    First you have to examine what the bond entails. is it bond to cover for any damage that the company would incur in the exercise of duties? or is it a bond for items provided to the employee? or is it a bond on competitive employment? in order to properly advise you on the implications of the bond, you must determine what it is for in the first place.

     

    there is no hard and fast rule on employment bonds, because they are essentially private agreements (surety bonds) by and between the employee,employer and the third party insurer. what is provided though is the option by one party to rescind the bond agreement if 1) the terms are clearly not the intent of the parties and 2) when it is unconscionable on one party. though contracts presume equality, i would think that since this forms part of the employment of an individual, then the bias towards labor precept of Philippine labor law may apply, but not to the injury of the employer.

     

    from your information, we can only assume that the bond is for him to remain with the company for two (2) years. since he terminated their employment agreement after only two (2) months, what would happen is this: 1) the employer would act against the bond, seeking reparation for damages incurred by them upon the termination of employment, 2) then the bonding company would recover their costs from your friend since your friend failed to comply with the promise she undertook when she agreed to the bond. this is only clear speculation since facts are scant as it is.

     

    who provided the bond? is it a prerequisite that the bond employer provided be the bond the employee agrees to?is there a no bond no employment policy?

    tnx for comprehending my QUESTION! about who provided the bond? the answer is the company itself prepared it. will my friend be liable for the bond? since he's not yet regular though he signed it?

  2. sorry got no time to read all the post but i want to asked if an employee signed a contract with a bond on a probationary period only will this bond be an employee account of her since his not yet regular? as par as i know upon regularization lang po pde mag bond db? unless it is training bond is is right? well i have a friend signed a bond for two years but then he decided to leave the company for just working for 2 months only to his recent employer. anyone can help me off this?

    pano po ba magdemanda ng employer? kasi po pinagpabalikbalik lang ako ng employer ko nde nila binibigay sakin yung r3 form or certification ng remittance nila for me....and another thing is ung wife ng kapatid ko ng apply ng maternity na dis approved sya kasi nde pa nya na file yung change status nya so it was mailed last june 3 2005 pa po till now nde pa nadating yung mail kasi andun yung mga requirements nag aalala sya bka nawala na yung sulat kasi lumipat sila ng bahay...anu po kayang advised nyo sa kanya?

    hingi k ng xerox copy ng R3 s employer mo... or certifications (kung ala cla R3)... then submit mo s SSS office for posting.... baka late posting lang cla....

    thanks sir izzecoh...but one last question wat if ala sila mabigay sakin na r3 form? wat shud i do? nde ko po ba pde itanung nlng sa sss kung nagbayad itong sti tagaytay sa king sss?

  6. meron form yan s mga SSS Office,,, fill-up k lang tapos submit mo s SSS....

    kasi po may previous employer which is STI did not gave me any remitance report or yung contribution list na hinihingi ko kasi po nung ng inquire me sa Online inquiry system nde ng appear yung STI sa employment ko...so nung tumawag me humingi daw me ng copy nung contributions list sabi ng head ofc ng sss pero ala sila maibigay sakin pano ko po kaya masu sure kung ngbayad sila kasi sabi ng accountant dun nagbayad daw po sila.

  7. hmm... u should file first for an request for manual verification of contribution payments in the SSS office.... there the SSS will see if your employer really paid your contributions in the said periods... there are some cases n hindi lang n post ung nahulog s inyo... so you need for that certain request... but the findings resulted to non paid contributions.... pakita mo s employer mo ung results from us... then ask them to pay for it... puede nman nla byaran yun... pero may penalty n lang... :)

  10. Waaaaa wala daw TV sa Cocobeach rooms!!!  :grr:  gusto ko pa naman dun scenery dun  :thumbsdownsmiley:

     

    Sa Whitebeach resort na lang ako, I can get it for 1K/night:  Airconditioned rooms with TV and beachfront pa daw...  :P

    Pare kung gusto mo yung comfortable place marami sa white beach and i assume gurlz will go wild at nigth kaya mahirap mag isa OP ka dun depende nlng sa diskarte mo...damage pde na 3500 per person sulit naman lahat na yun including boat ride if u want PM me for details....

  11. well if u really want to go there...tama yung mga info nila but i'd love diving kasi u cant imagine how beautiful yung world under he sea....malulufet....and yung banana ride mas matagal unlike sa bora saglit lang lolz :)) lufet ng banana ride sa white beach kasi ibabagsak ka ng madming beses more than ive experience in 20 space rocket sa enchanted kingdom....
