got the latest update from DTI regarding sa case ko. they said that the schedule for my hearing will be on February 2009 pa. They are fully booked as of the moment and so many filed cases are waiting in line also.....is it ok? is it a valid reason? is such case as "fully booked" really happens on DTI? anyways, I also called up PAO in Las Pinas, they didn't accomodate me as well. They said that small claim cases are beyond or not included with their "extension"...again, is it true? ganun ba talaga ang patakaran sa PAO? Pardon me for asking a lot of questions. it's just that I barely know a lot of legal procedures. Again, thank you for your answers.

Yes there is such a thing as "fully booked" in the hearing of cases, be it civil, criminal or administrative ones. If the calendar is already full, it could no longer accommodate cases anymore, hence, "fully booked". Furthermore, January is usually an inventory month and there are no cases scheduled for said month, thus, your hearing on February 9 is probably the earliest they have.

 

Regarding your query about PAO, please be reminded that the services of PAO is not for everyone. it caters only to the poorest of the poor or what is referred to as "indigents". Who are indigents, you ask? well persons and their families who have a gross monthly income of less than P14,000 in cities are considered as an indigent. Furthermore, the priority of PAO lawyers are criminal cases assigned to them, so dont expect them to prioritize your case if they have conflicting schedules. Hope this helps.

Kasi po habang nagpapalit po ako ng gulong sa emergency bay ng Katipunan eh nabundol ako ng delivery motorcycle ng isang sikat ng pizza restaurant, sinagot naman po ng resto yung hospitalization, medication and rehabilitation po ng paa ko. Kaya lang po sa dahil sa lakas ng tama po sa akin eh nalamog ng husto ang legs ko kaya d ako makapasok ng opisina, ang tanong ko po eh liable po ba ang resto na bayaran ang sweldo ko? at ano pa po ang dapat nilang sagutin? 2 months na po but until now di po ako nakakakuha ng feed back sa management ng resto, pero tuloy p rin po ang bayad nila sa rehabilitation ko. Yes you can. damages can be a lot of different things and your unrealized income as a result of the accident is one of them. If this case goes to trial, you can even ask for moral damages. What you should do first is to talk to a lawyer and pay him to make you a good demand letter. the pizza company would probably settle as this would be bad for their image should this go to court.

Thank you po for the quick reply sir. My partner already had a lawyer create a demand letter but up to now po kasi wala pa rin pong feed back yung resto eh, pahirapan po eh. One of the other dilema i have right now is if the case goes on trial i dont know a good lawyer to represent me as well as I dont have the means to pay for the legal fees, im just praying that the resto would just settle na lang out of court. By the way if the case goes to court what are the things should we demand out of the resto? tnx po ulit.

gud day sirs! i've been reading thru the pages of this thread hoping to find an answer to my problem, although i've learned so much from the various issues here, i didnt find any similar cases to what i have. heres how it goes. me, my gf and her child plan on migrating to australia. We can all be granted immigrant visas thru their student program, wherein my gf applies for a student visa and her immediate family (meaning me and her child) are also granted immigrant visas as fast as 3 weeks which all depends whether we can produce the required docs in time. requirements are medical exams, bank certs for show money purposes, offer letter from school, marriage certificate to prove that we are husband and wife and letter of consent from her illegitimate daughters father. problem is if we let the father know our intentions we definitely wont get the letter of consent we need. so what i did was i consulted a friend who's taking up law right now, and asked him to compose a moa for me regarding our situation. so he made me this moa saying that all financial, educational, health, etc.... in short everything that has anything to do with the child, my gf will shoulder and be responsible as long as the purpose is for the good of the child and until the child reaches the right age. moa also indicates that the rights of the father are not stripped away since those rights are not really possible to take away especially with just a moa. so we tried to talk to the father but unfortunately he's too thickheaded or too dumb to even hear out what we are trying to propose. right now were thinking of a way to strip away the fathers parental authority over the child. i've been reading a lot on the child welfare act and i read somewhere in there, one ground for classifying the child as neglected or abandoned is by having my gf file a petition to the dswd that the father hasnt been giving child support for more than 6 straight months. and we just heard that he just had his 2nd child from another woman last month and they are now living together and he is jobless for almost a year now but he lives with his parents. my question is if we do file a petition is it going to be that simple or do we have to endure a very long court hearing, and if we do get the moa signed arent we in danger of losing the child bec we have to get married, i read somewhere in the article that once the mother marries 1st her parental authority is stripped away. is there another way i can adopt the child without the consent of the father or if i could void his parental authority since i've been filling up his role as father to the child (like all the expenses and especially the care and love are all given not bec of my gf but bec its true that i've grown to love the child). so to make things short, what we want to happen is strip away parental authority from the moron, get married, adopt the child and take my name and fly to aussie and live happily ever after, so what am i doing here, is this all correct or is there an easier, faster way or is there a loophole in the system or i dont know........... im burnt out....... help please guys. fast facts; my gf isnt married, the child just turned 3, shes been with me since 2, last child support i could remember the father shelled out was june 22, but my gf says cakes and gifts are not considered sustento, hehehe. i know you guys will give your thoughts on this and i thank you in advance, mtc peeps are the best! :mtc:

It appears that the father is uncooperative. If the principal goal is just to migrate to Australia and letter of consent is a requirement, probaly instead of submitting a letter of consent, submit an sworn-statement by your gf saying that the father has effetively abandoned the kids and therefore, letter of consent is in applicable or could not be secured.

 

Sworn-statement must be precisely worded to attain your goals.

 

 

If such will not suffice, then you may consider going to a lawyer. Ok naman opinion ng law student but ang layo nyan sa opinion ng practicing na lawyer. So better go to one who is licensed to practice law. O good luck.

1) Before you can take your child outside the country, you must secure the consent of your wife, OR a court decision appointing you as her sole guardian;

2) you can ask your wife for support if she is gainfully employed HOWEVER, you must think this over because she may use this as a ground to gain custody of your child;

3) Yes, these could be grounds for annulment/legal separation, but best to consult a lawyer who knows ALL the facts;

4) Between P50,000 to P200,000, depending on the ground used;

5) Technically yes, but bear in mind that she is the mother and for you to have a peace of mind, it is best for the Courts to decide who among you is well-suited to take custody.

I was just sexually harassed by a gay guy inside a steam bath room sa gym. I was there alone but I wanted to ask the maintenance man to put some camphor fluid so that the scent would be nice inside. So I went out the steam room and found the M.man. When I went back again to the Steam room someone came after me. I was seated next to the door and he was seated on my same seat just barely 3ft away from me. Not even a minute has elapsed and the gay guy moved closer to me. He did that twice and on the second he did that I moved away and I was already hitting the wall on the side. I thought maybe he wanted to get close just to talk or maybe he's feeling dizzy from the heat. But things got way out of hand when he approached me the 3rd time and we were literally rubbing thighs and shoulders. In my mind "what's up with this guy?" Then all of a sudden he grasped my legs, twice! I shrugged him off twice but the 3rd time he made a quick move and got a quick hold of my crotch. I immediately asserted myself and shoved him away and I said angrily to him that I'll sue him for sexually harassing/assaulting me! He quickly said that he was sorry, again and again but I didn't give in. I asked him that we both get out of the steam bath and I'll accompany him to his locker and get his identification. He said that he didn't have ANY ID on him?! Then, one of the instructors saw us and I asked him to immediately call security, by luck the security suddenly was just besides him. From that moment he was down on his knees praying and asking for my forgiveness. He confessed to the security and all the instructors that were there on the locker room who saw him. I didn't lay a finger on him and I told him I'm going to file a sexual assault case against him. I've been a Filipino citizen my whole life and this is the 1st time I was sexually abused, by a gay guy no less! He both wrote an incident report wherein he confessed about his malicious deed and he also said that to the manager of the gym. I told the manager that we should have security escort us to the nearest police station but of course the gay guy was waiting for his attorney. No matter, since he already confessed personally to all the witnesses almost a dozen of them and also a sworn statement that he was guilty of the crime I simply left with all the documents... a copy of his statement, a copy of the statement of the security guard who was with us during the time, a copy of his SSS ID and also the firm backing of the gym if ever I might need witnesses. I felt really defiled that time, till now, actually. According to a friend of mine that even if he had an attorney there's no way their case will even hold up in court due to his written and verbal confession and the numerous witnesses who saw it. My friend said that "aregluhan nalang ang last option nila" because I was morally defiled. But the question ko po sana is how much should the gay guy pay me in moral damages? Will there be a flat rate? Or will that depend on my decision and what is agreed upon? I was the talk of the town in the gym that time. I felt like there's a logo on my back saying "gay guy got to you first!" I don't know if I can go back to the gym again without being paranoid or overly cautious to ANY guy that I encounter in the lockeroom. :sadsmiley02:
