Ito naman po iba naman.. but would help me a lot talaga..

Could anyone explain further what is complex crime and compound crime.. what is the example for both? When does a complex and compound crime apply and when do they NOT apply? THANKS PO ULI.

nag-a-asikaso ako ng papel ng lupa. tapos na po itong bayaran sa developer ng subdivison pero hindi pa rin ito na-transfer sa pangalan ng nakabili. 1985 pa ang date ng contract to sell. Pinakita ko sa BIR para ma-compute ng capital gains pero kailangan nila ma-verify yung authenticity ng contract to sell dahil nga sa sobrang luma na. Tinanong ko sila kung san ko pwede to gawin, sabi nila pa-archives ko raw sa National Library. Nagpa-archives ako sa National Library ngunit wala silang nakita doon.

 

Ano po ang ibig sabihin nito. Hindi po ba authentic yung hawak kong Contract to Sell? Anong governement office ang nagtatago ng mga Notarized Documents? Yung lugar ng abogado na nakalagay sa Notaryo ay Manila, meron kaya ito sa Manila city Hall? Sa mga abogado na nag-no-notaryo, san nyo dinadala yung mga na-notaryohan nyo? Thanks!

pwede ko po ba sha ipapulis sa kasong estafa? or sa breach of contract? or kahit anong kaso?

Anyway, Complex Crime occurs when a single act constitutes two or more grave or less grave felonies or when an offense is a necessary means for committing the other (pls refer to art. 48 ata ng RPC).

 

So it means that there are at least two crimes involved in a complex crime; either two or more grave of less grave felonies resulted from a single act, or an offense is committed as a necessary means for committing another.

 

There are two kinds of complex crimes, to wit:

 

1. Compound crime or one by which a single act constitutes two or more grave or less grave felonies; and

 

2. Complex crime proper by which an offense is a necessary means for committing another. Please take note that necessary does not mean indespensible.

 

Hope that now u can at least get an idea.

Again for humanity's sake, magdemand ka muna sa kanya. Notice and demand is important kasi kahit ung umutang ay may karapatan p rin. Kahit n may kasunduan kau kung kelan sya dapat magbayad, it will be better if u make demands to the person.

 

As to the question of imposing interest, that is legal and it seems both of you agreed to impose the same.

 

May guarantor b yan? Suggest na next tym manghingi k n ng guarantor man lang para hindi k ganyang namomroblema.

Legal rin ang kasunduang ginawa ninyo.

At pwede itong maging basehan kung sakaling kailanganin mo nang maghabol sa korte.

Bigyan mo muna ng tinatawag na demand letter; yung sinisingil mo siya.

Pag wala pa rin, get a lawyer na.

Ang tawag sa kaso ay Collection for a Sum of Money.

Pahabol lang po. So may mga provisions pa dun sa kontratang galing sa bangko na makakaapekto as far as Maceda Law is concern at hindi basta2 ko makukuha ung 50% ng payments ko?

 

As far ar Republic Act No. 6552 is concerned, you should be entitled to 50% of the installment payments you have made. Likewise, before they can cancel your contract to buy, you must be notified of the cancellation by a notarized notice of cancellation and by payment to you of the 50% cash surrender value. Kung wala yun, walang bisa dapat yung pagbenta nila sa iba nung lupa.

 

My only problem is, without looking at the documents between you and the bank, di tayo nakakasiguro talaga kung ano ang relationship nyo ng bank at kungt ano ang provisions ng contract nyo. My advise is: get all the necessary documents and consult a lawyer, para di ka gumastos, pwede kang pumunta sa Integrated Bar of the Philippines dun sa munisipyo o city na tinitirhan mo. Puwede ka ring pumunta sa Public Attorney's Office (tanong ka sa pinakamalapit na Hall of Justice kung saan ang mga ito)

hi, patulong lang. nakabangga ako ng tricycle. amputate ang third part ng left pinky finger niya ( yung buong kuko and 1/2 inches from the top pinutol) sinagot ko yung hospital and some medicine bills... gusto niya una out of court settlement ng 40,000 sabi ko wala ako ganayn kalakaing pera. sa insurance ko nalang pinasok, ngayon humihingi na siya ng 100,000pesos. or else mag file siya daw ng case... pero the other day, wala na siyang gamot, humihingi ng 10,000 ang lawyer niya... ano dapat gawin? insured naman yung car ko... thanks...

Maceda law applies to sale or financing of real estate on instalment payments. Without seeing the documents evidencing your transaction with the bank, di natin masabi kung ito nga ba ay sale or financing of real estate on instalment payments. If your contract with the bank is really sale or financing of real estate on instalment payments, di dapat maaapektuhan ng contract ang provisions ng Maceda Law. Kaya nga lang, kung di naman siya sale or financing of real estate on instalment payments, di applicable ang Maceda Law (baka kasi pinalabas ng bangko na loan with real estate mortgage). Da best talaga, pakita mo sa abugado ang papeles mo, me mga libre naman diyan

The pertinent law here is the Family Code, to wit:

 

Art. 210. Parental authority and responsibility may not be renounced or transferred except in the cases authorized by law.

 

Art. 211. The father and the mother shall jointly exercise parental authority over the persons of their common children. In case of disagreement, the father's decision shall prevail, unless there is a judicial order to the contrary.

 

Children shall always observe respect and reverence towards their parents and are obliged to obey them as long as the children are under parental authority.

 

Art. 212. In case of absence or death of either parent, the parent present shall continue exercising parental authority. The remarriage of the surviving parent shall not affect the parental authority over the children, unless the court appoints another person to be the guardian of the person or property of the children.

 

Art. 213. In case of separation of the parents, parental authority shall be exercised by the parent designated by the Court. The Court shall take into account all relevant considerations, especially the choice of the child over seven years of age, unless the parent chosen is unfit.

 

Art. 214. In case of death, absence or unsuitability of the parents, substitute parental authority shall be exercised by the surviving grandparent. In case several survive, the one designated by the court, taking into account the same consideration mentioned in the preceding article, shall exercise the authority.

 

So pag wala dito ang isa, sa naiwang asawa ang mga anak.

Pwedeng ma-suspend ang parental authority pero I don't think they will apply to your case.

Hindi kasi enough ang financial reason lang to deprive a mother of custody over her children.

 

Art. 231. The court in an action filed for the purpose in a related case may also suspend parental authority if the parent or the person exercising the same:

 

(1) Treats the child with excessive harshness or cruelty;

(2) Gives the child corrupting orders, counsel or example;

 

(3) Compels the child to beg; or

 

(4) Subjects the child or allows him to be subjected to acts of lasciviousness.

 

The grounds enumerated above are deemed to include cases which have resulted from culpable negligence of the parent or the person exercising parental authority.

 

If the degree of seriousness so warrants, or the welfare of the child so demands, the court shall deprive the guilty party of parental authority or adopt such other measures as may be proper under the circumstances.

Hindi tama yun, dapat pareho ang treatment, kung ang kasal ay automatic nilang nire-register, dapat ganun din ang unmarried (although baka kasi papayag yung father nung illegitimate to recognize and have his surname used by the child and there might be some other documents that will have to be accomplished).

Not by the family, it should be the guy himself impugning (contesting) the paternity of the child. The family are third persons to this dispute (they can only file in case the purported father dies - see Art. 171, Family Code which should apply by analogy)

 

3) what kind of lawyer do you go to (anong specialty? family law, meron bang ganun?) when you want such things corrected? kung na-issue-han na din kasi ng birth certificate yung baby (tho sa bagal ng census natin, baka next month pa yun kasi she was born this month lang), will her parent have to appear in court for a change of whatever (her biological father is already dead)?

 

Any practicing lawyer should be able to do this, although mas maganda kung especialista sa civil law. Siyempre lalabanan ng ina yung kaso (palalabasin mo ba namang walang ama yung bata) kaya magpapakita yun (di lang ito kaso ng correction ng birth certificate, ito ay impugning the filiation of a child). Anyway, kung di siya magpapakita, kailangan pa ring patunayan na di nga yung lalaki yung ama. Mas maganda kung sa blood test pa lang makita na na di siya ang ama (para menos gastos), otherwise kailangan nyan ng DNA testing to show na di siya ang ama

Ang notaryo publiko ay dapat kumukuha ng kopya nung dokumentong ninonotaryo niya. Ang pwede mong gawin, hanapin mo yung abogadong nagnotaryo at ipacertify mo sa kanya (ipapaxerox mo tapos tatatakan lang niya ng "Certified True Copy" tapos pirma niya).

 

Tapos, sinusurrender din ng mga notaryo ang kanilang libro at documents sa Regional Trial Court. Pwede kang pumunta sa Notarial Section ng Manila para magtanong tungkol sa dokumentong yan at sa nagnotaryo nito (although sa dami ng dokumento sa notarial section ay nakabodega ito at inaayos pa nila hanggang sa ngayon - pero malay mo)

 

Kung pwede rin naman, kausapin mo yung Developer (tutal fully paid na, sabi mo) at kung payag sila, pagawin mo na lang sila ng Deed of Sale kung saan ibenebenta na ng Developer yung lote sa nakabili (para di ka na naghahanap ng Contract To Sell), tapos itong Deed of Sale ang ipakita mo sa BIR.

Mahirap sabihin kung magkano ang reasonable na amount for annulment, depende kasi ito sa maraming factor. Tsaka, di rin natin alam kung ano ang ground mo para ipa-annul yung kasal (annulment ba o declaration of nullity), tumataas at bumababa din ang expenses depende sa ground.

 

Anyway, I have yet to hear of a marriage being declared null and void on the ground of psychological incapacity (kung walang ibang depekto ang kasal, usually ito ang gagamiting batayan ng kaso) for less than P100,000.00

 

The usual factor that will affect the cost will be the lawyer (e.g. kung mga sikat na lawyer katulad ni Katrina Legarda ang kukunin mo, baka kulang pa ang kalahating milyun. Kung bagong pasa lang sa bar, baka pumayag na sa 50mil, depende). Ask around. Ang importante, competent ang lawyer na makukuha mo.

 

First, anong klase ba ang kaso mo (lalabanan ka ba ng kabilang partido o di na ito magpapakita - pag di na lalaban baka di mo na kailangan ng abugado de campanilla; malakas ba ebidensya mo o nedyo kailangan pang hilutin - pag malakas, di mo rin kailangan ng magaling na magaling na abugado)

 

Pangalawa, ilang taon na ba siyang nagprapraktis (kasi pag bago talagang pagprapraktisan ka niyan) at ilang kaparehong kaso na ba ang nahawakan niya (ano ang resulta ng mga kasong ito)

 

Pangatlo, ano ba ang sinasabi ng ibang tao tungkol sa abugadong yan

 

Pang-apat, ano-ano ba ang babayaran mo (kailangang klaro para di kayo nagkakasamaan ng loob later on, dapat walang hidden cost)

 

Panglima, pagkatapos nyong mag-usap nung abugado, OK ba siya sa iyo, do you feel comfortable and confident with the lawyer
