  1. NO. Madaling sabihing OK siya ngayon. Pag nagbago ang isip niyan, problema ka. The right time to do things correctly is when HINDI KA PA NAGLALABAS NG PERA!

     

    Kung talagang gusto nilang ibenta ang property, may paraan. Kung ayaw, may dahilan.

     

    Alalahanin mo ang Art. 96 ng Family Code:

     

    In the event that one spouse is incapacitated or otherwise unable to participate in the administration of the common properties, the other spouse may assume sole powers of administration. These powers do not include disposition or encumbrance without authority of the court or the written consent of the other spouse. In the absence of such authority or consent, the disposition or encumbrance shall be void.

     

    Kapag picture-picture or video lang, hindi ito matibay na ebidensya na pumayag talaga siya sa bentahan (baka sabihin pa nga niyan, Photoshop o inedit nyo lang yung video). Pinakamaganda, gumawa siya ng SPA kung saan binibigyan niya ng kapangyarihan yung asawa niya dito sa Pilipinas na ibenta yung property. Tapos, ipanotaryo niya sa consul. Kung hindi siya maka-appear sa consulate, pwede naman yung authentication lang (ipapanotaryo niya sa local notary public, tapos ipapadala sa consul by mail; depende ito sa lugar, icheck na lang sa internet).

     

    Pag nanotaryo na o na-authenticate na yung SPA, ipadala sa Pilipinas. O, ayos na.

  2. Hi attys of mtc. I have a question is it safe to have the deed of sale signed overseas? Ipapa dala ang deed of sale sa ibang bansa papa pirmahan habang pumipirma i video or picture. Medyo remote area abroad at malayo daw sa consulate kaya hndi maka pa consularize. Husband is signing here in manila wife is the one signing abroad. Safe ba ako pag binili ko ang property? Wife already sent me message on messenger na i acknowledge nya na sya pipirma for assurance na alam nya ang bentahan

May Car Loan ako sa isang Bank at the same time may credit card. na delay ako sa kotse ng ilang months kasi talagang hirap ako kumolekta sa clients ko pero plan ko na bayadan in full para ma kuha ko na ang CR ko. how ever ang sabi ng tumatawag saakin kailangan ko din bayadan ang Credit card ko dahil meron sa contract na dapat bayadan din yun para i release ang CR. tama ba yun?

  4. Magandang Araw po. Mag tatanung po sana ako sa mga attorneys natin re: Acquisition of a land. May binibili po kami na property sa isang individual. Nag pa check kami sa RD kung clean ang title ng seller. Lumabas na walang annotation pero may isang kaibigan na nag sabi na mag back check or silipin yung pinangalingan na documents bago mag confirm. Lumalabas na ang documents tulad ng previous title ay may mga annotations ngunit na cancel na ang mortgage. Nailipat ang title mula kay company A (developer) nuong 2012 sa new owner. Ang tanung ko po, possible ba na may iba pang owner na baka may hawak ng title? Kasi may hindi magandang reputation etong si Developer. Kung ma bibili ba namin na clear na ang present title at walang annotation incase sabihin natin na may mag hahabol for whatever reason maabala pa kami?

  5. Good day po! Tatanung ko lang kung kalian kailangan mag file ng extra judicial. May kaibigan kasi ako na ang FATHER ay na matay few months ago. Ang nakalagay sa title ay MOTHER married to FATHER at hindi spouses . Pag kailangan po ba i benta dadaan padin sa extra judicial settlement or waiver of rights lang? Lahat naman po ng anak ay willing na i benta ang property.

  6. guys hindi ko alam kung saan to pwede i lagay. pwede kasing sa annulment and real estate so MODS of MTC sorry po pero i post ko na din ito dito. very important lang po kasi THANKS

     

    Atty’s of MTC pa hingi naman po ng advice. Yung pinsan ko kasi under process yung annulment of marriage nila nung asawa nya. May document na din na nag sasabi na may separation of properties and kung ano mang bibilihin na property ay wala na silang paki alam sa isat isa. Si pinsan (guy) ko may magandang deal na makukuha sa isang condomium sa Makati na binebenta ng napaka mura. Gusto nya bilihin para i benta din or parang fast break lang maski kumita ng onti. Ang problem is presently married pa talaga sila nung girl, pero sabi within the year baka matatapos na yung case.

     

    Regarding sa documentation para sa sale nung sinabihan namin na mag pa gawa ng SPA or pumirma sa documents pag bili at pag benta eh ayaw makipag cooperate. Baka daw magkaroon ng effect sa annulment nila. By the way si babae ang nag file ng case and 100% wala balak mag habol sa mga ibang properties na pwede nya bilihin. Now pag gumawa po ba ng deed of sale dapat padin ba i lagay na married? Or ok lang na single si pinsan? alam po namin na mali yun pero sayang yung pag kakataon. Pag nilagay na married hindi naman pipirma sa babae.. pag nilagay na legally separated baka hanapan naman ng docs. Pag nilagay kaya na single walang maging problem?

  9. good morning sa mga attorneys! may question lang po ako tunkol sa copyright? yung mga pinsan ko kasi gusto mag tayo ng restaurant ang theme nila medyo retro. gusto nya mag lagay ng mga posters like elvis, rock and roll band even mga actors and athletes. pag kumuha ba sya sa internet at i print at i frame tapos i lalagay sa wall pwede sya ma kasuhan? yung iba naman ang plan nya ay bumili sa memorabilia shops then i lalagay nya din. na pansin kasi namin na may isang shop sa trinoma na may mga pictures na naka frames ng mga basketball players pero binebenta nila legal din ba yun? yung pag gamit ng angry birds at i lalagay sa damit legal din ba yun? please help me enlighten them

  10. hello docs. mag tatanung lang ako re STD's. i had previous contact with a nightclib girl. nag condom naman ako so medyo confident ako na lesser chance na mag ka sakit ako. my worry though is kung anong possible na sakit ang ma kukuha INCASE may sakit yung girl. ma linis naman yung area ng ari nya no signs of warts etc pero pag bigla kumati yun saakin natatakot ako. although alam naman natin sometimes na ngangati din talaga. after the contact ba gaano ka tagal mag karoon ng sign and symptoms pag talagang infected ang babae? medyo na pa praning ako eh!

  11. One spouse cannot sell the property of the absolute community or conjugal partnership without getting the written consent of the other (if he/she cannot get the written consent of the other, he/she can go to court and get judicial authorization to do so).

     

    If a married person sells absolute community property or conjugal partnership property without the written consent of the other spouse, the sale is VOID (see Art. 96, 124, Family Code).

     

    Note that in the absence of proof one way or the other, property acquired DURING the marriage is presumed to belong to the absolute community/conjugal partnership. So, it is important to know when the property was acquired. If it was acquired while they were already married, its presumed to be absolute community/conjugal partnership property (See Art. 93, 116, Family Code).

     

    Note also that if the property relations of the spouses is absolute community of property (which happens 99.9% of the time) all property owned BEFORE the marriage is also absolute community property (See Art. 91, Family Code).

     

    Moral lesson: Kapag kasal ang seller, it is ALWAYS THE BETTER PRACTICE to get the consent of the other spouse, by having the other spouse sign the Deed of Absolute Sale at the end under the portion "With my marital consent", otherwise you run the risk of having the sale declared void when the other spouse suddenly questions why the property was sold without his/her consent.

     

    P.S. Marital consent is, of course, not necessary if the property is exclusive but the burden of proving that it is exclusive falls on the buyer if it is proven that the property was acquired during the marriage (which could be hard if the seller does not cooperate)

     

     

    DIFFERENT ISSUE:

     

    It is difficult, if not impossible, to state an opinion on this issue when the documents involved are not presented. As of the present, we do not know what are the documents being used in the case.

     

    However, note that if there are two titles over the same property, both of which have not been cancelled, the older one will prevail. If the mother title was never cancelled, it remains valid, as against another title issued on the basis of another more recent title. Again, without all the facts, we cannot whether this is the doctrine applicable in the Visayas Avenue/Sanville case.

     

    thank you very much!!! i really appreciate it. as for the 1st issue it is now clear to me that whether "married" or "spouse" is written in the absolute sale both must have consent before they can sell the property.

     

    Sir i heard that if the primary owner of the property eg ABC married to XYZ was abandoned or if XYZ died ABC may just file an affidavit of abandonment to sell the property. on the other hand if eg "Spouses ABC and XYZ" one of them dies there must be an extra judicial settlement. is it true sir?

For purposes of ownership of properties, the term "married to" may be argued as a description of the person's civil status as one who is "married" but it does not follow the property co-owned by the married couple. As such, in some cases, if you were to sell a property where the description is merely Mr. ABC married to Mrs. XYZ, Mr. ABC may be able to sell the property even without the marital consent of Mrs. XYZ.

     

    If the description of the owners are "Spouses ABC and XYZ" it can be presumed that the married couple are the co-owners of the property. Thus, you cannot validly sell the entire property without the marital consent of the other spouse.

    thanks!! i have a followup question. so if the owner declared that he or she is married during the time of happy relationship and soon after, the couple will be separated, is the husband or wife of the owner can run after the property? like what you said the owner can sign the DOAS without the consent of the husband or wife. unlike when both spouses signed the contract it is clear that both of them did agree to sell the property. please enlighten me. thanks in advance!

    Different Issue

     

    to all the attorneys. what can you say about the issue of torres group who are assuming that they are the real owners of the 24 hec land in QC? if they have the original title, then what is the purpose of the title which the LRA has given to the present lot owners? i presume that those owners did some verification first from the RD before they build their buildings and homes. what if they have a certified true copy of those titles? which among the "real" title will be honored the mother title or the subdivided title?

  13. please enlighten me. ano po kaibahan pag ang nakalagay sa deed of sale is "married to" or "spouses".

     

    sabi nila pag married to at nag hiwalay na kailangan lang ng affidavit of abandonment ok na where as sa spouses kailangan dumaan sa korte.

  14. good evening! i dont know if this is the right place to inquire about a case. yung lolo ko kasi was given 2 titles ng isang ex general ng marcos regime years ago. itinago nya hanggan sa nakalimutan na na may title pala sya na hawak consisting of few hectares. ngayon yun uncle ko na anak ni lolo was cleaning the closet until he found the titles. he asked my lolo and dun na nga nya na kwento na bigay ng ex general. naka pangalan nga pala sya sa Republic of the Philippines

     

    my question is may chance ba na mailipat yung title sa pangalan ng lolo ko or uncle ko? kailangan yata dumaan sa DAR? anong government agency sya pwede i lapit? walang ibang document kung hindi yung orig na TCT na pa certify na din at lumabas na totoo sya.

  15. estafa yang ginawa ng taong yan [falsely pretending to possess property Art. 315(2a)], pwede nyong ireklamo sa piskalya.

     

    walang bisa yang "notice of levy" kung ito ay hindi galing sa korte. Pwede lang makuha yung properties niya sa pamamagitan ng court order, hindi sa pamamagitan ng notice na gawa-gawa nyo lang. ibig sabihin, kailangang magsampa muna kayo ng reklamo sa korte. pinaka d'best niyan, sumangguni na sa abugado otherwise, di nyo mababawi yang pera nyo (Moral of the story: pag pera na ang pinag-uusapan, wala yang tiwala-tiwala na yan, kailangang me kasulatan at palagi dapat may ebidensya kung ano ang karapatan ng kabilang partido dun sa ari-arian na dinidispatsa)

     

    salamat po! may isa pa po sana ako tanung. yung pinsan ko ay hawak pa niya ang sasakyan na sinangla sakanya. hindi nya naman ma i surender dahil ang sabi ng abogado ng nag refer ay ang sasakyan na iyan ang pwede gamitin para ma kuha din yung pera na na invest nya. in short i papa tubos. ang malaking problem is wala naman siya hawak na kasulatan dahil katulad namin nag tiwala lang kami sa mga binitawan nyang salita! pwede po ba niya i pa tubos ang sasakyan at mag negotiate sila ng totoong may ari upang tubusin ang oto? baka kasi maka suhan syang carnaping naman pero tulad ng sabi ko biktima din sya.

  16. What can we do? yung kakilala po ng grupo namin ay nag refer saamin ng isang deal. mga Kotse na ang sabi ay galing sa isang casino. Singanla saamin at ginamit na collateral pero dahil sa tiwala namin hindi na kami gaano nag usisa dahil matagal na naming sya kilala. Nung una ay humingi kami ng request na ang owner mismo ay pumapayag na ipagamit saamin ang auto sa isang kasulatan. Ngunit hindi niya ito sinunod! Kami ay nag tiwala hanggan sa isang araw ay ang mga auto na gamit namin ay kinuha ng mga may ari at ang sabi rent a car sila! In short niloko niya kami at hindi nag sabi ng totoo! May na invest kami na malaking pera dahil ang buong akala namin ay sangla ang auto.

     

    Kami ay sumisingil sa kanya pero ayaw niya mag bayad! Ano ang pwede naming gawin? May mga properties sya at mga kotse! Applicable ba ditto ang notice of levy?

  17. Based on your post, it includes lessees, homeowners, and lot owners. Are the foreigners lessees? (Obviously they can't be homeowners or lot owners.) If so, they can be members, however, as homeowners and lot owners, their wives are the only ones allowed to be members. I hope this helps.

     

     

    yes sabi nila mag le lease sila sa bahay mismo nila! hehehe kaloko nga pinipilit talaga. dahil sa "racial dicrimination" daw kaya sila nag ka ganoon. pero afaik wala naman ganung nangyari.

     

    pwede ka bang mag lease sa bahay na tinitirahan mo? or bahay ng asawa mo ng walang bayad?
