1. - Ano yung mga legit basis para ma-grant ka ng Government for Single Parent Beneficiary?

 

Kailangan solo parent ka, which is:

 

(1) A woman who gives birth as a result of rape or crimes against chastity, even without a final conviction of the offender: Provided, that the mother keeps and raises the child;

 

(2) Parent left solo or alone with the responsibility of parenthood due to death of spouse;

 

(3) Parent left solo or alone with the responsibility of parenthood while the spouse is detained, or is serving sentence for a criminal conviction for at least one (1) year;

The law applies to the spouses of prisoners, whether or not a final judgment has been rendered, provided they are in detention for a minimum period of one (1) year;

 

(4) Parent left solo or alone with the responsibility of parenthood due to physical and/or mental incapacity of spouse as certified by a public medical practitioner;

 

(5) Parent left solo or alone with the responsibility of parenthood due to legal separation or de facto separation from spouse for at least one (1) year: Provided, that he or she is entrusted with the custody of the children;

 

(6) Parent left solo or alone with the responsibility of parenthood due to declaration of nullity or annulment of marriage as decreed by a court or by a church: Provided, that he/she is entrusted with the custody of the children;

(10) Any family member who assumes the responsibility of head of family as a result of the death, abandonment, disappearance or prolonged absence of the parents or solo parent: Provided, that such abandonment, disappearance, or absence lasts for at least one (1) year.

need some advice.. here's the scenario

 

november 2013 - new roof was installed

june 2014 - construction next door started ( apartment complex, adjacent to the south side of the house)

october 2014 - we filed a complaint against the construction for damages to the property.. they did not put up a net to catch any falling debris and the almost year old roof was damaged. their worker would sometimes take their breaks on our roof without permission. and they would also step on our roof. we have construction waste (wood .. i think you call it dos por dos? basically its the long squarish wood that might actually be 2x2) at one point we even found a plastic full of human waste. we filed a complaint sa barangay

december 2014 - an agreement was settled that they would replace the roof and fix any damages caused by their construction

 

as of now, they have not done any repairs and roof replacement. also it rained tonight and the second floor was flooded... some of my stuff had water damage because of it. although the stuff are not expensive (craft materials) but they do hold a lot of sentimental value for me... clothes were damaged too and most probably the floor.

 

question, can i take them to court at this point? it has been 9 months since an agreement was documented through the barangay and there is still nothing.

 

btw, we went next door to talk to them after the rain, and they did not come out to talk to us. so basically nagtatago na sila.

 

another thing, i have not sued anybody so i dont know how much lawyers would cost. so if anyone can pm me if i can sue the neighbors for damages as well as how much we'll need. im hoping to sue them and have them pay an amount so we can have the roof replaced again since it doesnt look like they'll fix it. or should we go thoruogh the barangay again?

 

btw last time we went to the barangay they were no help at all... like they just sat down and asked us to talk instead of tell the neighbors to fix our roof.

 

also there are 2 other houses affected, not just ours.

dahil may napagkasunduan na kayo sa barangay, NA HINDI NILA SINUSUNOD, you can now have the agreement implemented through the Municipal/Metropolitan Trial Court, You'll have to file a petition for implementation of the kasunduan with the MTC

What if you build a closed shed for your car to park in to protect it from the weather then your neighbor is envious about it so they will spray water using a hose on any opening to make your car inside wet. The shed is not on their property at all. What kind of charges or complaint can you file against them? What kind of penalties will the charges have?

Other mischiefs, punished under Art. 329 (3) of the Revised Penal Code, which provides: By arresto menor [imprisonment of 1 day to 30 days] or fine of not less than the value of the damage caused and not more than 200 pesos, if the amount involved does not exceed 200 pesos or cannot be estimated.

 

Ngunit, subalit, datapwat... dahil kayo ay magkapitbahay, kailangan munang dumaan ito sa barangay. Ireklamo mo muna sa barangay. Titigil naman siguro yan pag inireklamo mo na sa barangay

Pwede ko ba tanggalin sa trabaho? Wala na kasi ako tiwala. pwede pa rin nialng gawin sa akin yun. Madalas na nga late sila at absent pero pinagbibigyan ko p rin.

Pwede kang magtanggal ng empleyado sa sumusunod na dahilan:

 

a. Serious misconduct or willful disobedience by the employee of the lawful orders of his employer or representative in connection with his work;

b. Gross and habitual neglect by the employee of his duties;

c. Fraud or willful breach by the employee of the trust reposed in him by his employer or duly authorized representative;

d. Commission of a crime or offense by the employee against the person of his employer or any immediate member of his family or his duly authorized representatives; and

e. Other causes analogous to the foregoing.

 

Yung a at b, hindi applicable.

 

Yung c. baka pwede. Pero, kailangang ang mga posisyon ng empleyado mo ay nangangailangan ng trust and confidence, para masabi na ikaw ay nawalan na ng tiwala sa kanila, Mga halimbawa ng pwesto na may trust and confidence ay manager, security guard, salesman, cashier, etc. Kung ordinaryong laborer o mananahi, halimbawa, mahirap gamitin ang loss of trust and confidence.

 

Yung d, baka pwede rin kung babagsak sa paninira o libel yung mga pinagsasasabi ng mga empleyado mo, sapagkat ito ay pinaparusahan sa Cybercrime Act of 2012 (RA 10175).

 

Kung talagang desidido ka (o para matigil lang ang mga ito), padalhan mo ng Memo yung empleyado concerned "to explain in writing within 72 hours why they should not be held liable and disciplined, INCLUDING THE PENALTY OF DISMISSAL, for making malicious and false imputations against the proprietor (or owner or manager, o kung ano man ang posisyon mo)." I-attach mo ang transcript ng relevant portion ng kanilang FB conversation (transcript na lang, at portion lang, para di mahuli yung nagbigay sa iyo, at para din di nila alam ang extent ng alam mo sa ginawa nila)

 

Pagkatapos nilang mag-explain, kung di katanggap-tanggap ang explanation nila, you WRITE ANOTHER MEMO and give it to them, where you impose disciplinary sanctions on them. Bahala ka kung ano yun.

Hiwalay sila sa amin eversince malilit pa kami so sa madaling salita ako lng lumaki sa parents ko. Willing naman ako ibigay kung anu mga naiwan ng mother ko. Need help lng po regarding my siblings na decesead po mother namin etong mga siblings ko nag hahabol sa akin never silang lumaki sa amin. Hiwalay sila sa amin eversince malilit pa kami so sa madaling salita ako lng lumaki sa parents ko. Willing naman ako ibigay kung anu mga naiwan ng mother ko. Yung problema pati pera ng company na under my name gusto nila habulin naka or kasi si mother sa bank accounts ko po. sa akin may habol pa po ba sila? Sole prop. Po yung business nag hehelp lng si mother sa business po nung buhay pa sya.

don't mind them. you have no obligation to your siblings..the question, however, is when your mother died, did you execute an extra judicial settlement of estate? did your mom leave any real estate under her name? do your siblings bear your mother's name in their birth certificate? how about your dad, where is he?

 

while your siblings have no cause to run against your company, some lawyer may have advised them to go after you for some inheritance you have where they were excluded, and therefore, use your company to off set whatever claim they may have.

Ito po scenario. My high school buddy is being accused online at facebook by some woman. Ngayon ang problem is that he tried confronting the woman and told her na magdalahan nalang ng abugado and settle this dispute in court but the girl snubbed my friend and even posted my friend's full name along with his picture and telling all her friends to BEWARE of my friend. My friend would like to file a case against this woman but all he can get from her is her name in facebook, not even sure if it's her screename or real name kasi she "models" and does "stage acting." Pwede pa ba mag file ng demanda and is there any way to identify her true identity?

yes possible.... under libel.

but then, you have to have enough evidences to do it, including her real name, her real address, etc.

if you pay a private investigator and do some additional computer tracking, you can identify her true identity. gagastos ka nga lang and uubos ka ng oras for what?

 

another option is just to ignore it, and delete his facebook account.....
