  1. Under rule 38 if filed Can they use the previous evidences and say now lang nila nacheck or need new evidences?

Example exhibit A which has been presented and heard during actual trial. And they are not part of the document. Questions 1) can they still use the evidences sa formal offer ng plaintiffs for this rule 38 or need new evidence? Since napagusapan na ung mga evidences during regular trial can they dig the previous evidences and say ' ay may nakita kami na kaduda duda.' when their chance to check the docs has lapsed? 2) they are not part of the documents since illegal settlers sila their documents points to another lot.   5. I mean baliktad po. Kami ung owner. Illegal settlers occupying our lot. When we entered, threaten nya kami. Can we file criminal charges for the threatening?
  6. No future crime naman po. Pero the atty that may testify handled a land dispute case. The new case naman may involve the prev client of the atty or the atty knows private personal info of the client. Baka hanapin lang sya ng party to testify. Pued po ba?

  16. hi po, ask ko lang din. if meron pong lote na pina lease ng matagal say, 30-40 years. tapos within that period we the owners decided to stop the lease and pay anu nakalagay for the breaching of contract. pued po ba un? or di pued? i mean can the owner initiate and cancel the contract without any court case?

Hi mga masters, how does claiming of right-of-way just compensation work? our lot was affected by a DPWH road widening project several years back. since may pending court case, di ko inasikaso since baka ma affect ung case. but since it is taking a long time for the court case, i decided to move forward since i heard from dpwh that it will take 6 mos for the first half of the payment be processed. tapos by installments pa pala. 1) ganon ba katagal ang processing? another option i am thinking is to sell as is, if sold without getting the just compensation from the govt, and selling the whole lot without reducing the affected road widened area. 2) what are the things that may happen and consider? heard from dpwh kasi that if we sell it daw without claiming the just compensation, di na daw pued ihabol ng buyer ung just compensation since magiging road na daw. how come di na pued eh govt has not paid us yet so technically di pa govt-owned ung lots until paid. 3) what is the best option? a) sell the entire lot without claiming? di ba ako habulin ng buyer after knowing na bawas pala ung lote? kasi may possibility na as is nya bilhin with a court case na merong illegal possessor even if the court has decided kami ung rightful possessor un buyer na daw magtataboy? b) claim the just compensation and sell after the titles has been annotated with the reduced area?

Hi would like to seek advice on this matter: Meron kami lot that has been occupied by illegal settlers for so long sa qc, di mapaalis, now, nagaagawan kami magbayad ng amilyar, the illegal settlers was able to pay for several years up to 2027. 1) pued ba un na magadvance sila ng 2-3 years? di ho ba di pued ganon magadvance? 2) how to ask city assessor and city treasurer to stop accepting payments from the illegal settlers? 3) any other advice? thank you in advance.
