good sirs, eto tanong lang. ano po ba ang legal age of consent sa pinas?

Kung gusto mong maging kontrobersyal, sabihin mo - 12 YEARS OLD ANG AGE OF CONSENT SA PILIPINAS!

 

Ito rin ang makikita mo kapag iyo itong hinanap sa Google.

 

NGUNIT, SUBALIT, DATAPWAT...

 

Ito ay isang simplistikong pag-aaral ng batas, base lamang sa pagbabasa ng Republic Act 8353 (na di na isinalang-alang at inalala ang iba pang batas na may kaugnayan dito!).

 

Ayon sa RA 8353:

 

Article 266-A. Rape: When And How Committed. - Rape is committed:

"1) By a man who shall have carnal knowledge of a woman under any of the following circumstances:

"a) Through force, threat, or intimidation;

"b) When the offended party is deprived of reason or otherwise unconscious;

"c) By means of fraudulent machination or grave abuse of authority; and

"d) When the offended party is under twelve (12) years of age or is demented, even though none of the circumstances mentioned above be present.

 

Dahil sinasabi sa RA 8353 na kapag ang offended party ay below 12 yrs, rape na, kahit wala yung ibang bagay bagay na kailangan para sa rape, IBIG DAW SABIHIN, 12 nga ang edad para legal nang makipagsiping ang isang babae sa lalaki.

 

Ating alalahanin na ang edad ng hustong gulang sa Pilipinas ay 18 (RA 6809). Dahil dito, ipinapalagay ng batas na walang kapangyarihan magdesisyon para sa sarili niya ang menor-de-edad.

 

Ayon din sa RA 7610:

 

Section 5. Child Prostitution and Other Sexual Abuse.Children, whether male or female, who for money, profit, or any other consideration or due to the coercion or influence of any adult, syndicate or group, indulge in sexual intercourse or lascivious conduct, are deemed to be children exploited in prostitution and other sexual abuse.

The penalty of reclusion temporal in its medium period to reclusion perpetua shall be imposed xxx xxx xxx

 

Sa madaling salita, ang batang nakipagtalik dahil sa impluwensya ng isang nasa hustong gulang ay ipinapalagay na "child exploited in other sexual abuse," at maaaring masentesyahan ang nasa hustong gulang ng reclusion temporal medium hanggang reclusion perpetua (14 years, 8 months and 1 day to 30 years).

 

 

Hiwalay pa dito ang Article 337 at 338 ng Revised Penal Code:

 

 

Art. 337. Qualified seduction. — The seduction of a virgin over twelve years and under eighteen years of age, committed by any person in public authority, priest, home-servant, domestic, guardian, teacher, or any person who, in any capacity, shall be entrusted with the education or custody of the woman seduced, shall be punished by prision correccional in its minimum and medium periods.

The penalty next higher in degree shall be imposed upon any person who shall seduce his sister or descendant, whether or not she be a virgin or over eighteen years of age.chanrobles virtual law library

Under the provisions of this Chapter, seduction is committed when the offender has carnal knowledge of any of the persons and under the circumstances described herein.chanrobles virtual law library

(Ang ibig sabihin ng salitang "virgin" sa Art. 337 ay babaeng maganda/malinis ang reputasyon, hindi na ito ay literal na "birhen")

Art. 338. Simple seduction. — The seduction of a woman who is single or a widow of good reputation, over twelve but under eighteen years of age, committed by means of deceit, shall be punished by arresto mayor.chanrobles vi

Makikita mula sa Art. 337 at 338 na krimen pa rin ang pakikipagtalik sa babeng nasa edad 12 hanggang bago mag-18.

Alalahanin din na rape ang pag-aabuso ng kapangyarihan para makatalik ang isang babae (see Art. 266-A[c])

Maari mong gawing depensa na PUMAYAG AT WALANG PAMIMILIT ANG PAKIKIPAGTALIK MO SA BABAENG EDAD 12 - BELOW 18.

Pero, dahil wala pa nga itong kapasidad na magpasya para sa sarili (wala pa siya sa hustong gulang), pag gusto ng magulang magkaso ng rape, YARI KA!!! Dahil walang bisa ang pagpayag nung babae (wala nga siyang kapasidad na magpasya pa). Palalabasin ng magulang na ang pakikipagtalik ay dahil sa impluwensya nung nasa edad, at presto... ito ay child exploited under other forms of sexual abuse na. YARI!!!

 

 

Kung kaya't masasabi natin na HINDI 12 ANG LEGAL AGE OF CONSENT SA PILIPINAS. ITO AY 18!!!

Hello po mga boss, anyone here is familiar with the law regarding "Pamana" and also "utang" of a person who suddenly died due to vehicular accident. Need some advice and consultation whats the right thing to do. Thanks in advance!

Ang utang ay hindi namamana (see Article 776, 777, Civil Code at Genato versus Bayhon, 596 SCRA 713).

 

Ang utang nung namatay ay dapat singilin ng nagpautang sa ari-ariang naiwan nung namatay, hindi sa mga tagapagmana nito.

 

Kaya't kung walang lupa na naka-rehistro sa pangalan ng namatay, o di-kaya'y sasakyan na nakarehistro sa pangalan nito, o shares of stock na nakapangalan dito, uuwi ng luhaan ang nagpautang (ano ang hahabulin niyang ari-arian? wala naman siyang ebidensya na ang alahas o appliances na naiwan nung namatay ay pag-aari nito, siyempre hindi rin ito aaminin nung mga tagapgmana).

 

Kapag may lupa, o sasakyan, yun ang maaaring habulin ng nagpautang (kung alam ng nagpautang, bakit rin ito ipapaalam ng mga tagapagmana, maghirap ang nagpautang na maghanap, tapos kailangan din niyang magsampa ng kaso sa korte para maghabol sa kanyang pautang).

 

malas lang ng mga tagapagmana kung ang lupa o kotse ay naka-mortgage, dahil maaari na itong habulin ng nagpautang sa pamamagitan ng pag-ilit nung lupa/sasakyan

Brother dapat may retainer ka na dito sa MTC. Hehehe. Great perspective re: legal age vis-a-vis the Seduction provisions in the RPC. I always thought that if some of the elements of seduction are not present such as deceit, abuse of confidence etc. malabo may kaso, yun pala halos parang technically below 18 narin ang statutory rape due to the "other sexual abuse" provision in 7610.

Good day po, Sir. I understand that it's a common practice for an employer to require employees/applicants to submit an NBI clearance but is it common or proper for an employer to ask for one every year? Thanks in advance!

it's not common. but it's proper. It is well within management prerogative to learn whether employees are conducting themselves properly.

Nasa barko po ako ngayon at pwersahan po akong pinagtatrabaho nang dalawang position pero ang kontratang pinirmahan ko po ay para sa isang position lamang. Para po akong hostage dito dahil galing po ako saten bakasyon at pinasampa po ako sa barko sabay sabing gagawin mo tong trabaho nato at wala kang choice kundi mag quit o ituloy mo, pasalamat kana lang may trabaho ka.

 

Saan po ba ako pwedeng mag reklamo habang nasa barko ako at anong reklamo ang pwede kong ilaban sa kanila? Sumulat din po ako sa Norwegian Seafarers Union wala pa lang silang sagot baka sakaling matulungan nyo po ako Sir at mabigyan ng linaw sa aking mga gagawin.

2) pareho ba ang sweldo ng dalawang posisyon na yan, o magkaiba?

3) ano ba ang posisyon mo? at ano yung isang pinapagawa din sa iyo?

nag reklamo ako sa union ng seafarers nag padala sila nang form at pina fill up saken sinend ko na rin sa kanila.naghihintay na lang ako ng feedback as for the evidence ginagawa ko naman na ang trabaho talaga marami akong documents na maipapakita na ginagawa ko ang work pwede ko sila ireklamo sa POEA salamat po sa input Sir

Ang distant relative ko po ay isang professional na napili as member ng PLEB o People's Legal Enforcement Board, tanong lang po, kung napili po siya as member ng PLEB need pa po ba siya ng authority to engage in a private practice po?

Mukhang hindi. Ayon sa Sec. 43© ng RA8551, ang membership sa PLEB ay isang "civic duty". Wala din itong sweldo, per diem at insurance coverage lang. Lumalabas na ito ay bahagi lamang ng responsibilidad ng isang mabuting mamamayan, at hindi ka nagiging bahagi ng Civil Service kung mapili ka na maging miyembro dito.

 

Dahil di ka naman bahagi ng Civil Service, maaari ka pa ring mag-engage sa private practice (wag lang sa mga bagay na may conflict of interest sa PLEB).

Now here's the problem, I've got a project opportunity that cost hundreds of million of pesos and I'm expecting a huge commission from it. But the management decided to give me only a specific amount of commission rather than following their company sales incentive schemes. Their reason is the company didn't earn well this year. So I'm planning to complaint them in NLRC and I want to know what's my chance winning the case. I have all the evidence and documents including the Sales Incentive Scheme from the HR that will prove that I'm the sales person of that project.

When does a sales person become entitled to the commission? (ex. upon award, upon contract signing, upon payment of services, etc.)

 

So long as that event has already happened, you would be entitled to a commission.

 

also, how is the incentive scheme worded? Are there qualifications? Can it be changed by the company?

 

If not, then you would be entitled.

 

Just make sure all these have already happened.

 

Also, be aware that going to the NLRC will damage your relations with the company. After you file a complaint, expect the company to to look for opportunities to terminate your employment.

 

Also, are you an employee or part of management? This could impact on whether you can go to the NLRC or not.
