(ex. upon award, upon contract signing, upon payment of services, etc.) So long as that event has already happened, you would be entitled to a commission. also, how is the incentive scheme worded? Are there qualifications? Can it be changed by the company? If not, then you would be entitled. Just make sure all these have already happened. Also, be aware that going to the NLRC will damage your relations with the company. After you file a complaint, expect the company to to look for opportunities to terminate your employment. Also, are you an employee or part of management? This could impact on whether you can go to the NLRC or not.Hi rocco69, thanks for the quick response. The accounting dept. will include the sales commission in our payslip after 6-8 months after closing the deal. The commission we can get will be computed based on their Sales Incentive Scheme. By the way HR gave me copy of this incentive scheme upon signing the contract. The project that I mention was closed September 2018 and I receive the incentive April 2019. Waiting for 7 months I'm expecting to receive almost 1 million commission from that project but they just gave me a merely 5% of it. Now the same project occur again because its a subscription based product and closed it again for the 2nd time. I'm thinking they will do it again giving me lousy reasons for not giving me the correct commission. Right now I'm looking for another job opportunity before I resign and complaint them to NLRC. ThanksDropping by to give a few cents, though just a disclaimer that this isn't conclusive: 1) Was this so-called incentive scheme by your company properly explained to you during your interview/orientation/job offer? If not, do you have evidence to prove they didn't? If you can get that sort of information then you can contest that the terms of employment weren't explained properly to you, therefore you had no actual consent. 2) Keep all your payslips, etc. This will be important to establish that you had an employer-employee relationship, which they may deny by pointing to the terms of your contract. Which brings us to number 3... 3) Keep your signed copy of the contract safe. Look at the terms, particularly your job description. These days, a lot of employers add the term "Manager", "Officer", or "Associate" to a job title not only because these words make it sound snazzy, but also because they'll try to use it later on to claim you're not rank-and-file but rather management. Take solace in the fact that the Labor Arbiter will not fall for those cheap tricks--SC rulings have pointed this out countless times. Only idiots would make (or fall for) those arguments. I agree with Libertine that this will definitely sour your relations, and even getting a whiff of your plans may make them out to get you. Make sure you're fine losing the job before proceeding, kung segurista ka. Tibay lang ng loob sir. Magastos at nakakapagod ito for sure though. Nagstart ako sa work Nov.7,2019 as receptionist sa isang spa sa loob ng mall. ang sahod ko is 537/day. Umaabot ng 11-12hrs ang duty ko pero wala naman bayad ang OT ko. umabot pa ko ng 13-14hrs duty this month kasi nagmidnight sale ang mall then sumabay pa yung pag aayos ng CCTV nila na ang permit is 12am-2am ako ang nagbantay nun so halos 16hrs yon. but still walang OT, tapos kapag late ka 100per hour ang singil nila. And as far as I know, double pay ang holidays pero walang ganun sa pinasukan ko. And sa nature of work, ang expectation ko sa work ko as receptionist is pag accomodate sa client and pag provide ng information needed ng clients pero bukod dun, ako din ang nag aayos ng payroll, penalties and deductions ng therapists. for double checking nalang yung may ari. Even small towels na pwede namang isama sa laundry ng malalaking towels eh hndi nya pinapasama kasi ako daw ang maglalaba ng small towels na yon so ayun gnagawa ko. Any other applicable laws?I hope to hear from u soon atty.Thanks in advance.Have a good day.It could fall under RA 9995 (the Anti-Photo and Voyeurism Act of 2009).I say "it could" because RA 9995 prohibits the following:(a) To take photo or video coverage of a person or group of persons performing sexual act or any similar activity or to capture an image of the private area of a person/s such as the naked or undergarment clad genitals, public area, buttocks or female breast without the consent of the person/s involved and under circumstances in which the person/s has/have a reasonable expectation of privacy; (b ) To copy or reproduce, or to cause to be copied or reproduced, such photo or video or recording of sexual act or any similar activity with or without consideration; (c ) To sell or distribute, or cause to be sold or distributed, such photo or video or recording of sexual act, whether it be the original copy or reproduction thereof; or(d) To publish or broadcast, or cause to be published or broadcast, whether in print or broadcast media, or show or exhibit the photo or video coverage or recordings of such sexual act or any similar activity through VCD/DVD, internet, cellular phones and other similar means or device. Kung babasahin natin ang letter (a) ng Section 4 ng RA 9995 hiwalay yung "performing sexual act or any similar activity" sa "to capture an image of the private area of a person/s such as the naked or undergarment clad genitals, public area, buttocks or female breast". Lumalabas na dalawang magkaibang gawain ang pinaparusahan sa letter (a), at ito ay dahil sa salitang "or" na naghihiwalay sa dalawang parirala na iyon. ANG PROBLEMA... pagdating sa letter (b ) at (d), ang pinaparusahan na lang ay yung gawain kaugnay sa "performing sexual act or any similar activity". Mas malala, sa letter ©, naging "sexual act" na lang, pati yung similar activity NAWALA. Ngayon, ang binabanggit mo na di-umano'y kriminal na gawain ay ang paggamit lang ng larawan ng hubad na babae, na PARANG saklaw sa letter (d) ng RA 9995. Kaya lang, hindi ito nasa akto ng pagtatalik o kahalintulad na gawain, na klarong pinaparusahan sa letter (d). Ngayon, kapag may doubt sa application ng batas, ang doubt ay dapat kumiling sa akusado. Kaya, dahil may pagdududa kung saklaw nga ang pag-publish ng "image of the private area of a person/s" sa pinaparusahan ng batas, dapat HINDI ito saklaw. Ngunit, subalit, datapwa't... ang talagang makakapagsabi lamang kung saklaw nga ang publication ng "image of the private area of a person/s" sa letter (b ). (c ), at (d) ng Section 4, RA 9995 ay ang Korte Suprema. Bago pa ang RA 9995 at di pa umaabot ang issue na ito sa pinakamataas na hukuman.
