  3. There is a law penalizing drunk driving. This is Section 56, par. (f) of the Land Transportation Code. The law imposes a penalty of a fine not less than one thousand pesos or imprisonment of not less than three months nor more than six months for driving a motor vehicle while under the influence of liquor or narcotic drug.

    Intoxication, as you very well know, is an alternative circumstance... may be mitigating or aggravating. Case to case ( or barrel to barrel ) basis.

    thanks...i get it so if you runover someone while drunk you're charged with homicide or physical injuries aggravated/mitigated by intoxication... or if you crash into someone's car, its damage to property and intoxication mitigates or aggravates your liability. but there's no law per se prohibiting you from driving while intoxicated. weird...

  5. hey everyone...i was just wondering. is there really a law against drunk driving in the philippines ? or a philippine counterpart of the US DUI laws? wala lang. i just realized that i have never seen or studied a law on this... :upside:

    You looked amazing! How long has it been? God! I remember NYC in 96! I would walk from manhattan to central park in the freezing cold hoping to catch a glimpse of you. Then the horrible news came while we were waiting for Romy's bus from Newark. Johanna told me everything, although Romy admitted she found out just before she boarded the plane in Seattle. And then, so many things happened in between now and then. Its been 8, almost 9, years...damn! Well, people say I look like her. I say, why have a look alike when you can have the real thing? :rolleyes: I hope it lasts this time around. You really deserve to be happy. Congratulations!   10. Contracts which prohibit an employeee from engaging in business in competion with the employer are not necessarily void for being in restraint of trade. Such a clause is valid and enforceable when reasonable. It has been held that a non-compete clause that is limited as to time and trade is reasonable and therefore valid.

     

    A non-compete clause that is limited in time but not as to trade, however is unreasonable. It must be limited to those trades in competition with the employer's business.

     

    I am not competent to discuss 16600, but the phrase "Except as provided in this chapter.." suggests that there are exceptions to the general rule. A limited non compete clause may be among the exceptions.

     

    But MNC-Philippines may definitely enforce it here in the Philippines without violating any local law.

    hey cdma...i think i vaguely remember the SC striking down a provision in an employment contract prohibiting the employee from seeking subsequent employment in a "competitive" company for like a year. if i remember correctly the court held it unreasonable to prevent the employee from looking for employment with competitive companies. it recognized that it would seriously impair the employee's chances of finding gainful employment if she is barred from applying for a job within the same industry for a significant amount of time. the courts also pointed out that necessarily the employment opportunities that would be immediately available to her would be those related to her previous employment as that would be where she would be most qualified. i think this case was (obviously) decided based on considerations of equity rather than law.

  12. You just can't imagine how much profit these guys are getting from people

    who believed that there's an easy way to build such fine abs.  Ang dami ng

    lumabas na mga designs na AB cruchers.  Puro backed up pa by scientific studies and

    endorsed by well known fitness celebrities and athletes.  Just do your regular floor

    exercise or buy yourself a swiss ball.  Its more effective for ab exercise.

  13. Not really true. What "appellation controlle" or "denomination controli" really means is that the wines carry a regional appellation. A Bodeaux is from the Bordeaux region of France ONLY. A Champagne is ONLY from the Champagne region of France - from Spain it's a "cava", from other places it's a "sparkling wine". A Chianti is from - you guess it!, the Chianti region in Italy.

     

    That's different from the way American, Australian, New Zealand and other New World wines are marked, which is by varietal - cabernet sauvignon, suavignon blanc, chardonnay, etc. A Bordeaux is typically a cabernet sauvignon, cabernet franc, or merlot, or a blend of some or all. A Burgundy is pinot noir (red) or chardonnay (white). Chablis is chardonnay. Vouvray is chenin blanc. The Rhone varietals are grenache, syrah, mourvedre. Loire Valley wines are either chenin blanc or semillon.

     

    Interestingly enough, the US now has what's called an AVA - American Viticulture Appellation - similar tothe French system. This was driven by some Napa Valley wineries that were upset with Central Valley (Fresno. Modesto, Lodi) wineries putting "Napa Valley" somewhere on the label to try to fool the unwary consumer into thinking these were Napa Valley wines. This from a local industry that has a couple of wineries producing "California champagne" in defiance of the French appellation laws.

     

    As for "houses" on lables - lots of French wines carry a drawing of a house, chateau or castle on the label. Many are made by "chateaux" or estates and carry the name of the state. Hence the drawing of the house (or manor, or chateaux, or castle) that stands on the estate. Has nothing to do with quality.

     

    Bonny Doon (Santa Cruz Mountains, just south of where I live) also has a wine with a house on the label - Big House Red. It's a blend, varies from year to year, but is blended for consistency and quality. Relatively inexpensive, drink now (doesn't get appreciably better with age). The "Big House" is a prison!  :cool:
