Butsoy, Dont worry pre pagmalapit na akong umuwi I'll PM you. I have a lawyer uncle sa pinas his retired now. Although from my first hand experience masarap kainuman ang mga abugado maraming kwento. This is probably a silly question but bakit ang tawag nila sa ibang lawyer ay "DE KAMpanilla"?

Kaya tinatawag ang abugado na di kampanilla eh.. may mga tillilling yun kagaya ni MIriam... hehehe

 

pag super galing na abugado tawag dun ay di kampana... hahahahaha

 

Kidding aside.. kaya tinatawag na di Kampanilla kasi in olden times sa Escolta .. ang mga magagaling na abugado may bell yun na pantawag sa sekretarya nila pag kakatapos ng usapan ng client... saka ibibigay ng sekretarya kung magkano singil nya...

Ciminal offense are all defined by statutes...if an act is not categorized as criminal in nature.. there is no crime..

Hello atty. May nagtanong sa isang thread, I'm reposting it here.
Kaya ko naghehesitate pumunta sa mps dahil sa dalawang bagay, 1) sakit saka 2) baka maraid. Sa una, pwede ko gumamit ng protection pero sa pangalawa, parang ala kong ligtas lalo na pag nahuli ako sa akto ng nagraraid. Mga pips, may tanong lang ako. Ano ba pwede ikaso pagkapag nahuli ka in the act? Pwede ka ba ikulong?

for the second time in this site, i am going to pose a query without reading previous posts since i am in a bit of a hurry... so i apologize beforehand if this topic was already asked and answered :).... anyway, can you give me the rules on land or property ownership, business ownership and several other pertinent topics regarding expats.... i know a bit about them, i just want to make sure that im right. thanks

Doctor red: I think the problem there would occur if she's less than 18 years old and she decides to sue you. Qualified seduction yun, kahit nag-consent pa sya. Ang gagawin kasi nya, sasabihin nya na she trusted you because you were her doctor. Pero pag di naman magdedemanda, okay lang. But as butsoy said, if she's more than 18 years old, okay na yun. Physician-patient relationship na lang problema, yung nasa solis, ha? Di yung pinipilit ni korina na ipasa ngayon...

ohhhhlolzzz forgot to follow-up on my inquiry.. i was just looking for generalization e.g. they cant own land but can own condominium units... they can own 60% of a business.. can they go into individual business ownership... ganun lang.. :D... i knew you'd suggest we talk it over personally....ohhhh lol..... wonder how long that will take us and whether anything will be discussed at all... :))

You ask lawyers because you're expecting the discussion of the nitty-gritty of the law... otherwise if you are after generalizations... the presumption is every citizens knows about it.. remember we have this dictum: "Ignorance of the law excuses no one"...

 

Your question tends to elicit the salient points of the Foriegn Investment Act of 1991 as amended.. the constutional provision on land ownership...the SBMA law the condominium law, etc.. etc. etc.. dami nun tsang...

 

One thing more, kung alam na natin ang generalizations.. mag mumukha kang "smart alec" niyann pag tinatanung mo pa kung anu ang alam mo.. hehehehe ..do you know what a "smart alec" is?

fishken,

 

get a notarized affidavit of loss then go to your LTO office and submit it for you to be issued a new one, if they redirect you to LTO MAIN in east ave., it means you need to get clearance pa. This is a tedious process, but if you have contacts, you'll be out of there in 30 mins. Hope this helps.

I have a question. There was a note on my UST alumni card (nawala ko na) saying na according to RA ****? Excuses doctors from minor traffic violations when we're answering emergency calls. I forgot the RA number. Anyways, my brother, who's also a doctor, eh hinuli ng MMDA because of violating the vehicle coding scheme. When he presented his PRC license saying he's on emergency call, the MMDA officer said that he should produce a permit issued by the MMDA excusing him from the said scheme. Eh, we're not aware of that ruling... May ganon bang law? And if there is, di ba dapat kinakalat muna ito sa mga dyaryo, radyo, and tv para alam ng lahat na existing ang ganong rule? Eh kung iniimbento lang pala to nung MMDA na yun?

Naalala ko rin yan.. kaya lang di ko matandaan ang number... anyway ipahahanap ko... for your purposes... alam ko sa traffic code may provision exempting doctors on emergency, ambulance, firetrucks, etc.. from minor traffic vviolations.. di nakailangan humingi ng exemption... just show your hospital ID or PRC license and a note that.. DOCTOR ON CALL (by your mother inlaw heheheh)

Inasmuch as we're having this legal thread where the expert opinion of our in-house lawyers are being highlighted, eto po tanong ko (you can help me on this one, bro Butsoy):

 

1. What happens to the poor guy who got caught in the middle of a raid, say sa isang nightspot na may lewd show? Or sa isang MP?

2. What happens to the same bloke who got caught with a chick (not necessarily a minor) in a raid sa isang motel/hotel?

 

Himas rehas ba? :( Sabagay, pagpipyestahan na ng networks so it aint worth it na makasama sa 6o'clock news. Scary proposition huh?

Generally, a guy caugth in a nitespot that was raided for a lewd show is not liable for any crime as they were as much a victim ( :boo: ) of the incident. It is not a crime (as of yet) to watch a lewd show. Neither is it a crime to go to an MP. So theoretically, the cops have no reason to haul you to the police station if you refuse. But of course, the Philippine setting being as it is, more often than not you will be invited to the police station for questioning and they have all the legal right to do so, especially if there were lewd activities that were caught when the raid was conducted. This is called, police investigation.

 

On the other hand, raids of hotels/motels are not done in general. Meaning, for the police to conduct a raid of such establishments, they must have the appropriate search warrant the specifies the exact place (room number or floor) to be raided. They cannot just go to the hotel or motel and ask all occupants to come out and have the room checked. This is an illegal search, even if there is a warrant to accompany it. The only exception is if the entire premise (hotel or motel) is being used as a front for illicit activities. Thus, my suggestion would be if you would like to mess around, do it in a more reputable hotel or motel.

 

Sorry for the intrusion, but I just passed by and thought to give my 10 cents worth. ;)
