top secret
Grabeng harassment 'to... Quote Link to comment

top secret
Quote Link to comment
top secret
Quote Link to comment
Quagmire2008
By law, credit card non-payers are protected because just like any other business, sometimes people experience downturn in their financial capabilities so it is just a civil case. But in actual practice, banks/financial institutions have a certain percentage (3% me think) of total loans given as potential bad loans. Now banks/credit card companies are fine with that because the interests and charges far outweigh the effect of these non-performing loans. In other words, it is accepted and what the banks do is to sell them to special purpose vehicles like collection agencies at very very low price. (sometimes at only Php 1 ) Now if the borrower doesn't know about this, collection agencies do everything to collect on something bought at very low price (next to nothing). Now why do banks/credit card companies don't collect themselves? It is because if the good borrowers know that "Hey, they can give discounts or even offer below principal balance settlements, why should I continue to pay?" Now that you know this, should you pay collection agencies who won't go to court because there is no certainty that the borrowers will pay who simply bought the rights on something that banks/credit card companies are willing to accept?(i.e. non-performing loans) Quote Link to comment
chris_ewans40
any ideas how we can get back at these collecting agencies? pwede ba natin sampahan ng kaso itong mga taong ito and what are the chances na manalo ang kaso isasampa natin? Quote Link to comment
Google
NBI only deals with criminal cases. If ever magsama sila ng kaso sa iyo, it will be a civil nature, so hindi kasama ang NBI dyan. Quote Link to comment
Google
I do not know how they got my cp #... but a certain Atty.___________ called me up this morning. He said that they will proceed to the Municipal court of Pasig to ask the Court Sheriff to seize whatever real or personal property that I have. He said that it is related to a case that they filed for my violation of RA 8484. He gave me until 5pm today to call him for the settlement of my (alleged) debts. If not, I could expect the sheriff to come to my house tomorrow. He said that they made their research already and knows my properties. He mentioned the plate # of my car (with make and model) and told me that it would be seized/garnished as settlement for my debt. What will I do? First things first. a. No seizure of real or personal property can occur unless the credit card companies file a civil case of sum of money and a decision is handed by the court... Matagal na proseso yan. b. Under garnishment, there are exemptions under the civil code. Among of which is the family home, tools that you need to earn your living, personal belongings like clothes, furnitures, etc. So unless you have received a summons for a civil case, ignore them..... Anything tantamount to that is equivalent to robbery. Sila ang pwede mong kasuhan.... Criminal case ang robbery.... May kulong and may hit sa NBI. Quote Link to comment

There are lots of things you can do.First is you can sue for harassment, oral defamation or vexation. But then again, you would have to have sufficient evidences and time and money to spare. Kailangan mo ng abogado eh, and kailangan mo mag attend sa court hearings. Quote Link to comment
top secret
Thanks for all your opinions... I now know what to do just in case some collectors/agents try to disturb me again... Quote Link to comment
maddromeo
Quote Link to comment
