  1. Supernatural Finale- The Ultimate Swan Song




    NO SPOILERS AHEAD.



    Like most Supernatural fans all over the world, it’s 15-year run encompass the better part of my adult life. I was in college when it debuted and it was one of the first things I ever “binge-watched” before it was the thing to do. It has been a week since I watched the series finale and I have to say, it was as bittersweet as any ending can get.



    As a staunch fan of this series, and the two brothers who were the lifeblood of the show, I was hoping for a slightly different ending. That said, what he current show runners’ treatment of the finale as no less than fitting of the Winchesters’ great journey.



    What I liked most about this show is its faithfulness to its roots, which, for better or worse, is the love between Sam and Dean. Many shows have stayed on the air for several seasons often fall prey to veering off too much from their original concept that made them endearing to fans. Supernatural had seasons that were less than stellar- Eherm :unsure: Leviathans and Alphas :rolleyes: - but through all the monsters, gods, angels, and GOD, they remained those two lost boys everyone rooted for and cheered on.



    Never has there been a more dysfunctional, co-dependent relationship between brothers than that which exists between Sam and Dean. The constant need to sacrifice oneself to save the other “Every time one of us up the creek one of us is begging to sell their soul”- Dean Winchester, No Rest for the Wicked- This is part of the show’s sinister charm that kept fans like myself on the hook for 15 seasons.



    I respect how this show ended, and how the story came full circle. The way these wayward sons carried on was damn near perfect. :)

  2. Fave Fresh Perfumes for Women:

    1. Flowerbomb Bloom- One of the very few Viktor and Rolf frags that is restrained enough for morning and/or office use. It bears a lot of it’s parent’s scent DNA- Flowerbomb EDP, but it has the light touch of florals and Spring vibe that allows for casual use. If you like V&R perfumes but don’t like to clobber people with your perfume, FB Bloom is just the ticket
    2. Prada La Femme- Soapy type/Iris rich clean smelling perfume. Perfect for daytime/nighttime wear and appropriate for office use.
    3. Prada Infusion D’iris- Fresh powdery. Perfect for long meetings. Dries down to a great scent.
    4. JML Lotus Blossom & Water Lily- Perfect scent for women who dislike strong smelling/heavy perfumes. Dries down to a creamy skin scent.
    5. D&G Light Blue Sunset in Salina- The original release D&G Light blue EDT and eau Intense for women are both become too common. Seems like everybody using one or the other these days. Sunset in Salina, although extremely hard to find, is the best flanker for this massive crowd pleaser. If you love the Light Blue Scent character but prefer not to smell like your typical workaday plain Jane, you should give this flanker a sniff.
    6. Honorable mention- JML Silk Blossom- Amazing fragrance but it's longevity is practically non-existent. If you don't mind having to spritz yourself 10 times or more in a span of a workday, you'd probably like this one. One of the most unique JML fragrances ever created, but I have to say, for the price it is a bit of a ripoff because of its lack of lasting power.


    Fave Fresh Frags for Men:

    1. Prada L’homme- The prefect companion to Prada La Femme. Both are fresh, soapy, and have a strong Iris foundation. Picture a young CEO or account executive-cool, calm, collected. This lasts all day on clothing (no does not stain your crisp white shirt) but might not find purchase on acidic skin for more than a few hours. Still, it is worth every painful penny. A masterful scent DNA which is personal favorite to smell on my husband. I buy him a bottle every few months.
    2. Creed Silver Mountain Water- Among the freshest and most crisp, clean Creed fragrances ever created. A staple office fragrance for powerful men. If you are a road warrior, SMW is a good frag to have in your man purse. It costs an arm and a leg-maybe a lobe of your liver- but it is worth it if you prefer fresh frags that do not need re-applying after a few hours. Mouthwateringly good. A few sprays of this fine scent lasts for hours, especially on clothing.

  3. I ordered fleshlights and pocket pussies from Lazada before. Totally discreet. It didn't even indicate it on the label. Pangalan ko lang nakalagay dun.

     

     

    Yep totally discreet. I ordered a couple of things I wanted to try and the seller/s packed each item well. Bubble wrapped and everything. Still gotta check the seller's ratings. Anything below 65% is a redflag.

  4. 1. Does my friend (the landlord) have the right to forcibly evict the tenants despite the latter having paid their dues?

     

    No. Whether they have paid their dues or not, you cannot forcibly evict tenants, as the same would constitute grave coercion (see Art. 286, Revised Penal Code). You have to have a court order to evict tenants.

     

    2. Is he obligated to give them the leeway/extension considering the circumstances?

     

    No. As the owner, he has a right to demand that non-paying tenants leave, more so in this case where there is no written contract, which means that the lease expires every month, as rentals are paid on a monthly basis.

     

    In sum, he cannot forcibly evict the tenant; but the tenant cannot unilaterally insist on an extension either. Which means, at the end of the month, he can demand that the tenant leave. However, if the tenant refuses to leave, he has to file a case for eviction against the tenant; as he cannot forcibly evict the latter.

     

    Thank you for the response and advice. Follow up question: If he does decide to go through the courts for eviction, how long does the process usually take? Thanks a lot.

  5. Posting this question on behalf of a non-MTC member friend.

     

    My friend has 3 investment homes which he leases out to tenants. One of the homes was leased to someone who ran into a bit of cash flow issue. My friend has yet to give his tenant a lease contract, although rent has been paid for the past three months except for the month of Oct-Nov. The tenant previously agreed to vacate, but because they cannot find a suitable place to live after 2 weeks of searching, they asked for an extension, and deposited the rent due for the month.

     

    Question: Does my friend (the landlord) have the right to forcibly evict the tenants despite the latter having paid their dues (since there is no contract signed), or is he obligated to give them the leeway/extension considering the circumstances.

     

    By the way, the deposit has not been consumed and the rent for this month has been paid via deposit.

     

    My friend asked me to refer tenants, which I found, but they were concerned since the present tenants have asked for a bit of an extension. I advised my friend to allow them as much time since the new tenants are willing to wait anyway. However, I do not know the letter of the law on this one so I hope someone can spare some advice. thank you.

  6. Two weeks after, Party B reneged on the agreement?

     

    I am assuming from the tenor of the question that it was actually Party A who reneged on the agreement, given that it is Party B who would render the services, and it appears that it was Party A who needed/wanted the campaign at first.

     

    Once a contract is perfected, a party to the contract cannot unilaterally withdraw, without a valid reason, from the same (unless there is a clause in the contract allowing him to do so).

     

    Accordingly, so long as Party B is ready and willing to perform the services and there is no clause allowing for unilateral withdrawal, Party A may not withdraw from the same on the reason that they no longer need/want it.

     

    However, the law does not also like unjust enrichment, which would happen if Party B gets to keep the P19k without performing any services for it.

    Accordingly, the equitable solution would be to allow Party A to withdraw from the contract, but he has to pay Party B the expenses which the latter has already incurred by reason of the contract PLUS DAMAGES suffered by Party B due to the unilateral withdrawal. The expenses already incurred plus damages MAY OR MAY NOT EQUAL 19k (I'd say it probably is less than 19k). So, I suggest that Party B inform party A that he will return the 19k less the expenses incurred and damages (pwede isoli niya 10k na lang, depende sa kanya).

     

    Note that, legally speaking, Party B can insist on the contract (it appearing that unilateral withdrawal is not allowed). The problem would be that Party A might not release the remaining 17k, so walang incentive to perform without full payment first. Note also that they cannot insist on a refund so long as Party B insists on the performance of the contract. Basically, magkakasamaan lang ng loob si Party A at B, until one of them files a case (which, given the small amount involved, is a remote possibility).

     

    Sorry, my bad. It was Party A who reneged on the agreement. Party B is willing to render services and forgo the remaining balance still owed. The Service provider has already done most of the work and will accept not getting paid the rest of what was due, mostly in deference to their existing business relationship which was going well prior to this particular transaction.     I am looking for legal advice regarding Buyers Remorse (on Services NOT Goods)

     

     

    Party A contracted Party B to run a Social Media and Online Visibility Campaign for 60 days. Total contract price was 36,000. Party B was paid an initial payment of Php19,000. The agreement was that 36,000 will be paid in full, but Party B decided to allow a staggered payment plan to help out Party A. Two weeks after, Party B reneged on the agreement, wanting to cancel the entire campaign and asking for a refund. The reason behind the decision was that they decided they no longer needed/wanted it. Party A is asking for a refund. What does the law say about Buyers Remorse on Services.

    my advice.. do a loan restructuring.

     

    every filipino is crazed with smartphones.. pawn his cellphone.. pay the LR. you will get a much better interest rates from pawnshops. if he defaults the pawn.. they will not pursue him legally

     

    Thanks for your input. I ended up loaning him the cash so he can pay off the debt, under the condition that he will NEVER again entertain the idea of borrowing from loan sharks. It is financial suicide.

    if he cannot pay, then don't pay. parang wala namang PDC involved. if a case is filed against him, it would only be a civil case of sum of money. walang kulong.

    let the lending institution bring him to court.

    pag nasa court na, question in front of the judge the excessive interest rates. papagalitan pa ni judge yan. the supreme court ruled anything that is more than 2% per month as usurious.

     

    however, check the fine print ng loan agreement. baka meron dun na pwedeng batakin ng lending institution mga gamit nya pag di sya nakabayad without going to court. kung wala, take my above advice.

     

    note. it is not estafa. for estafa has the initial intent to deceive. the lending institution should prove that since they are the plaintiff. but for me, its only a civil case for sum of money, which is the worst thing the lending institution can do.

     

    and mind you. gagastos pa si lending institution dyan ha? filing fees, attorney's fees, etc.

     

    Thank you for your advice. He's paid up now. I told him to explore any other means to secure a loan next time.

Yung 7k lumobo naging 9,200 na tapos dagdag 50 pesos araw-araw. Kaya ko lang bayaran 1k per week kasi ala pa ko makastart ng work till next month. Grabe sila gusto ora mismo yunng bayad kundi 50 pesos pa din daily kahit naghuhulog ako 1k per week. Ano pwede gawin? Check mo contract kasi madaming words na di ko intindi. takot man ako styemore sa estafa kaya lang no means pa talaga sa ngayon. Pa help naman day. salamat.

    A little bit of a back story. On September of this year, a friend asked if he can borrow some money because of a family emergency. At the time, I was not in the position to offer any financial assistance so I sent a link to an online payday loan website that caters to people needing short term loans without putting up any collateral. I sent several leads but apparently, he only got approved at LR. At the time he applied for and got approved for the loan, he had a stable job and was able to make both ends meet, albeit except for his mother's medical expenses. He got approved for a 7k loan with a term of 13 days, and a total of 7545 payable amount. a few days before his loan was due, he got fired from his job due to the company downsizing. He got no back pay or any sort of severance package. So now he is strapped. I read his contract and understood the fine print but since I have not had any experience dealing with loan sharks, I figured I get him some help from the good folks here and anyone who might be able to help.

    Facts:

    As per the contract, he did agree to an 8% interest.

    The 50 pesos daily "late charge" is also in the contract

    He is looking to pay in increments of 1000 per week until he gets a stable job (which I was told was 30 days away)

    He has yet to receive a formal demand letter, but there have been emails twice a day since his loan became overdue.

    Questions:

    If he is able to pay 1000 pesos weekly, is it still reasonable for the loan shark to charge 50 pesos per day?

    Is failure to pay on time, or opting to pay in incremental amounts constitute grounds of Estafa?

    If he does get sued for Estafa, what does the process entail, i.e. court appearances, legal representation, etc.

    Can LR garnish his wages once he gets a new job?

    DOes that mean he is obliged to pay exorbitant "fees" just because he agreed to it, even if the amounts are way past the reasonable limit?

    Any information you can share that is relevant to loan shark transactions, please feel free to share it. Thank you in advance.

    We have recently moved in to an apartment that is much bigger than our previous residence. Against my better judgement I agreed to take in a bedspacer. He took one of the two spare rooms that are not occupied and paid for the required one month deposit and advance. I gave him an ackowledgement receipt and was preparing a lease agreement when he suddenly got a "job" elsewhere which necessitated moving out soon. We never agreed to a short term stay and while we had no contract yet, he said that he wanted to stay till at least December of this year.

     

    While incensed, I tried to be reasonable and offered that we pay back his deposit as soon as there is another tenant. He is insisting that we pay him back in a week regardless of whether or not we find a tenant right away, which I find appalling. I have perused RA 9161 and RA 9653 to find out what our recourse may be (said tenant claims his father is a lawyer), and found no specific provisions that cover buyers remorse. I would like to know the amount of time landlords have to pay back deposits by tenants who suddenly changed their minds. If any lawyers or expert landlords here can provide advise, I would greatly appreciate it. Thanks.

    IN light of this development, I am leaning towards not accepting tenants at all, if I can avoid it. However, I need at least 10 days to get the money back out. Do I have that long? Thanks again.

     

     

    I was hoping this would be resolved by now. Alas, the ex-tenant is adamant and not willing to listen to reason. Based on the practice of the landlords in the area (I have done a thorough survey since this whole matter started. He vacated 2 days ago and came by today demanding his money back PRONTO. So I countered with an offer that since we do not have a binding contract, I give him back his security deposit (minus the advance, which he consumed). I offered to put everything in writing, including the exact amount that he will receive as refund (his entire deposit) and the exact date as to when he can come by to collect it.

     

    The ex-tenant just said "Magkita na lang tayo sa korte". I agree that such is a legal recourse he can and must utilize. I just want to confirm if I understand the process correctly. These cases start on the barangay level, and, if amicable settlement is not reached, the complainant reserve the right to file with the courts.

     

    He's also been alluding to the fact that his father is a lawyer and that he can "by-pass" the barangay. I have not seen any provision in the laws that says that so I want to know if that is even remotely possible. I'd like to say I have faith in the letter of the law and due process but I want to be sure I am prepared for any and all possibilities.

  11. You must pay him back. But there is no law as far as I know that says how long. That's what a signed contract is for. Since you don't have a contract, and you need at least 10 days, then I think 10 days is fine. He or his dad can report you, it's their right to do so, but that process would take longer than 10 days. So it's better for him to just wait. He's being such a baby, it's only 3 fcuking days!

     

    And don't be discouraged. Not all tenants are asshats. But next time, no signed contract, no move in.

  13. Decent gin martini (I have been to a few bars here where the bartender practically leers at you when you ask for a gin martini with olives.

     

    They should also have some of the classic concoctions like Manhattan, Melonball, mojito, margarita (frozen preferably), and long island iced tea.

     

    A good bar must have a decent selection of Single Malt Scotch, and the bar keep should know the difference between Scotch and Whiskey.

     

    As far as food goes, it should offer at least the basics, i.e. hot wings, peanuts (fresh not stale), and Jalapeno poppers (with our without cheese).

     

    The music must be just audible enough to simulate a vibe, but not too loud that you have to scream at each other, which limits any chance for a decent conversation.

     

    Lastly, a good bar, must have an actual BAR. My husband and I went to oblivion two Saturdays ago and found that they do not have bar stools at the bar. Just weird, in my opinion. Then again, I prefer to be as close to the bar keep as possible. I know most drinkers here prefer to be in a large table with chairs.

    Business correspondences are usually ignored, mostly because they are boring and our works do not intermingle. Other than that, every message that we send or receive can be viewed by each other at any given time.
