i know... for handlers human trafficking... but for PSP like me?... im not really sure what case or law i am liable into and what are the grounds... and punishments...

REPUBLIC ACT NO. 9262

 

AN ACT DEFINING VIOLENCE AGAINST WOMEN AND THEIR CHILDREN, PROVIDING FOR PROTECTIVE MEASURES FOR VICTIMS, PRESCRIBING PENALTIES THEREFORE, AND FOR OTHER PURPOSES

SEC. 3. Definition of Terms.- As used in this Act, (a) "Violence against women and their children" refers to any act or a series of acts committed by any person against a woman who is his wife, former wife, or against a woman with whom the person has or had a sexual or dating relationship, or with whom he has a common child, or against her child whether legitimate or illegitimate, within or without the family abode, which result in or is likely to result in physical, sexual, psychological harm or suffering, or economic abuse including threats of such acts, battery, assault, coercion, harrasment or arbitrary deprivation of liberty. It includes, but is not limited to, the following acts:

 

A. "Physical Violence" refers to acts that include bodily or physical harm;

B. "Sexual violence" refers to an act which is sexual in nature......

 

C. "Psychological violence" refers to acts or omissions causing or likely to cause mental or emotional suffering of the victim such as but not limited to intimidation, harassment, stalking, damage to property, public ridicule or humiliation, repeated verbal abuse and mental infidelity. It includes causing or allowing the victim to witness the physical, sexual or psychological abuse of a member of the family to which the victim belongs, or to witness pornography in any form or to witness abusive injury to pets or to unlawful or unwanted deprivation of the right to custody and/or visitation of common children.

 

D. "Economic abuse" refers to acts that make or attempt to make a woman financially dependent which includes, but is not limited to the following:

1. withdrawal of financial support or preventing the victim from engaging in any legitimate profession, occupation, business or activity, except in cases wherein the other spouse/partner objects on valid, serious and moral grounds as defined in Article 73 of the Family Code;

2. deprivation or threat of deprivation of financial resources and the right to the use and enjoyment of the conjugal, community or property owned in common;

3. destroying household property;

4. controlling the victims’ own money or properties or solely controlling the conjugal money or properties.

(B) "Battery" refers to an act of inflicting physical harm upon the woman or her child resulting to the physical and psychological or emotional distress.

 

© "Battered Woman Syndrome" refers to a scientifically defined pattern of psychological and behavioral symptoms found in women living in battering relationships as a result of cumulative abuse.

 

(d) "Stalking" refers to an intentional act committed by a person who, knowingly and without lawful justification follows the woman or her child or places the woman or her child under surveillance directly or indirectly or a combination thereof.

 

(e) "Dating relationship" refers to a situation wherein the parties live as husband and wife without the benefit of marriage or are romantically involved over time and on a continuing basis during the course of the relationship. A casual acquaintance or ordinary socialization between two individuals in a business or social context is not a dating relationship.

 

(f) "Sexual relations" refers to a single sexual act which may or may not result in the bearing of a common child.

 

(g) "Safe place or shelter" refers to any home or institution maintained or managed by the Department of Social Welfare and Development (DSWD) or by any other agency or voluntary organization accredited by the DSWD for the purposes of this Act or any other suitable place the resident of which is willing temporarily to receive the victim.

 

(h) "Children" refers to those below eighteen (18) years of age or older but are incapable of taking care of themselves as defined under Republic Act No. 7610. As used in this Act, it includes the biological children of the victim and other children under her care.

 

 

 

 

pls. help me.. I am an abused wife.. mentally and emotionally battered .. for 5 years ive been deprived of many things as a wife..it seems that i'm non existemt.. It is simply because... I happened to marry the man who's very wealthy and we have an ABSOULUTE PRENUP..

I didn't cause a BIG sin but why he punished me like this..How can i give justice to what he does and did to me.. Mental anguish and torture...But I want justice, rightness and fairness.. how?

had a live in partner 3 years ago and bore a baby girl. we separated last year. eversince she's been asking me for money to support her, which is no problem naman when i have extra money.

 

the thing is, she's always using our kid as a tool to get money from me. i have the kid with me, sa akin na lumaki. she got used not having her mom around. the girl is always saying she has the right to the kid and she'll take her away from me. i told her she can get the kid but she has to prove first that she can support her.

 

is there a law somewhere that can help me out?

 

i mean, my ex doesn't have any means of living, even her parents... ( i used to support them ), they live in a house with 5 other families. the kind that you see rugrats running around without undies... old guys drinking nightly...mahjong or tongits table... out of school teenagers up til the wee hours of the morning... are these grounds i can use to prove that she is incapable to raise our daughter?

The general rule is that mothers are given preference over fathers if the child is 7 years old and below. The court may, however, give custody of the child to the father or another relative if it is proven that being under the custody of the mother would NOT be in the best interest of the child. The court takes into consideration factors such as the financial capacity of the mother, her emotional/psychological state, and over-all ability to provide a good home and environment for the child.

what would happen if i havent paid my credit card dues and it was already forwarded daw sa legal tapos wala pa rin ako pambayad talaga?

 

di ba ang masama lang naman yun pag nag bigay ka ng check na mag bounce?

pero pano kung wala pa pambayad talaga but willing to pay them,like waiting for the midyear bonus to pay them or something?

 

If the total amount is relatively low, the company might not take the trouble of filing a complaint since the costs might not be worth it. If it does reach the court, it usually lasts a long time, some take years to be resolved. I've handled collection cases for banks and it's really a pain in the ass, hehe. It's just a civil case, you won't go to prison.

this gives me courage, and i thank u sir...

 

onemore thing, if ever umabot nga sa court... while the case is being heard, she can have temporary custody pa rin? i'm afraid she may bring my daughter somewhere i can't find them...

of course i know that im not doing what in the society calls " legal " since im into this field.

and theres no other way i could i ask any lawyers for that matter in this idea, cause admit it or not, what im doing is shameful... well... er...with what the society or the goverment refer to.

i dont deny that im a PSP but im not proud of it... :upside:

From what I remember, the following provisions of the Revised Penal Code may be applicable:

 

Article 202

Vagrants and prostitutes; penalty. — The following are vagrants:

 

1. Any person having no apparent means of subsistence, who has the physical ability to work and who neglects to apply himself or herself to some lawful calling;

2. Any person found loitering about public or semi-public buildings or places or trampling or wandering about the country or the streets without visible means of support;

3. Any idle or dissolute person who ledges in houses of ill fame; ruffians or pimps and those who habitually associate with prostitutes;

4. Any person who, not being included in the provisions of other articles of this Code, shall be found loitering in any inhabited or uninhabited place belonging to another without any lawful or justifiable purpose;

5. Prostitutes.

For the purposes of this article, women who, for money or profit, habitually indulge in sexual intercourse or lascivious conduct, are deemed to be prostitutes.

Any person found guilty of any of the offenses covered by this articles shall be punished by arresto menor or a fine not exceeding 200 pesos, and in case of recidivism, by arresto mayor in its medium period to prison correccional in its minimum period or a fine ranging from 200 to 2,000 pesos, or both, in the discretion of the court.

 

Article 341 - the penality of prision mayor in its medium and maximum periods shall be imposed upon any person who, in any manner, or under any pretext, shall engage in the business or shall profit by prostitution or shall enlist the services of any other person for the purpose of prostitution."

I don't think you have anything to be ashamed of. Some are simply less fortunate than others and certainly there would not be any sellers if there were no buyers. I always wish the best of anyone who is constrained to enter this industry. The sooner you get out of it though, the better for you.

sirs, two questions lang po...

 

1) i dowloaded pics and video clips from my digicam to my hard drive. when i burned it, the pics were ok but the video clips were on "slow motion" pati yung audio, tumatalon at parang umaalon ang tunog. i used nero, and burned it as a data cd. may ginawa ba kong mali?

 

2) my laptop, pag nag-boot, may lumalabas:

 

error loading C:\WINDOWS\System32\ddvjasqv.dll

 

what does this mean?

1. yung videos should be burned as video CD or SVCD format. hindi data. and try to use the slowest burning rate, which i think is 8x.

 

2. dunno about your second question. but probably, this is a result of a removed program (uninstalled program). try to check it out sa MSCONFIG tsaka sa REGEDIT kung anong program ang tumatawag sa DLL file na yun.

anong kaso sa naka pulot ng cellphone,nangyari yan sa isang pinay dito sa taiwan,nakasuhan dahil nakapulot ng cellphone at hindi binigay sa police station

 

Only someone familiar with Taiwanese laws/ordinances can answer this. It's probably considered some form of theft.
