rocco69 Posted June 30, 2013 Share Posted June 30, 2013 (edited) Yes, your my can demand a share in the properties. assuming that your marriage took place after 1988, and that you have no pre-nuptial agreement, you will be governed by the regime of absolute community of property (which basically means that everything you own is also owned by your spouse). so, when you buy property, you will basically be using BOTH your property, and then when you put it in the name of your kids, it would basically be a donation to your children. Under the Family Code, one spouse cannot donate their property (in this case, the property bought using money belonging to both of you) without the written consent of the other, and that any such donation is void. In short, not only can your wife demand a share, she could actually have the donation declared void (resulting in the property reverting back to the absolute community of property existing between both of you). kenazansuz Posted July 1, 2013 Share Posted July 1, 2013 mga bossing, ikonsulta ko lang yung issue ko, which is a followup nung huli kong post. naka unpaid floating status na ko for 3 months as of this writing. meron na po akong pinirmahang document galing HR namin regarding sa paglagay nila sa akin ng floating status at naipadala na din nila ng kopya ang department of labor. so malinaw na malinaw na naka floating status talaga ako. two weeks after nalagay ako ng unpaid floating status, tumawag yung recruitement department ng opisina at ino offer nila sa akin maging agent ulit. natural lang po na inayawan ko. ngayon po naman nakakuha ako ng letter mula sa HR namin na sinasabi na "I believe this is the perfect opportunity for you to re-start exploring your options by checking on our internal job postings." Lagi ko naman tinitingnan yung mga available positions na naka broadcast sa email ko. Pero wala na talaga akong makitang position para sa akin dahil wala nang product line na nagfi fit sa job skills ko bilang subject matter expert. nag try po ako mag apply ng mas mataas na position bilang team leader, ngunit bigo. ang wait time para mag reapply ulit is 6 months, which is the same time na 6 months na din ako sa pagiging unpaid floating status ko. so in short malabong malabo na talaga ako maging TL. puno't dulo, kahit saan anggulo tingnan ay agent ang bagsak ko. kahit alam kong walang ikinababa ng sweldo sa akin, demotion pa din po yung kalalagyan ko nito. isa sa mga rason kung bakit inayawan ko kaya naman nilagay nila ako ng floating status.ang tanong ko lang po ngayon ay:pwede pa din ba nila ako pilitin mag apply bilang agent level kahit sa kalagitnaan ng pagiging floating status ko?magiging problema po ba sa akin ang pag ayaw ko ng mga ino offer nilang agent position? naghihihintay na lang po ako ma redundancy at ano na lang po ba ang 3 months na pag aantay. pero gusto ko lang po na makasiguro na hindi ako gagawa ng kilos na ipapahamak ko sarili ko para hindi nila ibigay sa akin yung mga benefits na kasama sa redundancy.Antayin ko po reply niyo. Pero sinisuguro ko din na habang technically employed pa ako sa kanila, ayoko makahanap sila ng butas para ma terminate nila ako at mapurnada pa mga benefits na makukuha ko sa kanila. Anyway, siguro madami lang din akong iniisip kaya ko naitanong yung sa itaas. Hopefully maayos na to sa katapusan ng Semptember at nakakapagod din yung naka PMA mode ng ganito katagal. hehe Quote Link to comment

Meron daw bibilhin na lote and idedevelop daw ito. Ang cooperative is registered with CDA (Cooperative Dev't Authority). Ang price per lot is P50T for 50 sq.m., payable in 5 years. Marami po ang naeengganyo kumuha including our family. In all po 6 lots ang kinuha namin na iba iba ang sizes. Naiissuehan kame ng certificate of lot reservations. Nagbabayad kame ng monthly contributions until last Dec. 2012, wherein itinigil namin ng sobra na ang pagdududa namin dahil nung ininquire ko sa barangay Cupang, Antipolo ay wala pa rin daw progreso at ni walang application itong cooperative to make any kinds of improvements. Malaki napo ang naihulog namin, mahigit 200k napo. Meron silang inissue sa amen na Member's Passbook na nandun po nila nirereceive lahat ng binabayad namin. Sa ngayon po tuwing tatanungin namin ang opisyal nila ay puro pangako pa rin ang binibitawan na bibilhin na yung lote, etc. Pero puro ganon lang. Nakakuha na rin ako ng ibang complainants, sa ngayon nasa 5 na kameng indibidual. Gusto na naming mabawi ang pera namin pero walang humaharap na opisyal, laging wala sa opisina. There is nothing better than the threat of imprisonment to make them talk. At any rate, I suggest that you avail of the services of a lawyer. Guest Jiraiya792 Posted July 11, 2013 Share Posted July 11, 2013 (edited) i suggest write a formal demand letter first to the officers of the cooperative airing your concern. in preparing the letter, try asking legal assistance from the PAO District Office nearest you.consider mo din ung available recourse sa Cooperative Development Authority as per Mr. roamtheplanet's post... of course, kelangan indigent ka para qualified ka sa legal services ng PAO. this is the reason why ndi humahawak ng corporate cases ang PAO, kc pinepresume na may pera ang isang korporasyon. Members of a cooperative, however, is a another thing. anyway, since napag usapan ang free legal services ng PAO, share ko na lang how to avail their services: PAO's indigency test: Metro Manila > below 14k monthly individual incomeother cities > below 13k monthly individual incomemunicipalities > below 12k monthly individual income better kung kuha ka na lang ng Certificate of Indigency sa barangay niyo.. sadly, from my experience, kahit ndi indigent nakakakuha nito..pwede ding Certificate of Indigency from DSWD or latest ITR/payslip ndi kelangan dalhin lahat ng yan. kahit alin sa tatlong yan pwede na.
