Parish Priest ba pwede?

 

Members of the judiciary, priests, rabbis, imams, ministers of registered churcges or religious sects; consul-generals, consuls, vice-consuls. Military commanders in the absense of a chaplain and ship captains and airplane chiefs can solemnize marriage in articulo mortis. If you use a religious officiant you or your partner must belong to the officiant's sect.

im starting po a corporation. base from the steps i reserved na a name for the company. next po sana is un paid in capital. i checked the table of SEC wala naman po kami don sa list(different types of companies with starting capitals) since our company is a software solutions provider. eto po un nakita ko sa isang website

Ayon sa Sec. 13 ng Corporation Code (Batas Pambansa 68):

 

Sec. 13. Amount of capital stock to be subscribed and paid for the purposes of incorporation. — At least twenty-five percent (25%) of the authorized capital stock as stated in the articles of incorporation must be subscribed at the time of incorporation, and at least twenty-five (25%) per cent of the total subscription must be paid upon subscription, the balance to be payable on a date or dates fixed in the contract of subscription without need of call, or in the absence of a fixed date or dates, upon call for payment by the board of directors: Provided, however, That in no case shall the paid-up capital be less than five Thousand (P5,000.00) pesos.

 

Dahil di naman kasama ang software solutions provider sa nangangailangan ng mas malaking paid-up capital, pwede na ang deposit na P5,000 sa bangko. Kailangan nga lang na yung P5,000 mo ay pasok dun sa capitalization ng company. In other words, ang maximum capitalization mo ay P80,000 lang (kasi 25% o 20,000 nito ay kailangang subscribed na, at sa 20,000 na ito, bayad na ang 25% o P5,000). lalabas na sa 5 incorporator mo (assuming na lima lang ang incorporator), silang lahat ay maghahati-hati dun sa 20,000 na capital (kung piso kada share ka, 20,000 shares ang paghahati-hatian nila.

 

Note: baka mababa ang capitalization na 80,000. Kung ang isang kumpanya ay nangangailangan ng software, baka magdalawang-isip ang mgt. na makipag-deal sa isang software solutions company na ang kapital lamang ay P80T

20 YEARS na po kaming nangungupahan dito sa suburban na lugar sa cavite city. okay naman po ang relationship namin ng landlord, kahit alam naming hindi naman nakaregister sa bir yung tinitirhan naming apartment, yung OR po kasi wala nmang nakalagay na registered sa BIR. last 2010, tinaasan nila kami ng upa, from 2,750 pesos, naging 3,000 pesos na po. unfortunately, inatake sa puso yung landlord namin. ngayon po, ang tumatayong landlord namin yung anak na niya.

 

here's the deal. last year sinabi niya sa amin na tataasan niya yung monthly rent namin ng 500 pesos, effective daw po this january. nagresearch po ako sa internet, nakita ko itong: Republic Act (RA) No. 9653 – Rent Control Act of 2009. COvered ba po kami nitong law na ito? kasi po sa pagkakaintindi ko, sa December 2013 pa po nila kami puwedeng increasan ng monthly rent, and 7 percent lang ang puwede nilang itaas, sobra sobra po ang 500 pesos na itatas nila dahil ang 7% ng current na upa namin ay 210 pesos lang po.

maaari siyang mag-increase yearly ng upa, pero 7% lang (mali yung sinasabi mo na 2013 lang sila pwede mag-increase, taon-taon pwede, pero 7% lang kada taon. Pagdating sa December 2013, mapapaso na ang batas, pagdating ng panahon na yun kahit ilang percentage pwede na silang mag-increase, wala nang limit - don't worry, laging nai-extend o naipapasa ulit ang batas na ito dahil maraming congressman at senador ang gustong ma-re-elect, mula pa nung 1971 [RA 6359], PD 20, BP 25, BP 877, RA 6643, RA 6828, RA 7644, RA 8437, RA 9161).

Note: lumalabas pa nga na bawal yung ginawa nila na increase in 2010, dahil lampas 7% din yung increase from P2,750 to P3,000 (at kung pasok pa ito sa one-year period from August? 2009 to August? [not really sure what month in 2009 9653 took effect] 2010, walang increase na pwede actually)

I'm going to simplify my suggested action plan for you:

First, don't rely on on heasay, go to your HR and get a copy of your company's retirement plan.

Second, I take it that you're still a yuppie (30's or so). The law does not entitle you to a retirement benefit yet. you're best bet is if your Company provides an early retirement plan.

Third, assuming na may retirement plan nga kayo sa company, you cant get more than what is stipulated there.

Fourth, your best bet to get more than what you're entitled to is to gamble your resignation vs the idea that you are indeed an asset of the company that they company will move heaven and hell to retain you using a substantial amount of money. :ninja:

I would like to seek for an assistance,coz meron akong frend kinasal cla sa simbahan tpos ung marriage license was d last thing n ginawa nila, ang sabi sa kanila sa civil rgistry baka daw ma void un ksi daw mali ung date ng marriage nila and dapat magpakasal sila ulit.pero tinatakan daw ng seal ung marriage contract nila.

 

1.tingin nio po b valid ung marriage nila kht mali ung nkalagay n date sa marriage contract even my seal ung marriage contract?

2.bakit po kelangan nila magpakasal p ulit, panu kng nde sila magpapakasal ulit void p den b ung kasal nila?

nagpapaupa ako ng pwesto and meron kasi akong isang tenant na gusto ko sanang mapaalis na due to delinquency in paying the rent, excessive heat emanating from the place(bakery kasi un business) at nasira na un place due to their neglect to maintain the place well.

 

Ano po ba ang dapat na maging step ko para mapaalis ko sila. nagkaron kami ng contract but nag expire na sya last Dec 2011. We have not made a new contract as of this time. Meron bang prescribed sa law stating kung ilang araw,weeks,months ang notice ko for them to vacate the premise?

 

Hope you can advise me on what steps I need to do so that I will not bypass their rights and at the same time serve my purpose to have them vacate my place.

nag demand na po ba kayo na umalis na sila? pag hindi pa po, according to rule 70 of the rules of court, you have to demand that they vacate the premises in which case they have 15 days in case of land or 5 days in case of buildings.

if they did not comply, try to reach a compromise or settlement on the barangay level. If no compromise/settlement can be reached, you can then file for unlawful detainer in the proper municipal trial court.

According to article 3 of the Family Code

the formal requisites of a formal marriage are

1. Authority of the solemnizing officer

2. A VALID marriage license except in some cases

3. A marriage ceremony which takes place before the solemnizing officer and their personal declaration that they take each other as husband and wife in the presence of not less than two witnesses of legal age.

 

from your statement, they were married in a church. lets assume that the marriage was solemnized by a priest. In that case, the authority of the solemnizing officer is valid. And lets also assume that 2 or more witnesses attended, requisite number 3 would then be complied with.

 

the question would lie on requisite 2. whether they have a valid marriage license. because they only had the marriage license after the celebration, then it is presumed that there was no valid marriage license during the wedding ceremony. BUT it may be valid provided that they fall under those marriages where a license is not required. those are:

 

1. Marriage in Articulo Mortis (point of death of one or both parties) as provided for in article 27 of the Family Code (FC)

2. The residence of either party is so located that no means of transportation would enable them to appear before the local civil registrar (Art 28 of the FC)

3. The marriage is among muslims or other ethnic cultural community where, according to their customs, no marriage license is necessary.

4. The couple have been living together as husband and wife for at least five years without any legal impediment to marry each other. In which case they have to make an affidavit before any person authorized to administer oaths (like a notary public). The solemnizing officer (in this case, the presumed priest) should then state under oath that he has ascertained that there are no impediments for the couple to marry each other and they are qualified to get married. But this should be BEFORE the marriage ceremony.

 

If your friends does not fall under any of the exceptions provided, then the marriage is void.

Lastly, the marriage license will be valid for 120 days after the date of issuance.

i signed an overseas employment contract good for one year, 2 weeks ago.

it also says in my contract that either party can terminate the contract not less than one month written notice without explanation,

my question is, since the contract signing is so fast and the start of the contract is next month na, is there any possibility to use this clause in the contract?

 

i'll be penalized one month salary if i resign within my tenure of contract, magbabayad ba ko? kasi technically, di naman ako magreresign kung di pa ko nagstart magwork?tama ba?

 

at sinabi rin na: this employment is subject to laws of COUNTRY XXX

so, mahahabol ba nila ako dito sa pinas? meron kasi sila counterpart na company dito e.

 

e paano pala kung nagbago ang tenure of contract? may original date kasi sa contract, pero binago na kasi sa last working day ko dito pinas.

di naman ako nabigyan ng kopya, they asked me to sign lang the page, and they said its for visa processing.

What curian advised is correct. Since the contract has already expired there is no need to send a demand letter but you should send one anyway so that your tenant cannot use that as an excuse. As much as possible, resolve the matter via compromise agreement or a complaint with the barangay. If you have to file an ejectment complaint with the court, it may take from 6 months to over a year to evict your tenant because of legal requirements and procedures.

 

If your contract states that you can re-take possession of your property without filing a court action then one thing you can do is turn off the electricity at the circuit breaker/fusebox. If only you and not your tenant has access to it then there's no way they can turn the power back on. It will force them to settle with you.

Bagong salta lang po ako, labas ng college. At soon, magwowork na rin ako. Pero balak ko agad mag-invest at mag-setup ng maliliit na business. Unang option is foodcart. Ano bang kelangang papeles para makapagoperate maliban sa DTI-SEC na automatic hinihingi ng mga admin sa mall? Tsaka since franchise naman, kelangan ko pa bang kumuha ng permit sa FDA (dating BFAD?) o bahala na yung mother company ng franchise?

i'd like to know if DOLE entertains anonymous complaints of an employee against his or her employer regarding poor working conditions like working longer than 8 hours without pay, not having sss and other mandatory benefits, no vacation leave and no sick leave, and no 1 hour lunch breaks? especially if the employee is still working in the company. Also does BIR entertain anonymous complains or reports?

Isn't it that even if the written contract has expired but you allowed the tenant to remain on your property, the lease is deemed renewed on a monthly basis if rental is paid on a monthly basis, or weekly if rent is paid on a weekly basis, etc.? It is always better to issue a demand letter to forestall any legal excuse the tenant may have to continue staying on the property. Make sure that there is proof that the tenant received copy of the said demand letter by getting a written acknowledgment of receipt or by sending the letter by registered mail.

That's true. To be specific, for a renewal to be implied, the lessee must have occupied the property for at least 15 days with the acquiescence/permission/consent of the lessor and neither party has given contrary notice.

 

If the contract has expired but the lessee refuses to vacate, the lessor may immediately (within 15 days from expiration) file a barangay complaint/ejectment case without having to send a demand letter first. Having said that, it is still a good idea, as you said, to send a demand letter to avoid legal complications.

 

I've filed ejectment cases before and it's amazing (and also irritating) how creative people can be when it comes to finding holes and defects in your complaint! :P :P

Nagbukas kami ng siomai franchise last year pero sa isang commercial bldg sa loob ng village, hinde sa mall. Kumuha kami ng barangay permit, DTI registration, mayor's/business permit, at BIR registration. Di na kami pinakuha ng FDA permit.

a batch mate of mine has a 35k debt to me since kaibigan ko naman dko na ginawan ng written note na nangutang sya at ginamit nya kasi un sa emergency regarding her mom who was on the hospital at the time. ngayon malapit na mag 2 yrs un utang kahit ano wala pa sya nabayaran. paano po ba ang magandang step na gawin para idaan sa legal means para po magbayad sya? worried po ako baka kasi i deny nya un utang since wala kami kasulatan about it.

a batch mate of mine has a 35k debt to me since kaibigan ko naman dko na ginawan ng written note na nangutang sya at ginamit nya kasi un sa emergency regarding her mom who was on the hospital at the time. ngayon malapit na mag 2 yrs un utang kahit ano wala pa sya nabayaran. paano po ba ang magandang step na gawin para idaan sa legal means para po magbayad sya? worried po ako baka kasi i deny nya un utang since wala kami kasulatan about it.

Your problem is proving the existence of the loan. I suggest that you meet your batchmate to discuss payment of the loan, preferrably at a public place like a restaurant. You should bring a friend, or friends, to the meeting to personally witness the discussion. (If you think your batchmate will not discuss the loan in front of a 3rd person, have your friend/s sit at a nearby table where s/he can hear the discussion). In case you have to file a complaint for sum of money, you can present your friend/s as a witness since s/he personally witnessed the discussion and can testify on what was discussed.

 

Depending on where you live, this may be filed with the Small Claims Court.

 

I do hope you can collect without having to file a court complaint.
