I have only two questions.

 

1. What can you say about the constitutionality of Executive Order No. 464 as amended in relation to the principles of checks and balance and separation of powers?

 

2. One evening, A, while drunk, went to to dark portion of the sidewalk, pulled out his penis, and was about to take a pee when he stumbled over B, a female, who was squatting at the same place because she was also peeing. In the process, A fell down over B and his penis penetrated B's vagina.

 

B filed a complaint for rape with the aggravating circumstances of nocturnity and intoxication. A's counsel pleaded "not guilty" and alleged that the victim was guilty of contributory negligence because the latter did not warn him that she was also at the same place squatting. The trial court convicted A of "Reckless Imprudence Resulting to Rape". A appealed.
