    ACTOR William Martinez was acquitted of a drug charge yesterday by a Pasay City judge who found the case against him "legally weak."

    In a 23-page decision, Judge Eleuterio F. Guerrero ruled that the case against Martinez was full of loopholes.

    Guerrero found the prosecution's evidence on the improvised tooter, a tube used to sniff shabu, allegedly seized from Martinez on April 24 at the Centennial Terminal of the Ninoy Aquino International Airport, unreliable and unconvincing.

    The decision further stated that the prosecution, led by 2nd Assistant Prosecutor Artemio Puti, failed to identify the glass tube presented in court as the same improvised tooter allegedly seized from the accused.

    The actor was on his way to Dakak resort in Zamboanga del Norte with his wife, Yayo Aguila, last April when he was apprehended after a routine body search allegedly yielded a tooter in his possession.

    The judge also noted that while the actor

    had been subjected to a drug test and was found to be positive for methamphetamine hydrochloride or shabu, such evidence did not satisfy the requirement of proof of moral certainty that Martinez had indeed used shabu.

    Damages

    Guerrero also directed the court to return to Martinez the amount of P50,000 he had posted for his temporary liberty during the duration of the trial.

    Martinez, who turned up in a polo barong and black pants, gamely posed with his wife for souvenir pictures, following a request from some members of the court staff.

    THE PHILIPPINE Drug Enforcement Agency (PDEA) filed a case against former matinee idol William Martinez for allegedly using illegal drugs before the Pasay City prosecutor's office, a PDEA official told INQ7.net on Wednesday.

     

    The PDEA charged Martinez with violating Section 15, Article II of Republic Act 9615, banning the use of illegal drugs, Senior Superintendent Orlando Mabutas, PDEA director for Metro Manila said.

     

     

     

    Martinez is also facing charges for illegal possession of drug paraphernalia, for which, he had posted a 40,000-peso bail bond.

     

    Mabutas said it was up to the Pasay court to set bail for the new charge against the actor.

     

    On Tuesday, Martinez's urine sample and the glass pipe or "tooter" confiscated from him at the Centennial Airport last Saturday tested positive for metamphetamine hydrochloride or "shabu."

    FORMER matinee idol William Martinez is facing charges for allegedly using an illegal drug after he tested positive for metamphetamine hydrochloride or "shabu," an official of the Philippine Drug Enforcement Agency (PDEA) told INQ7.net Tuesday.

     

    "The Philippine National Police (PNP) crime laboratory found traces of shabu in his urine sample," Mabutas said, adding the residue of the banned drug was also found in the glass pipe or "tooter" recovered from Martinez, when he was arrested at the Ninoy Aquino International Airport (NAIA) last Saturday while on his way to Dipolog City in Zamboanga del Norte province with his family.

     

    A separate report on radio station dzRH said the Department of Health in its own test confirmed that the actor used "shabu."

     

    Martinez had posted a 40,000-bail on the charge of illegal possession of drug paraphernalia.

     

    Mabutas said Martinez could also post bail for drug possession before a Pasay City court, where they would file the charge. He added the court could also order Martinez to undergo rehabilitation.

     

    The dzRH report said the rehabilitation program could last up to six months.

     

    Mabutas said it was "most probable" that Martinez took "shabu" before going to the airport.

    FORMER actor William Martinez was taken into police custody Saturday after he was reportedly caught with an illegal drug paraphernalia at the Centennial Terminal of the Ninoy Aquino International Airport.

     

    Martinez was reportedly on his way to Dakak beach resort in Mindanao with his wife, Yayo, when a routine body search led to the discovery of a three-inch glass tube which could be used to sniff shabu (methamphetamine hydrochloride), known as "crack" or "ice."

     

     

     

    The tube, called a "tooter," was reportedly found inside a pocket of Martinez.

     

    Police Inspector Jaime Estrella, a member of the Philippine Drug Enforcement Unit at NAIA, said Martinez was brought to Camp Crame, headquarters of the Philippine National Police, after the incident.

     

    Estrella said the glass tube would be tested to determine if it had been used in sniffing shabu.

     

    Martinez is also reportedly set to undergo drug testing, the official added.

  6. thanks for your opinion. if i opt to buy a new battery pack- is there shop here in metro manila which sells battery packs as my laptop is already an old model (circa 2001).

  7. hey guys...i need your help - the battery of my laptop (an acer travelmate 212TX) is already drained out (its still the orginal one). Somebody told me that i could replace the original metal hydride batteries with lithium ion - as in break open the battery pack get the old batteries and replace them with new ones. Can you confirm this?

     

    If this is workable can you suggest a shop which does this?

    1. go consult a lawyer

    2. go consult a clinical psychologist (normally its the lawyer who refers the shrink)

     

    cost? it really depends.

    lawyer's fees for this kind of cases usually ranges from 100-500 thousand pesos (excluding appearance fees for each hearing and other out of the pocket costs which lawyers charge). The clinical psychologist also charges for his services usually package deal - ranges from 50 to 200K. (Beware though these fees may no longer be accurate).

     

    case for declaration of nullity of marriage takes time....sometimes up to 3 years.

     

    most importantly, there is no guarantee that your marriage will be declared null and void...

  9. not sure if this is the righ tplace to post this.. but i have heard about a bill that is being passed regarding poeple taking up nursing and being required to work at least 3 years in the philippines before being allowed to wrok abroad...

     

    can anyone shed more light on this?? of course,  only if possible...

     

     

    do you see anybody protesting in the streets?...nurses or owners of nursing schools? chances are wala pa...takot mawalan ng boto at pondo ang ating mga tongressista at sinators.

I need some advice here. here's the problem.  i got married 1991 in a simple ceremony in my ex-wife's house and the very next day i left abroad to work. when i came back two years later we never had the chance to consummate the marriage coz we decided to partways. question is do i have to file for nullity or annulment?

    have a clinical psychologist examine you and your spouse...either of you may be psychological incapacitated to fulfill your marital obligations. Art. 36 of the Family Code says its a ground to declare your marriage null and void.

    we have a rather easy job that pays well

    we are able to help customers

    we can buy our own stuff

    we can party anytime we want

    we get to surf the net

    we're always in an airconditioned environment

    we don't feel "useless"

    we earn as much as or more than a normal breadwinner

    i just finished the probationary six months period and i was wondering, if it is included in the labor law, what type of salary adjustment i can ask for.

  15. my ninong who is a rich guy from a nearby province bought a camry (24.0 variant). he was so damn proud of it...would drive it during the weekends. he would even bring it to high society gatherings..political gatherings (he is a politician)...and brag about how good it is.

     

    The sad thing is when ninong and I went to taipei just month for a business trip and guess what we saw just as we stepped out of the airport....a camry taxi!!!!

    Worse thing is that this taxi has better interior than the local camry....although the taxi camry is a 2.0 variant.

     

    talk about a major turn off!!!!!

The problem your friend is facing is that anything serious you can file against the firl will actually back fire on her husband as well.  For example, you file a concubinage case against the girl, but it takes two to tango because you cannot commit concubinage without the husband.  :blush:

     

    Unless the girl commits something else other than flirting with the husband, there isn't anything other than malicious mischief that can be filed.

     

    Correct me if i am wrong the last time i read the RPC Malicious Mischief is defined as the willful damaging of another's PROPERTY for the sake of causing damage due to HATE, REVENGE or other EVIL MOTIVE.

     

    Filing a concubinage case against the her and the husband is also a longshot dont u think? Concubinage is one of the hardest crime to prove.

     

    I suggest that your friend do some investigation..gather EVIDENCE... If she finds out that the other woman is a government employee or officer, i think there are govt ethical and moral codes that were violated. If she is employed by a private corporation, it really depends if her employer has rules and regs on employee's personal conduct. Big companies (like banks) have strict policies on extra-marital affairs especially concerning its officers..nakakasira kasi ng image yon.

     

    Most importantly, if your friend finds out that "other woman" is married, then determine if she had "sexual congress" (sexual intercourse) with the husband. Hire a private investigator. There is this urban legend regarding a wife who was able to follow her husband and his girl to a motel and was able to get evidence of the tryst...a used condom from the room where the two checked in...(repeat urban legend). If your friend is able to establish that her husband and the married girl are doin the bling-bling...she can forward the evidence to the injured husband (husband of the married girl) so that he can file a case of adultery against the philandering wife.

     

     

    now, if you have proper info and knowledge....YOU'RE IN COMMAND, GIRL.
