It depends on your contract of lease.

 

read the contract first to see whether there is a stipulation there as to who is responsible for this kind of repairs. if there is a clause in the contract of lease that says this kind of repairs is your responsibility, then, sagutin mo yung ganitong repair, sorry ka.

 

But if there is no stipulation as to who makes this kind of repairs, Paragraph #2 of Art. 1654 of the Civil Code says that "the lessor is obliged to make on the [premises] all the necessary repairs in order to keep it suitable for the use to which it has been devoted." Pag ganun, sagutin ng owner yung repairs.

 

In this connection, Art. 1658 of the Civil Code says "the lessee may suspend the payment of the rent in case the lessor fails to make the necessary repairs or to maintain the lessee in peaceful and adequate enjoyment of the property leased.

 

Kapag ganito ang sitwasyon mo, sulatan mo yung lessor mo demanding that he make the necessary repairs and warning him that if he does not do so within the period you give (bigyan mo ng 15 days), you will suspend payment of rentals, copy furnished the condominium administration (para di ka mapalayas sa pamamagitan ng kutsabahan ng owner at ng condominium association)

 

 

I am renting a condo and the owner refuses to repair the leaking ceiling and other parts of the house that needs repairing. Is it not the owner's responsibility? Any advice? Thanks in advance!

Question mga boss, I bought a Gadget worth 15K+ tru the net

I deposited the money to the sellers bank account last week , up until now ,hindi ko pa nakukuha ung gadget..

ano pwede ko gawin? please help :unsure::unsure:

pwede ba matrace? or mareklamo sa banko? the seller told me naship na niya. pero one week na wala parin. i think hoax

 

please help me on what to do ..thanks

good day po...ang father ko po is SSS pensioner but he died last year October, kaso mga 1 month bago namatay yung father ko, wala na syang natanggap na pension from SSS, delayed lang daw sabi ng SSS....so ayun nag antay kami... till umabot na ng almost 10 months wala parin kkaming narereceived na pension from SSS...lagi nman kami nag pa-followup sa SSS kaso ang laging sagot nila sa amin eh mag antay lang daw....

 

 

 

ano po ba ang pwede ko gawin para makuha na po nmin ang pension para sa father ko? saka diba automatic na yun na sa asawa na mapupunta yung pension ng asawang SSS Pensioner na namatay??

 

 

sana po matulungan nyo po ako..

an employee can resign at any time (unless he has signed an agreement not to do so, eg. after being given training one can agree to work for a certain period of time for the compny who provided the training), but he is supposed to give notice in writing one month in advance. If he does not give the notice, his resignation will still be effective, but he could be held liable for damages by the company.

 

In your case, kung wala ka namang project, at walang itu-turn-over, the company will PROBABLY not suffer damages (probably, di natin alam), so hindi sila siguro maghahabol pag nagresign ka "effective immediately.".

 

In any case, just remember that an employee who resigns is not entitled to separation pay.

 

gusto ko magresign sa company naming.. may lilipatan na akong iba at start ko daw sa Sept 16.. pwede ba kong magresign effective immediately since wala naman akong project sa ngaun at wala akong ite-turn-over?

Gandang gabi po.. ask ko lng pano procedure kasi my dad died may naiwan syang negosyo.. partnership ito 3 silang mgpapartner pero un isa 10yrs nang inactive pero hinde updated un sec papers.. may naiwan na pera un business sa bank pano namin un makukuha.. un bank account ay nka pangalan sa business po. At And account ito.. saka po may papadating pa kami mga recievables na cheke pano namin ito maidedeposit sa account? Sabi ng bank ay froZEN na daw un account kasi may partner na patay na daw..

 

Di naman namin pdeng irequest na sa ibang account ipanhalan un mga padating na cheke kasi nka base sila sa invoice na iniissue ng company namin.. pano po dpt namin gwin para makuha un pera sa bank at un mga padating pa na recievables?

hindi legal ang employment bond KUNG wala silang damages na na-suffer. Sabi ko nga, an employee can resign at any time. Yung one-month advance notice, para lang hindi ma-disrupt ang operations ng employer at may time siya maghanap ng replacement. kung di naman madi-disrupt ang operation ng employer, anong damages ang pinag-uusapan natin.

 

ang problema mo, kung maliit lang ang amount na ikakaltas sa employment bond, baka mas perwisyo pa yung magcomplain ka sa Labor kesa dun sa amount na ikakaltas sa iyo. Pero kung malaki, pwede ka magreklamo sa Labor niyan.

 

Note: pag nag-resign ka, entitled ka rin sa 13th month pay (9/12 of your monthly salary), baka dun nila kunin yung employment bond na sinasabi nila, ikakaltas nila dun.

 

sir rocco69, pumayag nman sila na magresign ako effective immediately.. problema lang eh sinisingil ako sa "EMPLOYMENT BOND"... hindi po yan "TRAINING BOND".. iba po ang employment bond at training bond nmin.. legal ba yung "EMPLOYMENT BOND"? thanks

Upon the death of a partner, the partnership is dissolved (see Art. 1830[5], Civil Code).

 

Kailangan ngayon i-wind-up yung partnership business (bayaran ang utang ng partnership at i-deliver ang matitirang assets sa bawat partner [o di-kaya sa heirs ng namatay na partner]). ang gagawa ng winding-up ay ang surviving partner.

 

mangangailangan naman kayo ng proof na kayo nga ang heirs ng tatay ninyo, kaya kailangan ninyo ng Extrajudicial Settlement of Estate dun sa naiwang ari-arian ng tatay nyo.

 

tanungin niyo na rin ng bangko kung ano ang kailangan nilang documents para ma-release yung pera sa account, para pag may list na kayo, i-compile nyo na ang mga ito. Dito nyo na rin malalaman kung kailangan nyong kumuha talaga ng abugado.

looks like it. Mahirap actually magsalita, without seeing the actual terms and conditions of your contract of employment. ano ba ang sinasabi sa kontrata mo about the "Employment Bond." Depende kasi sa terms, although, at first glance, mukhang walang basehan yang Employmen Bond na yan.

 

Pangalawa, what composes your backpay? Parang anlaki ng 130k. tsaka, bakit backpay? ano pa ba ang hindi nila naibabayad sa yo?

also, yung sagot na "malakas ang laban mo" is based on your statement that you are going to resign 30 days from the date of your tender of resignation, i.e. your resignation will be effective october 16, as that is the requirement of the law; with full turn-over of your project; as they cannot claim damages by then
