usually, these companies resort to these tactics for maximizing their so-called investment. i think is a disguised plot to prevent you from joining the competition. :angry:

 

a friend of mine had a similar situation where he was asked to pay quarter of a million pesos! imagine that...

well its called netpros also known us versomina inc., located in ortigas... known for creating porn sites and editing porn videos and images... in this company i already expericed to be raid by NBI...

 

what training they gave me?

they just give me the porn project for almost 1 1/2 year.... and after 6 months after i signed the contract they make me regular and promoted me as a team leader..

 

when i came in the company im already well experinced and in expert level of using php and other web development language..

they just want me to stay.. but their offer is not enough to match the offer of other company... plus i dont really know if they put the tax they deducted on my salary.. because every time we ask for ITR they always ignored us ...

 

im just confused what to do... if the noticed will continue to pursue me... do i have to work on with it? or do i need to consult a legal council? pls help thanks...

 

is this located in centerpoint bldg. pasig?

 

found out that they were involved in scams. they are also known as: netpros, versomina, mytuscany

 

UK firm says RP-based web design outfit ripped them off

or get a lawyer if they pursue this course of action.

 

they have a lot of nerve to do this given their reputation.

 

what happened w/ the nbi raid? did they discover anything?

 

 

well actually many of my colleages.. did the same action as mine... i just did it becasue many of may co-wave developers already done it.. and they already recieve the same notice that i have...

 

with the nbi raid... i think its the third time that nbi did it...

 

but i experinced it onced... yes they found what they want ... compiscating 5 station that has the porn materials...

almost 20 agents and a female attorney and i think they call her atty. De Cafort not sure with the spelling but sounds something like that.. and they put us in the pantry while they search. the room...

 

after an hour after they they talk to the owner Mr. Joel Aquino.. they let us continue our stuff... and go out... i think theres a payment that occur...

hmmm...bribes? there's more reason for you to fight this.

 

i guess that's why they keep changing their names.

 

did some investigating...the first name they started out w/ is tulinonline.

 

you could start your research based on this.

 

when the time comes you may need this info.

about the names of the company.. well although we are in the same room staff there do have different comapany.. like my contract is in netpros.. others are in mytuscanny, some are in vesromina..

i think it has something to do with the tax of the company.. having a smaller and new comapany makes them to pay a smaller tax.. i think...

@fryxxter: i sympathize with you; you just need peace of mind.

 

anyway, having different & small companies have tax incentives.

 

btw, its required that they give employees their itr.

 

do they declare most of your salary as allowances?

 

another option is to go to the media or dole; i recommend inquirer.

 

 

yup about the itr thing.. i already requested it when im still in good terms with them... because im planning to get a credit card and one of the requirements is the ITR but they didnt issue it to me... thats the reason why i start to think of leaving the company...

 

according to my payslip its salary... and not allowance, but i think they use allowance for new trainees

that's highly irregular.

 

it would be wise to document all of these as evidence.

 

yup i agree that this comapany did something irregular like the contract i signed on... all they expalined to me is that they will going to deduct a cash bond for the training cost, and after a im not allowed to resigned within a year after the date of my reglarization...

 

that seems quiete different from other comapny....

 

all the documents i have are all intacked and can be used as needed..

all i need is an advice from an expert in legal affairs like you sir webmaster... wish you more power

I once worked in a call center. Malaking issue at that time ang night differential ng mga employees. Luckily may night diff naman at that time when I was still at the company. Pati ang HR office agree sa amin na dapat lang na may night diff, and pinagtanggol pa kami sa management. Ang main reason namin was "nasa Labor Code". So we (employees) enjoyed our night diff.

 

According to the government website, night differential pay is described as:

 

B. Minimum Night Shift Pay

 

* Every employee is entitled to a night shift differential or night shift pay of not less than ten percent (10%) of his regular wage for each hour of work performed between 10:00 o'clock in the evening and 6:00 o'clock in the morning.

* If overtime work or work in excess of eight (8) hours falls within the aforesaid period, premiums for overtime work should first be integrated into the regular hourly rate of the employee before computing night shift pay.

 

 

however..

 

Now that I am running a BPO company problema na ang night diff na yan. Gusto ko tangalin ang night differential na yan since ang regular work hours ng mga personnel ko is during our client's working hours, particularly at night. tindi kasi ng percentage para salary eh.. +10%.

 

I know the side of the employee and know the main reason that it is in the Labor code. However, the labor code was not designed with BPO graveyard shifts in mind. malulugi ang BPO companies dahil sa night diff na yan. Aside from the night diff ay ang holiday pay, since ang work ng BPO industry follows the client's calendar. Mahirap ang magpa force leave; also another issue in my previous company.

 

question ko ay what other compensation can I give my employees instead of the night diff, or how do I circumvent this night diff altogether?

as of now its still the notice.... that they want me to pay sa training cost plus damages....

 

 

as of now i just ignored it.... because i dont want to spend money for it

 

but i still want someone to expound and explain things in legal terms....

 

like what will happen if they pursue it... what legal article can they use agains me..? the last time we spoke is they tell me that they will charge me with bridge of contract and neglegence + damages
