Every nullity of marriage case is considered by Courts on a case to case basis particularly a petition under Article 36 of the Family Code on psychological incapacity. The granting of said petition will depend upon the pieces of evidence and point of view of the Judge of the Court where said case is raffled. Decisions on these will be based on current jurisprudence like tan-andal. But there are other cases that might justify or negate the granting of the nullity of marriage. So there are a lot of factors to consider but the LGBTQ relationship may be a ground for such nullity if it can be shown that said spouse has no capacity to perform her marital obligations existing at the time of celebration of the marriage and is incurable.
