I need a lawyer na magaling gumawa ng MOA and also yung marunong din na irepresent ako in case na hindi tumupad sa MOA yung kabilang party. Ang alam ko lang na mga lawyer eh iyong nakikita ko sa tv. Atty. Fortun etc... Pero etong particular situation ko doesn't need such a lawyer kasi di naman masyadong malaking halaga ang pinaguusapan sa MOA (less than 1 million). Can anyone please help me out? Thanks

it really depends on how much you are willing to spend. if it was me i'd just take a lawyer friend for lunch in his/her favorite resto for drafting the MOA. hard to believe you don't have a friend who is a lawyer or a friend who has a lawyer friend. as for hiring someone to represent you as a complainant for the MOA, just cross the bridge when you get there.

dude, the safest thing to do is to have the title transferred to the heirs first.

 

although pwede naman hindi na ilipat  (kung patay na ang tunay na me ari o me titulo) , pero delikado yun. lalo na kung me mga utang na naiwan yung namatay. dapat liquidate muna nila yung estate ng decedent. mas safe pag ganun.

 

thanks for the info bro. the lot came from an immediate relative, were just finalizing the deal. The titling of the Lot is quite a messy red-taped process, which I will deal later na lang.

unless me court order, hindi nya pwede makuha yung sweldo mo (can somebody correct me if i am wrong?), yan ang alam ko. 

 

yung sustento sa anak, tama yun, ikaw na magbigay ng kusa. hindi lang legal, pero moral obligation din yun.

 

wala ka magagawa pag nag skandalo sya, usually, and mag asawa hindi pwede magkasuhan ng criminal cases, lalo na kung mababaw lang.

 

i suggest na magkaroon kayo ng legal separation. if annulment is possible, why not?

only after filing a petition for support with a prayer for the issuance of a writ of garnishment is one of the ways the salaries of an employee be taken by another person other than the employee...another venue is for receivership or bankruptcy...but that's another case altogether...

 

in the civil case for support, the sourt would determine what would be adequate amounts you would need to give at certain periods to maintain the standard of living of the child...may even include the mom if the court would allow it...

 

as for the scanadl...and the embarassment well that is part of it...so long as you are calm, and you do your duties, then is there a reason for such outbursts...also reasoning out to communuicate maybe a venue rather than making the situation more acrimonious than it already is...

I do have lawyer friends, but they are also friends with the other party. Hence, I'm looking for someone outside our circle. Your tip of taking a lawyer out to a restaurant actually worked for me several times in the past. :P

i know some lawyers. not in the ranks of fortune, but can definitely can draft it and represent you in case of a problem (meaning, retainer). i know several laywers. depende sa budget talaga at kung saan yang MOA na yan (corporate, etc).

I'm no lawyer, but I prepare and handle all legal documentation and agreements (MOAs, etc) for the company. I can provide you a draft, based on your needs and details.

i have a friend who is scared that he will be axed from his job for unjust reasons. is there any way to prevent this? or, if he IS fired, what can he do? can he take legal action against his employer?

will be axed? so that means he's still employed.

 

if the causes are not just or authorized, then he may have something going for him.

 

but first we'd need to see the circumstances IF and WHEN he gets terminated.

 

best to see the termination letter first (if and when it arrives).

Who will determine kung magkano dapat ang sustento sa pamilya?

Kung may trabaho naman ung wife, dapat lang din ba na i-account din ung earnings niya?

actually, sharing kayo ng asawa mo sa sustento.

yes, her income will be taken into account.
