fauxhead
I am not sure how you read the decision, but IMHO, it is only fair. Good news para sa mayayamang Pinoy na ayaw na sa asawa!I don't agree with the decision but it's the Supreme Court speaking.Republic v OrbecidoGR No. 154380October 5, 2005<{POST_SNAPBACK}> Quote Link to comment

fauxhead
Dual citizenship is not mandatory. A filipino who gets naturalized as a citizen of another country retains his Filipino citizenship only if he executes the process provided in RA 9225. isn't there going to be a problem concerning dual citizenship? <{POST_SNAPBACK}> Quote Link to comment

A filipino who gets naturalized as a citizen of another country retains his Filipino citizenship only if he executes the process provided in RA 9225.<{POST_SNAPBACK}>therein lies the problem...both the naturalization and dual citizenship are upon the volition of the applicant...so if one is a naturalized citizen of a foreign country and opts for dual citizenship, then obtains a valid divorce decree in the country of naturalization...i know it sounds extreme...but the crux of the decision is the citizenship of the divorcee at the time a valid divorce is obtained...what if the applicant for divorce is of dual citizenship at the time abovestated? just ruminating... jopoc
isn't there going to be a problem concerning dual citizenship? <{POST_SNAPBACK}> that will be, of course, another issue. but on the practical side, if you are the counsel, just tell your client not to apply for dual citizenship. kaya nga sya umalis ng pilipinas. he can choose, dual citizenship and risk being prosecuted, or drop the filipino citizenship.
