Marcos for violating an injunction that barred them from dissipating assets of the estate.The judgment amounting to $353.6 million is believed to be the largest contempt award ever affirmed by an appellate court.The judgment may be implemented against any US property owned by Imelda and Bongbong. However, the human rights victims need to ask the Philippine government for implementation of the judgment against the Marcoses’ personal property in the Philippines.A Philippine law requires that all ill-gotten wealth recovered from the Marcoses should be spent on the government’s land reform program.Robert Swift, lead counsel for the 10,000 Filipino human rights victims who obtained a judgment against the late dictator and his estate in 1995, said he was satisfied with the new judgment.“The Marcoses have thumbed their noses at the United States court and Filipino human rights victims ever since the $2-billion judgment was entered in 1995,” Swift said in a statement. The SC First Division denied the petition for certiorari filed by Marcos and her daughter Irene Marcos-Araneta which sought the reversal of the Sandiganbayan's January 2014 decision declaring the jewelry collection as ill-gotten wealth.Known as the Malacañang Collection, the jewelry set is the latest of Marcos' 3 collections which were disputed in court and have been stored in a bank vault for decades. The other two collections had already been forfeited in favor of the government. The collection is worth $110,055 to $153,089, according to the Sandiganbayan. Compared to the other two collections, the Malacañang Collection is made up of smaller, less expensive jewelry that the Marcoses left behind when they fled the country in 1986. In the decision penned by Chief Justice Maria Lourdes Sereno, the SC said the former First Lady and her daughter "failed to satisfactorily show that the properties were lawfully acquired; hence, the prima facie presumption that they were unlawfully acquired prevails." The court noted that the Marcoses' legitimate income from 1966 to 1986, during which the jewelry were supposedly acquired, only reached $304,372.43. "We reiterate what we have already stated initially in Republic v. Sandiganbayan, and subsequently in Marcos v. Republic: that 'whenever any public officer or employee has acquired during his incumbency an amount of property which is manifestly out of proportion to his salary as such public officer or employee and to his other lawful income and the income from legitimately acquired property, said property shall be presumed prima facie to have been unlawfully acquired," the SC said. The SC also found no merit in the Marcoses' arguments that they were deprived of due process, saying "the allegations are utterly baseless." The Marcoses' jewelry collections, worth at least $8 million, are kept in the vaults of the Bangko Sentral ng Pilipinas. The government plans to ultimately auction them off. Lyse Posted January 8, 2018 Share Posted January 8, 2018 It is very hard to gather verified information /documents regarding the late President Marcos, Anti-Marcos groups and the Liberal Party either hid/destroyed/twisted and denied some of the facts on what really happened during those years (heck, even my foreign History book was painting the Late President Marcos as Hitler of Asia (written by a Filipino contributor)).. During my vacation in PH last 2006, I interviewed most of our Barangay's Elders that lived from the later years of Japanese occupation and Marco's Era for my Class' History Presentation back abroad. According to some of them (8 to be exact including my grandparents on both of my Parent's side of families), they were present during EDSA people power, however they didn't knew that it was a rally for the President to step down. "Ang sabi sa amin ay para sa dagdag sweldo ng mga guro yung pupuntahan namin" - Lola Paring. However, one Elder said that abuses from the Police and Military were really happening but in isolated areas / cases only. "Sa kabilang baryo may inarestong babae noon na hindi na nakabalik sa pamilya nya hanggang sa ikinamatay na ng mga magulang nya, kaya hindi na kami lumalabas pasado 7 ng gabi. Pero doon sa baryo ng kapatid ko, wala naman silang ganoong kinatatakutan, mababait naman daw ang mga sundalo sa kanila." - Lola Aida. After that interview, I came into a realization that those abuses done by men in uniform were isolated cases only and not a direct order from the President, opposite on what our book informed us. I was trying to collect Reports / papers / anything that will link to the story of Lola Aida but to no avail. In the end, I presented my research during our class, and at that time me and my very beautiful English instructor had a very long argument. I only got a grade of C after all that effort. Excactly what facts where hidden/destroyed/twisted by the anti-Marcos and Liberal Party? Please enlighten us on the missing details. ...And please back it up with credible sources. You said that "It is very hard to gather verified information / documents regarding the late President Marcos" I think you need to brush up on your research skills because contrary to what you say, there are numerous information/documents out there regarding the late President Marcos both locally and internationally.
