If a female law student had an affair with a married man and they had a child, can the wife file a complaint to prevent the law student from taking the bar or does the wife have to wait for the student to be a lawyer before she files the complaint? Does she also have to include her husband in the complaint even if they've already made peace with each other?

  2. My mom leases out residential units. One of her tenants vacated the unit he was renting in the middle of the night without paying his rent which is a big amount. Is there a practical and legal way she can find out where he lives so that we can at least attempt to collect his balance? Thanks in advance.

    Sorry, I forgot to clarify that I wanted my laptop motherboard checked. When I turn my laptop on, the power button stays on as well as the video player keys (Play, Pause, Volume, etc.). When I had it checked, the technician took out the memory and cleaned it but nothing changed so he said it's most likely the motherboard. The laptop is an hp dv1016 and the technician said it's a common problem for that series/model.

  4. Guys i was just wondering. I booked a flight with Cebu pacific and decided to cancel it. However as most of the people know cebu pacific is really problematic when it comes to refunds they claim that the customers should have known that refund would take atleast 2 months till 6 months when paid for in credit card. Now what I am wondering is this, they have the perfect right to do such thing if they had it in writing (in their agreement acceptance) but when i checked it there aren't pertinent info about it!     Now I am wondering does anyone have the same problem with me and is there anything we can do to make this stupid practice stop. I can grow my money for a bit in half a year and consider the number of people who are asking for refunds then they are already holding a lot of payables in their hand

     

    It's always irritating when companies are very slow in reimbursing/returning a customer's money but are so damn quick in accepting them. Since there is nothing specific written in the agreement about when the refund should be made then Cebu Pacific regrettably has a lot of room (or time) to work with. As customers, we can complaint to the management, write to the newspapers, or even avoid flying with the airline.

    Thanks for the tip. The other residents are threatening to stop paying their dues if the officers push through with their plan. Hopefully this will be enough to end the situation.

The president of our homeowner's association is insisting on hiring as a security guard a person who has numerous complaints against him in the barangay hall for various reasons like vandalism, destruction of property, and theft. The president is insisting on hiring the person despite oppositions from residents.

     

    Where can we file a complaint to stop the president from hiring the person? I don't think the association is registered with the SEC but I'm told it is recognized by the village association.

  7. If there is a pending case against a company by an ex-employee and the company closes before a decision is issued, what can the ex-employee do in case he wins in the case?

  8. The other day I went to LBC to have a letter delivered overnight to a client. I had already closed and sealed the envelope before going to LBC. The attendant told me that I had to open the envelope so he could inspect the letter I was sending. When I asked why, he couldn't give me a straight answer. The best he could do was say "Sir, syempre, kung kayo di ba gugustuhin nyo rin malaman kung ano ung pinapadala sainyo?"

     

    I had no choice but to open the letter since it was obvious he wouldn't accept the letter for mailing unless I complied. Anyway, it was just an ordinary letter. My question is, is it legal for courier companies to do this? Isn't this a violation of my privacy or confidentiality of private documents?

  9. Thank you very much for the assistance. Magagamit ko eto para maka-negotiate ng mas reasonable interest rate. My tita heard from other officemates that her officemate often lends money to other people at very high rates but no one complains. Hopefully, this will change things, at least for my tita.

    "SEC. 237. Issuance of Receipts or Sales or Commercial Invoices. - All persons subject to an internal revenue tax shall, for each sale and transfer of merchandise or for services rendered valued at Twenty-five pesos (P25.00) or more, issue duly registered receipts or sale or commercial invoices, prepared at least in duplicate, showing the date of transaction, quantity, unit cost and description of merchandise or nature of service: Provided, however, That where the receipt is issued to cover payment made as rentals, commissions, compensation or fees, receipts or invoices shall be issued which shall show the name, business style, if any, and address of the purchaser, customer or client.

    "The original of each receipt' or invoice shall be issued to the purchaser, customer or client at the time the transaction is effected, who, if engaged in business or in the exercise of profession, shall keep and preserve the same in his place of business for a period of three (3) years from the close of the taxable year in which such invoice or receipt was issued, while the duplicate shall be kept and preserved by the issuer, also in his place of business, for a like period.

    "The Commissioner may, in meritorious cases, exempt any person subject to an internal revenue tax from compliance with the provisions of this Section."

  10. Thank you to everyone who replied. I told the situation to a friend of mine and when I told her that the interest rate of the loan is 5% per month (60% per annum), she said the interest rate is way too high and may even be illegal.

     

    Is there a particular rule in our tax laws that requires someone like the officemate to issue official receipts and not just handwritten receipts? Baka pwede ko gamitin yun as leverage to negotiate for a lower interest rate. Because of the high interest rate, palalim ng palalim ang debt ng tita ko.

    May question po ako. My tita borrowed money (around P500K) from her officemate who has a sideline money-lending business aside from her office work. My tita has made partial payments but the officemate won't issue any type of receipt for the payments. Although it's just a sideline business, is the officemate still required to issue receipts for each payment?

  12. I'd say your family can TRY demanding rent and arrears from the DepEd. Your problems are twofold. One, you are going to demand rent and arrears only now, when several decades have already passed. Two, DepEd is a government entity, which is generally immune from suit.

     

    Once you demand and DepEd refuses to pay, you may be able to go to court to demand rents and arrears under the Amigable v. Cuenca doctrine (43 SCRA 360) which allows the government to be sued if injustice will result in allowing it to be immune from suit (kaya lang di sigurado ito).

     

    And even if you are allowed to sue, the Court may declare that you have slept on your rights as you are demanding only after several decades have already passed (see DepEd v. Onate, G.R. No. 161758, June 8, 2007) and the Court may declare that the school is now entitled to the use of the property for free.

     

    Pero sabi nga nila, no harm in trying. Hope this helps.

     

    Thanks for the advice. The people who lived on the land have little or no educational background, they're just simple farmers. I hope this fact will help our case.

  13. My mother's family has a large plot of land in Zamboanga that was originally owned by her father. The land has been occupied by a public elem school for several decades but the land was not donated or sold to it. The school was just established there.

     

    Can my family demand rent from the school and also arrears for all those years that the school was illegally established there?
