  1. Mga Gurus, I have a question.

     

    For QC RD, does getting a Certified true copy really takes 1 week? I remember in the 90s. getting a CTC usually takes less than day.

     

    Is there a way for me to get it faster? thanks

    Most Registry of Deeds issue the Certified True Copy of the OCT/TCT/CCT within 3 days. QC and Makati are faster in that it averages 2 days while Caloocan is one of the worse at 6 days. As for getting it faster, of course there are ways, but they are illegal. :rolleyes:

    register a sole proprietorship name with DTI. what do i do next to establish my broker company?

    do i have to apply with BIR again for the OR under my company name?

  2. 3 days in Sagada was fun, well, aside from the pain in my calves, thighs, butt, lower back, upper back, and neck. Oh, and yeah, the cold sniffles and cough that I seem to have developed.

     

    Anyway, while the big falls (bomod-ok) is where most people tend to go, we went on an overnight trek to the Twin Falls ... it was a definite winner. The last day was spent in doing the cave connection, though with the sheer number of people in the caves, it wasn't worth it anymore.

     

    Dinner at the Log House was ... so-so at best. The pinikpikan (native chicken, smoked ham, potatoes, and string beans) was bland at best. All told Salt and Pepper is a better place to eat, at a far lower budget to boot.

     

    There is a large number of rest houses there now, all of which are pretty much ugly and cheap. Personally Canaway rest house was the cleanest of the 3 that we stayed in.

  3. Good point, however based on his post that its his grandmother's property, odds are its a personal property, thus a capital asset. However, you are right in that if its an ordinary asset they'd have to pay 12%VAT and 6%CWT in addition to the 1.5%DST.

    Without any set of rules from the homeowner's association then the default rules of the community (barangay/municipal or city ordinances) then apply.

     

    While there are no titles to the road (barring certain road lots not deeded to the city but are instead the private property of certain developments), often there is the mistaken assumption made that parking on the road is a right when it is in fact a privilege that is often abused. Certain developments now no longer allow parking on the streets longer than 4 hours as the roads are for travel and parking (other than for short periods of time) is no longer allowed, with parking to be done within the property limits.

    I am selling a 400 sq.m. residential property in Teachers Village, Quezon City. The lawyer of the buyer insists on putting on the deed of sale the provision: "The VENDORS declare and obligate themselves to send written notices by registered mail with return cards to all possible redemptioners (adjacent lot owners) in accordance with Civil Code Article 1623 and to execute an affidavit declaring such fact and providing copies thereof to the BIR or the ROD and other government offices as the need arises."

     

    I already checked this with the Examiner of the Register of Deeds of Quezon City and she said this is not applicable/needed for the transfer of the title to the Vendees. But the LAwyer of the buyer insisted that this is needed. I also read Articles 1621, 1622 and 1623 and it is very clear that this law covers RURAL LANDS and URBAN LANDS so small and bought in speculative in nature.

    I would check with the buyer if he has made that condition a part of the contract of sale or if its an attempt by the lawyer to show his self-importance.

    sa kontrata, ang mga partido ay may karapatan na maglagay ng anumang kondisyon na gusto nila, kailangan lang na di ito labag sa batas, immoral etc., etc.

     

    in other words, if the other party insists and you agree, its OK.

     

    if they insist and you do not agree, its also OK, di lang matutuloy ang bentahan. wala namang pilitan sa kontrata eh.

     

    kung talagang labag sa kalooban mo yung i-inform ang adjacent owners about the sale, tell the prospective buyer about your view. kung bumigay sila, OK. Kung matigas ang ulo at ayaw pumayag, nasa yo na yun kung papayag ka o hindi.

    i have a client who is having her house rented for P30,000 a month. tenant issued pdcs. however, pdcs have been bouncing since feb, mar 2010. tenant has not paid to date and upon the instruction of my client's lawyer, client still has to deposit the apr check para 3 consecutive months nag bounce ang check - grounds for ejectment.

     

    but i read the rent control act of 2009, my client's situation is not covered since first P30,000 ang monthly rent nya.

     

    question:

     

    how do we proceed in ejecting this tenant? what are the legal procedures to file eviction case against the tenant? barangay ba dapat muna? thanks.

    If the lessee is in violation of the contract of lease (and assuming that the contract of lease is duly notarized and that withholding tax and VAT are being paid by the lessor to the BIR) then the lessor can file a complaint with the barangay captain, the local police, and the courts.

    ZV doesn't change all the time, sometimes it can be 10 years old without any changes.

    Capital Gains/Creditable Withholding Tax is 6% of the selling price or the market value of the property, whichever is higher.

    Documentary Stamps Tax is PHP15 per PHP1000 (rounding up) of the selling price or the market value of the property, whichever is higher.

    Transfer Tax varies from city to city.

    We are now paying for a townhouse unit with a total cash price of 1.7 million, through the owner's in-house financing plan, payable for 10 years.

    I have already paid the total of 500k (more or less).

     

    Now, we want to sell the property for the same amount (500k) that we have already paid, then the buyer will assume paying the balance.

     

    Is this as simple as it sounds, or do we have to pay anything to the owner/developer for the sale to take effect?

    What are the legal steps to take, if any?

    Can we increase our price? To compensate for the improvements that we have included in the house like- we have constructed a dirty kitchen?

    Yes you can increase your prices to whatever the market will bear, keep in mind though, the higher the price, often the harder or longer it takes to sell.

    There are a couple of pretty good resto's that serve European cuisine in Davao.

     

    Buona Terra (Torres St.) serves a mixture of Spanish/French Provencal/Italian dishes.

     

    Spirale (Matina Square) serves Italian food with a large wood fire brick oven that makes their pizzas extremely delicious.

     

    Both are a bit on the expensive side, but the food is good.

     

    Luz Kilawin is relatively cheap with massive portions, but its a rougher establishment, no frills whatsoever.

  9. Casa Leticia is where i am staying now here in davao. The staff is friendly and accommodating, and here I get real value for my money. I'll be back on Manila come wednesday night and would definitely recommend this Hotel to my friends back in the Metro. And oh, before i forgot their home made sardines tastes really good!
    The Vietnamese and Japanese restaurant alongside (Hanoi and Tsuru) are also owned by the hotel. I agree, I was there for 4 days, it is a great place to stay.
  10. Value for money in Hotels, I'd say Casa Leticia or Ponce Suites, both are good places in the center of the city, neither of which will break the bank as far as the budget goes, clean and good service for both places.

     

    Pretty much my major complaint in my trip here is that most of the city is non-smoking now, talk about being prejudiced to the minority.

  11. Luz Kilawin (Davao)

     

    This place was highly recommended by several native Davao inhabitants.

     

    It appears as a small hole in the wall turo-turo place.

    We had already eaten so we only ordered the panga and the behod.

    The panga is soft and definitely fresh, the charcoal grilling adds a smokey flavor, but this would definitely taste better if marinated longer.

    Behod is the egg sack of tuna, for some strange reason people seem to think its healthy because it comes from fish, however, I'd like to point out that it is still EGGS, thus full of cholesterol. That said, this reminded us of something ... we thought about it while eating and it ended up as smoked saba (the Japanese mackarel). Tasty, but oh-so-unhealthy.

     

    Oh yeah, the Kilawin is also pretty good and the Squid is grilled almost right, its just very slightly rubbery, enough to give a texture when accompanying beer.

  12. Spirale (Davao) Take 2

     

    Okay this time I was more prepared to eat really good European (Italian) cuisine in Davao.

    We started off with Tutto Spirale (sort of a rectangular pizza with air dried beef, tomatoes, roasted eggplants, mozzarella cheese, asparagus and capers), Gamberi Ali Olio (basically gambas but with only garlic, basil, and extremely good extra virgin olive oil), and Insalata de Prosciutto (salad greens with prosciutto ham and fresh goat cheese, some parmesan, and a really nice balsamic dressing).

     

    Those were the appetizers. I'd love to show you guys pictures, but the food disappeared mere seconds after arriving on the table.

     

    For entrees we ordered

     

    Pizza Napoli - the handmade thin crust pizzas here in Spirale is of course their specialty. Their Pizza Napoli is classic Neapolitan in look, aroma, and flavor.

    Lamb Racklets - tasty and tender, these lambs were a hit with the family, we ordered 2 extra plates. The roasted capsicum (pepper) sauce is also pretty good, but essentially superfluous in this dish.

    Roasted Garlic Chicken - didn't get to try this dish out as I was so stuffed.

    Pasta Ali Olio - Using spaghettini instead of angel hair. Good taste of premium extra-virgin olive oil, garlic chips, and sliced chili peppers.

  13. Spirale

    Davao

     

    A small and simple looking establishment, we came here looking for coffee, this place serves heavenly smelling and great tasting coffee. Then the large wood-fired oven made us look at their menu.

     

    Lots of interesting looking dishes, but we settled on the pot roast and a couple of pizzas. The pot roast was pretty good, but not super-spectacular, then the pizzas arrived, small, perhaps good for 2 or 3 people each, they have that aroma that is just amazing. The toppings are simple, but the ingredients are fresh. The pizza crust is hand made to order, thin, with that crunchy roasted flavor that only wood ovens can impart.

     

    All in all, a great place to eat. I must simply try the other pizzas in their repertoire.

  14. Ta Yuan (Malate, across from Pan Pacific Hotel)

     

    Often the restaurants that serve Singaporean style cuisine here in the Philippines served either tasteless or really bad versions of these tasty treats. Not anymore, for the first time I've found a place that serves really good Hainan Chicken with just the right amount of flavor and the price is pretty reasonable as well.

     

    We started the meal off with some Tsingtao beer and ordered merely 3 dishes and some Hainan Chicken Rice of course.

     

    The Hainan Chicken arrived first.

    It was tender and juicy, the taste is about perfect. My companion preferred the ginger/scallion sauce while I enjoyed the sambal to accompany the chicken. Most Hainan chicken served in the Philippines is boiled to death, this one is oh-so-delicious.

     

    Of course, what is Hainan Chicken without the greasy, and oh-so-filling rice that should accompany it?

    Yes, I know that a lot of people wonder why one would enjoy eating greasy rice, but that's the authentic way to eat this meal, not to mention that it was cooked with the stock from the chicken so there is a lot of flavor in the rice.

     

    The second dish to arrive was the Laksa, a spicy noodle dish that requires no description except that it is another must-eat here.

    The spice level is definitely there, as well as the curry taste (which are not the same by the way), the only complaint I would have about the Laksa is the sheer size, 1 order is good to fill 4 to 6 bowls ... with some left over for round 2.

     

    Unfortunately I didn't have time to take pictures of the 3rd item we ordered, the spicy crab ... it was totally decimated by the voracious eaters sitting on our table. Is there any need to describe this dish further for those that enjoy eating this armored package of delicious goodness?

     

    All in all, this place is definitely a must-go for those that enjoy good food and for those that want to eat good Singaporean cuisine.

    [/font]Though some of us do get warts ...... Its hard to say if this was the result of eating frogs legs (or frogs for that matter) Perhaps we should ask a doctor about this.

     

    You only get warts if you are infected, with regards to frogs legs, in general, provided it is cooked adequately and correctly, you can't quite catch warts from eating frogs legs.

  16. 1521 - Shaw Blvd. near Mr. Poons

     

    I had dinner here recently with a companion. First impressions are that the ambiance is nothing great, simple, but easy on the eyes. The tables and chairs are functional and comfortable. The A/C keeps the resto just properly cooled.

     

    The menu is fun to look at since the owners obviously spent some time coming up with fairly unique and amusing twists on the names of their dishes.

     

    For appetizers we had the chicharon bulaklak, at first glance, nothing special, though admittedly it was cooked just right without the excess greasy oil that one normally expects from this dish. The dipping sauce was also just right.

     

    The server kept recommending the pochero ... and she was right ... it was pretty good, though I'm still not a big fan of gabi. That and the Satay chicken, as well as some rice was enough to fill up the tummies of two guys ... together with half a dozen bottles of beer of course.

     

    All told, not a bad place, I'll need to recon here further to try out the other dishes.

  17. @sir asmodeus - you know me, im just a text away, we can try the foods in estero, i havent tried it but everytime i pass by, nakakagutom ang amoy! or we can eat at UNO, which is located at escolta or the newly opened one just besides UNO, pwede din sa greenland! wag lang sa sky dragon. and to comment your last post, sure! it'll be my pleasure to tour you around here in my territory hahahaha (peace). btw, dont forget the fried siopao's!! yummy!

    Thanks for your time in responding to my inquiries. Basically, my question boils down to the legality or the regulation of the computation of the association dues and the penalties involved by the condominium administration. I also have the same inquiry regarding the rates being charged by the administration for the electric and water bills even if it's measured by individual submeter since it is different from the prescribed residential/commercial rates in our area.

     

    Is there a law or regulation that can protect the unit owners/residents/tenants against unfair rates, being charged for non-existing facilities and other unjust practices that the administration can take advantage of? Or is it a really private contract between the administration and the owners/residents/tenants as long as the election or creation of the condominium administration is legal (i.e.: elected by the unit owners themselves).

    Its pretty much a private contract, however, if you truly feel that the practices are unjust you could sue the association. It might be better to ask your neighbors to see what their opinions are about the aforementioned practices.

  20. Mga sirs patulong naman, I saw a property for sale sa banko kaso me remark na "no tax declaration on improvement" on file and property still being use by owner. What does this mean? Mahirap ba bilhin ito pag me ganitong problema?

    Generally that means that there is a problem with the bank's forclosure and that there may be a court case still pending on the property. My advice is to ask the bank about it.
