  1. if you'd ask me, i love to see cases filed against GMA and her minions in court, not in the senate. ask yourself, how many cases has this administration filed in court against GMA?

    But everybody knows about the Garci Tapes ! And there are those who will close their eyes and minds and say that this conversation never happened and say "there is NO evidence". Those who know better...know better...

    the ombudsman and DOJ merely make PRELIMINARY INVESTIGATIONS, meaning, they will study/investigate whether or not the case should be filed in court.

     

    normally, the DOJ, or the public prosecutors aka fiscals, will file cases in regular courts while the Ombudsman will file the case in the sandiganbayan. its is the regular court (rtc or mtc) and the Sandiganbayan that is actually a court, not the ombudsman or doj.

     

    my point is simple. kung may malakas na ebidensya ang doj or ombudsman, hindi dapat tumatagal ang investigation. they should have filed it in court already. so ask yourself, WHY THE DELAY????

     

    ps. on a personal note, i did not study law for 8 years. 5 years lang (had to extend 1 year for not being the brightest in class. hehe)

     

     

     

     

     

    a. so, what is the lie here? she merely admitted that the bank document is authentic. remember that rowena is a mere bookeeper. utusan lang sya. hindi naman sya ang magsasabi kung lease payment o hindi and whether or not it was an advance payment for the lease. she was merely relying on what she knows. saan ka nakakita ng bookeeper na nakikialam kung papaano magbabayad ang mga boss nya?

     

    b. rowena made it clear that her boss is iggy. the records are clear that mike is not a shareholder of LTA in 2001-2010, so how can mike be her boss in 2004?

     

    c. if someone lies to me, i file the proper case, i will not take the law in my hands. if rowena suddenly recants her statement, do you think its still believable? would you not say she was doing it out of duress and coercion?

     

    d. bondoc is an attack dog of the pnoy administration. look at his previous articles. he has always been the one taking a first crack against FG.

     

    i cannot be envious of you at all for belonging to a much maligned group of individuals...

    but thank you for enlightening me about how the legal process start and how it progresses...

     

    "why the delay"?...i think, as i have mentioned previously, we need better prosecutors...

    'fiscals' sabi mo nga...and with the change of administration, i'm hoping there will be changes

    in the mindsets of quite a few of our kababayans...perhaps, in 2 or 3 years...a more responsible

    citizenry would emerge ... it took gloria 9 years to turn us into what we are now...i am hoping that

    in half the time, we could turn 180 degrees...

  4. no, the ombudsman is not a court.

    its the prosecuting arm of the government against people who committed corrupt practices during their tenure as public officers.

     

    at best, the ombudsman can only make administrative sanctions against some officials. but of course, there can be no administrative sanction against GMA.

     

     

    the court where the ombudsman file cases is the sandiganbayan.

    know how to get around the law...with high paid lawyers, the rich and powerful use the law to their advantage....

    di ba sabi mo nga...nagbayad ng 10 million yung kliyente mo para hindi matawag

    sa senate hearing - that's one way of getting around the law...

     

    ..if there's anything that we could agree on...totoong marami ang incompetent sa administrasyon ni Pnoy...pero that's

    an improvement sa panahon ni GMA...talamak ang incompetent at corrupt sa panahon ni Gloria...

    i did not ask myself...i went to the internet to do some research...

     

    Five (5) plunder cases so far...and more to come...and may i quote ?

     

    "With the presidency behind her, Gloria Macapagal-Arroyo on Friday made an appearance at the Department of Justice (DoJ) to subscribe to a 58-page affidavit countering the plunder suit filed by former Solicitor General Frank Chavez.But this may not be her final appearance in the dock.     Then, there is the tax evasion charges filed against the son, Mikey who as you know, has a very interesting interview with your favorite - Monsod.

     

    And with the resignation of Merceditas Gutierrez and assumption of a new Ombudswoman we might see more cases. Maybe you would like to volunteer as a PROSECUTOR. I think the Philippines will need a lot of excellent Prosecutors to go against highly paid Defense Lawyers ?

     

    We will need the best prosecutors..or else, GMA and her cohorts might end up just like Imelda...and the Marcoses...back in power and enjoying their stolen billions...

     

    Let's just hope that there are some of us who have learned from the mistakes of the past...

    I was hoping that you will agree with me that nabawasan ng malaki,

    One way of fighting corruption is to expose the shenanigans of the

    previous administration. If the Aquino administration can show that

    there will be accountability, potential thieves might think twice.

    I have always asked you this but never got an answer. You are a lawyer

    and thus believe in the rule of law, why would you NOT agree to the prosecution

    of those who stole our money during the GMA administration. Why would you

    use words like "smokescreen" or "selective prosecution" as if you are in favor

    of not bringing these alleged culprits to trial. And please do NOT tell me that

    there is no preponderance of evidence nor lack of witnesses against the Arroyos

    and their cohorts.

    similar to what happened to the truth commission which was shot down...

     

    we both know that the buck stops at the supreme court...

    we also know that neri was allowed to remain silent ....

    because of the supreme court's interpretation of executive privilege...

     

    and there was that flip flopping, was it twice or thrice? about chartered cities... ?

    only in the philippines as you always say...

     

    my dream, is that someday, the SC will have less justices with the 'wangwang mentality'...

    and more of the 'new breed'...lawyers who can interpret law as they should be...

     

    imagine, if you will, our supreme court headed by a louis brandeis

    who believes that the right to privacy is trumped by the right of the public to know...and i quote ...

     

    "The right to privacy does not prohibit any publication of matter which is of public or general interest"..

     

    maybe this is the reason why watergate caused the resignation of a US president...

    while the garci tapes did not...

    it makes me wonder why news clippings and reports are posted in a forum like mtc...i thought to join a forum, the presumption is...we are 'informed' - have read the news, know current events and know quite a bit of history...

     

    a forum is where discussions and point of views are shared...where arguments and counter arguments are aired...

     

    a news report is NOT an argument...we can quote or paraphrase, even provide links, but we should avoid being a reporter here at mtc...

     

    please, Pnoy, ban those long and rambling news reports...it is redundant and mildly irritating...as it implies that posters here are not mentally 'well equipped'...

    there will always be benedict arnolds, quislings, vichys and makapilis...

    but they will be the EXCEPTION rather that general rule...and debates and arguments

    it would seem like we have forgotten that garci tapes which was brought

    out into the open by ignacio bunye's 'i have 2 discs'....(the left and the right)

    we all know that this resulted in gma saying 'i am sorry'..

    a 'lapse of judgment' daw...kuno...

     

    i think what should happen is for the courts to validate the 'garci' tapes similar

    to what the US did in watergate (which for those who read history - resulted

    into nixon's resignation)...garci and gma, with their voices, will tell their story...

     

    gudani and balutan should be heard, too, why ?...because they are a different breed

    of filipinos...those who would give up everything, even their jobs and pensions,

    to uphold morality and decency amidst the prevailing culture of thievery impunity

    and dishonesty during the gma regime...they are credible...

     

    quite a few of us still do NOT understand that we have to start thinking differently...

    we should move away from the 'wangwang culture'....if we are to progress as a

    nation...and if we have to move on, those who were responsible for the excesses

    of the previous administration should KNOW that CRIME does NOT pay....

     

    if we let them get away with what they did...

    similar to what happened to marcos and his cronies,

    it's almost sure that there will be another group who will do it again...

     

    it is not important who the players are...

    what is important is that those responsible should

    be made to answer for their misdeeds...

    assuming you are correct in what you said, you failed to equate that "the philippines" is equal to "All Filipinos". of course, saying that the Philippines is corrupt means the COuntry, IN GENERAL, is corrupt. It does not necessarily mean that ALL the filipinos are corrupt.

     

     

    so to say that we have an idiot for a president does not necessarily mean ALL the filipinos are idiots because THE PHILIPPINES, as a country, does not necessarily mean ALL the filipinos. the term "THE Philippines" is a mere generalization.

     

     

    (i am not saying that i agree with scam that the president is an idiot, my point here is that your conclusion is not logical)

    the remaining 58% are against him which are the majotiy. Of the 42% who voted for him, how any more are disgruntled with his incompetence that they

    are repenting they voted for him. So that's even below 42% as of now.

     

    On the replacement, Binay being vice president will automatically replace the idiot. Binay is no doubt more capable to govern than this stupid

  17. you must have a different definition of democracy. anyway, our country is run by laws, and not by democracy in the purest form. we are, technically, a republican country.

     

    at any rate, the constitution is clear, the duty of the senate is to make laws, and not be the exposer of corruption, etc. while they may conduct investigations in aid of legislation, the senate seems to have more investigations than legislation.

     

    it seems that the investigations are in aid of polictics.

     

    is that what you really want, a country with leaders doing nothing but politicking?

     

    for me, trasaprency is not watching the senate hearings... i personally can vouch for you that the senate hearings are designed to attack a person's credibility. the evidence there are mostly fabricated and the persons conducting the investigation are very partial.

     

    i handled several cases in the senate hearings, talo lagi clients ko. they are in a hostile territory. pinasasama na ng mga senador, ganun din sa media. tindi pa ng backdoor politics.

     

    we had a client wo paid a senator 10M so she wont be dragged in the investigation.

     

    if you only know that this democracy has been bastardized by your beloved senators.

     

     

     

     

    perhaps, my question would be...are your clients really innocent?... i believe that you are a good lawyer and you could compete mentally with the best senators of the land...

     

    jose pidal did well when he was called to testify...and so did iggy arroyo...both, as you are well aware, are 'still' free men... even garci did well...

     

    we cannot enjoy the freedom that democracy guarantees us and cherry pick what's good about the system...we can't say i love democracy because i am guaranteed free speech and yet say i do NOT like democracy because of the senate committee hearings...if i were a lawyer i cannot say 'i would only defend the innocent and to hell with those who admit guilt'...we have to take the good with the bad...

     

    why would you admit that your client paid off a senator ?...i hope you dont get disbarred ?

     

    finally, everything about politics is not bad...also, not all lawyers are bad....

     

    p.s. try watching the US senate hearings and the Murdoch hearings...if we listen closely enough, we might learn that democracy/politics is the same everywhere....manila, london or washington d.c....or would you rather be in north korea ?

    GMA started her presidency being loved by the people, remember edsa 2?

     

    while it may be true that there were presidents who were less competent who led their respective countries with honestly and integrity, i dont think Pnoy will be in the same category.

     

    are you asking me if i love gloria? no, i dont. in fact, i'd love to see her jailed.

     

    but i think we dont need senate investigations on what GMA did. do we really need a senate investigation for the poll cheatings when it is common knowledge? can the senate declare her guilty of corruption in the PCSO?

     

    the senate hearings are nothing but PR attacks against gloria, designed to make people hate her more.... nothing more than that through trial by publicity.

     

    i believe GMA still is entitled to a fair trial. if there are evidence of corruption or cheating, as the case may be. FILE IT IN THE APPROPRIATE COURT. not through trial by publicity.

     

    i believe it will save more time and govt resources (something Pnoy is "practicing") in prosecuting her if cases are filed in the Ombudsman or DOJ rather than in senate investigations. do you agree with me?

     

     

    the senate hearings are part and parcel of the democratic process...

    you might have a different opinion about why they are conducted but i think we should let democracy do its job...

    we would have NOT learned more about the nbn-zte if not for the senate hearings...

     

    like you, i believe GMA is entitled to a fair trial, and she might have been tried fairly

    if she allowed her impeachment(s) to proceed instead of paying off her party's congressmen,

    not once, not twice but three times !

     

    the least of what could have been accomplished would be

    that evidence could have been brought out in the open for us, the people, to discern...

    but she suppressed the process by bribery, which should NOT be done in a democracy...

    also, she used her office (by issuing orders) to supress people from testifying -

    remember Gudani and Balutan, in hello garci ?...

    and then, later on, Neri in the broadband deal?

     

    maybe the point i'm trying to make is ...congressional hearings will always be a part of a democracy...

    we elected senators and congressmen and they are just doing their jobs...

    if a person is NOT guilty, no trial, whether by publicity or court would convict him or her...

    i see nothing wrong with letting the nation participate in the democratic processes...

    transparency promotes a better democracy...

     

    note: sometimes, trial by publicity works for the accused...

    remember OJ Simpson ?...or recently, Casey Anthony ?...

    remember that Pnoy's popularity is still high, although it is in a downward trend. once the popularity is low enough and the 2013 elections is closing in, scams in the Pnoy administration will start coming out.

     

    i have already conceded that arroyo had all the necessary skills and competence which she used to bring the Filipino masses down to its knees,

    as was reported by an independent TCI...now, we know why there is pervasive hunger and poverty -

    our taxes were re-directed to the personal bank accounts of 'competent gloria' and her 'able' assistants....

    only very, very competent people can do such feats....you have won that argument...the argument of competence...

     

    fidel castro, luis 'lula' da silva, (actor) ronald reagan, (mechanic) ramon magsaysay...

    are some of the most beloved presidents who, before they became leaders,

    were less 'competent' than (vice president and economist) gloria arroyo...

    they led their respective countries with honesty and integrity and because of that they are loved by their people...

    Arroyo should be 'commended' for her administration's competency taking the Philippines from 62nd to 134th place in its list of corrupt countries...note:(the higher the ranking, the more corrupt)

     

    new details are now coming out ....and the following are Arroyo's most competent assistants: Carlos Garcia of the AFP , Uriarte of PCSO, Genuino of PAGCOR, the Ampatuans of Maguindanao, Jose Pidal, Abalos, Garci & Bedol of the COMELEC etc...

     

  21. It is not primarily persecution and vendetta, although that's what seems to personally drive Noynoy in all his political actions.

     

    His amateur showbiz government -- the people who put this clown into power-- are the ones who are really orchestrating the blame game and demolition jobs. They even have a timetable on when to release "juicy" tabloid news about alleged sins of the past admin. It's all for the entertainment of rapidly thinning numbers of gullible Noynoy supporters.

     

    All these PCSO expose's are just to feed the hate campaign. But in the end, there is still no proof of anything to pin down the former president in the proper court. Chasing after the wind.

     

     

    I have to agree with the "amateur showbiz government"...a concrete example, i think, would be when Erap was placed under house arrest in his Tanay property while he was tried on Court TV...He was convicted of plunder after a long drawn out trial...and then given amnesty by Arroyo...

     

    So that our nation can perpetuate our showbiz mentality, Pnoy should do what GMA did to Erap..but, maybe, he should omit the amnesty part...

    gloria sacked a lot of cabinet secretaries during her administration...

    she sacked gilbert teodoro for doing a good job during ondoy...

    gonzalez was sacked because he is more focused on what kris aquino was doing...

    nani perez was sacked because he got 2 million from IMPSA...

    then there was Cito Lorenzo SACKED because of the fertilizer scam...

    and then the Hyatt 10...they were all SACKED for singing 'if we hold on together'....
