  1. joepoc is bossig vic aka smith. the guy is pissed off because i gave him a can of good whoop ass in several threads. and i am now ignoring him since we have been warned by the admins. but he feels that he has to level things.  and this is the only way he thinks he can get back at me, by being a copycat.

     

    he is using alternicks that will blatantly violate rules so his primary handle will not be affected. sadly, the admin cannot stop him. i understand why. so its best to just ignore him. he is jsut craving attention.

  3. oo naman, dapat kayo magduda nun. start by checking the city registry kung naipasok na mag asawa na sila. check kung sino nagkasakal, etc.

  4. My sympathies to you and your family on the passing of your father.

     

    If you inquire from Allied Bank regarding their requirements for claiming a deceased account, they will gladly assist you.  Some documentary requirements though, may take a while before you can secure them.

     

    Offhand, these are the usual documents you'll need to submit to the bank:

     

    1.  Proof of evidence of bank deposit (passbook, deposit certificate, etc)

    2.  Identification papers of deceased

    3.  Identification papers of heirs (his spouse and children)

    4.  Marriage Contract

    5.  Birth Certificate of children

    6.  Death Certificate

    7.  Certification from BIR that all taxes have been paid (estate)

    8.  Extrajudicial Settlement among Heirs

    9.  Affidavit of Publication from newspaper of general circulation

    10. Other documents as required by bank's approving officer/committee

     

    Your bank may or may not require all of the above, or may even ask you to submit other documents not mentioned in this list, depending on amount of deposit involved, and if the submitted documents are to their satisfaction.

     

    Pag ok na, they will issue you a Manager's Check payable in the names of all the heirs.  If you are authorized by your mother and siblings to transact on their behalf, just secure a written authorization signed by each of the parties.

     

    Wag kang matakot, you will be able to claim the funds, although it make take time.  Many people think, pag wala kang documents na ma-submit, goodbye na ang pera.  That's not true.

     

    Is the account of your father a joint account or in his name alone?

    While these are the usual requirements, most of the time the branch manager will have discretion on whether to require all these doucments or not. It is very difficult but not impossible to bet a certification from the BIR that all estate taxes have been paid. You will need to work on the Extrajudicial partition first, then have it published, present the Deed of Partition and Proof of Publication to the BIR who will then assess the estate taxes which you must pay within 90 days from date of death of the deceased otherwise there will be a corresponding penalty. I'm not too sure about the 90 day period but the BIR is strict on penalties nowadays.

     

    At the end of the day, a joint and/or account is still the way to go to avoid all the hassle.

     

    Talk first to the Branch Manager to see what he can do about your father's account. Good luck.

  5. I have a question regarding my SSS & Pagibig contributions which were not remitted by my previous employer.

     

    From 1996 up to 2001, the company I worked for religiously deducted my contributions every month only to find out that they were lagging behind the quarterly remittance of their employees' contributions until eventually, they stopped remitting at all. Now, I can't even apply for a new loan even if I have already exceeded the number of contributions required because I still have a pending SSS salary loan amounting to P13,000+. I have my payslips to confirm that I was able to pay off my loan in 24 months. Before I left the company, we were informed that by next year, everything should have been cleared with SSS because the said company applied for amnesty. I've already inquired from SSS & was informed that I have to pay my salary loan in cash to be eligible for a new loan.

     

    I've worked my ass off for this company, I want to get everything they've taken from me. It might be a small amount but I've learned that I wouldn't be able to apply for a passport if I have unpaid loans.

    While it is true that the company is liable to remit its SSS contributions, it seems you are applying for another SSS loan. While the company deducted your SSS loan payments, it seems that the company did not remit this to SSS. You may file a complaint with the SSS against the company for non-remittance of SSS contributions/payment but then this will take time. However you still cannot avail of a loan until your previous loan is fully paid.

  6. Thanks, I agree to that. Will it be possible if I'm going to issue a contract extension notice, stating the areas that the agents need to improve then if with in the 3 months extension & they don't improve their performance they will be terminated.

     

    I think this is still subject to the 6 month rule on regular employment. So as long as the termination is done within the probationary period, you will be OK. I have a feeling if ever a case like this goes to the NLRC, it will rule in favor of the employee, particularly if the employer cannot justify that the work is seasonal or project related.

Meron din derivative acquisition of Philippine citizenhsip for the minor children of dual citizens.

     

    That was the most practical thing I could think of. Also the right to work here without getting a work permit. I'm sure there are others.
