This paid-up capital must not be less than PHP 5,000. Some banks in Manila charge a fee up to PHP 105 for each certificate of deposit. ok na po ba un 5k for us to get the bank certificate of deposit? Amount of capital stock to be subscribed and paid for the purposes of incorporation. — At least twenty-five percent (25%) of the authorized capital stock as stated in the articles of incorporation must be subscribed at the time of incorporation, and at least twenty-five (25%) per cent of the total subscription must be paid upon subscription, the balance to be payable on a date or dates fixed in the contract of subscription without need of call, or in the absence of a fixed date or dates, upon call for payment by the board of directors: Provided, however, That in no case shall the paid-up capital be less than five Thousand (P5,000.00) pesos. Dahil di naman kasama ang software solutions provider sa nangangailangan ng mas malaking paid-up capital, pwede na ang deposit na P5,000 sa bangko. Kailangan nga lang na yung P5,000 mo ay pasok dun sa capitalization ng company. COvered ba po kami nitong law na ito? kasi po sa pagkakaintindi ko, sa December 2013 pa po nila kami puwedeng increasan ng monthly rent, and 7 percent lang ang puwede nilang itaas, sobra sobra po ang 500 pesos na itatas nila dahil ang 7% ng current na upa namin ay 210 pesos lang po. thanks po in advance. ayaw ko lang po kasing mapahiya ako once na nagharap na kami for this month's rental. at lasy na po, granted na covered kami sa RA 9653, ok lang po ba na ipresent ko sa kanya yung ipiprint kong pdf file format ng RA na ito? nagtanong po kasi akos a city hall namin at wala silang alam tungkol dito. maraming salamat po.. dj_flip03 Posted January 15, 2012 Share Posted January 15, 2012 I'm going to simplify my suggested action plan for you:First, don't rely on on heasay, go to your HR and get a copy of your company's retirement plan.Second, I take it that you're still a yuppie (30's or so). The law does not entitle you to a retirement benefit yet. you're best bet is if your Company provides an early retirement plan.Third, assuming na may retirement plan nga kayo sa company, you cant get more than what is stipulated there.Fourth, your best bet to get more than what you're entitled to is to gamble your resignation vs the idea that you are indeed an asset of the company that they company will move heaven and hell to retain you using a substantial amount of money. japlog Posted January 27, 2012 Share Posted January 27, 2012 mag seek lang po ng legal advise... nagpapaupa ako ng pwesto and meron kasi akong isang tenant na gusto ko sanang mapaalis na due to delinquency in paying the rent, excessive heat emanating from the place(bakery kasi un business) at nasira na un place due to their neglect to maintain the place well. Ano po ba ang dapat na maging step ko para mapaalis ko sila. nagkaron kami ng contract but nag expire na sya last Dec 2011. We have not made a new contract as of this time. Meron bang prescribed sa law stating kung ilang araw,weeks,months ang notice ko for them to vacate the premise? Hope you can advise me on what steps I need to do so that I will not bypass their rights and at the same time serve my purpose to have them vacate my place. Quote Link to comment
curian Posted January 27, 2012 Share Posted January 27, 2012 nag demand na po ba kayo na umalis na sila? pag hindi pa po, according to rule 70 of the rules of court, you have to demand that they vacate the premises in which case they have 15 days in case of land or 5 days in case of buildings.if they did not comply, try to reach a compromise or settlement on the barangay level. According to article 3 of the Family Code the formal requisites of a formal marriage are1. Authority of the solemnizing officer2. A VALID marriage license except in some cases3. A marriage ceremony which takes place before the solemnizing officer and their personal declaration that they take each other as husband and wife in the presence of not less than two witnesses of legal age. from your statement, they were married in a church. lets assume that the marriage was solemnized by a priest. In that case, the authority of the solemnizing officer is valid. And lets also assume that 2 or more witnesses attended, requisite number 3 would then be complied with. the question would lie on requisite 2. whether they have a valid marriage license. because they only had the marriage license after the celebration, then it is presumed that there was no valid marriage license during the wedding ceremony. BUT it may be valid provided that they fall under those marriages where a license is not required. those are: 1. Marriage in Articulo Mortis (point of death of one or both parties) as provided for in article 27 of the Family Code (FC)2. The residence of either party is so located that no means of transportation would enable them to appear before the local civil registrar (Art 28 of the FC)3. The marriage is among muslims or other ethnic cultural community where, according to their customs, no marriage license is necessary.4. The couple have been living together as husband and wife for at least five years without any legal impediment to marry each other. In which case they have to make an affidavit before any person authorized to administer oaths (like a notary public). The solemnizing officer (in this case, the presumed priest) should then state under oath that he has ascertained that there are no impediments for the couple to marry each other and they are qualified to get married. But this should be BEFORE the marriage ceremony. If your friends does not fall under any of the exceptions provided, then the marriage is void.Lastly, the marriage license will be valid for 120 days after the date of issuance. Quote Link to comment
