Before you let them rent your unit, nilinaw po ba nila sa inyo kung ilan ang magiging tenant? if wala po kayong contract sa kanila you are legally free na paalisin sila since that is your property.

Just to also add as a tip make sure to always have a Contract of Lease with your tenants. 

Nakalagay na lahat doon pagdating a monthly rent and kailan magbabayad, security deposit, tagal ng kontrata, ilang tao lang pwede doon, etc. 

Mas mabuti lagi may kasulatan sa mga bagay tulad nito para pag may problema kontrata lang ang basehan para mabilis ang usapan.

Any advice po regarding sa neighbor na humaharang lagi yung sasakyan nila sa tapat ng gate ko, opposite side ng kalye  kaya lang maliit kalye sa subdivision namin. di po kase makalabas yung sasakyan ko lalo na pag may biglaan need umalis.

Kinausap ko na sila ng maayos regarding sa situation, wala rin naitulong yung pag discuss sa subdivision officers and di naman nakikialam barangay since dapat daw ang mag resolve ng issue ay officers ng subdivision.  

Any diplomatic advice?

perwisyuhin mo sya until di na sya magpark sa harap ng gate. labas ka ng madaling araw pag tulog pa sya paulet pulet. pag nag reklamo sya sabihin mo di wag sya mag park sa tapat para makalabas ka. problema sa mga ganyang tao di sila makikinig until napeperwisyo na din sila. or kung mauna ka dumating sakanya, ipark mo sa harap ng gate mo ung sasakyan mo para wala sya space mag park sa tapat.

Practical advice po, seek for lawyers advise kasi wala na yung original owner. Pero try to go to Registry of Deeds para mai acknowledge po yung deed of sale sa original father at tsaka yung lolo mo. Para once ma ok na, maitransfer na sa yung father mo.

Sana may makasagot. May kilala kasi ako na magretire na this year. Bale palagi kasi syang project hire since nasa construction kami, pero never po syang nabakante sa trabaho. Nung sinilip ko yung SSS premium contribution nya, bale naka 15years 8 months sa company. Ang tanong ko lang po, meron ba sya makukuha na separation pay/retirement pay considering yung length of service nya kahit hindi sya regular employee? Thanks in advance.

Separation pay is only given to certain scenarios on termination on employment (i.e. Authorized causes under the law). Wala po syang kinalaman sa years of service or tenure ng employee sa isang employer

Medyo marmaing complication ung scenarion na to. The things you need to know first are the following:

  • Is the Original owner named on the title still alive?
    • If the original owner is already dead , then are the heirs still alive?
    • You need to coordinate with the Administrator or executor of the estate.

Disputes between neighbors should be settled or conciliated within the lupon first (barangay). You should go to your barangay and raise the said concern and have a conciliation meeting with your neighbor and would hopefully be resolved. If not you need a conciliation certificate from the barangay and the court is within your disposal.
