But there is a DOLE process to follow and there will be severance pay. About reduction of salaries, is touchy. But normally allowed by the law if the requirements are met. It is not outright illegal to reduce salaries if there is justification.Thanks for the reply..... I tried to settle things amicably pero puro empty words lang binibigay sakin dahil nga ang katwiran nung ex ko, hindi naman naka-pangalan sa kanya ang bata at wala sa poder nila. Tapos maayos na usapan lang daw ang pwede since walang record of his name anywhere indicating that he is indeed the father. I have never received anything from him for our daughter. But I want to start collecting what's rightfully due to my child. I do not know how much it will cost me to get a lawyer and I do not know which laywer to approach. Ayoko pong mabiktima ng pretenders. Do you have recos I can talk to? Sir what I mean is if there is a laywer in the gravepine that has provided the best service for scenarios such as mine na hindi mashadong exorbitant ang fee. rocco69 Posted April 7, 2011 Share Posted April 7, 2011 you have two options - either a civil case for support; or criminal cases for child abuse (failure to support one's child could fall into "other forms of child abuse, punished under Republic Act 7610) or violation of the Anti-Violence Against Women and Children [Republic Act 9262]). In both instances, I'd say you need to have a formal demand letter sent [and received] by your ex, so you have proof that he has refused to pay for support. You will also need to prove that, indeed, the child is a child of your ex (this can be done in the course of the proceedings, by asking the Court for the conduct of a DNA test). Sa ilalim ng Anti-Wiretapping Law, kailangan authorized ng lahat ng partido ang pagre-record. kapag walang authorization ng lahat ng partido, violation ng batas. 2. snowman74 Posted April 10, 2011 Share Posted April 10, 2011 hello everyone! meron akong kakilala na gusto makipagbusiness pero informal lang. bale iiwan ko daw ang mga producto ko sa kanya at ipapakita nya ito sa mga estudyante nya (nag lelesson ng dance sa bahay nya at madami daw interesado sa produkto ko) ngayon natatakot ako baka kung ano mangyari sa produkto ko. paano ko masisigurado na may panghahawakan ako na panlaban kung sakali ay hindi niya ibalik ang produkto ko or baka magclaim sya na hindi naman ako nagbigay ng gamit na ganon sa kanya, mamahalin kasi yung mga gamit. jewelry sya. may contrata ba or legal document ako na pwede ipanotarize na nagsasaad na kaya iniwan ang gamit is para ibenta nya and pag binalik dapat in good condition at pag hindi nabalik ay babayaran nya ito? They have a POC that signed the receive form indicating that he/she will be liable for any losses or damages to the products. Kung ako po sa inyo, picturan nyo na lang ung mga alahas at yun ang iwan nyo sa instructor. Para walang sisihan kasi madali itakbo ang alahas di po ba? Besides, mas doble pa ang loss sa part nyo kung sakali naman po na ma-swindle kayo. Wala na nga ung product, naghahabol ka pa, nagbabayad ka pa kaliwa't kanan sa abogado at sa mga hahawak ng kaso para lang mapabilis. I would also suggest creating an online site for your products para pag may nag-request ng partnership, may ibibigay ka ng reference. Usually pumapayag ang korte ng reduction ng up to 50% ng recommended bail, kung mapapatunayan nyo na walang pambayad yung akusado. HimuraButosay Posted April 30, 2011 Share Posted April 30, 2011 magandang araw sa inyo, mga MTC legal consultants... matagal kasi ako nawalan ng trabaho (approx 10months)...ngayon, naapektuhan ang pagbayad ko ng aking credit card. kaya heto ngayon, nagpapadala na sila ng demand letter at kung anu-ano pang pananakot (i.e. litigation). 1) ano ba ang pwedeng maging consequence kung patuloy na hindi ko mabayaran ang utang/obligasyon ko sa credit card? makukulong ba ako? sa ngayon, nagkaroon na ako ng trabaho at regular source of income 2)pwede ko bang sualtan/inform ang banko na ngayon pa lang ako naka-recover sa pagkawalan ko ng trabaho? pwede ba ako mag-declare na hindi ko pa kayang magbayad ngayon dahil ang kinikita ko ay sapat lang para sa mga pang-araw-araw na pangangailanga ko?
