Tip: Dim the lights the darker the better, I'm thinking peeping vcd pornographers wont bother publishing a scene that is not worth taping (ie lighting is too low and the cam hardly sees anything). Maghahanap or maghihintay nalang sila ng iba where there is good light.

I heard stories of hidden cameras. Question ko lang, can you sue the management of the said establishment if ever you prove na kinuhanan ka ng hidden camera while having sex. MTC Lawyers need your reply!

hmmm.. d ako lawyer pro im planning to study law aftr my grad nxt year. i think u can sue them,against sa privacy kc ng isang tao un eh. dba kya tyo ngppunta sa gnung place is bcoz to get some privacy? consult some lawyers or law studs,i think gn2 rn issagot nla

ako, graduate n ako ng law and m currently reviewing for this year's bar exams. well u can definitely sue them in a civil action for damages. Theoretically, pwede talaga un. Pero on the practical aspect, malalaman ng buong madla na nakuhanan ka ng video sa motel kase ang court records are public records that can be viewed by anyone. so, by suing, u practically tell the whole world na ikaw un nasa video. so, u better not. :D

on the issue re: hidden cams....

 

no place is safer than ur own home guys but be sure na isa lang dadalhin o dun (yung legal lang)......... for other stuffs... try their house...

 

if it's inevitable, and u must use a motel.... just turn of the lights.... if u still feel uncomfty with hidden cams.... MAGTAKIP KAYO NG KUMOT.......

as to the legal issue....

 

let's start.... suability vs. non-suability

 

motels generally are privately owned... and the relationship of the management and the customer is lease..... therefore it is contractual even though not in writing coz it need not be in writing........ in this sort of contracts, it includes implied warranties by the management.... see art. 1654 of the civil code, therefore it is a breach of contract.........

 

as to the cause of action....

 

you may either file an action for damages(moral not actual, obviously) under art. 2217 of cc in relation with art. 19, if and only if there is evidence that it was sold to the public....

 

 

constitutional issue....

 

in one case it was held that the use of a hidden cam was lawful.... however this is not without limitations..... if it is in furtherance of the security of the person or establishment , as the case may be, the owner may, utilize such device to serve the purpose....

 

criminal aspect.......

 

hmmmmm.. no case in point yet about this (only my opinion, if there is, kindly search for it) .... of course there is intrusion of the rights of the customers.... however, if there is no law that punishes it... then.... they are free to do it anytime, anyday.... to deprive them of such right is to deny them of their right to property.....

 

i havent read the law on cyber crimes... i am not sure if they also tackled electronic devices...

 

the anti-wire tapping act..... i believe it only applies to voice records and telephone conversations and subject to conditions embraced therein.... i'll check anyway....

 

possible defenses of management...

 

1) good faith

2) lack of knowledge of the installation

3) right to ownership

ME kausap akong manager ng anito na friend ko, sabi nya, MOTELS DONT PLACE HIDDEN CAMERAS JUST FOR THE FUN OF IT.

 

reason:

1. gastos lang yun, mahal din ang gamit nyan

2. pagkakakitaan ba nila yun? anong paki nila kung i-post ka na nakikipagtalik sa net?

3. legal implications....

 

but they can install if:

1. somebody asks for it

2. it is for a good reason. especially kung mga ng pa Private investigation due to infidelity, etc.

3. they are paid. (minimum 5t)

 

in other words, if you're conscience is clear, why not go there? mas matakot ka pa kung naka cell with camera ang kasama mo. :D
