Art. 116. Withholding of wages and kickbacks prohibited. It shall be unlawful for any person, directly or indirectly, to withhold any amount from the wages of a worker or induce him to give up any part of his wages by force, stealth, intimidation, threat or by any other means whatsoever without the worker's consent.

 

Ano ba pwede gawin dito? Yung AR na di ko pa naibabalik sa kanila ay nasa parents pa ng student ko. I have consistently reminded the student to return it as soon as possible. pero laging di available yung parents nya everytime tinatawagan ko para iremind about sa AR. Medyo nakakapikon na din dito sa school kaya gusto ko sanang matindi ang buwelta ko sa kanila... ano pwede gawin dito?

write a letter/memo/answer to the admin. explain your side and tell them that it is not your fault. make sure that you have a received copy in case you might be interested in filing a labor case with the NLRC.

Master if I remember right, this is an old case arising out of the 1982 BAR controversy when then Justice Vicente Ericta was reported to have personally approached the bar chairman to inquire whether his (Ericta's) son passed the bar, raising suspicion he exerted pressure on the chairman.

With my current enlightenment on viodable marriages, it is to my understanding that you cannot file for annulment if the marriage is to be considered void from the start. Is this correct? Should I file for a motion to declare my marriage void, due to lack of (or the failure to secure) the requisite Marriage License?

 

Psychological incapacity is hard to admit, though, it is not the truth that I want the public to know and accept.

the only time that there is a specific party/person who can file for annulment are those cases enumerated in art 45 of the FC (voidable marriages like underage, unsound mind, fraud, force and intimidation, physical incapacit, and sexual diseasse).

and, for void marriages, only the husband and the wife can file for action to annul (rules on declaration of absolute nullity of void marriages)

void and voidable marriages are different things... an example is the former is imprescriptible while the latter is not

there is nothing wrong with psychological incapacity. the supreme court, in a decided case, declared that such incapacity is personal to the spouse. meaning, it does not mean that you are now incapacitated to marry another.
