now medyo nagkakalabuan kami i was trying to take back my passbook pero ayaw po nya ibigay n

lagi nagtatago sa akin.

 

ano po ba ang legal way para mabawi ko ito o ma withdraw man lang iyung pera ko?

puede po bang mag pa lost passbook ako or mas meron pang legal way, magbabakasyon po

ako this month at gusto kong makuha na ito o ma withdraw ang amount

 

please help naman po !!

 

If it is a joint 'and/or' account, just simply withdraw the money. If it is joint 'and' account, you can't withdraw without the signature of your co-depositor.

ang sobrang ingay ay "nuisance" na maaring ipatigil.

 

pero para di ka na gumastos ng malaki, magtanong ka sa homeowner's association kung meron rules ang association na nagco-cover dito. kung meron, yung ang gamitin mo.

 

kung wala, baka may system to settle disputes between neighbors ang ass'n, itanong mo na rin, at tingnan sa by-laws.

 

kung sasabihin ng ass'n na wala silang magagawa, sa barangay ka magreklamo. dapat me magagawa ang kapitan, o di kaya ang lupong tagapamayapa, tungkol diyan (lalo at mag-eelekson na naman sa barangay).

 

kung walang mangyari sa brgy., bibigyan ka ng Certification to File Action" at pwede ka na maghabla sa korte para ipatigil yang maingay mong kapitbahay. pwedeng civil case for TRO and injunction or criminal case for violation of Art. 155 of the Revised Penal Code (alarms and scandals)

 

is there any legal action that can be taken against noisy neighbors? by the way these people are not part of the home owners association they are just renting the place... they are not the owners... thanks

My friend married his girlfriend two months ago and they discovered recently that his former live-in partner of whom he has four kids with carried his surname in the birth certificates, even if they were not married.

 

Is there any legal implication? Are the kids still considered illegitimate?

so long as your frined and his former live-in partner never married each other, their children will be illegitimate.

 

the use by the four kids of their father's surname has no effect on their status as illegitimate children.

imo, something's wrong with our legal system as there are no illegitimate children. only illegitimate couples. too bad in our society, the children by law are considered illegitimate!

pwede itong ipa-walang bisa. Lamang, kailangan niyang pumunta sa korte. At ang grounds niya, sa ilalim ng Art. 166 ng Family Code, para ipawalang-bisa ito, ay ang mga sumusunod lang:

 

(1) That it was physically impossible for the husband to have sexual intercourse with his wife within the first 120 days of the 300 days which immediately preceded the birth of the child because of:

(a) the physical incapacity of the husband to have sexual intercourse with his wife;

(B) the fact that the husband and wife were living separately in such a way that sexual intercourse was not possible; or

© serious illness of the husband, which absolutely prevented sexual intercourse;

(2) That it is proved that for biological or other scientific reasons, the child could not have been that of the husband, except in the instance provided in the second paragraph of Article 164; or

(3) That in case of children conceived through artificial insemination, the written authorization or ratification of either parent was obtained through mistake, fraud, violence, intimidation, or undue influence. (255a)

 

Kung nakatira siya sa bayan kung saan ni-rehistro yung bata, may isang (1) taon siya mula sa pagrerehistro upang gawin ito. kung nakatira siya sa isang bayan na iba sa bayang pinagrehistruhan ng bata, may dalawang (2) taon siya. at kung siya ay nasa abroad, tatlong (3) taon.

ngayon, kalimitan ayaw umamin ng mga partido na sila ay hindi kasal sa isa't-isa at na kabit lamang si babae. ang gagawin, palalabasin na sila ay kasal sa isa't-isa. pag nalaman ito ng tunay na asawa, maaari pa silang makasuhan ng falsification of public documents. ang masasabi ko lamang ay... mag-iingat kasi!

guys, an illegitmate child was born and was acknowledged by the father, would it follow that the child may use the surname of the biological dad?

if so, if the mom does not want the kid (super minor) to use the dad's surname, is there a process to revoke or revert it so that the kid will remain using the mom's surname? thanks

My fiancee and I are planning to get married secretly (without the knowledge of her family and friends) this March and we don't know what the requirements are if the couple are resident aliens residing permanently in the Philippines (I was born here while my girlfriend came here last 1995.) The both of us have our ACR/ICR or which is now known as the I-Card.

 

1. Do I still need to procure a copy of my birth certificate and CENOMAR at the NSO?

2. Do we still need to secure a copy of the "parental advice" since she's only 23?

3. Can we just procure copies or our legal capacity to marry at our respective consulates?

4. Can we just execute affidavits if we don't have the time to request for copies of our legal capacity to marry at our respective consulates?

5. What is the expected budget for a civil wedding to be held in secret in the Philippines for resident aliens or foriegn nationals?

thanks sa advice... by the way na report ko na ito sa HOMEOWNERS association namin at naka blotter na sila... pati sa BRGY ni report ko na at nagkaroon na kami ng sitdown sa BRGY and naka record na sa logs ng BRGY. unfortunately temporarily lang na tumahimik... wala na ung blaring radio PERO nag papatugtug parin sila ng RADIO na maririnig mo parin sa loob ng bahay namin pati TV nila kahit sabihin mo ng tone down compared before sa BRGY reporting eh loud enough parin na mag invade sa home namin... and final note... ung radio, tv at malakas nilang usapan eh umaabot ng 2AM halos araw araw...

 

balak ko eh itanong sa talagang may ari ng bahay hangang kailan ang contrata nitong mga boarders nila kasi talagang maingay sila at walang paki sa oras... palibhasa kasi mga dayo at sa lugar namin kaming mga homeowners na 20 plus years ng nkatira eh pag sapit ng gabi na eh tumatahimik na.

Mga sir, ito yung case: A friend of mine has a 2 year old child and she's not sure if the father already got him a birth certificate. They're really in bad terms. They can't even agree on what to name the child. Is it possible for her to procure a birth certificate for the child and name him without the consent of the father? How does she apply for the BC? They're not married by the way.

 

She really needs to have a BC of the child ASAP. Anyone she could go to? She resides in Manila. Pwede na rin siguro sa QC samahan ko na lang. Thanks.

Fellow MTCers, need an answer for this one.

 

My Father Died last July 2008, He has an account due on PLDT worth P3.6K before he passed away. My mother decided not to settle it because wala na nga yung father ko plus fact na they had a service problem on the PLDT. last month may na recieved sila Letter from a Law Firm na my father should settle it or else may i file daw na case ang client nila which is PLDT kapag hindi na settle yung debt .

 

Tama ba yung decision ng mother ko and may rights ba ang court na habulin ang isang dead accused client.???

saan ba ipinanganak yung bata? kasi duty ng hospital na isubmit yung birth certificate sa Civil Registrar (tsaka iniipit din nila ito habang hindi pa sila bayad). kung sa midwife lang, duty rin ng midwife na magsubmit ng birth certificate. whether hospital or midwife, alamin niya muna mula sa ospital or the midwife kung sila ba ay nagsubmit na ng birth certificate sa civil registrar, kung wala talaga, late registration yan. pwede siyang pumunta sa civil registrar kung saan ipinanganak ang bata para magparehistro dun sa bata. di na kailangan ang consent ng lalaki dahil di naman sila kasal

ang utang ng isang namatay ay hindi nawawala dahil patay na siya. ito ay dapat bayaran sa pamamagitan ng kanyang mga naiwang ari-arian. lumalabas, ang mamamana nyo sa inyong ama ay ang kanyang ari-arian LESS ang mga utang niya.

 

sa madaling salita, pwedeng maghabol ang PLDT sa mga naiwang ari-arian ng inyong ama. Pero, kung wala namang naiwang ari-arian ang ama ninyo na nakapangalan sa kanya (halimbawa lupa, sasakyan, stocks), mahihirapan ang PLDT maghabol dahil wala silang ebidensya kung ano ang pag-aari ng nasira mong ama. pero kung meron, pwede talaga silang maghabol dun.

 

Note, however, that for 3.6K, malabong maghabla pa ang PLDT (dahil mas mahal pa ang ibabayad nila sa abugado at sa iba pang gastusin) lalo na na wala na nga yung kanilang hinahabol. in other words, mukhang pananakot lang ang sulat na natanggap ninyo, at di rin nila talaga ito itutuloy.

 

yun nga lang, kasabihan nga - ang utang ay dapat bayaran.

Actually, hawak daw niya ung original nung "Information sheet for live birth certificate registration" yun ba yung pinapasa sa Civil Registrar? Our Lady of Lourdes Hospital daw sa Manila. So punta na lang sa Civil Registrar sa Manila City Hall?
