yeah bro, we are on the same boat, the 150-250K, may share yung asawa mo dyan and it's going to be a long process...

 

at least for legal separation, all your future assets will be secured...

I hope your lawyer told you that LegSep only allows you to go separate ways but it does not extinguish the marriage bond, meaning if you get into a relationship with another girl technically you are still covered by the provisions related to concubinage (if you have sexual intercourse, under scandalous circumstances, with a woman not your wife or cohabit with her in any other place).

 

Ipon na lang kayo pa ng konti, para tuluyan nyo na lang ipa-declare na void yong marriage mo. Think of it this way, at present you have no intention of remarrying but what if you fall in love eventually and think of settling down but you wouldn't be able to kasi legal separation lang ang ginawa nyo. So, you pay P75,000 now (more or less) but then later you still pay the fees for the action to declare your marriage as a nullity, nagpatong lang yong gastos.

 

Although yon nga lang kung may assets to consider ok ang legsep. But if you have assets to consider, ibig sabihin may pera ka so bakit hindi mo pa tuluyan na ipa-void yong marriage mo?

 

Oh ingat lang din pala sa sharing fees with your wife when it comes to declaring your marriage void, verbal lang lahat walang contract or agreement dapat. May rule kasi against collusion. If the Fiscal (who is acting in representation of the State) finds in his investigation that there is collusion (or an evident agreement that the parties want to have the marriage voided) the court will dismiss it. Pero kung may "special arrangement" na kayo for the process, hindi problema yon.

yeah bro, i know this, actually, i am postponing my legal separation because in the near future, i would be applying for an annulment, i am sure my wife would agree on it and soon, hopefully it would be over..

alalahanin mo din na ang paghahain ng petition for legal separation ay isang pag-amin na mabisa ang kasal mo (otherwise, hindi lang legal separation ang isinampa mo, kundi nullity of marriage na). dahil dito, baka hindi ka na payagan, later on, na maghain ng action for nullity of marriage (dahil nga inamin mo beforehand na valid ang kasal mo).

care to expound on this statement sir??? and what's your best advise??

 

our lawyer, in my assesment is not too bright (hence, the cheap rates she offers us) so i am compelled not to ask some opinions regarding this...

Sir, What would be the probability or chances of my marriage to be null and void kung ganito po ang nangyari.

1) Nagpakasal po kmi sa Manila City Hall pero hindi dumaan sa tamang proseso. May fixer po kc pero may nagkasal sa amin doon.

2) Wla po yung parents ko and kailangan nila ng written parents consent because Im only 20 years old(male) and my wife is 25. Dpo alam sa amin to. So ginawa po nila dinaya na lang po yung written parents consent na ako po ang nag sign.

3) Nagtaka rin po ako dhil sabi nung employee don na sa Caloocan City Hall daw namin makukuha marriage contract kc mahigpit daw po don sa MCH at that time. Sa manila ako nagpakasal pero sa caloocan ang marriage contract ko.

4) 1999 pa po kami kasal and valid po ang kasal kc naka registered po sa NSO.

 

I want to know the chances kc po sayang naman po yung magagastos ko kung wla naman pong mangyayari...

sabi nga ni redblack, legal separation only allows you to live separately from your spouse, but the marriage bond is not severed. sa madaling salita, kasal pa rin kayo sa isa't-isa - mabisa pa rin ang kasal nyo, yun nga lang, pwede na kayong di magsama.

 

kung humihingi ka ng legal separation, ito ay pag-amin na walang diperensya ang kasal nyo, na ito ay mabisa - kaya nga, imbes na hingiin mo na ipawalang-bisa ito, ang hinihingi mo na lang ay payagan ka ng hukuman na hindi na makisama sa asawa mo.

 

best advise - yung sabi ni redblack, mag-ipon ka na lang para mai-raise mo yung amount na kailangan para sa kaso na "declaration of nullity" ng kasal mo.

hindi mo na maipapawalang-bisa yung kasal mo kung ang pagbabasehan mo ay ang kawalan ng consent ng magulang mo ng ikaw ay magpakasal.

 

oo nga at ito ay ground upang ipawalang-bisa ang isang kasal, pero ito ay dapat isampa sa loob ng limang taon mula ng ikaw ay naging 21. ayun na rin sa kwento mo, 20 years old ka nung 1999, ibig sabihin naging 21 ka nung 2000. Hanggang 2005 ka lang pwedeng magsampa ng kaso para sa ground na ito. dahil 2010 na, paso na ang kaso.

 

pero ikaw na rin ang nagsabi na fixer ang naglakad ng papeles mo. tingnan mo ang iyong marriage certificate - sa dulo nito ay may bahagi na nagsasabing "Marriage License". tingnan mo kung anong numero ng lisensya at kung saang lugar ito na-issue. puntahan mo ang Civil Registrar ng lugar na nag-issue ng marriage license at magtanong ka dun kung meron ngang ganung marriage license (may mga fixer kasi nung 90's na gumagamit ng fake na marriage license). pag sinabi ng Civil Registrar dun na walang marriage license na na-issue sa pangalan mo at nung asawa mo, maswerte ka, at walang-bisa ang kasal mo mula sa simula - punta na sa abugado para maihain agad ang kaso. pero alalahanin mo na ito ay suntok sa buwan, kapag may ganun ngang marriage license, ang option mo na lang ay ipa-walang bisa ang kasal mo sa ilalim ng Art. 36 ng Family Code - na "psychologically incapacitated" ang asawa mo.

Hi to all!

 

my wife and i been separated for over 9 years, just a year after my wife gave birth to our daughter we decide to live separately for the very reason of irreconcilable compatibility. My wife's lawyer ask me to sign a certain agreement and agreed to live separately.

 

We still have communication, because i am supporting my daughter.

 

Last year my wife having an affair to another guy and got pregnant, recently she give birth.

 

I decide to file an anullment. what should i do?

P.S. malamang sa hinde, hindi ka makakapagfile ng adultery case laban sa asawa mo dahil dun sa pinirmahan mong agreement 9 years ago.

 

sa ilalim ng batas, ang maaari lamang magsampa ng adultery ay ang "napinsalang asawa".

 

kapag may parte dun sa agreement na pinirmahan mo na nagsasabi na pumapayag ka na ang bawat isa sa inyo ay maaaring magkaroon ng bagong partner, ito patunay na pumayag ka na makisama siya sa ibang lalake, kung kaya't walang pinsala sa yo ang pakikisama niya sa iba.
