PBA assistant coach accused of sexual assault

09/20/2006 | 02:39 PM

A former rookie of the year awardee and currently serving as assistant coach of the San Miguel Beer team in the Philippine Basketball Association (PBA) has been accused of allegedly sexually molesting a manager of a Quezon City restaurant in July.

Based on the complaint filed before the Quezon City prosecutor’s office Wednesday, Emmanuel "Boybits" Victoria Jr. was accused of committing acts of lasciviousness against complainant Rhowannie de Leon, manager of the Zeno BMW Lifestyle Lounge located at 184 E. Rodriguez Jr Avenue, Quezon City.

In her complaint, De Leon said Victoria twice molested her on the night of July 14 and early morning of July 15 inside the restaurant.

De Leon said that while she was going around the lounge and attending to their various guests, she exchanged a few pleasantries Victoria who had just arrived then.

The complainant added that while she was talking with one of the guests, Victoria allegedly approached and embraced her from behind, and subsequently wrapped his arm around her neck.

Since he was already choking her, De Leon pleaded to Victoria not to strangle her and asked him to stop what he was doing.

But Victoria allegedly ignored the complainant’s plea, and started kissing her on the jaw and on the neck area. Victoria was also said to have whispered to De Leon that he wanted to "kiss her from head to toe" and invited her to his house.

Shocked, De Leon said she was unable to ward off the respondent until the latter finally relaxed his grip, enabling her to push him away.

De Leon then left Victoria and started conversing with other guests at another table. But the respondent went near her again, and started sending obscene messages to her mobile phone.

Worse, Victoria allegedly shouted at her in front of other guests, insinuating that De Leon would go out with old men inside the restaurant. This prompted De Leon to inform George Diploma, one of her superiors, about the incident with Victoria.

Just as De Leon was conversing with Diploma, Victoria allegedly put his arms around the complainant’s waist, grabbed both her breasts and squeezed them tight against her will.

De Leon said she was again unable to free herself from the respondent, and after a few minutes of struggle, was able to run behind Diploma. At this juncture, Victoria was supposed to whisper his intentions of having sexual intercourse with De Leon, prompting the latter to lounge at the respondent, causing a minor scratch on his face.

It was then that other personnel of the restaurant were able to convince Victoria to leave the premises, who remained outside and sent another obscene text message to the complainant.

De Leon said she reported the matter to the QC police station 8 only on July 28 after seeking legal advice from her superiors.

Also in her complaint, De Leon asked the court to order the respondent to pay her P500,000 for moral damages; P100,000 for exemplary damages and P100,000 for attorney’s fees.
