Yong ang nasa rules, pero in practice kasi, hindi mo naman ikinakabit lahat ng dokumento mo at ebidensya sa pleading, ang required lang kasi doon ay full narration of facts, yong claim mo, thus, as a matter of course it follows therefore na yong ibang lawyers naghahain na ng motion to present evidence ex parte. Bakit presentation of evidence ex parte, usually kasi pag ganitong motion, ni-rerequest mo na din na sa harap ka na lang ng Clerk of Court (the Lawyer-Chief of Staff of the judge) mag-pe-present ng ebidensya para hindi mo ma-take up and time ng Court and since si Clerk also sometimes "prepares" the decision for the judge, mas mapapabilis ang proseso, somewhat. usually granted ang motion to present evidence ex parte kasi wala ka naman kalaban and the judge is usually not in a position to deny it kasi nag-volunteer ka na nga magbigay ng ebidensya, pipigilan ka pa nya? hindi siguro. Ang makakapigil lang siguro dyan sa ganyang motion is if may technical flaw yong pleading mo, e.g. wala kang attached verification or certification against forum shopping or non-payment of filing fees, ganon, pero those stuff napupuna naman sa umpisa pa lang. As to your question on speed, as a practicing lawyer, I never give my clients any estimate on the speed by which a court would render a decision. Nasisi lang ako. The speed of a judge to give out a decision is wholly his own. Kahit na ano pang-administrative order ng SC na bilisan ng mga judge na mag-decision, kanya-kanyang diskarte yan. Don't hold your breath, baka mawalang ka ng hangin, the wheels of justice in the Philippines is a slow churn. Bawal ang korporasyon na maging may-ari ng public land (Section 3, Art. XII, Constitution). kung ang lupa ay private, kahit ilang hektarya pa ang bilhin niya, pwede. yung nga lang, kung ito ay private AGRICULTURAL land, maari itong kunin ng gobyerno para ipa land reform. Sa ilalim ng land reform, maaaring magtira ang landowner ng hanggang 5 hektarya. itong limang hektarya ay hindi na pwedeng i-land reform, i.e. hindi pwedeng kunin ng gobyerno para ipamigay sa mga magsasaka. He issued a post-dated check as payment but when the check matured he kept asking for time to fund the check. After two months passed, I said I will deposit the check even if it bounces. He became hostile and threatened to accuse me of trying to buy drugs from him. He said he will print previous texts I sent him and edit them to make it appear as if I tried to buy drugs from him. Can he use these edited printouts of text messages to accuse me? Or more importantly, will any court accept these as evidence against me? Thank you in advance. Quote Link to comment
rocco69 Posted December 10, 2010 Share Posted December 10, 2010 (edited) A study opf R.A 9165 (Dangerous Drugs Act of 2002) will show that it punishes the person who will "sell, trade, administer, dispense, deliver, give away to another, distribute dispatch in transit or transport any dangerous drug". on the other hand, the user can be convicted only for possession or use of dangerous drugs. yung alleged texts kung saan a persons tries to buy, if true, would probably constitute an attempt to sell or trade wherein the seller or trader could be punishable under the law. in short, siya pa ang sasabit pag ginawa niya yan. remember also, mahirap patunayan nga galing sa yo ang text (andaling magpalit ng SIM ngayon). pag napatunayan man niya, kung ang mga sagot niya sa text ay magpapatunay na pusher siya, siya pa ang madadale, dahil di naman yan use or posession, na siyang krimen na maaring malabag ng isang user. kasuhan mo na ng BP 22 para mahimashimasan ang ka-opisina mong yan I loaned my ex-officemate a large amount of money. Ang panganay na babae po ang me hawak ng mga documents, ang problem po is di alam ng nanay ko at ibang mga kapatid (9 sila lahat) nagpapirma pala ng SPA sa mother nila bilang administrator ng mga lupa nila.Ang worry po namin kasi baka isanla niya or ibenta or ilipat sa pangalan niya yung mga lupa. Tapos ang gusto ngayon nila mama at ibang kapatid hatiin na yung lupa, ayaw ngayon ng ate nila na ipahati kasi ibebenta lang naman daw nila yung parte nila. kami po ay pursigido na kunin na yung share ni mama at ng 3 pa niyang kapatid na lalaki. Sa ngayon kinuha nila lahat ng sukat ng lupa ng father nila at doon sana kami magbabased kung ilan ang sukat ng para sa parte ni mama at ng 3 pang kapatid at saka na lang ipasukat actual yung parte nila. Yung ibang lupa nakasanla po yun dahil sinanla ng ibang kapatid with consent sa lola ko kasi kahati din sya.Tanong ko po1. legal ba yung SPA na yun ng panganay nila na wala naman silang consent.2. Pwede ba na kahit man lang sa papel mahati na yung mga lupa at makuha na namin ang para sa mama namin? at sino pipirma doon para makuha yun.3. Kahit po ba nakasanla yung lupa, pwede na namin kunin yung parte namin kasi di naman kami kasali sa sangla na yun, sila lang naman ang kumuha ng pera. Ang problema din sa ngayon, yung ibang kapatid takot sa ate nila kaya nagdadalawang isip kung i claim na rin nila ang lupa nila dahil yun nga sabi wag daw pipirma kung ano man ang papirmahan sa kanila nila mama. I worked really hard and my manager happily gave me the highest rating which would merit a 10-15% increase. Around 80% of the department didn't even get the "meets expectations" rating. But a week after I signed my appraisal my manager told me that because we were in a new department and that there were no standard goals and also for the benefit of the majority, everyone would be given the "meets expectation" rating including me. This would mean my salary increase would only be around 7% and less career opportunities within the company. I was hoping to transfer to a different department but my new rating automatically disqualifies me from transferring. I just want to know where I stand. It seems so unfair after all the hard work I've put into the program. Thanks in advance.
