  1. Guys, questions:

    • Sinong nakakaalam kung san pwedeng makabili ng air hose para sa Paasche airbrush. Nanakaw kasi yung sa akin, haven't found a place to get a replacement yet.
    • Does anybody play Warhammer 40,000 here?

     

    Actually, I haven't even seen a Paasche airbrush sold here. Might be the only option is mail order thru the internet? Perhaps the more experienced modelers here have a better idea.

    When I signed up for my current job I was told that annually there will be an appraisal of my performance and that my annual salary increase will be dependent on said appraisal.

     

    I worked really hard and my manager happily gave me the highest rating which would merit a 10-15% increase. Around 80% of the department didn't even get the "meets expectations" rating.

     

    But a week after I signed my appraisal my manager told me that because we were in a new department and that there were no standard goals and also for the benefit of the majority, everyone would be given the "meets expectation" rating including me.

     

    This would mean my salary increase would only be around 7% and less career opportunities within the company. I was hoping to transfer to a different department but my new rating automatically disqualifies me from transferring.

     

    I just want to know where I stand. It seems so unfair after all the hard work I've put into the program.

    Welcome to the real world. A merit increase is purely discretionary on the part of your employer, especially if you are an officer. If you are rank and file, you can take this up in a proper grievance procedure or with your union if you have one.

  3. I loaned my ex-officemate a large amount of money. He issued a post-dated check as payment but when the check matured he kept asking for time to fund the check. After two months passed, I said I will deposit the check even if it bounces. He became hostile and threatened to accuse me of trying to buy drugs from him. He said he will print previous texts I sent him and edit them to make it appear as if I tried to buy drugs from him.

     

    Can he use these edited printouts of text messages to accuse me? Or more importantly, will any court accept these as evidence against me? Thank you in advance.

     

    Just deposit the check so that the bank can return it as a DAIF or due to closed account and make your ex-officemate liable under BP 22. I wouldn't worry about those edited printouts of text messages. Why are you so concerned about them?

  4. Should solo parent leaves (not more than 7 days) be deducted from emergency leaves? How many leaves are employees entitled to in a year?

     

    Solo parent leaves, unlike vacation, sick and maternity leaves, are not mandatory benefits. If the company grants solo parent leaves, it depends on company policy on how this will be applied.

  5. Good morning po sa mga Legal Minds ng MTC,

     

    Hihingi po sana ako ng advice kung ano ang mabuting gawin, tungkol sa pagbili namin ng lote.

    Ang subdivision po ay located sa Antipolo. Pero hindi pa po ito nade-develop. Pag pumunta po kayo doon ay puro damo at mga punongkahoy ang makikita nyo. Wala pa pong anomang kalsada. Ang total land area po ng subdivision ay 9 hectares.

    Ibinebenta po nila ito sa paraang kung tawagin ay "pre-selling".

    Napakamura po ng downpayment, 5,000.00 pesos lang po. Ang monthly po 650.00 pesos lang, payable in 25 years.

    Ang regular cut na lupa ay 40 square meters "with title" daw po ito. Sabi po sa kanilang leaflet ito po ay "thru: COMMUNITY MORTGAGE PROGRAM".Lote lang po ang ibinebenta nila, wala pong house construction na kasama.

    May resibo naman pong ini-issue, may TIN no. naman po sa resibo.

    January,2011 daw po ang start ng pag-develop.

     

    Paano po kaya namin matitiyak na hindi "scam" o lokohan ito?

    Saan pong opisina o sangay ng gobyerno pwedeng i-verify ang legalidad ng pagbebentang ito?

    It is only the Housing and Land Use Regulatory Board (HLURB) that gives licenses to sell to developers. Their office is located near the City Hall of Quezon City. I suggest you be very careful before you pay anything.

  6. Tried the new MB twice already. The first time, I was able to do two pops without pulling out. I was still very stiff after the first pop so I just left it in. The girl asked if I had taken some medicine and of course I denied. The second time I took an MB because I wasn't in the mood but lo and behold, was able to get it up and rock hard. Have to get more of this stuff.

  7. Mahilig ako dati magbuo ng 1:24 cars, high school days, sumasali din ako pag may competitions dati sa motorshow & transhow. meron pa ba competitions ngayon?

     

    There are two major competitions hosted by two different IPMS chapters in the Philippines, one is in November, and the other is in.. I forgot but someone will chime in for me.

  8. Dr. Pepper..Thanks for the advice. I wrote a demand letter to my former company per your advice. Kahapon binigay na nila yung huli kong sweldo after over a year. Yun nga lang yung commission ko hinde pa naisama pero nangako sila (again) na in a week or two ibibigay nila din. Good enough.

     

    Consult ulit ako.. I helped this company get a project. As a reward they are offering me to be a director of one of their subsidiary company. If ever, as a director, ano po ba ang liability ko say sa isang project pumalpak yung kumpanya or magka-kaso yung kumpanya?

     

    Glad to be of help. I'm clueless what a director is. Is it a member of the Board of Directors or is it a rank in the company?

  9. I mean for example: Ahente ka ng pako sa isang hardware tapos yung cutomer na bumili ng pako pumutok yung checke,

     

    responsibility b ng ahente yun? , and yung customer na yun bumibili na sa hardware na yun, before pa nagwork yung ahente dun

     

    sa hardware , kumbaga sya lang yung naghandle nung account na yun...

    Ordinarily, the agent has no responsibility for the unfunded check of the customer. Unless of course, he was specifically instructed not to accept check payments.

  10. Good afternoon mga Attorney. Last year I consulted here yung sitwasyon ko. I resigned from a company and they held on to my last pay and commission, ITR and clearance because I have demo units on loan to clients that I needed to pull out and return. I've done that and reached an agreement with my former company to pay for some of the items that are unreturned per advice here.

     

    However, several weeks have passed since they told me that I'm cleared and they just keep on telling me that they would give me my money. Yesterday, I followed up and still nothing. So, I requested HR to give me a copy of the clearance if it's ready. They sent it to me and from the clearance, I saw that as of March 11, 2010, the person in-charge for demo units cleared me already and April 19, 2010 the VP for Finance has already given instructions. Today is July 21, 2010 and still no certainty that they are going to give me my last pay.

     

    Please advice me on what action I can take.

    Write a demand letter to the HR department, asking them to give you your last pay and commission, together with a computation. Attach a copy of your clearance. Copy furnish the president of the company. Keep your tone civil but point out that what they are doing is unreasonable and you would like an explanation why it hasn't been done yet. It's time to document everything just in case you have to file a complaint in DOLE.

  11. other question atty. may mga credit card company na kahit di na ako nag fill-up ng form binigyan nila ako ng card at nung tinawag ko sa hotline nila, pina-activate ko, activated na. ngayon, may mga late charges & finance charges na naiwan at lahat ng purchases ko lang binayaran ko upto single centavo. yung charges na nag accumulate nireklamo ko due to delay ang pag deliver ng SOA kaya delay din yung bayad.

     

    ngayon nasa collection agency na daw yung kaso ko at dadalhin nila sa Legal. tanong ko lang, may laban po ba ako? kasi wala naman akong pinirmahan na application form or agreement, maliban lang don sa credit card receipt na pini-pirmahan kapag nagpurchase.

     

    yung application ko lang po sa kanila is referals from bank, kaya walang akong application forms na sinangayunan or pinirmahan.

     

    Usually the credit card has fine print at the back that says something like "by using this credit card you agree to all the terms and conditions etc."

  12. paano na po ang mangyayari dun sa pagkakautang nila sa lending company?

     

    It depends on how virtuous the lending company is. Unfortunately, what I think will happen is that the lending company will simply declare the entire loan due and demandable, send a demand letter, and either continue with a foreclosure under the mortgage and even if the SPA is proved to be forged, will simply try to attach the wife's and husband's properties.
