cbr400rr
as to the legal issue.... let's start.... suability vs. non-suability motels generally are privately owned... and the relationship of the management and the customer is lease..... therefore it is contractual even though not in writing coz it need not be in writing........ in this sort of contracts, it includes implied warranties by the management.... see art. 1654 of the civil code, therefore it is a breach of contract......... as to the cause of action.... you may either file an action for damages(moral not actual, obviously) under art. 2217 of cc in relation with art. 19, if and only if there is evidence that it was sold to the public.... constitutional issue.... in one case it was held that the use of a hidden cam was lawful.... however this is not without limitations..... if it is in furtherance of the security of the person or establishment , as the case may be, the owner may, utilize such device to serve the purpose.... criminal aspect....... hmmmmm.. no case in point yet about this (only my opinion, if there is, kindly search for it) .... of course there is intrusion of the rights of the customers.... however, if there is no law that punishes it... then.... they are free to do it anytime, anyday.... to deprive them of such right is to deny them of their right to property..... i havent read the law on cyber crimes... i am not sure if they also tackled electronic devices... the anti-wire tapping act..... i believe it only applies to voice records and telephone conversations and subject to conditions embraced therein.... i'll check anyway.... possible defenses of management... 1) good faith2) lack of knowledge of the installation3) right to ownership Quote Link to comment

Suicide_boy
14 pages and still, no actual concrete accounts or any indications that neither proves nor disproves the existence of hidden cams in motel rooms. i'm actually considering the idea of keeping all the hanky-panky activity in the secure confines of my parked (switched off) car in the motel garage instead of in the room itself just to avoid the prying eyes of hidden cameras. For the good of the entire MTC community, we want names and places people! Quote Link to comment

For the good of the entire MTC community, we want names and places people! maybe kulang pa ata yun proof ko na it doesnt or most likely doesnt exist.... your right, doing it in your can is better.... police na lang ang bahala sayo... and who knows, nasa tv patrol ka next day pagnakunan ka ng media sa presinto. sikat ka pa. again, go to a safe, legit and clean motel. im afraid to tell this, but yung 5 star hotels pa ang me capbility magkaroon ng hidden cams as their SECURITY CAMERAS. remember, celebrities and big people ang nadun. so they really have to acquire security cams. the question is... is it properly placed??? did anybody see the show SPECIAL EDITION last night in abs-cbn? they feature a room boy sa isang run down (i presumed judging on the place) motel who admitted na namboboso sila? better check it out. bods1000
you really can't trust mirrors, you can't trust the holes in those little nooks and crannies...the best is to turn off the lights na lang, or what i do, i turn off the lights sa may bed but I turn on the bathroom light para may konting ilaw pa din...
