Issuing a bank guaranty to a seller of real estate is standard practice for banks. The bank wants to make sure that the REM can be annotated before it releases the loan to the borrower/buyer of the property and that the proceeds go directly to the seller. Once the REM is annotated on the title, the bank should release the proceeds to you, the seller, immediately, which I would say within three (3) banking days is considered reasonable. The bank guaranty should state that these are the only conditions (transfer of title plus REM annotation) for them to release the proceeds to you. The bank guaranty is therefore as good as the bank issuing it. For your protection, deal only with reputable banks, and if possible, ask for an undertaking from the buyer that he will return to you the title still in your name free from any liens or encumbrances and reimburse you for any expenses should the loan not be released by the bank for any reason.

I had asked buyer to request the bank to have the loan disbursement conditioned on my turnover of signed Deed of Sale and surrender of title,tax dec,RE receipts and other pertinent documents. Bank has not favorably responded. I guess the Bank, a reputable one, will not be inclined to veer away from the standard terms of their bank guaranty. Thanks a lot for your comments and the heady advice to seek a buyer undertaking for return of title and reimbursement of expenses should bank fail to release loan to me.More power to you

im not a lawyer, but i think the school has the right to do this to preserve their morality stance.

and yes, i think she has to transfer to another school, dahil maski andun pa sya, o i-allow sya mag enroll next sem, di na rin nya makakayanan ang intriga, which which result in her being defocused. aalis at aalis din sya dun.

 

each school or institution kasi has its own guidelines na kailangan ding i-observe, outside of the legal system. ngayon, if she feels that her rights are violated, then its another story. siguro, pwede syang maghabol dun sa school for damages, pero dapat wala na sya dun.

 

its like this.... pag nagwowork ka, tapos ginagagu ka ng mga tao sa office nyo up to the point na bagsak na moral mo, and hindi ka na makafunction normally, then its time to go. you can still go after the company, although it will take lots of your resources, for damages. pero sino ang talo? ikaw din.

 

imho lang ha? and i repeat, i am not a lawyer.

Well, you know how banks are. They will not deviate from their operational policies unless you're a VIP or capable of making a big stink, especially if they are among the top five. Good luck with your transaction.

i have a question about placing an ad :)

 

The exterior wall of our office is facing a. bonifacio, i plan to put up a tarpoline ad of our company..

 

1. Is there a charge ba if i place an ad? like tax or something.

2. If yes, what's the maximum limit allowed so i wouldn't be charged. plan ko kasi 3mx3m lang :)

Punta ka sa City hall kung saan naka-locate business mo at doon nyo po malalaman kung pwede pong maglagay ng tarp, kung magkano ang eksaktong buwis na babayaran ninyo at kung ano-ano ang regulasyon nila (tulad ng limitasyon sa sukat) sa paglagay ng ads / tarp / signage (whatever)

sa mga lawyer may tanong po ako

 

may isang lalake edad 19 at nakipagrelasyon sa isang babae, edad 16. sa una, tulad ng normal na relasyon, pa-date-date lang, hanggang sa umabot na sa nagsex na sila. ang babae, sa hindi ko alam ang dahilan, nagustuhan ng sumama sa lalake, as in "live-in". nalaman ito ng mga magulang ng dalawang partido at napagusapan at napagkasunduan na magsama sila sa bisa ng isang kasunduan na nilagay sa kasulatan. Ang kasunduan ay nagbibigay pahintulot sa dalawa na magsama na parang mag-asawa at kapag dumating na sa edad 18 ang babae ay dapat ay pakasalan sya ni lalake. Lumipas ang panahon at tulad din ng mga normal na relasyon, dumating sa kanila ang hindi pagkakaunawaan at naglaon, naghiwalay sila. Samakatuwid, hindi nagampanan ng lalake and kanyang kasundaan sa babae dahil naghiwalay na sila. Ngayon 2007, may planong magpakasal ang lalake sa ibang babae at nalaman ng patido ng babae ang plano nito. Nagbanta sila ng demanda. sa una ang kaso nila ay hindi pagsunod ng kasunduan o "breach of contract". Nung maglaon, may nagpayo sila na pwedeng kasuhan ang lalake ng "statutory rape" dahil minor de edad pa ang babae at may nangyayari na sa kanila ng sekswal.

 

Ito po ang mga tanong ko:

1. Pwede po bang kasuhan ang lalake ng "breach of contact" kung ang kasunduan naman ay hindi na-notaryohan ng abogado? Kung ngayon taon (2007) lang na-notaryohan ito dahil sa karasunan gagamitin sa kaso, pwede po ba ito? Legal po ba ang nabanggit kong kasunduan na gagawing kasunduan ay ang pagpapakasal sa babae sa takdang panahon kahit may posibilidad na pagdating ng panahon na ito ay hindi mo na gusto ang babae at mapipilitan ka na lang gawin ang kasunduan?

2. Pwede po bang kasuhan ang lalake ng "statutory rape" dahil minor de edad ang babae ng magsex sila? May pahintulot naman po ang kanilang aksyon dahil ang mga pumirma sa kasunduan ang mga magulang ng babae at lalake. Wala pong pagpipilit na gawin nila ang kasunduan at nagkaproblema lang nang hindi na gumanda ang relasyon ng babae at lalake at magpapakasal si lalake sa ibang babae.

gusto ko lang po sana mag consult about sa products (airconditioner).

actually im on the side of the manufacturer. one of our costumers complaints her product

when its was about 2 months old. (the unit is already 1 year today)

 

we had several series of repairs and services and even turned to

replacements, sometimes po ok ang unit which was intalled to the computer shop

 

but due to the fact na meron lapse sa isa sa mga service centers namen na naginstall,

kinuha na namen yung burden to solve the problem. pero kapag nagook ang unit, tapos

within 2-3 months tatawag para magreklamo. then babalikan namen to service the unit.

 

almost 15 backjobs na yung nagawa namen, until today. so bale dumating na yung point

na nagrereklamo na para sa "refund" yung customer. pero meron kasi company policy

na walang refund eh, pero papayag na 50% from the acquisition cost na lang ung unit kapag

iinsist ng customer which ayaw talaga. we had to offer the customer another alternative

which is to "upgrade" na lang to higher capacity. pero ngayon galit na galit na yung customer

gusto talaga full refund. ako naiipit since empleyado lagn ako pero ako yung medium between

the company and the customer eh, kaya ayun po.

 

meron na threat yung customer na magdedemand na at ipapasagot lahat ng gastos including

moral damages samen, natatakot po kasi ako at nahihiya sa customer.

1. Hindi ito pwede dahil illegal ang contract na yun dahil contrary to law and morals. Anumang kontrata po ay di pwedeng maging labag sa batas, moralidad, good customs at public policy. Bunga nito, hindi pweng maghabla nang ang basis ay isang illegal na kasunduan o kontrata. At walang kinalaman sa puntong ito kung naka-notaryo man o hindi ang kasunduan.

 

2. Hindi siya pwedeng kasuhan ng statutory rape dahil ang ganitong kaso ay pwede lamang sa mga batang edad 12 at pababa. Pag 12 pataas hanggang 17 ang edad, ang kaso ay Simple Seduction kung may pandaraya o deceit na ginawa ang lalaki para maka-sex ang babae.

 

3. Kung may deceit na gaya ng nabanggit na, pwede ang kasong Simple Seduction. Pwede ring civil case for damages based on breach of promise to marry batay naman sa Article 21 ng Civil Code. Dahil ito'y kasong sibil lamang, hindi makukulong ang lalaki. Pagbabayarin lamang siya ng danyos o damages batay sa hihingin ng nagreklamo.

 

Art. 21. Any person who wilfully causes loss or injury to another in a manner that is contrary to morals, good customs or public policy shall compensate the latter for the damage.

Look at the terms of the sale ulit. Hanggang saan ba ang warranty ng company? Even then, you may have done more than what may have been written there. Anyway, it's the company's liability, not yours personally.

 

From the consumer point of view, of course, he can opt to sue the company. That option is always there for him. And that's the beauty of our justice system because if he sues you, you will be given the opportunity to air your side and the issue would be finally put to rest. If the consumer abuses his rights under the law, manufacturers are likewise given remedies with which its rights are protected.

If I may...

 

Under Art. 338 of the Revised Penal Code "simple seduction" is he seduction of a woman who is single or a widow of good reputation, over twelve but under eighteen years of age, committed by means of deceit, shall be punished by arresto mayor (1 mo and 1 day to 6 mos). Of course, under the provisions of the RPC, seduction is committed when the offender has carnal knowledge of any of the persons and under the circumstances described herein.

 

Tungkol naman sa "deceit," ito ay isang bagay na dapat ma-prove through evidence na nag-eexist at that moment when you supposedly entered into the so-called contract. but in any case, the same is contrary to laws and morals as to give one's self is not the proper subject of a contract and that the same is contrary to the fundamental principle that one may not be forced to do something he refuses to do subject to certain exceptions.

 

as for being forced to enter into marriage based on the said "contract", even assuming na valid to, one cannot be forced to marry another based on the same as the necessary element of consent in entering into a marriage contract would be defective. caveat though is that when the said 'contract' or 'promise' was done in bad faith (as in may asawa ka na and thus cannot possibly enter into another marriage contract unless muslim ka), damages may be collected. plus, the following premise when coupled with the fact na abugado ka...sad to say, lagot ka! hahaha.

legal assistance on meritorious cases.

 

B. Public

If you are complaining in a labor case(a case against your employer) - your complaint may be received for arbitration but if no settlement is reached, the Labor Arbiter may refer you to a lawyer for free assistance.

But in all instance, there is no such thing as absolutely "free" legal service. You will have to spend for the costs of documentation (paper works), court costs and fees, transportation, etc., etc., while your case is being attended to by your lawyer.

One of our new members needed help. Below is so far information I obtained from her.

 

1. Meralco has threatend to sue them if they do not pay P90K for allegedlly tampering with the meter. Apparently, her family was told that the seal was broken hence tampered.

2. As far as the household members are concerned, they have not tampered the meter and that the seal was broken due to natural causes.

3. Our new member is now contemplating to become a psp just to pay off the 90K becuase she is afraid that they will go to jail should they fail to pay up.

 

For me, this is a great injustice to her. I have nothing againsts psps. But if a person left no option but to sell her body for a violation that is not proven beyond reasonable doubt, I strongly feel against her decision and beseech admirable MTC members who are part of the justice system to help our fellow members and save her from such injustice.

sa lahat ng Lawyers who may have answers to this:

 

Meron po kasi ako dating hinuhulugan na rowhouse sa bacoor, Cavite then, nung mawalan ako ng trabaho, natigil yung pagbabayad ko. May katagalan na rin akong hindi nakakapagbayad.

 

Binabayaran ko siya noon sa Asiatrust bank. Bale, ang sistema, binayaran siya ng bangko sa developer tapos ako ngayon ang nagbabayad sa bangko. Mahigit po sa 2 years ko siyang binayaran sa bangko.

 

Last year, tinawagan ako ng Asiatrust tungkol sa mga arears ko, and they are telling me na forfeited na raw ung property na binabayaran ko kasi nga hindi na ako updated sa pagbabayad at kung gusto ko raw, bayaran ko ng P120 thousand ung property pero ang sabi ko, wala akong ganoon kalaking pera, so ang sabi ni bangko, ibebenta na raw po yung property. Lately nalaman ko na lang may nagpapagawa na dun sa bahay. Tinawagan ko po ung bangko at sinabi ko sa kanila na wala akong natanggap na notice of cancellation galing sa kanila, so sabi ko illegal ung pagbebenta nila ng property.

Meron pa po ba akong habol sa mga naibayad ko na as far as Maceda Law is concern?

 

Baka pwede naman po ninyo akong mabigyan ng further information sa kung ano ang habol ko at sa kung ano pa ang pwede kong gawin kung may mahahabol pa ako.

Meron kaya akong chance na mapunta sa akin yung custody ng dalawang anak ko aged 5 and 3 kung yung mother nila eh nde capable na bigyan sila ng magandang buhay...I was sending them an average of 30k a month pero kinakapos pa din...nde pa naman kami annuled pero may chance kaya na mapunta sila sa akin or dahil nga nasa abroad ako sa parents ko sila mag stay.

And I don't see how they can make you liable for lost future income ng victim, unless kelangan niya sa trabaho niya ang tatlong toes na nawala.

The pertinent law here is the Family Code, to wit:

 

Art. 210. Parental authority and responsibility may not be renounced or transferred except in the cases authorized by law.

 

Art. 211. The father and the mother shall jointly exercise parental authority over the persons of their common children. In case of disagreement, the father's decision shall prevail, unless there is a judicial order to the contrary.

 

Children shall always observe respect and reverence towards their parents and are obliged to obey them as long as the children are under parental authority.

 

Art. 212. In case of absence or death of either parent, the parent present shall continue exercising parental authority. The remarriage of the surviving parent shall not affect the parental authority over the children, unless the court appoints another person to be the guardian of the person or property of the children.

 

Art. 213. In case of separation of the parents, parental authority shall be exercised by the parent designated by the Court. The Court shall take into account all relevant considerations, especially the choice of the child over seven years of age, unless the parent chosen is unfit.

 

Art. 214. In case of death, absence or unsuitability of the parents, substitute parental authority shall be exercised by the surviving grandparent. In case several survive, the one designated by the court, taking into account the same consideration mentioned in the preceding article, shall exercise the authority.

 

So pag wala dito ang isa, sa naiwang asawa ang mga anak.

Pwedeng ma-suspend ang parental authority pero I don't think they will apply to your case.

Hindi kasi enough ang financial reason lang to deprive a mother of custody over her children.

 

Art. 231. The court in an action filed for the purpose in a related case may also suspend parental authority if the parent or the person exercising the same:

 

(1) Treats the child with excessive harshness or cruelty;

(2) Gives the child corrupting orders, counsel or example;

 

(3) Compels the child to beg; or

 

(4) Subjects the child or allows him to be subjected to acts of lasciviousness.

 

The grounds enumerated above are deemed to include cases which have resulted from culpable negligence of the parent or the person exercising parental authority.

 

If the degree of seriousness so warrants, or the welfare of the child so demands, the court shall deprive the guilty party of parental authority or adopt such other measures as may be proper under the circumstances.

Ans. A and B’s marriage is void ab initio. A and C’s marriage is VALID.

A and B’s marriage, being void from the beginning (against public policy art 38) does not give any impediment to the marriage of A and C. The provision on Art 40 that there must be a final judgement on the nullity of the previous marriage are only for purposes of remarriage on VOIDABLE marriage only, thus, not needed on a marriage void ab initio.

Ito po ay walang bisa mula pa sa simula (void ab initio). Ayon sa Art. 38(1) ng Family Code, ipinagbabawal ang kasal sa pagitan ng mag-pinsang buo (dahil sila ay relatives within the 4th degree of consanguinity). Ang kasal sa malalapit na kamag-anak ay di sang-ayon sa pampublikong patakaran

Pag nagdeklara ang korte na walang bisa ang kasal, yun ang sinasabi nating absolute nullity na nung kasal. Alalahanin mo lang na dalawang klase ang walang bisang kasal, yung voidable at yung void ab initio. Yung void ab initio, pag dineklara ng korte na walang bisa mula sa simula, parang never na nakasal yung dalawa (dahil wala nga siyang bisa mula sa simula). Yung voidable, pag dineklara na ng korte na walang bisa, absolute nullity pero dahil ito ay voidable lang, may bisa ito nung di pa naidedeklara na walang bisa. Sabi nga sa una, ang annulment ay tumutukoy sa "voidable" marriage, habang "declaration of nullity" naman ang para sa kasal na void ab initio.

As far ar Republic Act No. 6552 is concerned, you should be entitled to 50% of the installment payments you have made. Likewise, before they can cancel your contract to buy, you must be notified of the cancellation by a notarized notice of cancellation and by payment to you of the 50% cash surrender value. Kung wala yun, walang bisa dapat yung pagbenta nila sa iba nung lupa.

 

My only problem is, without looking at the documents between you and the bank, di tayo nakakasiguro talaga kung ano ang relationship nyo ng bank at kungt ano ang provisions ng contract nyo. My advise is: get all the necessary documents and consult a lawyer, para di ka gumastos, pwede kang pumunta sa Integrated Bar of the Philippines dun sa munisipyo o city na tinitirhan mo. Puwede ka ring pumunta sa Public Attorney's Office (tanong ka sa pinakamalapit na Hall of Justice kung saan ang mga ito)

Last year, tinawagan ako ng Asiatrust tungkol sa mga arears ko, and they are telling me na forfeited na raw ung property na binabayaran ko kasi nga hindi na ako updated sa pagbabayad at kung gusto ko raw, bayaran ko ng P120 thousand ung property pero ang sabi ko, wala akong ganoon kalaking pera, so ang sabi ni bangko, ibebenta na raw po yung property. Lately nalaman ko na lang may nagpapagawa na dun sa bahay. Tinawagan ko po ung bangko at sinabi ko sa kanila na wala akong natanggap na notice of cancellation galing sa kanila, so sabi ko illegal ung pagbebenta nila ng property.
