?

chipped off wooden doors, doors not properly closing, dented pvc (t&B) door, finishes that does not comply with specs, windows not properly opening, misaligned power outlets, poor workmanship, etc.

 

we already did 4 inspections but still the defects were not rectified, although the developer's coordinator said it has been done but it's not when we went to the unit. its very frustrating coz last time my wife have to fly over to do inspection.

 

i gave them an ultimatum until end of this month to finish everything, that's why i'm checking my options in case they still don't deliver. im flying over to check personally.

 

the developer is Earth & Style Corporation.

When I read the name of the developer I couldn't help think, "Oh, them again!". I used to work for its sister company (Extra-ordinary Dev't Corp) several years ago and even then both companies had problems with complaints about shoddy construction. If you haven't already done it, put your complaints down into writing and send it via registered mail or private courier so that there is proof of receipt. This will be important if ever you need to file a complaint. In fact, as much as possible, your communication with the company should be documented either in writing or email.

 

If E&S still does not make the repairs you can demand for a different unit of equal value. If they don't agree to this you can file a case for rescission with damages. By the way, the defects you listed are those which you can see when you inspect a property. Check your contract for a clause which states that you've inspected the property and found it satisfactory. If there is, the company can argue that you can't complain about the defects since you've already inspected the property and saw no problems with it.

Gusto ko lang bigyan xa ng record para maulit man ang ganung insidente di na xa basta basta manununtok. Advice po pls anong dapat kong gawin?

Yes, the police can file the complaint themselves under Rule 110, sec. 3 of the Revised Rules of Criminal Procedures. Personally and based on experience, it would be better if you file the complaint yourself so that you'll have more control over what is included in the complaint.

ako din please help. warning: mejo mahaba ito.

 

Nung mga last week of Feb 2012, I was looking for a second-hand car online for me to buy. My practice is if the plate number is visible sa advertisement, text ko yung LTO hotline para macheck kung tama yung description. I still have that text reply of LTO on a certain car. Sa madaling sabi, i was interested and met with the contact person sa isang mall sa north.

 

i met with that person on march 4 (may text history pa kami sa celfone ko). before i agreed to buy it, i looked at the papers. mukhang okay naman. the information sa CR is consistent naman. the history is that second owner daw siya nung car pero he did not transfer ownership to his name. so ang nakalitaw sa OR, CR, and open deed of sale is yung name nung first owner. he also said na binebenta nya yung car because meron siyang company issued car na.

 

yung mga papeles: OR, CR, open deed of sale, yung TPL and photocopy nung ID nung first owner. when i agreed to buy it, nagpaphotocopy yung second owner ng dalawang ID nya and may statement na nakareceive siya ng payment for sale nung sasakyan. also, pina-fill out ko na rin yung deed of sale reflecting na ako yung bibili na kasi i plan to transfer ownership to myself. i thought walang problema sa mga papeles.

 

after a while, i noticed na iba yung engine number from the CR and dun sa iron na nasa loob ng hood. pero i thought okay lang kasi correct na naman yung naka-reflect sa CR and yung actual engine number. my assumption is naipa-change engine na siya (kasi nga naman lumitaw na sa CR, kung hindi edi dapat old engine number yung naka reflect)

 

i had the deed of sale notarized this april. then last week, i contacted a friend who can help me in registration and transfer. here are some revelations:

 

1. yung engine number na nakalagay sa CR, kulang pala ng isang number. example: 2E-0123456 pero ang nakasulat, walang zero. well, hindi naman kasi nakikita agad in the naked eye na may zero. impact is that kelangan palitan yung mga affidavit and open deed of sale pati na rin yung maling CR.

2. nung nagpa smoke emission, yung olde engine number ang lumitaw. again, we thought may problema na naman si LTO because aside from the lacking zero, eh hindi pa pala update sa database nila yung bagong engine number.

3. what we did is we had lto pull-out the record of the car. yung CR sa records ni lto ay iba sa CR na hawak ko. madaling sabi, peke yung CR ko.

4. when i got that information and some other instruction para makapag-comply, i tried searching for the first owner. as of writing, hindi pa confirmed pero may nahanap ako na tao with the same first and last name pero iba ang hitsura nya dun sa photocopy ng ID that i acquired nung binili ko. sa madaling sabi, peke din yung ID nung first owner.

 

the good thing: i have the name, address, and picture of the second owner who i think deliberately sold the car with fake docs.

 

questions:

1. are there any legal remedies/actions that needs to happen?

2. if yes, anu-ano yun?

Question po, a friend of mine has an illegitimate child with a woman. He is the father written on the birth certificate. The mother recently died. Who has the right to take custody of the child, the father or the mother's parents? The father wants to take care of the child but the mother's parents won't allow him.

Between the father and the grandparents, the father has preference. Kaya lang, dahil ayaw ibigay sa kanya, mangangailangan siyang magkaso for custody of the child.

 

Also, is he married to somebody else, baka naman kasi may asawa na siya, baka hindi pumayag asawa niya.

 

Kung single siya, OK yun. Also, when you say "he is the father written on the birth certificate", nakapirma ba siya sa likod ng birth certificate? Kasi, iba yung nilagay lang pangalan niya without his participation, at yung siya ang nakapirma sa likod bilang ama nung bata. Mas madaling patunayan na siya yung father in the 2nd case.

Gusto ko sana huminggi ng advice sa problem ko.

 

 

May anak po ako isang babae as of this moment 10yrs old na siya, hindi ako kasal sa mother nya, kaya apelyedo ng mother nya ang gamit nya, but naka pirma ako sa likod ng birth certificate nya. We are not in good terms ng mother nya. As of now nakatira siya sa mother nya.

 

Question - Pwede ko bang ipa change na ang surname ng anak ko? paano ang gagawin ko?

1. Pakasalan mo ung mother nya and execute and affidavit of legitimation of which both parents will sign.

 

2. Kapag nakasal ka nanan sa ibang babae, mag file kayo ng legal adoption para sa anak mo na iyan.

My sister recently went to the BIR to register her business. During the process, the BIR asked for her TIN which she gave. When the BIR entered the numbers, the records showed that her TIN was registered to a different person! When the BIR entered her name, she was not in their records. She was shocked because she applied for her TIN way way back in 1996 and has had several jobs since then, including a 6-year government stint. This means that all the taxes being deducted from her salaries were being credited to someone else.

 

Does anyone have any idea on how this could have happened - and remained undetected for so long? Has this happened to anyone else?

dahil hindi kayo kasal ng ina ng bata, ito ay illegitimate.

 

Sa ilalim ng batas (Article 176, Family Code), ang apelyido na gagamitin ng isang illegitimate child ay apelyido ng ina.

 

NGUNIT, SUBALIT, DATAPWAT...

 

Dahilan sa Republic Act 9255 (na isinulong ni Sen. Revilla, na alam nating maraming anak), maaari nang gamitin ng anak sa labas ang apelyido ng kanyang ama, kapag papayag ang ama dito, at kikilalanin niya ang bata bilang anak niya.

 

Sa iyong kaso, kinilala mo na ang iyong anak, ang kulang na lang ay ang Affidavit to Use Father's Surname (AUSF).

 

Magpunta sa Civil Registrar kung saan naka-rehistro ang bata at dun magtanong kung ano ang kailangan para maidagdag na ang iyong apelyido dun sa birth certificate ng bata.

 

NOTE: Sa ilalim ng Art. 176, ang ilehitimong bata ay nasa kapangyarihan ng ina. Kung ating susuriin, dahil ang bata ay nasa ilalim ng kapangyarihan ng ina, dapat kailangan munang pumayag ang ina sa pagbabago ng apelyido (dahil siya dapat ang nagde-desisyun at menor-de-edad pa ang bata), kahit pa gusto ito ng ama.

 

Kaya lang, walang sinasabi ang Implementing Rules and Regulations ng RA 9255 na kailangan ang consent ng ina bago mabago ang apelyido ng bata, kung kaya't TAKE ADVANTAGE NA (at sabi mo nga ay di kayo magkasundo ng ina)

 

PANGALAWA: Sa ibang Civil Registrar (tulad ng Manila at QC), may interview pa na ginagawa ang Civil Registrar kung saan kailangang humarap ang magulang at bata, baka lang magkaproblema ka pag ganito, at baka di mo madala ang bata sa Civil Registrar for interview at sabi mo nga ay di kayo magkasundo ng ina. That is the reason why you have to go to the Civil Registrar concerned to ask what are their specific requirements (aside from the AUSF).

plan namin magpa civil wedding ng gf ko next year, pwede ba un kahit di alam ng family nya? family ko lang at sya nakaka alam ng relationship namin for now and plan namin magpakasal na di muna paalam sa family nya.

 

and may complications ba kung may anak na sya? pero hindi sya kasal sa ama ng mga anak nya and hiwalay na din sila?

depende sa edad ng ikakasal.

kapag ikaw ay 18 hanggang bago mag-21, kailangan ng consent ng ama, o ina, o nabubuhay na magulang, o guardian [kung patay na ang magulang], in that order (e.g. kahit ayaw ng ina kung payag ang ama OK; kung payag ang ina pero di payag ang ama, problema). pag walang consent, depektibo ang kasal, maaari itong ipawalang-bisa.

 

kapag ikaw ay 21 hanggang bago mag-25, kailangan naman ng advice mula sa magulang, kung walang advice di ka makakakuha ng marriage license agad (delayed ito ng 90 days). Yun nga lang, makakakuha ka pa rin ng lisensya (pag walang lisensya ang kasal, wala rin itong bisa. ang gustong magpakasal ay nag-aapply muna at kumukuha ng marriage license sa Civil Registrar bago sila ikasal).

 

kaya, kung kayo ay 25 or over, no need for consent or advice mula sa pamilya ninyo.
