No. 166, "the rate of interest for the forbearance of money when secured by a mortgage upon real estate, should not be more than 6% per annum or the maximum rate prescribed by the Monetary Board of the Central Bank of the Philippines in force at the time the loan was granted. Ibig sabihin may kapangyarihan ang CB sa ilalim ng batas na magsabi kung ano ang maximun interest rate, na siya namang ginawa nito ng ilabas nito ang Circular 905. Dagdag pa dito, sinabi na rin ng Korte Suprema na: CB Circular No. 905 did not repeal nor in anyway amend the Usury Law but simply suspended the latter's effectivity. (Security Bank and Trust Company vs. Regional Trial Court of Makati, Branch 61, G.R. No. 113926, 23 October 1996) Hope this clarifies matters. ayon sa liam law vs sawmill, inexistent na ang usury law dahil sa circular no 905 ng central bank. SamanthaJones Posted November 26, 2007 Share Posted November 26, 2007 my question i regarding sss benfits..im not really sure if this is the right thread to ask this but here goes.. my dad dies a few weeks ago. he used to be an sss pensioner recieving pension checks for his retirment benefits and the other check for my mom who died few years ago. i'm the youngest and i happen to be 29 already. my understanding is that if my dad doesnt remarry, i would stay as his beneficiary but only if im less than 21 right? since im already 29 since his pension will be cut off already right? and is it true that since he died this month, they will not be sending his 13 month pesnion anymore including his december pension, is that true? they also mentioned that the money he left at the bank(pension for the month of november that he got beofre he died) will be sent back to sss and all of us (my 3 brothers) would need to file a death claim for it. are all those true? please enlighten me regarding all these. thanks. sam Quote Link to comment

redax Posted November 28, 2007 Share Posted November 28, 2007 May be better to ask an accountant when it comes to taxation. BIR does not make any deductions. The taxpayer deducts allowable deductions from his gross income to derive taxable income. Withholding tax from the wages of the employee is a duty imposed upon the employer to withhold and deduct from said wages a tax determined in accordance with rules and regulations prescribed by the Secretary of Finance upon recommendation of the Commissioner of Internal Revenue, and to remit said tax to the BIR. The withheld tax is not deductible anymore as you already deducted the wage from your gross income. Wages are considered expenses and is an allowable deduction from gross income. If what you mean from deduction by the BIR are income tax rates, it would depend on whether you are individual or a corporation/partnership. Quote Link to comment
