mga sir, tulong lang po sana kung anong course of action ang dapat namin gawin:

sa barangay po namin ay maliit ang iskinita, bale one-way lang kaya kung may 2 sasakyan na magkasalubong ay bigayan talaga. sa mga taga roon po ay walang problema dahil talagang bigayan lang ng daan.

isang hapon po, pauwi yung hipag ko, drive nya yung maliit na kotse eh may isang sasakyan na nasa iskinita, tumigil lang muna si hipag, ni hindi nabusina dahil obvious naman na papasok siya. Lumapit sa kanya ang isa sa tatlong lalake na magkakasama sa sasakyan na yon, eh mga lasing pala. Eh habang kinakusap ni hipag na kung maari iusad muna ang kanilang sasakyan para makapasok at maka-grahe siya eh nagalit pa at namewang ang lalake at pinakita na may nakasukbit na baril sa bewang. Natakot si hipag at sinarado na lang ang bintana ng kotse.

Nagkataon naman na nakamasid lang ang mga kapitbahay sa mga pangyayari kaya may mga lumapit para mamagitan pero sa halip na maayos ay umakma ng suntok ang mga lasing kaya nagkagulo na, eh ready rin naman ang mga taong-bayan kaya dinumog ang tatlong lasing. Sa rambulan na yon eh nakuhang bumunot ng baril ang isang lalake at yung isa ay kumuha ng baril sa sasakyan kaya talagang mga armado pala ang mga lasing, pero hindi naman nagawang magpaputok.

Lumalabas na ito palang 3 lalake ay bisita ng isang taga roon din na mag-asawa at lumabas nga ng magkagulo, eh masama rin ang bibig ng mag-asawa dahil sinabi doon sa 3 na "bakit di nyo pinagbabaril ang mga iyan". Pinapasok ulit nila ang mga bisita nila at pagdating sa bahay nila ay saka doon nagpaputok ng baril. Syempre nagkatakot ang mga tao.

Hindi naman bugbog sarado yung tatlong lasing, yung isa lang ang may bangas eh balita ay nagpa-medical at gusto magdemanda, ang problema ay 4 na tao lang tinutukoy nila dahil gusto lang mamerwisyo ay isinama pa ang anak ni hipag bale pamangkin ko.

Alam naman po sa barangay ang mga pangyayari dahil may isang kagawad na nakasaksi nito, kaya kinabukasan ay opisyal na nagpa-blotter sa barangay ang hipag ko. Doon sa banta na magdedemanda ang 3 lasing ay wala pa naman nag-materialize, yon nga lang po ay nagkakatakot ang mga tao dahil mukhang mga gangster yung nakasagupa nila. Ang hipag ko naman ay mukhang nag-nervous breakdown na at hindi mapagkatulog dahil sa natatakot siya na baka gawan ng masama ang mga anak nya eh araw-araw napasok sa college ang mga bata.

Ano po ang mai-advise nyo na magandang course of action sa sitwasyon. Sa ganito po bang kaso ay uubra nga magdemanda ang 3 lasing kahit di kumuha ng clearance sa barangay? Ano po kaya kaso ang pwede isampa sa 3 lasing at sa mag-asawa? Marami naman pong testigo, buong barangay.

sa pamilya po itong isasangguni ko bale property ng parents ko un itatanong ko... tungkol sa pwedeng gawin na legal na paraan para di na kelangan muna ilipat sa pangalan ko un gusto namin patayuan ng bahay bale un likod ng bahay ng parents ko. sa parents ko po kasi ayaw pa nila sa ngyon ibigay un likod ng bahay at palagyan ng title ng lupa. ang tanong po, ano po ang mas mabuting gawin namin kung sakali kami na magpatayo ng bahay na may hinahawakan na papeles hindi man title or ibang dokumento para di naman maging magulo balang araw.

sa pamilya po itong isasangguni ko bale property ng parents ko un itatanong ko... tungkol sa pwedeng gawin na legal na paraan para di na kelangan muna ilipat sa pangalan ko un gusto namin patayuan ng bahay bale un likod ng bahay ng parents ko. sa parents ko po kasi ayaw pa nila sa ngyon ibigay un likod ng bahay at palagyan ng title ng lupa. ang tanong po, ano po ang mas mabuting gawin namin kung sakali kami na magpatayo ng bahay na may hinahawakan na papeles hindi man title or ibang dokumento para di naman maging magulo balang araw.

Dude, I'm afraid there's nothing much you can do to assure yourself that the other half of your parents' property will ultimately be adjudicated to you. Your parents are the owners, hence, they may do whatever they want to do with it. They may even sell it even if you're occupying a portion of that property. Until one of your parents shall have died, I'm afraid you have absolutely no interest in any of their property.

 

But here's what i suggest you do. Enter into a written agreement with your siblings, obliging themselves to recognize the portion you are already occupying.

Albeit technically that agreement is illegal and invalid (because under the law, no contract may be entered into over future inheritance), still your siblings may be less inclined to question your possession of that portion of your parents' property, as they would always think of that agreement they executed with you. In short, pang discourage lang yung agreement na yan, para naiisip lang nila na may pinirmahan pala sila sayo tungkol sa property na yun.

Pag ang isang tao ba na naaresto ng pulis dahil nakita naman na may ginawang masama yung tao na yun eh pwede ding pakawalan dahil magiging arbitrary daw yung pagkadetain sa kanya kung sakaling nahuli sya ng sabado at walang piskal o court na available para masampahan ng complaint agad at sa lunes pa? may oras ba o time limit ang pag detain sa tao na yun ? gaano ba kabigat dapat yung offense para di pakawalan yung tao?

Once a person is arrested for committing a crime, a case against him must be filed in court within a certain period of time (12 hrs, 24 hrs, 48 hrs), depending on the gravity of the offense. The graver the offense, the longer the period.

 

This period, however, does not run on days where courts are not open (holidays, saturdays and sundays). Arbitrary detention occurs only when a police officer failed to file the necessary information in court against a person arrested when he COULD HAVE DONE SO.

 

In short, mali yung sinabi ng police sayo.

A candidate for the CPA is allowed to take the exams for 3 times and if they do not pass the exams by then, they would be required to undergo a refresher course to update and refresh the knowledge of the candidate in the core subjects to be covered by the new exams.

 

A refresher course is not like a review but more like repeating 4th (or 5th) years of college. The reason for this is becuase it is likely that the accounting rules and standards would have already changed and the candidate needs to re-learn them. :) After taking this refresher course (make sure it is a refresher course, in case of doubt ask your review school), the candidate will get a certificate of completion that will be submitted to the PRC before he/she will be allowed to take the CPA exams again for another 3 times.

 

The candidate can repeat this process as often and long as he/she wants, although in most cases, after the 3rd try most candidates give up already and look for a job somewhere or get alternative qualifications.

For BAR exams, the process is similar. :) Rule 138, Sec. 16 except that the law is very specific that the candidate must repeat the 4th year of Law (which are mainly composed of review subjects). The professors of the candidate must issue a specific certification under oath that the candidates have regularly attended classes and passed the subjects under the same conditions as ordinary students and the ratings obtained by them in the particular subject.

 

I am not familiar with the change and would defer to Bonito on this. :)

 

Besides, more often than not after 3 times of the torture that the BAR can give you, most candidate would just quit it.

First, determine the area of the portion of the property where you intend to build your house. You can easily estimate this by measuring (length x width = area). Or if you want an accurate area, get a surveyor. This will however cost you.

 

Ask your parents to sign a "Deed of Donation," where it says they are donating this portion to you. It does not have to indicate the shape but it has to indicate the area. Have it notarized and oay the donor's taxes. Also, have this document annotated on your parents' title. This document is legal and binding. Although, you still does not a separate title to the lot, you are already legally part owner of the property. Tell your partents that estate tax (inheritance) is much more expensive than donor's tax.
